COLOMBIA CONGRESS
DECRETA:
ARTICLE 1o. Addition to the Compuths of the Nation's Treasury Capital Resources and Resources for the fiscal life of the 1st. From January to 31 December 1992, in the sum of one billion eight hundred and fifty-six thousand two hundred and twenty-two hundred and eighty-two thousand six hundred and eighteen pesos ($1,856,214,782,618) currency, based on the certificates of Issued availability, which are incorporated according to the following detail:
ARTICLE 2o. Modifies the Decree-Law of Appropriations to address the state's operating expenses, for public investment, payment of court judgments, and payment of the service of public debt during the Fiscal validity from January 1 to December 31, 1992, by dialing the General Budget of the Nation, the sum of one billion eight hundred and fifty-six thousand two hundred and twenty-two hundred and eighty-two thousand six hundred and eighteen pesos ($ 1.856.214.782.618) currency, as follows:
ARTICLE 3o. Amend the Decree-Law of Appropriations for the Service of the Cats of the State, for public investment and payment of the service of the public debt during the fiscal year of January 1 On December 31, 1992, reducing the General Budget of the Nation of appropriations by the sum of: eleven thousand three hundred and eighty-three million four hundred and thirty-five thousand pesos ($11,383,435,000) currency, according to the following detail:
ARTICLE 4. Amend the Decree-Law of Appropriations to address the State's operating expenses, for public investment and payment of service of the public debt during the fiscal year of January 1 On December 31, 1992, carrying out contracts and credits in the General Budget of the Nation of appropriations for the sum of: seventy-three thousand three hundred and forty million nine hundred and thirty-two thousand seven hundred and eleven pesos eighteen cents ($73,340,932,711.18) current currency, according to the following detail:
ARTICLE 5o. The Titles of Treasury or T.E.S. Class B for the financing of appropriations of the General Budget of the Nation and for the purpose of carrying out temporary treasury operations, Articles 4o and 6o of Law 51 of 1990 and article 17 paragraph 3 of Law 6a of 1992 will not count with solidarity guarantee of the Bank of the Republic and the amount of the issue or emissions in the first event will be limited the amount of budget appropriations that are financed from this source of resources. In the case of T.E.S. to finance temporary treasury operations, the amount of issuance shall be fixed by the decree authorizing it.
The debt service of the titles that this article deals with will be appropriate in the General Budget of the Nation.
PARAGRAFO. Class A Treasury Titles will continue to be governed by the provisions of Law 51 of 1990 and other rules that develop it.
ARTICLE 6o. The execution of budget appropriations that are financed under Class B Treasury Titles may be carried out from the date of publication of the decree ordering its issuance.
ARTICLE 7o. In order to guarantee the economic conditions of the notaries and their employees, the National Notary Fund will transfer to the Social Welfare Fund of Notaries and Registry-Fonprenor-, the surplus resources of the proceeds of their income discounted their operating and investment expenses, in order to constitute reserves for the payment of pensions or to pay for the payment of pensions.
ARTICLE 8o. ARTICLE 9o. ARTICLE 11. The resources of operating expenses (salaries) left over from the 1991 term of the University of Tolima, can be invested in the construction of the University Citadel, Law 77/85.
ARTICLE 12. The items of 1991 and earlier that are in reserve in the Icetex, in the Community Development Fund of the Ministry of Government and in public recho entities that have as their purpose education, housing, health or public works programmes shall be paid by those entities before 31 December 1992, in accordance with the provisions in force on the date on which they were created.
ARTICLE 13. In exercise of the power conferred on the Congress of the Republic, by Article 150 of the National Constitution, it will be interpreted with authority to the Article 38 of Law 05 of 1992, in the sense that the 35 salaries indicated for the Legislative Unit of each Parliamentary, will be used solely and exclusively to cancel the salaries of the employees of the that Unit.
PARAGRAFO 1o. The employees of the Legislative Unit of the Congressmen will have the same social and premium benefits as they enjoy the employees of the Senate and Chamber Personnel Plant that deals with Law 05 of 1992.
PARAGRAFO 2o. The value of those social and premium benefits would be paid from each Chamber's Common Funds.
ARTICLE 15. Public works contracts to be concluded by natural or legal persons with the territorial entities and/or with the decentralized entities of the municipal, district and departmental order be excluded from VAT.
ARTICLE 16.-By distributing the global headings for the support of higher education in Colombia, the Ministry of Finance will include in this Additional Budget the Industrial University of Santander, giving it a proportional treatment to the Official Universities of the Central Sector.
ARTICLE 17.-The National Government is authorized to replace public debt on the other hand, provided that the change improves the time, interest and other conditions of the government's portfolio. In cases where the result of these operations does not increase the net borrowing of the Nation, prior to the authorization of the "Interparliamentary Public Credit Commission".
ARTICLE 18.-For the provision of public education and health services by the agencies and entities of the State, as provided for in Articles 49, 67 , and 365 of the National Constitution, contracts with entities may be concluded private of any nature, subject to the general rules of administrative procurement.
According to the article 341 of the Political Constitution, it is up to the government to prepare and present the National Development Plan. While the relevant laws and regulations are being issued and given the current constitutional transition period, the National Development Plan and the Regional and Sectional Plans approved by the Executive Branch of the Public Power will be ancillary criteria for the action of the Public Power Ramas in those cases where such plans are necessary.
ARTICLE 19.-The government will arbitrate resources in order to capitalize or restructure the Agricultural, Industrial and Mining Credit Fund up to the sum of $56,000.0000.000.00 from the 1992 budget. The capitalization process will be carried out once the board of directors approves a plan of restructuration of the entity, agreed with the Fund of Guarantees of Financial Institutions, Fogagin, for which it will have 60 days from the term of this Act.
ARTICLE 20. The Government, in distributing the global funds of the National Fund for Rural Roads, the National Rehabilitation Plan, PNR; the Fund for the Aqueducts of the Financial Development of Territorial Development, Findeter and the Solidarity and Emergency Fund, will include in this additional budget, for the economic and social development of indigenous communities and peoples.
ARTICLE 21. This Law governs and surposes tax effects from the date of its publication.
