The Swiss Federal Council and the Government of the Principality of Liechtenstein,
Taking into account the commitment made by the Principality of Liechtenstein as a State Party of the International Health Regulations of 23 May 2005 2 (hereafter RSI 2005) to establish an RSI national focal point that is achievable at any time and to designate the authorities responsible for the implementation of the sanitary measures provided for in that regulation;
Taking into account the fact that Switzerland is also a State Party of the RSI 2005, that it has designated its national focal point RSI and the authorities responsible for the implementation of the health measures provided for in that regulation;
Taking into account also the fact that the authorities of the Principality of Liechtenstein are integrated into the system of notification of Switzerland for the radio-nuclear, biological and chemical fields as a result of the Treaty of 29 March 1923 between Switzerland And the Principality of Liechtenstein concerning the meeting of the Principality of Liechtenstein in the customs territory of Switzerland (Customs Treaty) 3 ;
Agreed to the following provisions:
(1) In addition to the Swiss legislation on epidemics, applicable in the Principality of Liechtenstein due to the Customs Treaty and taking account in particular of art. 4 of the Customs Treaty as well as the existing cooperation between Switzerland and the Principality of Liechtenstein in the fight against communicable diseases, this agreement regulates cooperation between Switzerland and the Principality of Liechtenstein. Liechtenstein in the areas of assessment and notification of events that may constitute an international public health emergency in the light of the RSI 2005.
(2) The national contact offices of RSI in Switzerland shall, on behalf of the Government of the Principality of Liechtenstein, undertake to evaluate and assess in writing the events reported by the Liechtenstein authorities within the meaning of Art. 6 of RSI 2005.
(1) The national RSI contacts in Switzerland receive notifications from the Liechtenstein authorities and acknowledge receipt.
(2) The national offices of the RSI contact in Switzerland shall, within the time limits set by the IHR, evaluate the notifications once the latter are considered complete (Art. 6 of RSI 2005). The assessment shall include the necessary tests in accordance with Art. 6 and Annex 2 of the 2005 RSI. The events which, according to the decision-making scheme (Annex 2 to the RSI 2005) may constitute an international public health emergency in the eyes of the RSI 2005, are reported, by the most effective means of communication, at focal points National RSI of Switzerland and the Principality of Liechtenstein.
(3) In the event of a question, the Liechtenstein authorities and the competent national RSI contact office in Switzerland shall consult directly (by telephone or in writing).
(4) In an audit (s. 8 of the RSI 2005), the National RSI focal point of the Principality of Liechtenstein can apply directly to the national RSI contact annals in Switzerland. The Swiss National Focal Point in Switzerland must be informed simultaneously.
(5) Based on the evaluation issued by the national offices of the RSI contact in Switzerland, the national focal point RSI of the Principality of Liechtenstein will decide in due course (Art. 6 of the RSI 2005) of the notification to the World Health Organization. The national focal point RSI in Switzerland is simultaneously informed of any notification addressed to the World Health Organization.
(1) Switzerland and the Principality of Liechtenstein undertake, according to Art. 44 of the RSI 2005, to the close cooperation possible, in particular for the observation and evaluation of events, the reaction to them, and the provision and facilitation of technical cooperation and logistical support.
(2) The competent authorities and technical services concerned of the Principality of Liechtenstein and Switzerland are set out in Annexes 1 and 2 to this Agreement. The Annexes shall form an integral part of this Agreement.
The collaborators and officials of the two national RSI focal points, the national RSI focal points of Switzerland and the Liechtensteine authorities are subject to the secrecy of the Application of this Agreement.
(1) The competent authorities and services in accordance with Annexes 1 and 2 to this Agreement shall inform each other, as soon as possible and in writing, of the changes provided for in the legal requirements concerning the areas covered by this Agreement. Agreement.
(2) The annexes to this Agreement shall be supplemented or amended by mutual agreement between the authorities and services referred to in Annexes 1 and 2.
(3) The journals are published in the National Official Journal, the Landesgesetzblatt of Liechtenstein.
(4) The outstanding issues concerning the interpretation and application of this Agreement shall be settled through diplomatic channels.
(1) The authorities and services of Liechtenstein and Switzerland shall bear the costs incurred for them of the tasks carried out in accordance with this Agreement.
(2) If the costs arising from the tasks performed under this Agreement by the competent Swiss authorities and services for the benefit of the Principality of Liechtenstein exceed the usual framework, appropriate compensation may be invoiced On a case-by-case basis.
(1) The parties shall communicate to each other the performance of the procedures required by their domestic law and shall establish by diplomatic means the date of entry into force.
(2) Each contracting party may, at any time, terminate the agreement in writing and through diplomatic channels, subject to six months' notice.
In witness whereof , the Plenipotentiaries of both Parties have signed this Agreement.
Done at Berne, in two originals in German, on December 2, 2011.
(1) The national police emergency call and call centre of Liechtenstein shall assume the role of the national focal point RSI in the Principality of Liechtenstein.
(2) The Office for Food Inspection and Veterinary Affairs is involved when the event falls within the scope of the RSI 2005 in the field of food safety (areas A, B or C), zoonoses or epizootic diseases (domain B) and objects Usual (domain C).
(3) The Federal Office for the Protection of the Environment is involved when the event falls within the scope of the IHR 2005 in the field of ionizing radiation (domain A), genetically modified organisms and pathogens (domain B) Biocidal, phytosanitary and fertilizer products (domain C).
(4) The Office of Health and the Economy are involved when the event falls within the scope of the RSI 2005 in terms of increased exposure to radiation in the workplace (domain A).
(5) The Office of Health is involved when the event falls within the scope of the RSI 2005 for transmissible diseases in humans, contamination of blood products, therapeutic products and medical devices.
(6) The Liechtenstein National Police is involved when the event falls within the scope of the RSI 2005 chemical incidents.
(7) The Trade and Transport Office is involved when the event falls within the scope of the RSI 2005 in respect of technical installations, apparatus and objects (domain C).
(1) Within the Swiss Confederation, are competent for the tasks described below: the Federal Office of Public Health, the Federal Office for the Protection of the Population, the Federal Office for Agriculture, the Federal Veterinary Office 1 And the Swiss Institute of Therapeutic Products and other Swiss authorities or services expressly named in this Agreement.
(2) The Federal Office of Public Health is the national focal point of RSI in Switzerland.
(3) The Federal Office of Public Health, as the national RSI contact antenna, is involved when the event falls within the scope of the IHR 2005 in the field of ionizing radiation (Domain A), food safety 2 (domains A, B or C), chemicals and common objects (domain C) and communicable diseases (domain B).
(4) The Federal Office for the Protection of the Population, as the national RSI contact antenna, is involved when the event falls within the scope of the RSI 2005 chemical incidents (domain C).
(5) The Federal Office of Agriculture, as the national RSI contact antenna, is involved when the event falls within the scope of the RSI 2005 in the field of plant protection products and fertilizers (domain C).
(6) The Federal Veterinary Office 3 , as a national RSI contact antenna, is involved when the event falls within the scope of the RSI 2005 for zoonosis (domain B).
(7) The Swiss Institute for Therapeutic Products, as the national RSI contact antenna, is involved when the event falls within the scope of the RSI 2005 for therapeutic products and medical devices (domains B and C).
