§ 1 legal form, name, seat

§ 2 tasks

(1) The Federal Institute is responsible for the tasks previously carried out by the Federal Institute for Agricultural and Rural Development (Bundesanstalt für farms) Market regulations and the Federal Office of Nutrition and Forestry were transferred. Its tasks include:

The regulation and order of agricultural markets and implementation the common organization of the market, insofar as it is competent to do so by law or regulation,

the provision of the Measures referred to in Article 3 (1) of Council Regulation (EC) No 1290/2005 of 21 May 2005. June 2005 on the financing of the common agricultural policy (OJ L 327, 28.8. 1), as amended in each case, within the framework of Article 14 (2) of Regulation (EC) No 1290/2005, even in so far as the Bundesanstalt is not responsible for the implementation of the measures ,
3.
The exercise of tasks of food security and food security, insofar as it is responsible for this by law or regulation

The procurement, posture and recovery of supplies of food and feed supplies for security of supply,
5.
as part of its activity, the investigation, development and testing of new forms and ways of marketing to improve market flows,

§ 3 institutions

§ 4 President

(1) The President shall conduct the business and manage the assets of the Federal Institute on its own responsibility in accordance with the provisions of this Act, the Articles of Association and the instructions of the Federal Ministry. § 5 Board of Directors

(1) The Board of Directors consists of up to 28 members, not more than
1.
Six representatives of agriculture, including garden and viticulture, forestry, and the fishing industry,
2.
three representatives of the consumer,
3.
three representatives of the large- and external trade,
4.
two representatives of the retail trade,
5.
two representatives of the Dietary craft,
6.
two representatives of the food industry,
7.
two representatives of the food industry agricultural cooperatives,
8.
a representative of the country goods trade,
9.
Representatives of the Federal Ministry,
10.
a representative of the Federal Ministry of Economics and Technology,
11.
a representative of the Federal Ministry of Finance,
12.
four representatives of the supreme state authorities for Food, Agriculture and Forestry.
The members of the Board of Directors must meet the requirements for eligibility for the German Bundestag.(2) The representatives of the groups referred to in the first sentence of the first sentence of 1 to 8 (economic groups) shall be appointed and dismissed by the Federal Ministry on a proposal from the respective top-level associations. § 6 Rights and tasks of the Board of Directors

(1) The Board of Directors

§ 7 Advisory Councils

(1) Professional advisory councils can be formed for the technical areas. They shall be composed of experts from the producers, trade, processors and consumers who, on a proposal from the respective centres of excellence and, where not represented in the latter, shall also be appointed by the Bundesfachfederations of the Board of Directors appointed and dismissed. In addition, representatives of the Federal Ministry and the Supreme State authorities are members of the advisory councils; with regard to their appointment and dismise, Section 5 (3) applies accordingly.(2) The specialised advisory councils have the task of directly advising the institutions of the Federal Institute on matters relating to the respective department. § 8 Statutes and supervision

(1) The Federal Ministry is authorized to do so with regard to the sentence 2 Nos. 5 and 6 in the Agreement with the Federal Ministry of Finance, by means of a decree law which does not require the approval of the Bundesrat, to enact the statutes of the Federal Agency. The statutes shall, where necessary, include in particular provisions on

the designation of the Top confederations according to § 5 (2), the activities of the Board of Directors as well as the composition of the advisory councils,
2.
the rights and obligations of the institutions the Federal Institute and the Technical Advisory Councils,
3.
the transfer of the power of drawing to employees of the Federal Institute,
4.
the structure of the Bundesanstalt,
5.
the financial management, economic management and accounting of the Bundesanstalt,
6.
The borrowing pursuant to § 10 para. 4 and 5.
(2) The Federal Institute is subject to the legal and professional supervision of the Federal Ministry. The Federal Ministry may issue instructions to the Federal Office. The Federal Institute is obliged to provide the Federal Ministry with information on the management and to submit the documents to the Federal Agency.(3) In the event that the Federal Institute does not fulfil its tasks or only fails to do so, the Federal Ministry shall have the power to carry out the tasks itself or to have it carried out by a special representative. § 9 Administrative budget

(1) The Federal Agency shall have the revenue to be expected in the administrative area, and likely to be incurred in an administrative budget. § 10 Economic plan, credit authorization
