On the basis of § 53 (7) of the Federal Law on Wages, which is defined by Article 2 (38) of the Law of 5 February 2009 (BGBl. 160), the Federal Foreign Office, in agreement with the Federal Ministry of the Interior, the Federal Ministry of Finance and the Federal Ministry of Defence, has been rearranged:

§ 1 Tax base for the foreign surcharge and the assignment of the duty stations to the zone levels
(1) In the case of contenders, the foreign surcharge shall be paid instead of the basic salary according to the amount of the general contender and the prospect of a contender for the contender. In addition, Section 42 (2), second sentence, of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz) must be observed. (2) The duty stations, on which a representative of the Federal Republic of Germany is located, shall be assigned to the zone levels in accordance with the provisions of Appendix 1. The assignment of a duty station not listed in Appendix 1 depends on the assignment of the representation of the Federal Republic of Germany, in whose district the place of service is located. By way of derogation from the second sentence, the duty stations listed in Appendix 2 shall be assigned to the zone levels designated therein.

§ 1a Life Partnership
The provisions of this Regulation, which relate to spouses or married couples, shall apply accordingly to life partners.

§ 2 supplement to the international surcharge pursuant to § 53 (1) sentence 5 of the Bundesbesoldungsgesetz
(1) As a monthly supplement to the payment of exceptional material additional expenses or immaterial charges, additional to the foreign surcharge can be paid:
-
1.
-
up to 300 euros, if it is a place of service with an extraordinarly high rate of violent crime,
-
2.
-
up to EUR 400 if the place of service is affected by the effects of a local armed conflict or directly by a natural disaster, a man-made disaster or an epidemic,
-
3.
-
up to EUR 600 if the place of employment is affected by the effects of an armed conflict and if the state order is seriously affected or if the recipients of international service contracts at the place of employment are due to organised violent resistance or terror;
-
4.
-
up to EUR 700 if the place of employment is directly and currently affected by an armed conflict and the recipients of international service contracts, for example, by means of combat operations, air strikes or rocket fire are at risk,
-
5.
-
up to EUR 500 if the recipients of foreign service contracts at the place of work are affected by additional material burdens which occur in the short term.
The contract is awarded to civil servants, judges and soldiers only if they are entitled to foreign service remuneration for this place of employment. It shall not be paid during a home leave, holiday leave and any other absence from the place of employment, except in the case of special care measures for preventive health care of up to four consecutive calendar days. The surcharge increases by 10 per cent for each person eligible under Section 53 (4) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz).

provided that the person in the place of business for which the contract has been fixed is not only temporarily staying and
-
2.
-
as far as the supplement and the increase amount together do not exceed 700 Euro per month.
(2) In order to ensure the appropriate filling of a service post abroad, a surcharge of up to EUR 500 may be fixed on a monthly basis if the service item is due to exceptional material additional expenses, or cannot be filled with an appropriate applicant or a suitable candidate. The reasons for the award of the surcharge shall be documented. The surcharge shall be granted only to the person with which the post is occupied. It shall be paid, subject to budgetary resources, for as long as the person holds the post, but at the latest four years. It shall also be paid in the case of temporary absentia from the place of employment. (3) The surcharges referred to in paragraphs 1 and 2 may be granted side by side. Where the sum of the surcharges referred to in paragraphs 1 and 2 exceeds the sum of EUR 700 per person and month, the surcharge referred to in paragraph 2 shall be reduced. The surcharges are subject to the buying-in force. (4) The top service authority shall set the surcharges in accordance with paragraphs 1 and 2 and the periods for which the surcharges are to be granted, in agreement with the Federal Foreign Office, the Federal Ministry of the Interior and the Federal Ministry of Finance. If a surcharge pursuant to paragraph 1 is fixed by the Federal Foreign Office in the case of a portfolio, other top service authorities may take over the fixed surcharge without re-obtaining the portfolio agreement for their business unit.

§ 3 External surcharge in the case of job division
If spouses are to be classified as having different grades or levels of experience in accordance with Annex VI to the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz), the amount of the Foreign surcharges pursuant to § 53 (3) sentence 3 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz) according to the basic salary margin of the person or the person who is more or less paid.

§ 4 Increased foreign surcharge
(1) In accordance with § 53 (6) sentences 1 and 2 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz), the following shall apply to the increased foreign surcharge:

the basic salary,
-
2.
-
the maximum family allowance at level 1,
-
3.
-
the official and job allowances,
-
4.
-
the foreign surcharge for the recipients of foreign services and the first person to be taken into account in accordance with Section 53 (4) (1) or (3) of the Bundesbesoldungsgesetz (Bundesbesoldung gesetz).
(2) In the case of temporary use abroad, the sending service shall inform the body responsible for the determination of the remuneration if the period of the second sentence of § 53 (6) of the Federal Law on Remuneration is fulfilled. The periods of service provided before the entry into force of this Regulation shall be taken into account.

§ 5 Increased foreign surcharge for married couples
(1) In the case of a married female recipient of a foreign service for which the Foreign Service Act applies, a 6% increase in the amount of his/her salary is given to a foreign surcharge if she or her spouse or her spouse is Have a common household and are entitled to the increased foreign surcharge pursuant to § 53 (2) sentence 2 or 3 sentence 3 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz). (2) The salaries of the services include:

the basic salary,
-
2.
-
the maximum family allowance at level 1,
-
3.
-
the official and job allowances,
-
4.
-
the foreign surcharge for the recipient or the recipient of foreign service salaries and for the first person to be taken into account in addition to the recipient or the recipient of foreign service remuneration in accordance with § 53 (4) (1) or (3) of the Federal law on law,
-
5.
-
the increased foreign surcharge in accordance with § 53 (6) sentences 1 and 2 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz)
(3) If the spouse or spouse is in employment, the net income earned in the calendar year shall be credited to half of the increased foreign surcharge for that calendar year, as far as the 12-fold of the monthly salary limit for (§ 8 (1) (1) of the Fourth Book of the Social Code) or exceeds the corresponding amount in foreign currency. Net income of employment within the meaning of the first sentence is the sum of the income remaining after deduction of paid taxes on the income and labour shares of the statutory social security insurance:

Agriculture and forestry (Section 2 (1), first sentence, point 1, in conjunction with Section 13 of the Income Tax Act),
-
2.
-
Industrial operations (Section 2 (1), first sentence, point 2, in conjunction with Section 15 of the Income Tax Act),
-
3.
-
independent work (Section 2 (1), first sentence, point 3, in conjunction with Section 18 of the Income Tax Act), and
-
4.
-
non-self-employed work (Section 2 (1), first sentence, point 4, in conjunction with Section 19 (1), first sentence, points 1 and 3 of the Income Tax Law).

§ 6 Increased foreign surcharge for other beneficiaries
Recipients of international services for which the law on the External Action Service applies can also receive the increased foreign surcharge in accordance with § 5 for the persons referred to in § 53 (4) (3) of the Federal Law on Remuneration, to the extent that they participate in the service interest in the performance of duties of the diplomatic mission or of the recipients of international service related services.

Section 7 Entry into force
This Regulation shall enter into force with effect from 1 July 2010.
