DECRETA:
SERVICE DEFINITIONS
ARTICLE 1o. The Nation is associated with the commemoration of the 60th anniversary of the founding of the Colombian League of Radioamateurs and with such a motive pays tribute to its founders, gentlemen: Gustavo Uribe, Roberto Jaramillo Ferro, Fernando Carrizosa V., Jorge Alvarez Lleras, Roberto E. Lee, among other distinguished citizens, who were at the same time pioneers of Radiocommunications and Broadcasting in Colombia.
ARTICLE 2o. Declare public utility and national interest the activity of the satellite radio and amateur radio service.
ARTICLE 3o. The satellite radio and amateur radio service can be provided throughout the national territory, including territorial waters and airspace, as well as in the places that international conventions recognize Colombia the principle of extraterritoriality.
ARTICLE 4. The radio amateurs service is a radio communications service that aims at the individual instruction, intercommunication and technical studies performed by fans properly. updated that are interested in radio experimentation for exclusively personal and non-profit purposes.
ARTICLE 5o. The satellite radio-amateur service, is the radio communications service that uses space stations located on earth satellites for the same purposes as the service of radio amateurs.
ARTICLE 6o. The radio fan service station is one that comprises one or more transmitters or receivers with the accessory facilities to be operated on the bands and frequencies assigned by the Ministry of Communications, in accordance with the Radio Regulations of the International Union of Telecommunications to the service of radio amateurs or radio fans by satellite. The station may be fixed, mobile or portable, depending on the category of the license, which for this purpose is issued by the Colombian Ministry of Communications.
ARTICLE 7o. Radioaficionado, is the natural person who performs the radio-amateur or radio-amateur service by satellite, who will perform prior authorization, through radio-amateur stations. established in accordance with the rules of this Law, its regulations and the Radio Regulations of the International Telecommunication Union (ITU).
SERVICE DELIVERY
ARTICLE 8o. To operate a radio fan station requires authorization for the operation of the station and the corresponding license for its operator.
ARTICLE 9o. The radio amateurs license will be granted by the Colombian Ministry of Communications, subject to regulations that will make the necessary requirements and procedures.
ARTICLE 10. The National Government will establish everything related to bands, frequencies, powers, types of emission and other measures necessary for the due development of the radioactive activity according to the categories noted in the previous article.
ARTICLE 11. The national or foreign radio fans who have obtained a license in a foreign country with which Colombia has a reciprocity agreement, have the right to the Ministry of Communications grants them a license for radio amateurs in the equivalent category and for the same term granted to them abroad.
ARTICLE 12. Everyone who wishes to obtain a license to operate the apparatus of a radio fan station must approve an examination that certifies their fitness. The Ministry of Communications may delegate these examinations to duly registered radio amateur associations, subject to the approval of the question banks and the system of evaluation of such tests.
OF THE RADIO FAN ASSOCIATIONS
ARTICLE 13. Radioamateurs will be able to partner through entities or institutions, to improve their knowledge, to conduct scientific or technical research or to establish radio stations and networks of Communication at amateur level.
ARTICLE 14. It is the primary objective of radio amateur leagues or associations, to encourage the study, instruction, research and radio experimentation of communications at the amateur level.
ARTICLE 15. The radio amateur leagues or associations will be national and regional. The Ministry of Communications will regulate the requirements and formalities for the recognition and registration of the different categories of leagues and associations.
ARTICLE 16. The leagues or associations must register with the Ministry of Communications in order to obtain the registration, which will be the calling flag. Such registration must be renewed every five (5) years.
ARTICLE 17. The Ministry of Communications may authorize radio amateurs associations, the urging and the operation of repeaters, in accordance with the national frequency plan, issued by the Ministry of Communications. Ministry, without this being the exclusive exclusive use of the frequencies attributed to the service of the radio amateurs.
FROM THE RADIO FAN SERVICE ADVISORY COUNCIL
ARTICLE 18. The Advisory Board of the Radio Fans Service, will be integrated by:
a) The Minister of Communications or his delegate, who will chair it;
b) The Administrative Director of Social Communication at the Ministry of Communications;
c) The Technical Director of the Ministry of Communications;
d) The Head of the Media Division of the Ministry of Communications;
e) Two (2) representatives of different national amateur radio associations, recognized as such by the Ministry of Communications and elected by them;
f) A representative of all regional associations recognized as such by the Ministry of Communications and elected by them.
The Ministry of Communications will regulate the election of the representatives mentioned in the literals (e) and (f) of this article.
ARTICLE 19. They are functions of the Advisory Board of the Radio Fans Service:
a) Advise the Ministry of Communications for issues related to the radio amateurs service;
b) Propose and recommend the necessary measures for the proper functioning of the radio amateurs service.
PARAGRAFO. The recommendations of the Advisory Board of the Radioamateurs Service should be heard, but in no case do they force the Ministry of Communications or the National Government.
ARTICLE 20. The Ministry of Communications will provide what is necessary for the installation and operation of the Advisory Board of the Radioamateurs Service.
DUTIES AND RIGHTS OF RADIO FANS AND FINAL PROVISIONS
ARTICLE 21. The radio fan license holder is the only authorized to use the appropriately assigned call flags. The radio fan who transgresses this obligation will be punished according to the current legal provisions.
ARTICLE 22. The radio fan that causes interference to other authorized services, must suspend transmissions until the causes of interference are corrected or removed. Otherwise, it will be the subject of sanctions that will set the current rules for the effect.
ARTICLE 23. The transmissions will be performed in clear and courteous language, observing national and international standards in this respect.
ARTICLE 24. On transmissions performed by radio amateurs, it will not be possible:
a) Spread news originating from other telecommunications services, except for express exceptions.
b) Establish communication with stations that are not properly identified.
c) Transmitting simple notes of audiofrequency, key conversations, political, religious, commercial or other issues that depart from the spirit of the radio amateurs service; nor false or alarming information that attacks the public peace, or the security of persons; or that contain obscene, unseemly or double-meaning phrases; or that terms may be used which may cause tort to the dignity of persons.
ARTICLE 25. The Ministry of Communications will regulate the provision of radio-amateur services, in case of public calamity, disturbance of public order, internal shock and emergency. In such circumstances, the use of bands, frequencies and types of emission, attributed to the radio amateurs service, may be temporarily suspended. Only in previously authorized cases will radio fan stations for links or retransmissions of another broadcast service be used.
ARTICLE 26. The Ministry of Communications will regulate the obligation of holders of a radio-hobby license, in relation to irregularities or violations in the use of frequencies or bands respective.
ARTICLE 27. The National Government will regulate the obligation of radio fans to license holders in respect of violations of the misuse of frequencies and violations of this Law and regulations.
ARTICLE 28. The Ministry of Communications will regulate all matters arising from this Law for the purpose of facilitating and promoting the work of radio amateurs.
ARTICLE 29. This Law governs from your sanction and repeals all provisions that are contrary to you.
