§ 1 Scope

(1) This Regulation regulates exceptions to traffic bans in accordance with § 40 (1) of the Federal Immission Protection Act and the assignment of motor vehicles to pollutant groups and determines requirements which are to be met in the case of a vehicle identification are fulfilled. The Regulation shall apply to motor vehicles of categories M and N in accordance with Annex II A (1) and (2) of Council Directive 70 /156/EEC of 6 February 1970 on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers (OJ L 327, 30.4.2004 EC No 1), as last amended by Directive 2005 /64/EC of the European Parliament and of the Council of 26 June 2001 on the European Parliament and of the Council of the European Parliament October 2005 (OJ C 327, EU No 10). § 2 Assignment of motor vehicles to pollutant groups

(1) Motor vehicles marked with a badge in accordance with Annex 1 shall be exempted from a traffic ban within the meaning of Article 40 (1) of the Federal Immission Control Act, insofar as a traffic sign related thereto provides for this. § 3 Labelling

(1) For the identification of motor vehicles in accordance with groups 2 to 4 of pollutants, use shall be made of non-reusable lightfast and counterfeit plaques according to the model of Annex 1. The labelling of the pollutant group shall be determined by the number of the pollutant group indicated on the badge and the corresponding colour design. The colour of the badge is red for motor vehicles of the pollutant group 2, yellow for vehicles of the pollutant group 3 and green for motor vehicles of the pollutant group 4. (2) The plaque shall be provided by the competent issuing office in the Writing field with light-tech pen to enter the license plate of the respective vehicle. In order to identify a motor vehicle, the badge must be placed clearly visible on the inside of the windscreen. The plaque must be designed and fitted in such a way that it is destroyed by the windscreen itself when the windscreen is detached. Unofficial table of contents

§ 4 Issue of badges

Issuing offices for the badges are the registration authorities or bodies which are otherwise competent under national law, and the bodies recognised pursuant to section 47a (2) of the road traffic permit system for the performance of exhaust gas investigations. This also applies to motor vehicles within the meaning of § 1 of the Regulation on International Motor Vehicle Transport in the revised version published in the Federal Law Gazan Part III, No. 9232-4, the latest by Article 10 of the Regulation. of 25 April 2006 (BGBl. 988). § 5 Proof of the pollutant group for vehicles registered in Germany

(1) The assignment of a motor vehicle to a pollutant group is detected
1.
the emission-related key number entered in the registration certificate part I, in the motor vehicle registration certificate and in the motor vehicle letter,
2.
for motor vehicles covered by the provisions of the motorway tolling law for heavy goods vehicles as amended by the Notice of 2 December 2004 (BGBl. 3122), by way of evidence in accordance with § § 8 and 9 of the HGV toll regulation of 24 June 2003 (BGBI. 1003).
(2) The Federal Ministry of Transport, Building and Urban Development announcates the allocation of the emission key numbers entered in the vehicle documents to the individual pollutant groups in the traffic sheet. Unofficial table of contents

Section 6 Proof of the pollutant group for vehicles registered abroad

(1) In the case of vehicles registered abroad and subject to the provisions of the toll road law for heavy goods vehicles in the version of the notice of 2 December 2004 (BGBl. 3122), the assignment to a pollutant group can be carried out by means of proof in accordance with § § 8 and 9 of the truck toll regulation of 24 June 2003 (BGBI. 2) In the case of vehicles registered abroad, it is presumed that they belong to the pollutant groups listed there, in accordance with the provisions of paragraphs 3 and 4, where no proof of compliance with the Requests for
1.
Council Directive 70 /220/EEC of 20 March 1970 on the approximation of the laws of the Member States relating to measures to be taken against air pollution by emissions from motor vehicles (OJ L 376, 27.3.1970, p. EC No 1), as amended, or
2.
Council Directive 88 /77/EEC on the approximation of the laws of the Member States relating to the measures to be taken against the emission of gaseous and particulate pollutants from compression-ignition engines for use in vehicles and the emission of gaseous pollutants from the emission of gaseous pollutants from the emission of gaseous pollutants from gaseous pollutants from spark-ignition engines fuelated by natural gas or liquefied petroleum gas for use in vehicles (OJ L 327, 22.7.2005 EC No 33), as amended, may be submitted in the relevant version.
(3) Motor vehicles with compression-ignition engines of categories M and N are:
1.
for pollutant group 1, if they are not covered by pollutant groups 2 to 4,
2.
on pollutant group 2,
a)
if they fall within the scope of Directive 70 /220/EEC, in the case of initial authorisation after 31 December 1996 and before 1 January 2001,
b)
if they fall within the scope of Directive 88 /77/EEC, in the case of initial authorisation after 30 September 1996 and before 1. October 2001,
c)
if they have been admitted for the first time after 1 January 1993 and meet or are equivalent to the requirements set out in Annex 2 (1) (2) (g) and (h), and this is demonstrated by a receipt,
3.
on pollutant group 3,
a)
if they fall within the scope of Directive 70 /220/EEC, in the case of initial authorisation after 31 December 2000 and before 1 January 2006,
b)
if they fall within the scope of Directive 88 /77/EEC, in the case of initial authorisation after 30 September 2001 and before 1. October 2006,
c)
if it's after the 1. , have been admitted for the first time in October 1996 and meet or are equivalent to the requirements set out in Annex 2 (1) (3) (j) to (l), and this is demonstrated by a receipt,
4.
on pollutant group 4,
a)
if they fall within the scope of Directive 70 /220/EEC, in the case of first authorisation after 31 December 2005,
b)
if they fall within the scope of Directive 88 /77/EEC, in the case of first authorisation after 30 September 2006,
c)
if they fall within the scope of Directive 70 /220/EEC, the requirements of Directive 98 /69/EC or Directive 1999 /102/EC or Directive 2001 /100/EC or Directive 2001 /80/EC or Directive 2002/80/EC or Directive 2001 /80/EC or Directive 2001 /80/EC or Directive 2001 /80/EC or Directive 2001 /80/EC or Directive 2001 /80/EC or Directive 2003 /76/EC (e.g. (b) by the manufacturer's certificate) that they do not exceed the particle limit value of 5.0 mg/km beyond the particle limit value prescribed in B (2005) of the table in section 5.3.1.4 of Annex I to the Directive,
d)

EU No 1), in the latest amended version, published in the Official Journal of the European Union.
(4) Motor vehicles with a positive-ignition engine of categories M and N shall be included in pollutant group 4 if they are
1.
fall within the scope of Directive 70 /220/EEC, in the case of initial authorisation after 31 December 1992,
2.
in the scope of Directive 88 /77/EEC, as amended by Directive 1999 /96/EC of the European Parliament and of the Council of 13 December 1999 on the approximation of the laws of the Member States relating to measures to be taken against the emission Gaseous and particulate pollutants from compression-ignition engines for the propulsion of vehicles and the emission of gaseous pollutants from positive-ignition engines fuelling natural gas or liquefied petroleum gas for use in vehicles and for vehicles Amendment of Council Directive 88 /77/EEC (OJ L 206, 22.7.1988, p EC 2000 No 1), which comply with the requirements of the Directive and in the case of emissions of gaseous and particulate pollutants covered by A (2000) or B 1 (2005) or B 2 (2008) or C (EEV) of Tables 1 and 2 in 6.2.1 of Annex I to the Directive do not exceed the limits laid down in Annex I to the Directive and proof of compliance with the limit values by a proof or
3.
in the scope of Directive 88 /77/EEC, as amended by Directive 2001 /27/EC of the European Parliament and of the Council of 10 April 2001 adapting to the approximation of the laws of the European Union Council Directive 88 /77/EEC Member States on measures to be taken against the emission of gaseous and particulate pollutants from compression-ignition engines for the propulsion of vehicles and the emission of gaseous pollutants from natural gas or liquefied petroleum gas Spark-ignition engines for driving vehicles to technical progress (OJ L 327, 30.4.2004, p. EC No 10), which comply with the requirements of the Directive and in the case of emissions of gaseous and particulate pollutants covered by A (2000) or B 1 (2005) or B 2 (2008) or C (EEV) of Tables 1 and 2 in 6.2.1 of Annex I to Directive 1999 /96/EC of the European Parliament and of the Council of 13 December 1999 (OJ L 327, 30.12.1999, p. EC 2000 No 1), and compliance with the limit values is demonstrated by a receipt.
(5) Motor vehicles with a spark-ignition engine of categories M and N shall be included in pollutant group 4 if:
1.
it is proved by a proof that the vehicle has an emission reduction which meets the requirements of Annex XXIII of the Road Traffic Authorisation Order as amended by the Notice of 28 September 1988 (BGBl. 1793), as last amended by the Regulation of 24 May 2007 (BGBl I). 893), is equivalent to or is equivalent to it; or
2.
A proof that the vehicle has been retrofitted with an exhaust gas purification system has a reduction in emissions, which is based on the provisions of the 52. Regulation of the StVZO of 13 August 1996 (BGBl. 1319), as amended by Article 1 of the Regulation of 18 February 1998 (BGBl I). 390), is equivalent to or is equivalent to it; or
3.
fall within the scope of Directive 70 /220/EEC or Directive 2005 /55/EC, as amended in each case, as published in the Official Journal of the European Union.

b)
within the scope of Directive 70 /220/EEC, as amended by Directive 96 /44/EC of the European Parliament and of the Council of 1 July 1996 (OJ L 136, 31.7.1996, p. with regard to of the individual amendments. The following motor vehicles are excluded from traffic bans in accordance with § 40 (1) of the Federal Immission Protection Act even if they are not marked with a badge in accordance with Section 2 (1) of the Federal Immission Protection Act:

mobile machines and equipment,
2.
working machines,
3.
agricultural and forestry tractors,
4.
two-and three-wheel motor vehicles,
5.
Ambulance, doctor ' s car with appropriate labelling "Doctor Emergency Use" (according to § 52 (6) of the Road Traffic-Admission Order),
6.
Motor vehicles used for driving or driving persons who are exceptionally disabled, helpless or blind and which are registered in the disabled person's ID card pursuant to § 3 (1) (1) to (3) of the Ordinance on the Disabled Persons Detect "aG", "H" or "Bl",
7.
vehicles for which special rights may be used in accordance with Article 35 of the Road Traffic Order,
8.
Vehicles of non-German troops from non-contracting states of the North Atlantic Treaty, which are in the framework of military cooperation in Germany, to the extent that they are used for journeys made for urgent military reasons,
9.
civil motor vehicles used on behalf of the Bundeswehr, in so far as these are unstoppable journeys for the performance of the Federal Armed Forces ' tasks of public authority,
