§ 1 Objective of the examination and designation of the financial statements

(1) In order to demonstrate the knowledge, skills and experience acquired through professional training as a construction machine operator in the fields of construction, construction and civil engineering or road construction, the competent authority may take the necessary steps to: in accordance with § § 2 to 12. (2) The examination shall determine whether the examination participant has the necessary knowledge, skills and experience to perform the following tasks of a construction machine operator in the respective subject area:
1.
Operating, driving and servicing the construction machinery and equipment of its field of expertise, using the knowledge of working methods, applications, driving machines and power transmission elements of these construction machinery and equipment,
2.
Transport, set up and set up the construction machinery and equipment of its specialist direction,
3.
Detection of faults in the construction machinery and equipment of its field of speciation and elimination of simple faults in these construction machinery and equipment,
4.
To comply with the rules on occupational safety, health and safety, accident prevention and protection of accidents in its area of responsibility, as well as the introduction and implementation of the necessary measures.

§ 2 Admission requirements

(1) For the purpose of examination, it shall be possible to
1.
a successfully completed final examination in a relevant recognised training occupation and a subsequent one-year professional practice, or
2.
a successfully completed final examination in another recognised vocational training profession and a subsequent two-year professional practice, or
3.
a five-year professional practice
redirects. The professional practice referred to in the first sentence must be carried out in activities which are conducive to the professional training of the construction machinery guide. § 3 Content and conduct of the examination

(1) The examination shall be carried out in the fields of construction, construction and civil engineering or road construction and shall be divided into:
1.
a theoretical part and
2.
a technical part.
(2) The examination shall be carried out in writing and orally as well as in the practical part in the form of practical exercises in accordance with paragraphs 3 to 6 and § § 4 to 9, without prejudice to § 10. The written examination shall be as a rule, do not exceed 4 hours and each examination subject is composed of a work to be carried out under supervision. If the written examination is carried out, the duration of the written examination can be shortened. (4) The oral examination is to be carried out at least in one examination subject and usually lasts 15 minutes per examination subject, in total but not more than 30 minutes. § 4 Specialist theoretical part, specials Hochbau

Basic knowledge of mechanics, oil hydraulics and electrical engineering; knowledge of the working methods and possible uses of the high-construction equipment, in particular via concrete mixing plants, concrete pumps, building cranes and construction lifts. (3) In the examination subject "Construction machinery dogs" can be checked:
Knowledge of the structure, maintenance and maintenance of the equipment and machines referred to in paragraph 2, in particular by means of drive types and power transmission elements. (4) In the "Load receiving means" examination subject, it is possible to examine:

§ 5 Specialist theoretical part, specialising in the field of earth and civil engineering

(1) In the subject-theoretical part of the field of earth and civil engineering, it is necessary to examine the following subjects:
1.
Working customer of the earth and civil engineering equipment,
2.
Construction machinery,
3.
drive types and power transmission elements,
4.
Occupational safety.

§ 6 Specialist theoretical part, field of road construction

(1) In the subject-theoretical part of the discipline road construction is to be examined in the following subjects:

road construction equipment,

Occupational safety.
(2) The examination subject "Arbeitskunde der Straßenbaugeräte" can be used to check:
Basic knowledge of mechanics and oil hydraulics; knowledge of the working methods and possible uses of road construction equipment, in particular soil compaction equipment, road finisher and grader. (3) In the examination subject "Construction machinery dogs" it is possible to examine:

§ 7 Specialpractical part, specialising in building construction

(1) In the subject-specific section of the field of construction, the following subjects are to be examined:
1.
Driving and operating high-construction equipment,
2.
Assessment of faults and elimination of simple faults in high-construction equipment.
(2) In the examination subject "Driving and using high-construction equipment", the test participant must prove that he can set up, operate, drive and maintain at least one building device, namely a building crane, a concrete mixing plant or a mobile concrete pump. § 9 Specialpractical part, Section for Road Construction

§ 10 Invoice of other exams

§ 11 Existence of the Examination

§ 12 Repeal of the examination

(1) A test which has not been passed can be repeated twice. § 13 Berlin-clause

Annex EV Excerpt from EinigVtr Annex I, Chapter XVI, Area C, Section III
(BGBl. II 1990, 889, 1135)

Federal law shall enter into force in the territory referred to in Article 3 of the Treaty, with the following measures:
1.
The Vocational Training Act of 14 August 1969 (BGBl. 1112), as last amended by Section 19 of the Law of 23 December 1981 (BGBl I). 1 and 2, § § 25, 29 (1), § 43 (1) and (2), § 46 (2), § 76 (2), § 77 (5), § 80 (2), § 81 (4), § 82 (2), § § 93, 95 (4), § 96 (2)), and the following measures:
a)
Legal regulations pursuant to § 21 (1) of the Act require the Federal Minister of Education and Science to enact a separate entry into force by means of a regulation which does not require the consent of the Federal Council. Legal regulations according to § 29 (1) and § 43 of the Act require the separate entry into force by the Federal Minister for Economic Affairs or the otherwise responsible Minister of Trade in agreement with the Federal Minister of Education and Science by Legal regulation, which does not require the approval of the Bundesrat.
b)
Until 31 December 1995, the competent authority may grant exemptions from the training regulations in accordance with § 25 of the Act, if the requirements set out by technical regulations cannot yet be met. The exceptions are temporary. g)

k)
The examination procedures in vocational training and vocational retraining, which are taking place on the day of the accession of the European Union, will be completed in accordance with the provisions of the previous rules.
