Input Formula

Based on § 53 (7) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz), which is defined by Article 2 (38) of the Law of 5. February 2009 (BGBl. 160), the Federal Foreign Office, in agreement with the Federal Ministry of the Interior, the Federal Ministry of Finance and the Federal Ministry of Defence, is ordering: href="index.html#BJNR117700010BJNE000200000"> unofficial table of contents

§ 1 tax base for the foreign surcharge and the assignment of the duty stations to the zone levels.

(1) For contenders, the Foreign surcharge instead of the basic salary according to the amount of the candidate's basic salary and the prospect of a special increase in the amount of the person's special interest. In addition, Section 42 (2) sentence 2 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz) must be observed.(2) The duty stations, on which a representative of the Federal Republic of Germany is located, shall be allocated to the zone stages in accordance with the provisions of Appendix 1. The assignment of a duty station not listed in Appendix 1 depends on the assignment of the representation of the Federal Republic of Germany, in whose district the place of service is located. By way of derogation from the second sentence, the duty stations listed in Appendix 2 shall be assigned to the zone levels designated therein. Non-official table of contents

§ 1a Life partnership

§ 2 supplement to the foreign surcharge pursuant to § 53 (1) sentence 5 of the Bundesbesoldungsgesetz

Bundesbesoldungsgesetz) (1) As a monthly supplement to the Distraction of exceptional material additional expenses or immaterial charges may be paid in addition to the foreign surcharge:
1.
up to 300 euros if it is is a place of service with an extraordinarly high rate of violent crime,
2.
up to 400 euros if the place of service is affected by the impact of a local armed conflict, or directly affected by a natural disaster, a man-made catastrophe or an epidemic,
3.
up to 600 euros if the place of service is affected by the effects of armed conflict and the state order is seriously affected, or if the recipients of international service contracts on the place of employment are affected by organised violent acts Resistance or terror is particularly at risk,
4.
up to 700 euros if the place of duty is directly and currently affected by an armed conflict and the Recipients of international services, for example, by means of combat, air strikes or rocket fire, are specifically at risk,
5.
up to 500 euros, if the recipients of foreign service contracts are affected by the place of additional material charges which occur in the short term.
The contract is awarded to officials, judges and Soldiers only if they are entitled to international salaries for this place of employment. It shall not be paid during a home leave, holiday leave and any other absence from the place of employment, except in the case of special care measures for preventive health care of up to four consecutive calendar days. The surcharge shall be increased by 10% for each person eligible under Section 53 (4) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz),
1.
if the person is in the place of employment, for which the contract has been fixed, not only temporarily and
2.
as far as the supplement and the increase amount together are not 700 Euro per month.
() In order to ensure the appropriate filling of a service post abroad, a surcharge of up to EUR 500 per month may be fixed if the post is due to exceptional material. Additional expenses or immaterial charges cannot be filled with a suitable applicant. The reasons for the award of the surcharge shall be documented. The surcharge shall be granted only to the person with which the post is occupied. It shall be paid, subject to budgetary resources, for as long as the person holds the post, but at the latest four years. It shall also be paid in the case of temporary absentia from the place of employment.(3) The surcharges referred to in paragraphs 1 and 2 may be granted side by side. Where the sum of the surcharges referred to in paragraphs 1 and 2 exceeds the sum of EUR 700 per person and month, the surcharge referred to in paragraph 2 shall be reduced. The surcharges are subject to the purchase force compensation.(4) The supreme service authority shall set the surcharges referred to in paragraphs 1 and 2 and the periods for which the surcharges are granted, in agreement with the Federal Foreign Office, the Federal Ministry of the Interior and the Federal Ministry of Finance. If a surcharge pursuant to paragraph 1 is fixed by the Federal Foreign Office in the case of a portfolio, other top service authorities may take over the fixed surcharge without re-obtaining the portfolio agreement for their business unit. unofficial table of contents

§ 3 foreign surcharge at workplace division

§ 4 Increased foreign surcharge

§ 5 Increased foreign surcharge for married couples

(1) Married Female Recipients of International Services, for which the law on the External Action Service applies, receive a foreign surcharge increased by 6 per cent of their salaries if they have a common household with their spouse or their spouse at the foreign service location and are entitled to the increased foreign surcharge pursuant to § 53 (2) sentence 2 or 3 sentence 3 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz).(2) The service references include:
1.
the basic salary,
2.
the family allowance at most level 1,
3.
the amperes and job allowances,
4.
the foreign surcharge for the recipient or the recipient of foreign service references and for the first to the recipient or the recipient of foreign service references Eligible person under Section 53 (4) (1) or (3) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz),
5.

(3) If the spouse or spouse is in employment, the net income earned in the calendar year shall be credited to half of the increased foreign surcharge for that calendar year, to the extent that it is the twelve-fold increase in the total amount of the net income. the monthly salary limit for minor occupations (Article 8 (1) (1) of the Fourth Book of the Social Code) or the corresponding amount in foreign currency. Net income of employment within the meaning of the first sentence is the sum of the income remaining after deduction of paid taxes on the income and employees ' shares of the statutory social security insurance:
1.
Agriculture and Forestry (§ 2 paragraph 1 sentence 1 number 1 in conjunction with § 13 of the Income Tax Act),
2.
Commercial Operations (§ 2 Paragraph 1 sentence 1, point 2 in conjunction with Section 15 of the Income Tax Act),
3.
independent work (§ 2 paragraph 1 sentence 1 number 3 in conjunction with § 18 of the Income Tax Act) and
4.
nonself-employed work (§ 2 (1) sentence 1, point 4 in conjunction with § 19 (1) sentence 1 (1) and (3) of the Income Tax Act).

§ 6 Increased foreign surcharge for other beneficiaries

Recipients of international service references, for which the Act on the External Action Service, the increased foreign surcharge in accordance with § 5 may also be granted for the persons mentioned in § 53 (4) (3) of the Federal Law on Remuneration, in so far as these are in the service interest in the performance of tasks the diplomatic mission abroad or the recipient of foreign service related services. § 7 Entry into force
