GENERAL PROVISIONS 1-mother milk replacement products are milk and other food items for children are produced by industrial methods or craft used to completely or partially replace breast milk includes dairy products, cereals, mixed vegetables, fruit juices, tea, milk jugs and rubber nipple.

The Ministry of culture and information, the Committee on the protection and care of children, the Ministry of health, Vietnam Ministry of trade is responsible for coordinating with mass information bodies, the Vietnam Women's Union, the Vietnam farmers Association and other social organizations to organize advocacy education, the mothers about the superiority of breast milk and breastfeeding Moms.
4-The information and promotion of breast milk substitutes must comply with the provisions of the law on information, advertising and the provisions of this circular.
II. SPECIFIC PROVISIONS REGARDING the TRADING of the PRODUCT REPLACE MOTHER'S MILK 1-The only commercial license to import these products replace mother's milk after the opinion of the Ministry of health.
2-the review process for licensing imports of these products replace mother's milk: a) the business licensing, please import the product replace breast milk must submit the full dossier as provided by the Ministry of Commerce to Department of health consultation. During 20 days from the date of the application, the Department of health to review and submit comments to the Ministry of trade (license).
b) at the latest within 15 days from the receipt of the written comments and the Ministry of health, the Ministry of Commerce is responsible for considering granting or not granting, if not level must reply in writing stating the reason.
3-the business licensed to import these products replace mother's milk want to import these products must take the product form and the profile of the product to the Health Ministry. After the Ministry of Health issued a certificate hygiene standard and food safety product for the business model to license of Ministry of Commerce in the business sector that closed the main office to receive the license by the Ministry of Commerce.
4-items included in the contract for import of the product replace mother's milk to be found in the category were the Health Ministry agreed to enter the trade and import licensing.
III. REGULATIONS on information, education, PROMOTION of BREAST MILK SUBSTITUTES 1-The fair trade exhibition related products replace breast milk held in Vietnam must have a permit of the Ministry of Commerce after being approved by the Ministry of health.
2-The program information on the protection of the health of mothers and children must be given priority for educational information about the benefits of breastfeeding mothers and the method of feeding babies, small children.
3-our bodies have the responsibility to reflect honestly, about the superiority of breast milk for infants, small children, use only breast milk substitutes under the direction of the medical officer.
4-The promotion of breast milk substitutes must comply with the provisions of article 4, 5 of decision No. 307-TTg dated 10 June 1994 by the Prime Minister.
5-In the label of the product replace mother's milk and the advertising content of this product are not there comments or painting to advocacy for business or encourage the use of the product, not the promotion of dairy products are full of substances such as milk or can completely replace mother's milk.
6-the institutions, not individual ads, showcasing the product replace breast milk at the medical facility.
IV. ENFORCEMENT of TERMS 1-Ministry of health, the Ministry of Commerce, Ministry of culture and information, the Committee to protect and care for children of Vietnam have common responsibilities decision No. 307-TTg and this circular down the subdivisions and local, and coordinate implementation of the relevant provisions , enhanced inspection, check for doing good work to encourage, sustain breastfeeding mom and reasonable use of the alternative products are mother's milk.
2-the person who violates the provisions of this circular, depending on the level of violation will be punished, the administrative sanction or prejudice to criminal responsibility, if the damage is compensated according to the provisions of the law, fines of sanctioning administrative violations are applied under paragraph 3 article 11 of decision No. 307-TTg dated 10 June 1994 by the Prime Minister.
