Protocol to amend the Convention on Wetlands of International Importance especially as Waterfowl Habitat

The Contracting Parties,

Considering that the effectiveness of the Convention on Wetlands of International Importance especially as Waterfowl Habitat to Ramsar February 2, 1971 2 (hereinafter referred to as "the Convention") requires an increase in the number of Contracting Parties;

Conscious of the fact that the addition of authentic versions would facilitate wider participation in the Convention;

Whereas the text of the Convention does not provide for an amendment procedure, which makes it difficult to amend the text which might be deemed necessary;

Agreed to the following:

Art. 1

The following Article shall be inserted between Art. 10 and art. 11 of the Convention:

Art. 2

The words "the English text serving as a reference in the event of a difference of interpretation" contained in the clause following s. 12 of the Convention, are replaced by the words "all texts being equally authentic".

Art. 3

The corrected text of the original French version of the Convention is reproduced in the Annex to this Protocol.

Art. 4

This Protocol shall be open for signature from 3 December 1982 at the UNESCO Headquarters in Paris.

Art. 5

1. Any State referred to in Art. 9, para. 2, of the Convention may become a Contracting Party to the Protocol by:

(a)
Signature without reservation of ratification, acceptance or approval;
(b)
Signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval;
(c)
Membership.

2. Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument of ratification, acceptance, approval or accession with the Director-General of the United Nations Educational, Scientific and Cultural Organization And culture (hereinafter referred to as "the Depositary").

Any State which becomes a Contracting Party to the Convention after the entry into force of this Protocol shall be deemed to be a Party to the Convention as amended by the Protocol, unless it has expressed a different intention at the time The deposit of the instrument to which s. 9 of the Convention refers.

(4) Any State which becomes a Contracting Party to this Protocol without being a Contracting Party to the Convention shall be considered as a Party to the Convention as amended by this Protocol, from the date of entry into force of this Protocol. Protocol for that State.

Art. 6

(1) This Protocol shall enter into force on the first day of the fourth month following the date on which two thirds of the States which are Contracting Parties to the Convention on the date on which this Protocol is opened for signature have signed it without Reservation of ratification, acceptance or approval, or have ratified, accepted, approved or acceded to it.

(2) In respect of any State which becomes a Contracting Party to this Protocol after the date of its entry into force in the manner described in s. 1 and 2 of Art. 5 above, the Protocol shall enter into force on the date of signature without reservation of ratification, acceptance or approval, or of its ratification, acceptance, approval or accession.

3. In respect of any State which becomes a Contracting Party to this Protocol in the manner described in s. 1 and 2 of Art. 5 above during the period from the opening of this Protocol to the signature upon entry into force of this Protocol, this Protocol shall enter into force on the date determined by the s. 1 above.

Art. 7

1. The original text of this Protocol in the English and French languages, each of which is also authentic, shall be deposited with the Depositary who shall transmit certified copies thereof to all States which have signed it or Who have deposited an instrument of accession.

2. The Depositary shall inform as soon as possible all Contracting Parties to the Convention and all States which have signed and acceded to this Protocol:

(a)
The signatures of this Protocol;
(b)
The deposit of instruments of ratification, acceptance or approval of this Protocol;
(c)
The deposit of instruments of accession to this Protocol;
(d)
The date of entry into force of this Protocol.

3. When this Protocol enters into force, the Depositary shall register with the United Nations Secretariat in accordance with art. 102 of the Charter 1 .

From 1 Er Oct. From 1986 to 30 June 1997, the Protocol was applicable to Hong Kong on the basis of a United Kingdom territorial extension declaration. From 1 Er July 1997, Hong Kong became a Special Administrative Region (SAR) of the People's Republic of China. According to the Chinese declaration of 9 June 1997, the Protocol is also applicable to the Hong Kong SAR from 1 Er July 1997.
