§ 1 Scope of application

(1) This Regulation regulates exceptions to traffic bans in accordance with § 40 (1) of the Federal Immission Control Act and the assignment of motor vehicles to pollutant groups and determines requirements which are to be fulfilled in the case of a vehicle identification. The Regulation shall apply to motor vehicles of categories M and N in accordance with the provisions of Annex II A (1) and (2) of Council Directive 70 /156/EEC of 6 June 1985. February 1970 on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers (OJ No L 1970, p. EC No 1), as last amended by Directive 2005 /64/EC of the European Parliament and of the Council of 26 June 2001 on the European Parliament and of the Council of the European Union, 1 October 2005 (OJ C 327, EU No 10) has been amended.(2) The competent authority, in non-displaceable cases also the police, may allow the transport of vehicles affected by traffic bans within the meaning of § 40 (1) of the Federal Immission Protection Act and to certain facilities, to the extent that this is in the public interest, in particular where it is necessary to supply the population with essential goods and services, or where the overriding and unstoppable interests of individuals so require, in particular where: Production and production processes cannot be maintained in other ways. § 2 Assignment of motor vehicles to pollutant groups

(1) Motor vehicles with a badge in accordance with Annex 1 , are exempt from a traffic ban within the meaning of § 40 (1) of the Federal Immission Control Act, insofar as a traffic sign referred to it provides for this.(2) Vehicles shall be assigned to pollutant groups 1 to 4, taking into account their pollutant emissions. The allocation of motor vehicles to the pollutant groups in detail is given in Annex 2.(3) Motor vehicles listed in Annex 3 shall also be exempted from traffic bans in accordance with Article 40 (1) of the Federal Immission Protection Act even if they are not marked with a plaque in accordance with paragraph 1. § 3 Labelling

(1) For the identification of motor vehicles according to pollutant groups 2 to 4, non-reusable vehicles lightfast and counterfeit stickers according to the model of Annex 1. The labelling of the pollutant group shall be determined by the number of the pollutant group indicated on the badge and the corresponding colour design. The colour of the plaque is red for motor vehicles of pollutant group 2, yellow for vehicles of pollutant group 3 and green for motor vehicles of pollutant group 4.(2) In the plaque, the mark of the respective vehicle must be entered by the responsible issuing office in the written field provided for this purpose with a light-tech pen. In order to identify a motor vehicle, the badge must be placed clearly visible on the inside of the windscreen. The plaque must be designed and fitted in such a way that it is destroyed by the windscreen itself when the windscreen is detached. Non-official table of contents

§ 4 issue of the badges

Issue points for the badges are the approval authorities or the national law otherwise competent authorities and bodies recognised in accordance with Article 47a (2) of the Road Traffic Authorisation Order for the performance of exhaust gas investigations. This also applies to motor vehicles within the meaning of § 1 of the Regulation on International Motor Vehicle Transport in the revised version published in the Bundesgesetzblatt, Part III, outline number 9232-4, as last amended by Article 10 of the Regulation of the 25. § 5 Evidence of the pollutant group for vehicles registered in Germany

(1) The assignment of a motor vehicle to a vehicle Pollutant group is detected
1.
by means of the approval certificate Part I, in the Motor vehicle registration certificate and emission-related key number registered in the letter of the motor vehicle,
2.
for motor vehicles, which are subject to the regulations of the motorway toll road law heavy duty vehicles in the version of the notice of 2. December 2004 (BGBl. I p. 3122), by way of evidence in accordance with § § 8 and 9 of the HGV toll regulation of the 24. June 2003 (BGBI. I p. 1003).
(2) The Federal Ministry of Transport, Building and Urban Development announcates the allocation of the emission key numbers entered in the vehicle documents to the individual pollutant groups in the traffic sheet. Non-official table of contents

§ 6 Proof of the pollutant group for vehicles registered abroad

(1) In the case of vehicles registered abroad and under the provisions of the motorway tolls for heavy goods vehicles, as amended by the 2. December 2004 (BGBl. 3122), the allocation to a pollutant group can be carried out by means of proof in accordance with § § 8 and 9 of the truck toll regulation of the 24. June 2003 (BGBI. I p. 1003).(2) In the case of vehicles registered abroad, it shall be presumed that they belong to the pollutant groups listed there in accordance with the provisions of paragraphs 3 and 4, if no proof of compliance with the requirements of
1.
Council Directive 70 /220/EEC of 20. 1 March 1970 on the approximation of the laws of the Member States relating to measures to be taken against air pollution by emissions from motor vehicles (OJ No L 1970, p. EC No 1), as amended, or
2.
Council Directive 88 /77/EEC on the approximation of the laws of the Member States relating to measures Against the emission of gaseous and particulate pollutants from compression-ignition engines for the propulsion of vehicles and the emission of gaseous pollutants from positive-ignition engines fuelling natural gas or liquefied petroleum gas for the purpose of driving Vehicles (OJ L 327, EC No 33), as amended.
(3) Motor vehicles with compression-ignition engines of categories M and N are:
1.
for pollutant group 1 if they do not fall under pollutant groups 2 to 4,
2.
Pollutant group 2,
a)
if they fall within the scope of Directive 70 /220/EEC, first authorisation after the 31. December 1996 and before 1. 1 January 2001,
b)
if they fall within the scope of Directive 88 /77/EEC, in the case of first-time authorisation after 30 years. September 1996 and before 1. October 2001,
c)
if it is after the 1. for the first time and the requirements set out in Annex 2 (1) (2) (g) and (h) are equal to, or equivalent to, the requirements laid down in Annex 2 (1) (2) (g) and (h)
3.

December 1999 on the approximation of the laws of the Member States relating to the measures to be taken against the emission of gaseous and particulate pollutants from compression-ignition engines for use in vehicles and the gaseous emission of gaseous pollutants from the gaseous and gaseous pollutants of the gaseous and gaseous pollutants Pollutants from spark-ignition engines fuelated by natural gas or liquefied petroleum gas for the purpose of driving vehicles and amending Council Directive 88 /77/EEC (OJ L 206, 22.7.1988, p. (5) Motor vehicles with a positive-ignition engine of categories M and N shall be included in pollutant group 4 if:
1.
is proof that the vehicle has an emission reduction which meets the requirements of Annex XXIII of the Road transport approval order in the version of the 28. September 1988 (BGBl. 1793), as last amended by the Regulation of 24 December 1993. May 2007 (BGBl. 893), or is equivalent to it, or
2.
is demonstrated by a proof that the vehicle is retrofitted with an exhaust gas purification system via a emission reduction, which is the provisions of the 52. Exceptional Regulation on the StVZO of 13. August 1996 (BGBl. 1319), as amended by Article 1 of the Regulation of 18 June 2008. February 1998 (BGBl. 390), is equivalent to, or is equivalent to, or
3.
within the scope of Directive 70 /220/EEC or Directive 2005 /55/EC, in the most recent modified, as published in the Official Journal of the European Union.

Vehicles, for which special rights can be used in accordance with § 35 of the Road Traffic Order,
