§ 1 Objective of the examination and designation of the Completion

(1) In order to demonstrate the knowledge, skills and experience acquired through professional training as a construction machine operator in the fields of construction or construction or civil engineering or road construction, the competent authority may: Carry out examinations in accordance with § § 2 to 12.(2) The examination shall determine whether the examination participant has the necessary knowledge, skills and experience to carry out the following tasks of a construction machine operator in the particular field:

§ 2 Admissions requirements

§ 3 Content and performance of the review

§ 4 Specialist theoretical part, field of building construction

§ 5 Specialist theoretical part, field of earth and civil engineering

§ 7 Specialised section, High-level construction

(1) In the subject-specific section of building construction, the following subjects are to be considered:

§ 9 Specialised section, Section for Road Construction

§ 10 Invoice of other audit services

§ 11 Existence of the review

(1) The test parts must be evaluated separately. For each part of the examination, a note is to be made from the performance of the individual examination subjects. In doing so, the grades for written and oral examinations are to be combined in one examination subject to form a note. The services in the written and in the oral examination have the same weight. The examination performance issued pursuant to § 7 (2), § 8 (2) and § 9 (2) has double the weight of the examination performance in accordance with § 7 (3), § 8 (3) and § 9 (3).(2) The examination has been passed if the examination participant in the 2 examination subjects of the subject-specific examination part of the respective subject as well as in 3 examination subjects of the subject-theoretical examination part of the field of building construction or civil engineering or in 4 examination subjects of the subject-theoretical examination section of the field of road construction, has provided at least sufficient examination results.(3) The existence of the test shall be subject to a certificate in accordance with Appendix 1. At the request of the examination participant, a certificate shall be issued in accordance with Appendix 2, from which the examination notes obtained in the individual examination subjects must be produced. § 12 Review Recover

(1) A check that has not passed can be repeated twice.(2) In the repeat examination, the examination participant must, upon request, be exempted from the examination in individual examination subjects and examination subjects, if his achievements have been submitted in a previous examination and he/she is within two Years, calculated from the date of completion of the non-passed examination, for the reexamination of the test. Federal law shall enter into force in the area referred to in Article 3 of the Treaty with the following measures:

Vocational Training Act of 14. August 1969 (BGBl. 1112), as last amended by § 19 of the Law of 23. December 1981 (BGBl. 1 and 2, § § 25, 29 (1), § 43 (1) and (2), § 46 (2), § 76 (2), § 77 (5), § 80 (2), § 81 (4), § 82 (2), § § 93, 95 (4), § 96 (2), issued on the following legal regulations Measures:
a)
Legal regulations according to § 21 paragraph 1 of the law require separate entry into force by the Federal Minister of Education and Science by means of a regulation which does not require the approval of the Federal Council. Legal regulations according to § 29 (1) and § 43 of the Act require the separate entry into force by the Federal Minister for Economic Affairs or the otherwise responsible Minister of Trade in agreement with the Federal Minister of Education and Science by Legal Regulation, which does not require the consent of the Federal Council.
b)
The competent authority may take up to 31 years of age. 1 December 1995 derogations from the training regulations according to § 25 of the Act, if the requirements imposed by technical regulations cannot yet be met. The exceptions are temporary. In agreement with the Federal Minister of Education and Science, the Federal Minister for Economic Affairs or the Minister for Economic Affairs may, in agreement with the Federal Minister for Education and Science, not require the approval of the Bundesrat, the power of the Federal Minister for Education and Science Limit or cancel.
