On the basis of Section 5, Section 3, Section 2 of the Federal Non-Smoking Protection Act of 20 July 2007 (BGBl. 1595) in conjunction with Section 36 (3) of the Law on Administrative Offences, as amended by the Notice of 19 February 1987 (BGBl. 602), as defined by Article 1 (5) (b) of the Law of 26 January 1998 (BGBl). 156, 340, 1999 I p. 1237), the Federal Ministry for Transport, Building and Urban Development is ordering: Unofficial table of contents

§ 1

(1) The responsibility for the prosecution and prosecution of administrative offences in accordance with Section 5 (1) of the Federal German Federal law on protection of the law, which is committed in institutions pursuant to § 2 (1) of this Act, shall be subject to the respective authorities referred to below. transfer for the premises in which they exercise the right to house:

Kraftfahrt-Bundesamt,

-

Aeronautics-Federal Office,

-

Federal Office of Construction and Regional Planning,

-

Federal Railway Authority,

-

Federal railway assets,

-

German Weather Service,

-

Bundesanstalt für Straßenwesen,

-

Federal Office of Goods Transport,

-

Federal Office of Maritime and Hydrographic

-

Water and shipping directorates.

(2) The responsibility for the prosecution and prosecution of administrative offences in accordance with Section 5 (1) of the Federal Non-Enforcement Act shall be applied to:

1.

-transfer the water and shipping directorates to the administrative offences, which are located on the premises of the water and shipping offices, including the outskirts, construction courtyards, revier centres and other facilities, which are located downstream; as well as the waterway Neubauämter,

2.

the Southwest Water and Shipping Directorate for the offences committed on the premises of the Bundesanstalt für Wasserbau and the Bundesanstalt für Gedilukunde,

3.

The Federal Aviation Office shall transmit the offences committed on the premises of the Federal Office for the Investiation of Air Accident Investigation, and

4.

The Federal Maritime and Hydrographic Agency is responsible for transmitting the offences committed on the premises of the Federal Office for the investigation of marine casualties.

§ 2

The responsibility for the prosecution and prosecution of administrative offences in accordance with § 5 (1) of the Federal German Federal law on protection of non-trust, which is in

1.

2 (a) and (3) of the German Federal Government's Protection Act (Bundesnichtraucherschutzgesetz) is to be transferred to the Federal Railway Authority (Bundesamt);

2.

Means of transport pursuant to § 2 no. 2 (c) of the Federal German Federal Law for the Protection of Crimes of the Federal Republic of Germany are to be transferred to the Federal Aviation Office.

§ 3

This Regulation shall enter into force with effect from 2 September 2007.
