Species 1

The Convention on the Conservation of European Wildlife and Natural Habitats, signed in Berne on 19 September 1979 by the Federal Republic of Germany, is approved. The Convention shall be published below. Unofficial table of contents

Type 2

The Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety is authorized to amend Annexes I to IV to the Convention pursuant to Article 17 of the Convention, which comply with the objectives of the Convention, by means of a legal regulation without Approval of the Federal Council to be put into effect. Art 3

(1) It shall be prohibited to plant the plants of the Federal Republic of Germany in areas which are not subject to any state jurisdiction, in particular from a ship or aircraft which is entitled to lead the Federal flag or the State belonging to the Federal Republic of Germany. in Annex I to the Convention or animals of the species listed in Annex II to the Convention. (2) The Federal Agency for Nature Conservation may, on request, derogations from the prohibitions referred to in paragraph 1.
1.
on the protection of plant and animal species,
2.
for the prevention of serious damage to crops, livestock, forests, fishing grounds, waters and other property,
3.
in the interests of public health and safety, the safety of aviation or other priority public matters,
4.
for the purposes of research and education, the recovery of stocks, resettlement and rearing, or
5.
to permit, under strictly supervised conditions, selectively and to a limited extent the catch, the holding or any other reasonable use of certain wild animals and plants in small quantities,
. The exceptions may only be allowed if there is no other satisfactory solution and they do not harm the population of the population concerned. (3) In the sense of this law, "take out nature" means:
a)
Picking plants, picking up, cutting, digging or tearing them out,
b)
Animals catch, hold, kill or disturb their breeding or resting places, destroy or destroy their eggs, or remove them from nature, or have these eggs, even if they are empty.

Species 4

(1) The offences listed in Annex I to the Convention or the animals of the species listed in Annex II to the Convention are unlawful, intentionally or negligently against Article 3 (1) in areas which are not subject to State sovereignty. (2) The administrative offence can be punishable by a fine of up to five thousand euros. (3) Plants or animals to which the administrative offence relates, or objects which have been used for their commission or preparation, or can be drafted. § 23 of the Code of Administrative Offences is to be applied. (4) The Federal Agency for Nature Conservation is the administrative authority within the meaning of Section 36 (1) (1) of the Act on Administrative Offences. Unofficial table of contents

Species 5

(1) This Act shall enter into force on the day following its announcement. (2) The date on which the Convention enters into force for the Federal Republic of Germany in accordance with its Article 19 shall be published in the Federal Law Gazprom.
