§ 1 Legal form, name, seat

In the division of the Federal Ministry of Food, Agriculture and Consumer Protection (Federal Ministry of Food, Agriculture and Consumer Protection) a federal law-capable institution of public law is set up by the merger of the Federal Institute for Agriculture and Rural Development ( Market regulations and the Federal Office of Nutrition and Forestry. § 2 Tasks

(1) The Federal Institute is responsible for the tasks which have hitherto been entrusted to the Federal Institute for Agricultural Market Regulations and the Federal Office for Food and Forestry (Bundesamt für Ernährung und forestry). Its tasks include:
1.
the regulation and order of agricultural markets and the implementation of the common organization of the markets in so far as it is competent to do so by law or regulation;
2.
the provision of the measures required for the implementation of measures referred to in Article 3 (1) of Council Regulation (EC) No 1290/2005 of 21 June 2005 on the financing of the common agricultural policy (OJ L 327, 30.12.2005, p. 1), as amended by Article 14 (2) of Regulation (EC) No 1290/2005, even in so far as the Bundesanstalt is not responsible for the implementation of the measures,
3.
the performance of tasks of food security and food security, in so far as it is competent to do so by law or regulation;
4.
the procurement, keeping and recovery of supplies of food and feed for security of supply,
5.
within the framework of its activities, the investigation, development and testing of new forms of marketing to improve the market's market,
6.
the granting of authorisations and the implementation of other legislation relating to the movement of goods and services across frontiers with products from the food, agriculture and forestry sectors, to the extent that it is competent to do so by law or regulation,
7.

the administration of administrative tasks of the Federal Government, for which no other competence is established by law and with the implementation of which it is entrusted by the Federal Ministry.

§ 3 Institutions

§ 4 President

(1) The President shall conduct the business and shall administer the assets of the Federal Institute on its own responsibility in accordance with the provisions of this Act, the Articles of Association and the instructions of the Federal Ministry. § 5 Board of Directors

(1) The Administrative Board shall consist of up to 28 members, up to a maximum of

six representatives of agriculture, including garden and wine-growing, forestry and the fishing industry,

three representatives of the consumer,

three representatives of wholesale and foreign trade,
4.
two representatives of the retail trade,
5.
two representatives of the food trade,
6.
two representatives of the food industry,
7.
two representatives of agricultural cooperatives,
8.
a representative of the agricultural trade,
9.
a representative of the Federal Ministry,
10.
a representative of the Federal Ministry of Economics and Technology,
11.
a representative of the Federal Ministry of Finance,
12.
four representatives of the supreme federal authorities for food, agriculture and forestry.
The members of the Board of Directors must fulfil the conditions for eligibility to the German Bundestag. (2) The representatives of the groups referred to in the first sentence of the first sentence of 1 to 8 (economic groups) shall be appointed by the Federal Ministry on a proposal of the appoint and discontinue their respective top-class associations. § 6 Rights and duties of the Management Board

(1) The Administrative Board shall:

Section 7 Technical Advisory Councils

(1) Professional advisory councils may be formed for the technical fields. They shall be composed of experts from the producers, trade, processors and consumers who, on a proposal from the respective centres of excellence and, where not represented in the latter, shall also be appointed by the Bundesfachfederations of the Board of Directors appointed and dismissed. § 8 Statutes and supervision

(1) The Federal Ministry is authorized, in agreement with the Federal Ministry of Finance, to adopt the statutes of the Federal Agency in agreement with the Federal Ministry of Finance, by means of a regulation which does not require the approval of the Federal Council. The Articles of Association shall, where necessary, include in particular provisions on:
1.
the appointment of the top-of-the-line associations according to Article 5 (2), the activities of the Board of Directors and the composition of the Advisory Councils;
2.
the rights and obligations of the institutions of the Federal Institute and the Advisory Councils;
3.
the transfer of the power of drawing to employees of the Federal Institute,
4.
the structure of the Federal Institute,
5.
the financial management, economic management and accounting of the Federal Institute,
6.
the borrowing pursuant to § 10 (4) and (5).
(2) The Federal Institute is subject to the legal and professional supervision of the Federal Ministry. The Federal Ministry may issue instructions to the Federal Office. The Federal Institute is obliged to provide the Federal Ministry with information on the management and to submit the documents to the Federal Agency. (3) The Federal Office does not fulfil its tasks or only insufficiently, so the Federal Ministry has the power to carry out the tasks themselves or to have them carried out by a special envoy. Section 9 Administrative budget

(1) The Bundesanstalt shall issue the revenue to be expected in the administrative area and the expenditure likely to be incurred in an administrative budget. § 10 Economic plan, credit authorisation

(1) The Federal Office shall present the expenses and income which are expected to be incurred outside the administrative area in the tasks referred to in Article 2 (1) before the beginning of the financial year in an economic plan. § 11 Officials
