§ 1

(1) For projects in accordance with § 43, first sentence, of the Energy Economic Law in the field of maximum voltage networks with a nominal voltage of 380 kilovolts or more, which are the adaptation, development and expansion of transmission networks for the integration of electricity from renewable energy sources, to the interoperability of electricity networks within the European Union, to the connection of new power stations or to the prevention of structural bottlenecks in the transmission system, and for which therefore a priority If there is a need, a demand plan is attached to this law. (2) The Projects included in the plan correspond to the objectives of § 1 of the German Energy Economic Law. For these projects, the need for energy and the need for urgent action are thus firmly established. § 2

(1) In order to test the use of underground cables at the maximum voltage level in the transmission system as a pilot project, the following lines, as referred to in paragraph 2, may be constructed and operated as a ground cable in accordance with the provisions of paragraph 2; or change:
1.
Section Ganderkesee-St. Hülfe of the line Ganderkesee-Wehrendorf,
2.
Line Diele-Niederrhein,
3.
Line Wahle-Mecklar,
4.
Section Altenfeld-Redwitz of the line Lauchstädt-Redwitz.
In the case of the new building, at the request of the authority responsible for the approval of the project, in the case of the projects referred to in paragraph 1, a maximum voltage line shall be set up on a technically and economically efficient subsection as a ground cable and shall be operate or change if the line

shall be constructed at a distance of less than 400 metres from the residential buildings covered by a construction plan or in the unplanned interior area within the meaning of Article 34 of the Civil Code, in the event that these areas are mainly used for housing, or
2.
shall be constructed at a distance of less than 200 metres from the residential buildings situated in the external area within the meaning of Section 35 of the Construction Code.

The obligation to pay shall be made by the transmission system operators whose actual costs are less than the share of the total cost accounting for them, but only up to the level of the proportion of the total cost of the transmission system to which they are calculated. § 3

At the end of three years, the Federal Ministry of Economics and Technology, in agreement with the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety, and the Federal Ministry for Transport, Building and Urban Development, shall examine whether: the demand plan for the development of electricity supply is to be adapted and submits a report to the German Bundestag, for the first time to the 1.
