The DECISION of the MINISTER of AGRICULTURE and RURAL DEVELOPMENT about regulation sequence, procedures, evaluation, approval of the engineering-design of estimation, design, engineering, construction-total estimation and construction drawing design-estimate items, irrigation _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the MINISTER of AGRICULTURE and RURAL DEVELOPMENT, pursuant to Decree No. 86/2003/ND-CP of October 18, 2003 of the Government functions, tasks, powers and organizational structure of the Ministry of agriculture and rural development;
Pursuant to Decree No. 51/1999/ND-CP on 08/07/1999 of the Government issued regulations on investment and build, Decree No. 12/2000/ND-CP dated 10/5/2000 and Decree No. 19/2003/ND-CP on January 30, 2003 by the Government on amendments and supplements to some articles of the Statute and building investment management;
Pursuant to Decree No. 88/1999/ND-CP dated 16/9/1999 of the Government issued tender regulation, Decree No. 14/2000/ND-CP dated 10/5/2000 and Decree No. 66/2003/ND-CP dated 12/6/2003 by the Government on amendments and supplements to some articles of the tender regulation;
Proposal of the Director of Department of construction management and Director of science and technology, the decision: article 1: attached to this decision regulates the sequences, procedures, evaluation, approval of the engineering-design of estimation, design, engineering, construction-total estimation and design of drawing-the estimation category of irrigation.
Article 2: this decision has the effect after 15 days from the Post Gazette. The previous provisions contrary to this regulation are repealed.
Article 3: Office, heads of agencies, subdivisions of the Ministry is responsible for the implementation of this decision.
 
The REGULATIONS establish procedures for sequencing, appraisal, approval of the design engineering total construction techniques or design-total, construction drawing design-estimation category of irrigation (attached to decision No 7/2004/QD-BNN on 23/3/2004 of the Ministry of agriculture and RURAL DEVELOPMENT &) chapter I : GENERAL PROVISIONS article 1. The purpose of the requirements of this regulation in order to materialize investment management regulation and construction of Government issued on work setting, appraisal, approval of the design engineering total construction techniques or design-total estimation and construction drawing design-estimating projects in the irrigation project by the Ministry of agriculture and rural development and management responsibilities, powers of the owner, the construction consultancy, Agency construction management majors of the Ministry of agriculture and rural development.
 
Article 2. Object, scope 1. This regulation applies to the consultancy contract or key contracts (EPC) in irrigation projects using State budget by the Ministry of agriculture and rural development, including: a)-the design of the package indicated the bid or tender (domestic and international);
b)-key contract (EPC) for the project or subproject, or the specified package bid or tender (domestic and international);
2. for irrigation projects by the local branches or other management organizations can apply accordingly.
In this regulation, the term is understood as defined in the investment management regulation and industry standards in building and Agriculture and rural development has issued.
 
Article 3. The design process all the irrigation must establish technical design-total or construction engineering design-total estimation and construction drawing design-estimate items.
Preparatory phase made the investment, depending on the nature and technical requirements of the works, made a step design (design, engineering, construction) or two step design (design, engineering and construction drawing design) are specified in the investment decision.
For works that require high technology, built in conditions of topography, geology and the environment is complex, requires background processing or have manicure solution, the main load-bearing structural complexity, the need to design two steps: design, engineering design and construction drawings.
For simple engineering projects or had design pattern, handle the Foundation and structural complex was not a step design: design-construction techniques.
 
Article 4. The total estimate, estimate projects all irrigation irrespective of the tender or the tender must specify the allowed set of estimation, estimation and items to be appraised, approved according to the current rules of the State.
Total works are appraised, approved along with design, engineering, or technical design.
Total approval authority by not exceeding the total investment was browsing.
Total construction approval authority is limited to a maximum cost of building works, as a base to hold a tender or bid and specify cost management during project implementation.

The case of A group project was the Prime through or approved the feasibility study report, which allows subgenus out component projects or subprojects, then after the feasibility study report of the project components or subprojects were approved by the authority , the jurors, nail, approval of estimation of the project components or subprojects that are made as the work of an independent investment projects.
A special case, if the construction work of the project group A has not had total approved or not yet eligible to establish total then the slowest after implementation was 30% of total investment must have the technical design and total are approved by the authority. In this case, before bidding or specify the contractor, the owner must set the sheet stating the reason and must be approved by the authority for permission to serve as a basis for the approval of estimation.
Total works as well as the estimation category or separate building works has been approved by the authority can be adjusted and supplemented, but overall not exceeding the total investment has been approved by the authority. The adjustment, additions made as specified in circular No. 9/2000/TT-BXD dated 17/7/2000 and circular No. 7/2003/TT-BXD dated 17 July 2003 of the Ministry of construction and the management of construction cost in the investment project and circular No. 8/2003/TT-BXD dated 9/7/2003 by the Ministry of construction of Guide content and general contract management bidding design-providing supplies, equipment-construction (EPC).
Article 5. Subcontract of consultant design consultant selection made under the provisions of Decree No. 88/1999/ND-CP dated 16/9/1999 issued the tender regulations, Decree No. 14/2000/ND-CP dated 10/5/2002 and Decree No. 66/2003/ND-CP dated 12/6/2003 by the Government on the adjustment , the addition of some articles of the Statute.
1. for contract design tender: consulting organization designed to establish technical design-total design or construction techniques – General estimation and construction drawing design-estimate items, survey estimation, estimation of design process of approval authority according to the current rules of the State to make the basis of payment.
2. for contract bidding advice: a)-international consultancy tender: investors, contractors consultants must follow the prescribed order, the procedure under this regulation and the provisions of the sponsor;
b)-in the tender: investors, consultant to perform the procedures under this regulation and the current regulations in the country.
 
 
CHAPTER II: sequence, the SURVEY PROCEDURE, SET DESIGN, ENGINEERING or CONSTRUCTION-TECHNICAL DESIGN of ESTIMATION and DESIGN of DRAWING-the ESTIMATION CATEGORY of article 6. Design survey 1. Asked of survey design: The survey must ensure the following requirements: a)-survey tasks must conform to the requirements of design steps; to ensure objectivity, honestly, properly reflect reality;
b)-outline of survey, volume, content, technical requirements for the survey design should be defined accordingly with the task of surveying, construction standards, technical standards: about surveys apply industry standards 14TCN 114-2000; about the application of geological survey industry standards 14 BC 115-2000 and stated in the contractor's tender bidding or outline of building survey has been approved by the authority for specified works.
Outline of survey design organization must be approved by the authority for specified works or through contractors in the bid before making (known collectively as the outline of the survey has been approved).
c)-survey results must be evaluated, conclusions, in accordance with the regulations of the State.
2. Perform survey: survey contractors to perform properly the contract signing, content outline of survey has been approved on the progress, the scope, volume and quality of work.
a)-for works indicated the bid: follow the outline and the approved estimates. Organized case design consultants recommend tuning, additional surveys, the investor must consider, verify your authority to approve content adjustments, supplements and additional adjustment, estimation;
b) – for public works tenders in the country or international tender: survey organizations follow the outline of the survey in the contractor's tender bidding and decided to approve the results for the consultant (survey part). Adjustable case, additional surveys, the investor must consider, verify your authority to approve adjustments, additional bidding decisions.
3. report the survey results: a)-the content of the survey report include:-base and survey methods;
-Data analysis, synthesis, evaluation survey results;
-The conclusions of the survey results and recommendations.

The product test survey conducted under the provisions of article 7 of decision No. 18/2003/QĐ-BXD dated 27/6/2003 by the Ministry of construction issued a regulation on quality management of construction works (decision No. 18/2003/QĐ-CONTRUCTION of the building).
c)-reported survey results to establish 7 sets, is the legal basis to implement the design, appraisal, approval design.
 
Article 7. The independent technical design-total or design engineering construction-total 1. Established technical design requirements: a)-matching investment projects have been approved;
b)-Online works, overall layout approach the main work items in other buildings and clue are reasonable, uniform and meet the requirements of operators, use;
c)-technical design should match the level works, with construction standards, technical standards have been approved in feasibility study report or report of investment, standards of prevention of fire, explosion, protect the environment and the other relevant standards to ensure safe, save;
d)-determine the exact location, scale, texture of the investment projects. Details of the main bearing structure, specific volume calculations, exactly meet the requirements estimating items and construction bid;
DD)-Select measures and reasonable work progress to the construction, maintenance and exploitation of works in an efficient manner, limiting the cause of negative effects on the environment;
e)-on the basis of the categories, the work has been oriented in investment decisions, look to improve the Division most affordable package, and determine the exact volume of the main work, the types of supplies, materials, equipment;
g)-the rules and instructions, the relevant text of the sponsors (MOU, technical review report ...). International design standards for the construction of the project of foreign loans.
2. set the base design, engineering or construction engineering design: a)-The specifications and indicators need to be achieved by the process according to the approved projects in the report NCKT or investment reports;
b)-the documentary survey, basic investigation, social-economic investigation by professional organizations have legal personality;
c)-building standards, construction engineering standards, design patterns are the State and the industry. Cases of application of construction standards, building technical standards of foreign countries must be approved;
d)-decided to specify bid or decide to approve the results for the design consultant, consulting bid of owner, tenders of the winning bid and the engineering design outline or outline of construction engineering design has been approved by the authority;
DD)-for works in the foreign loan projects, in addition to the above provisions, the contractor must design based on:-the rules and instructions of the sponsor for foreign loan projects;
-The text of the relevant sponsor (MOU, technical review report ...).
-International design standards by international consultants have used in viable projects have been approved.
3. The independent technical design or construction engineering design: 3.1. The contractor must perform the following sequence: a)-Established the outline design engineering or design construction techniques, presentation and progress made the owner verifies to the authority for approval;
b)-Establishing technical design or construction engineering design, presentation and progress is made on the basis of the approved outline.
3.2. The contractor must complete the profile design again after the appraisal to the assigned authority for approval.
3.3. for the process of construction engineering design after it is approved by the authority, the contractor must not establish the design drawing.
4. set content or design technical design construction techniques: the composition, volume, set content or design technical design, construction techniques, construction drawing design done in accordance within the Vietnam construction standards (TCXDVN 285 – 2002), industry 119-2002 attached to decision No. 51/2002/QD-BNN-XDCB on 17/6/2002 of the Minister of agriculture and rural development (decision No. 51/2003/QD-BNN-XDCB of the Ministry of agriculture and rural development) and decision No 18/2003/QĐ-CONTRUCTION of the building.
5. Component profile process, approval of the design, engineering, or construction engineering design: profile design engineering, process owner for approval include: process Sheet, approval of the design, engineering, construction engineering or design set under model Appendix 4 in decision No. 18/2003/QĐ-CONTRUCTION of the building.
A copy of the decision to approve the investment project profile attached to the preliminary design was approved by the same project;
The main report, summary report;
The reported survey results build have enough content referred to in paragraph 3 article 6 in this regulation.
Specialized reports. The works are not specialized reports, the contents of which are presented in detail in the main report.

Profile design, engineering or construction engineering design was established under annex 1 decision No. 18/2003/QĐ-CONTRUCTION of the building.
Report design verification for the works of the project prescribed in clause 1 article 8 of decision No 18/2003/QĐ-CONTRUCTION of the building.

For A group project, if not have the engineering design or construction techniques designed to be browsed, but need to start then the consultant must set design drawing of commencement items to the owner the authority for approval. Profile, the order of evaluation, approval of construction drawing design and estimating this category is done according to the order of evaluation, approved technical design-total. At the latest after implementation was 30% of the total investment, the contractor must establish design completed and approved by the authorized technical design or construction engineering design. The construction drawing design and estimation of items made according to the provisions of article 10 of this regulation.
 
Article 8. The order established the total construction work: 1. The requirements established total works: The Establishment of estimation works must ensure the following requirements: a) total works are by design consultants contractors winning bid or tender specified setting;
b) total works to full General, exact mass of the categories, the section in the profile design, engineering or construction engineering design;
c) total works must be established on the basis of norms, estimation, basic construction unit price of the State and of public buildings;
d)-the case of estimation works created on the basis of the unit price points, then the unit cost of the work shall be the competent authority of the State approval before establishment of estimation;
DD)-for public works projects in foreign loans (ODA), in addition to the implementation of the provisions above, the total works must follow the rules in the Treaty was signed (the structure of resources, the international consultancy fees ...).
2. set the base total project: to establish bases of estimation works are: a)-total investment in the decision approving feasibility study report or report of investment;
b)-profile design, engineering or construction engineering design by the design consultant;
c)-norm, the unit cost of the basic construction of the State and the construction sector;
d)-The mode, inbound or outbound policy relevant.
3. set content total works: a) total works are created according to the unit price sum or unit price, but not exceeding the total investment approved. Total value to be identified include: construction cost, cost of equipment, other expenses and the cost of backup;
b)-consulting units must perform computer costs, construction costs, equipment costs, and costs to calculate the volume of building works mainly in accordance with circular No. 9/2000/TT-BXD dated 17/7/2000 and circular No. 7/2003/TT-BXD dated 17 July 2003 of the Ministry of construction;
c)-for total ODA projects in the works, in addition to the implementation of the provisions on the Advisory Unit, is based on the regulations on domestic capital ratio (reciprocal capital), foreign capital for each type of fee agreement has been signed and the management costs of the owner to identify the source structure as specified in circular No. 9/2000/TT-BXD dated 17/ 7/2000 of the Ministry of construction.
4. Component profile process, approval of estimation works: a)-Sheet process, approval of estimation form Appendix 4 in circular No. 7/2003/TT-BXD dated 17/6/2003 of the Ministry of construction;
b)-approval decision report NCTKT, report NCKT and total investment;
c)-profile design, engineering or construction engineering design has been approved by the Ministry or through;
d)-norm, the unit cost of the basic construction of the State and the construction sector;
DD)-The mode, inbound or outbound policy concerned;
g)-a test resumes total works between investors and consultants;
h)-A demonstration of estimation;
I)-speaking of estimation, the aggregate private each item costs include: costs, construction costs, equipment costs and other mass building works primarily or estimating projects.
 
Article 9. The number of profile design and total construction 1. For technical design: design units delivered to owner 7 the Department to submit to the approval authority:-the technical design and total (1);
-Technical design and evaluation of estimation (1);
-Investor (3 sets);
-Fire fighting agencies to appraise the fire prevention (01-if needed);
-Construction contractors (7 set).
2. With regard to technical design-construction: design units delivered to owner 09 to send to the approval authorities:-the design and construction techniques of estimation (1);
-Key design and construction techniques of estimation (1);
-Investor (4 sets);
-Fire fighting agencies to appraise the fire prevention (01-if needed);

-Construction contractors (2 sets);
The case owner has the required number of records than specified above, must be agreed upon in the contract and the owner must bear the costs of printing the number of records increased.
 
Điều10. Establishment of construction drawing design-estimate items 1. General requirements: a)-design drawing to match the technical design was browsing;
b)-must be the architectural detail, texture, systems engineering to construction contractors performing construction;
c)-To ensure qualified to estimate;
d)-must have caption about how materials, instructions on order of execution measures, labour safety;
DD)-do not adjust or reduce capacity, the scale of construction, the main bearing structure and longevity of works stated in the mission design and technical design has been approved. The case of tune or modify to alter the above specification must be approved by the authorized adjustments.
-Adjustable instances that do not alter the above specification, must be approved by the authorized through the approval of the construction bid (if the bidding process) or approval of construction drawings (if the specified works contractor).
2. set the base construction drawing design: a)-technical design has been approved;
b)-standards, building standards are applied;
c)-documentary about the natural conditions and techniques: topography, geology, hydrography, meteorology, geology, hydrogeology, earthquakes in the construction sector, the impact of the environment, the current state of quality works (repair restoration case), technical infrastructure works.
3. content design drawing: composition, volume, content design drawing, estimating as specified in industry standards 14TCN 119-2002, issued decision No. 51/2002/QD-BNN-XDCB of the Ministry of industry and RURAL DEVELOPMENT.
4. Profile drawing design: profile construction drawing design include:-Set includes: detailed drawings using the current status, the position works on a map, of the premises, the architectural details (floor, the facade, the cut side ...), details of construction (structural foundations bearing structure, system engineering, ...), the typical link detail, complexity, technology ...-table of the prognosis of construction items, categories of ancillary construction service works;
-Technical instructions, execution measures;
-Process operation, maintenance works.
5. Estimate construction projects: a)-construction estimation value after tax of projects includes construction estimation value before tax and the tax value of output;
b)-construction estimation value before tax of projects includes direct costs, general costs and taxable income calculated in advance;
c)-The estimate construction projects, should follow the provisions of circular No. 9/2000/TT-BXD dated 17/7/2000 and circular No. 7/2003/TT-BXD dated 17/6/2003 of the Ministry of construction.
 
Article 11. Profile process, approval of construction drawing design-estimate items profile drawing design-estimate items is the legal base to form the bid or contract construction (for specified works contractor) and contractors performing construction.
Before the approval authority, records the construction drawing design and estimation of items must be the owner verifies signed seal as specified in decision No. 18/2003/QĐ-CONTRUCTION of the building.
1. the records appraisal, approval include: a)-Sheet process approval of design drawing and estimation of items;
b)-construction drawing design and estimation of items have been verified owner;
c)-technical design has been approved;
d)-standards, building standards are applied;
DD)-documentary about the natural conditions and techniques: topography, geology, hydrography, meteorology, geology, hydrogeology, earthquakes in the construction sector, the impact of the environment, the current state of quality works (repair restoration case), technical infrastructure works ... e)-norm estimation, basic construction unit price of current state and construction area;
g)-The mode, inbound or outbound policy concerned;
h)-a test resumes drawing-estimation categories between the investor and consultant.

CHAPTER III: ENGINEERING DESIGN APPRAISAL-estimation, DESIGN, ENGINEERING, CONSTRUCTION-TOTAL, CONSTRUCTION DRAWING DESIGN-ESTIMATE ITEMS.
 
Article 12. Pursuant to the relevant legal texts: a)-Decree of the Government;
b)-The text of the State bodies of management quality, cost of works;
c)-the standard technical, economic policy, the relevant mode;
d)-decided to approve the project.

Profile design and total works.
The text accepted the design of State administration authority on: traffic, aquatic safety prevention of fire, explosion, environmental safety, mineral resources, dykes and the related requirements (if any).

With regard to the works projects in foreign loans (ODA): in addition to the above, when the appraisal is based on the regulation of sponsors; related documents (memoranda, technical review report ...); the international design standard by international consultants have used in viable projects have been approved and the provisions in the agreement has been signed (the structure of resources, the international consultancy fees ...).
 
Article 13. Content evaluation assessment content or design technical design, construction techniques and the total irrigation done under Decree No. 51/1999/ND-CP on 08/7/1999, Decree No. 12/2000/ND-CP dated 10/5/2000, Decree No. 19/2003/ND-CP on January 30, 2003 by the Government; decision No. 18/2003/QĐ-CONTRUCTION of the building and decision No 91/2001/QD-BNN-XDCB of the Ministry of agriculture and rural development. The content mainly consists of: 1. the legal status of the unit, the individual design;
2. The suitability of the technical design with the approved content in investment decisions: the scale, technology, capacity, technical-economic norms, the norms, unit price and the current relevant policy of the State; planning, architecture, construction standards, technical standards are applied, technical solutions, structures and operational processes, namely: a)-conformance and correctness of design projects with investment projects, mostly content to consider include : + The design criteria;
+ Online dams, spillways, drains and other clues works, aqueducts.
+ The solution structures, density Earth packed, background processing, soil erosion prevention objectives ... of the works;
+ About capacity, the water column, the flow of the pumps, hydraulic turbines;
+ The overall layout of science, convenient for operation and management of fine arts works;
+ The norms, unit price, quantity and cost of the work, the efficiency of the project;
+ Land construction (construction and land protection corridors);
+ Management solutions and environmental and ecological protection;
+ Data solutions, plans on compensation, resettlement and migration;
+ Fire prevention projects, safety and social issues ... b)-technical-economic indicators compared to approved projects.
c)-fit of total with qualified engineering design not to exceed total investment approved.
d)-the conditions and the technical solutions guarantee the stability of neighboring buildings.
e)-environmental protection projects and ensure safety during construction.
3. for works in large group projects A, B can organize technical design each part of the work of the project construction phase matching (architecture, the Foundation, the main bearing structure, systems engineering works), but must match the total using the whole project.
4. for works in ODA projects, in addition to the content on the technical design, and the total estimate is consistent with the technical requirements, the structure of the capital and other provisions of the Treaty signing.
5. Report the results of the evaluation process of the approval authority must specify the errors of design and conclusions about the use of design-total.
 
Article 14. Assessment bodies 1. Key: a)-function body was the Minister of agriculture and RURAL DEVELOPMENT Affairs & chaired technical design-total or construction engineering design-total, construction drawing design-estimate items are responsible for organizing evaluation and opinions of the Agency units in and out of the industry concerned;
b) – for the irrigation project in Group A or group B are complex engineering, Minister of agriculture and RURAL DEVELOPMENT & established authority composed of representatives of the Department, Service functions, the relevant professional bodies and qualified specialists, professional experience (in geology hydrological, hydro, power structures, ...), the Agency chaired the evaluation is a permanent organ of the authority. Duties and powers of the authority specified in the decision of establishment;
c)-for irrigation projects in the works are technically complicated by Province, central cities have suggested text management agency of the Ministry of agriculture and RURAL DEVELOPMENT, the evaluation & owner of local works to process records appraisal and implementation sequence the prescribed procedure.
2. The powers of the agency evaluation: key investor requirements and design consultants: a)-ask the owner records appraisal is complete, valid and timely as specified in articles 6, 7, 8 and 10 in this regulation;
b)-request the consulting report or presentation of issues in the content of the evaluation referred to in articles 6, 7, 8 and 9 in this regulation;
c)-request the advisory organization to correct errors (if any). The case of the problem of inconsistency in the evaluation process, the evaluation agencies must report the Ministry of agriculture and rural development.
3. Responsible for appraisal: a)-appraisal or valuation Council is responsible for checking the valid profile due to the owner, if not yet valid must request in writing to the owner added in a defined period appraisal;

b)-chaired evaluation and relevant agencies involved appraisal is responsible to the approval authority and before the law about the results of their evaluation;
c)-related agency is responsible to the Ministry and the law on the evaluation unit's comments;
d)-assessment experts must take responsibility before the agency evaluation and before the law about his assessment comments;
DD)-chaired evaluation is responsible for synthesizing the opinions of the relevant unit, at the same time to have the conclusions and recommendations in the report of its assessment and must take responsibility for that. The appraisal report must comply with Appendix 5 decision No. 18/2003/QĐ-CONTRUCTION of the building and annex 3 of the decision No. 91/2001/QD-BNN-S & T on 11/9/2001 of the Ministry of agriculture and rural development on the management quality of irrigation works (decision No 91/2001/QD-BNN-the SCIENCE and TECHNOLOGY of the Ministry of agriculture and rural development);
e)-before the competent person approved technical design-total or construction engineering design-total works, the Agency chaired the appraisal must report organization who has the authority to approve the results of his evaluation. Join the report, have design consultants, local representatives and the relevant competent authorities;
g)-in the profile process of approval by the authorized technical design-total or construction engineering design-total works, the Agency chaired the evaluation and appraisal report must be accompanied by the full text of the evaluation of the agencies involved, the expert evaluation and the evaluation profile. The text must be stored in the same profile of investment projects;
h)-for technical design-total or construction engineering design-total works under the ODA loan project: after the profile has been appraising the Ministry, central management, irrigation project (CPO) is responsible for working with the sponsors to have a written agreement and send the agreement to the Agency chairing the evaluation to the person who has approval authority;
I)-chaired Evaluation Agency is responsible for the draft decision approving the technical design-total or construction engineering design-total submission to approval authority along with the records appraisal and must comply with Appendix No. 4 in decision No 91/2001/QD-BNN-the SCIENCE and TECHNOLOGY of the Ministry of agriculture and rural development.
Điều15. Time evaluation and appraisal costs: 1. Design evaluation time, total made as prescribed in paragraph 4 to article 37 of regulation on investment management and building attached to Decree No. 51/1999/ND-CP on 08/7/1999 of the Government, specifically the following: a)-project group A : no more than 45 days from the receipt of a valid application.
b)-project group B: not more than 30 days from the receipt of a valid application.
c)-project group c: no more than 20 days from the receipt of a valid application.
