The DECISION of the MINISTER of TRANSPORT issued the regulation on quality control, technical safety and environmental protection of railway transportation, the MINISTER of TRANSPORT pursuant to the law on railways Jun. 14, 2005;
Pursuant to Decree No. 34/2003/ND-CP dated 4 April 2003 of the Government functions, tasks, powers and organizational structure of the Ministry of transportation;
According to the proposal of the Director General of science and technology and Director of the Vietnam register, DECIDES: 1. Attached to this decision "regulation on quality control, technical safety and environmental protection of railway transport".
Article 2. This decision has effect from January 1, 2006.
Article 3. Chief, Chief Inspector, Chief of the Service of the Ministry, Director of the Vietnam register, Director Vietnam railway, heads of organizations and individuals concerned is responsible for the implementation of this decision.
 
 
Regulation on quality control, technical safety and environmental protection of railway transport (attached to decision No. 58/2005/QĐ-BGTVT dated 07/11/2005 of the Minister of transport) chapter I GENERAL PROVISIONS article 1. Scope, application object 1. This text stipulates the quality control, technical safety and environmental protection for other types of rail transport, import, manufacture, Assembly, conversion, restoration and in the process of tapping on the national rail network, rail, the railway had connected ray's specialized with national rail.
2. This regulation applies to the Organization, the individual is related to the design, import, manufacture, Assembly, conversion, recovery and exploitation of railway transport.
Article 2. Explanation of terms In this regulation, the terms below are interpreted as follows: 1. rail transport (hereinafter referred to as the media) is the early machines, carriages, wagons, specialized vehicles moving on the railroad.

8. The basis of the design is the organization with legal personality, has registered the design industry business means rail transport in accordance with the current rules.
9. Manufacturing base is manufactured, assembled, conversion, restoration, repair of vehicles that qualify under the current rules.
Chapter II QUALITY CONTROL, TECHNICAL SAFETY and ENVIRONMENT PROTECTION article 3. Grounds for checking the quality, safety and environmental protection techniques for quality control, technical safety and environmental protection of railway transport (hereinafter referred to as check) include: 1. The standards, regulations, processes, technical;
2. Profile design or technical records.
Article 4. Type of test 1. Check the product import and manufacture, Assembly;
2. check the product conversion, recovery;
3. periodic inspection of vehicles.
Article 5. Profile design profile design was the basis of the production or design facility established as 3 sets sent to the check post authorities to evaluator.
1. With regard to the means of production, Assembly, design profile include: a) technical drawing:-the overall drawing of the media;
-Drawings and installation of the system;
-Drawings and specifications of the total, domestic production systems;
-The specifications of the total, import System.
b) A demonstration, calculate:-presentation of the basic technical characteristics of the vehicle;
-Calculate the dynamics: soothing properties operation, safety against flip and fight derailed;
-Calculate the traction (applies to locomotives, carriages driving force or means of motivation);
-Calculation of strength test of car body, car prices and wagons of the early machines or means of propulsion;
-Calculate braking test.
2. In respect of the manufacture, Assembly, design profile include: a) the overall drawing of the product;
b) A demonstration of technical characteristics of products.
3. For the media conversion, design profile include: a) the overall drawing of the media before and after conversion;
b) of the technical documentation, the system was used to convert;
c) A demonstration, calculate related content conversion.
Article 6. Design 1. The evaluation profile design made for the products before the first Assembly, manufacturing or conversion.
2. Evaluation design is the consideration, the content of the profile design product with the regulations, the current technical standards. The evaluation design be made within 15 days from the date of receipt of a valid application. Cases must extend the evaluation due to the additional requirements of records then register agency design announcements in writing to the base design.

Article 7. Check the product manufacture, Assembly 1. Engineering records used in the screening process include: a) the profile of design products have been appraised registry Agency;
b) quality certificate (for products that require quality certificates) or related technical documentation of the systems, used to manufacture, assemble the product;
c) test profile and products of the production base.
2. check a) content for the media: test according to the content specified in annex 1 attached to this regulation.

Article 8. Check the media conversion 1. Engineering records used in the screening process include: a) the profile design means the check post agencies was appraisal;
b) quality certificate (for products that require quality certificates) or related technical documentation of the system, is used to convert the media;

Article 9. Examine import media 1. Engineering records used in the screening process include: a) the technical agreement of the contract;

Article 10. Periodically check for the media 1. Time check

Article 11. Check for unusual unusual test was done at the request of the competent State bodies or when there is a complaint about the quality of the product.
Article 12. Level and use the certificates of quality, technical safety and environmental protection 1. The certification of quality, technical safety and environmental protection are as follows: a) the product is tested according to the provisions of article 4 of this regulation and the profile design be appraised if satisfies the regulations, technical standards, the current register agency quality certification , technical safety and environmental protection (hereinafter referred to as the certificate) according to the corresponding template in Appendix 2 attached to this regulation;
b) after the end of the test, the certification is done within 1 day for the media to check periodically, 3 days for the media on the import, manufacture, Assembly, conversion.
2. The use of the certificate is as follows: a) the certificate of the producer, the Assembly is granted for production facilities to allow use, assembled on the media.
b) certificate issued to the media used to do the registration and circulation of vehicles.
c) vehicle, the owner of the exploitation of the media has a responsibility to preserve, conserve and present the certificate when required by the competent State bodies. Prohibiting the repair and erase the certificate already granted.
3. The validity of the certificate and the certificate revocation: a) the certificate of registry granted authority for the media will take effect when the accident vehicle.
b) register authorities made the recovery certificate when media owners, media mining server not fully implementing the provisions of the standards, regulations and current engineering processes in the maintenance, repair and exploitation of the media.
4. The Agency posted the check out register records within a period of 3 years from the date of the certification.

7. Annual periodic reports of Ministry of transport of results to perform quality checks, technical safety and environmental protection of railway transport.
8. Guide the implementation of this regulation.
Article 14. Responsibilities of the facility design, production facilities and media owners, media mining server 1. Responsibilities of the facility design: a) in compliance with rules, regulations, current technical standards.
b) make regulations about the design profile and profile evaluation design according to the provisions of article 5 and article 6 of this regulation.
c) responsible to the law on product quality design by themselves make.
2. The responsibility of the production base: a) in compliance with the rules, processes, regulations, current technical standards when importing, manufacturing, Assembly, repair, conversion, restoration products.
b) build process and product quality control test equipment investment consistent with production; the test equipment must be periodic calibration.
c) quality control organization for each product and responsible for the quality of products marketed.
d) responsible for the source, origin, quality imported products.
DD) subject to the supervision of the quality standards, safety engineering and environmental protection agency register in the production process.
e) preserving the technical profile, quality certificate, certificate and upon request of the competent State bodies.
3. Media Owners, media mining server is responsible for repairs and maintenance to ensure technical safety standards and protect the environment of the media between the two States examined by the Agency./.
