The DECISION of the PRIME MINISTER issued the provisional regulations on the conditions, criteria, the order and procedure of Ho Chi Minh Prize and State Prize for science and technology in 2005 FROM the PRIME MINISTER pursuant to the law on Science and technology on June 9, 2000;
Pursuant to the law the emulation, commended on November 26, 2003;
According to the recommendation of the Minister of science and technology, the DECISION: article 1. Attached to this temporary regulations decision of eligibility, criteria, the order and procedure of Ho Chi Minh Prize and State Prize for science and technology in 2005.
Article 2. This decision takes effect 15 days from the date The report.
Article 3. The Ministers, heads of ministerial agencies, heads of government agencies, the members of the Board of awards and State prizes in science and technology in 2005, the Organization and the individuals concerned are responsible for the implementation of this decision.
TEMPORARY RULES Regarding eligibility, criteria, the order and procedure of Ho Chi Minh Prize and State Prize for science and technology 2005 (attached to decision No 33/2005/QD-TTg dated February 15, 2005 by the Prime Minister) chapter I GENERAL PROVISIONS article 1.
1. This rules guide consider Ho Chi Minh Prize and State Prize for science and technology in 2005 for the works, the works of science and technology has been published and used from November 9, 1945 to the present.
2. Ho Chi Minh Award for science and technology in 2005 was considering donating to these works, scientific works and outstanding technology, has a very high value on Science and technology; have large and lasting effects in people's lives, contributing to serve economic development-social, defense and scientific career development and technology of the country.
3. The State Prize for science and technology in 2005 was considering donating to these works, scientific works and outstanding technology, high value on Science and technology; effective socio-economic expediency, with major impacts on the career service of socio-economic development, defense and development of science and technology in the country.
Article 2. This regulation applies to the works, the works mentioned in article 1 above by Vietnam, published and used in Vietnam.
Article 3. Authors of works, the works of Ho Chi Minh prize or prize of science and technology received the diploma of the President of the Socialist Republic of Vietnam and bonuses prescribed by the Government.
Article 4. Ho Chi Minh Prize and State Prize for science and technology in 2005 are announced on the occasion of the national day 2-9, 2005.
Article 5. In this regulation, the terms below are interpreted as follows: 1. the scientific and technological work is reward is the product of the process of creative workers in scientific research, technology development, application of the achievements of science and technology, including research on Science and technology research.
2. scientific research reward is the research, explore the natural law and society, the scientific discoveries, scientific theories lead to important changes in awareness, influence in science, economy and society of the country.
3. technological research be reward, including: a) works in research and development and technological innovation creates new technical solutions, new materials, new varieties, new products, leading to the important for the background technology, boosting national competitiveness, serves the career development of social-economic , defence and scientific and technological development of the country.
b) works have innovative technology applications especially successful application works and creation of technical achievements in the economic-technical works critical of the country such as construction-architecture, the work of Defense-Security and other works, which impacts the decision to the effect of the economic-technical works.
4. reward structures Cluster, including: a) a collection of works by the same author or co-author was identified in a scientific field or a field that applies.
b) collection of works by many authors made independently, to create the same results but uses the method, principle, different techniques.
5. The process of science and technology and the science and technology work is referred to as the public works.
6. The author is the person who works with his direct labour creation works.
Co-authored works is many people by his direct labour creation works.
People just help, technical support, material and funding for the author, the author without taking the creation of works shall not be considered to be the author, coauthor of works.
Article 6. Works recommended considering Ho Chi Minh Prize and State Prize for science and technology in 2005 must meet the following conditions: 1. A work suggested only consider Ho Chi Minh prize or prize.
2. review proposal works Ho Chi Minh prize or prizes to be announced or the application in practice of at least 3 years as of the time of submission of the proposal review.
3. There is no dispute about copyright, no complaints about the content and results of the work at the time of reward.
4. report the results of research works has been filed at the Center for information science and Technology Department of the Ministry of science and technology for the works is the result of the science and technology used in State funding, are testing after 1980 (according to Regulation No. 271/QD on 20 June 1980 of the scientific and Technical Committee State registration of the subject and submit a report research results) or in the Ministry of defence and the Ministry of public security for the subject by the Ministry of defence and the Ministry of public security management.
Article 7.
1. The review of Ho Chi Minh Prize and State Prize for science and technology was conducted independently and according to three levels:-Level basis;
-The Ministry, province, city and equivalent (referred to as the Ministry);
-National level.
2. The reward at the national level is conducted in two steps:-step 1: reward at the specialized Council Award by the Minister of science and technology founded on the basis of recommendations of the Board of awards and State prizes in science and technology, 2005-here referred to as the Council of national awards.
-Step 2: reward in Board national awards.
Article 8.
1. The Board of awards granted include representing the basis of applied results of works, scientists, technologists, managers have the credibility, objectivity, has the appropriate expertise and deep understanding of scientific field work.
2. Each Board member responsible for research awards, reviews and reviews of records suggest reward works in writing. Grassroots Awards Council and the Ministry assigned 2 deep knowledge expert scientific field of works do review write review, reviews of works.
3. The Council Award operated according to the following principles:

a) session reviews reward (yes vote) of the Council of the award must be at least 3/4 of the Board members attending, including the Chairman or Deputy Chairman and at least 12 fellow critics. The case of the absence of the review, the Commissioner must have reviews, reviews written.

c) are published and quoted on the prestigious scientific journals in the world.
2. About practical value a) Have extensive influence and lasting effects in people's lives, contributing to the cause of social-economic development, science and technology of the country and in one of the following objects:-new findings on the nature, laws of nature or the social impact is especially important to cognitive and social life;
-The proposed value on the theory elucidated the path of development of Vietnam; the scientific arguments have particularly important contribution for planning the way, sustainable development policy and economic integration; provide the basis and the profound practices for the process of industrialization-modernization of the country;
-The results of basic research oriented to the application have an impact the decision with regard to the selection, acquisition, and development of advanced technologies imported from abroad to Vietnam;
-Scientific achievements are particularly important in the operations of community health care, environmental protection, exploitation and use of natural resources, monitoring and forecasting natural disasters, catastrophes.
b) Have particularly important contribution for the development of the field or fields in the country, the region and the world.
Article 11.
1. The process of research, development and technological innovation are consider Ho Chi Minh award must meet the following criteria: a) on the value of innovative technology and innovation is particularly important for technology:-resolve the key issue to improve technology, develop or create new products;
-Contribute to the particularly important promote the shift of production, facilitates the establishment and development of new industries, enhance the competitiveness of the product, of the economic sector;
-Economic indicators-basic engineering of the product, the technology reached the international level or higher product norms, processes, other similar systems in water (stated to be address specific comparison).
b) On economic efficiency, social-economic and science-technology.
-Creation of economic or social-economic efficiency is very large; great contribution to socio-economic development and national defense and security;
-Have made important contributions in science-technology development of the field.

Article 13. Scientific research is gaining State Award must meet the following criteria: 1. The value of Science: a) achieved outstanding scientific achievements, leading to important changes in perception, production and social life.
b) Have a higher value in science.
c) are published and quoted on the prestigious scientific journals in the world.
2. About practical value a) works and extensive influence in society and in one of the following objects:-new findings on the nature, laws of nature or society have important implications to cognitive and social life;
-The proposed value on the theory elucidated the path of development of Vietnam; the scientific argument has made important contributions to the planning policy, sustainable development policy and economic integration; provide the basis and the relatively profound practices for the process of industrialization-modernization of the country;
-The results of basic research oriented applications have important implications for the selection, adaptation, and development of advanced technologies imported from abroad to Vietnam;
-Important scientific achievements in the activities of community health care, environmental protection, exploitation and use of natural resources, monitoring and forecasting natural disasters, catastrophes.
b) Have made important contributions to the development of the field or fields in the country and the region.
Article 14.
1. The process of research, development and technological innovation are gaining State Award must meet the following criteria: a) on the value of innovative technology and significant innovations in technology:-fix the relative key issues to improve technology, develop or create new products;
-Significant contributions promoting the shift of production, facilitates the establishment and development of new industries, enhance the competitiveness of the product, of the economic sector;
-Economic indicators-basic engineering of the product, the technology is higher than the target of the product, process, other similar systems in water (stated to be address specific comparison).
b) On economic efficiency, social-economic and science-technology-creating economic or social-economic efficiency; major contribution to socio-economic development and national defense and security.
-Contributed in the development of science-technology of the field.

b) Have contributed in the development of science-technology of the field.
Chapter III PROCEDURE and SEQUENCE of BONUS article 16.
1. reward proposal profile level include: a) review form the Ho Chi Minh prize or award of the State of the author or the co-author.
b) summary report works (according to the expression E1-1-KH, E1-1-CN, E1-1-UD respectively for scientific research, technological research, innovative application that works in particular).
c) A brief work with the list author (E1-2).
d) a copy of the text, the material science and technology related to the works:-dissertations, monographs, articles (cover page and table of contents).
-Degree of protection (if any).
-Review of the Organization, individuals using the results.
-Certificate of inspection or measurement technology, testing the products of science and technology of the work.
-Other related documents (if any).
DD) report on the evaluation of results of research topics in science and technology or experimental production project of the Council of State or the assessment of the Board due to the corresponding topic management level established.
e) Paper certifying the report research results as specified in paragraph 4 of article 6 of this regulation.
2. reward grassroots organization: a) the works have to be registrations and reward at the base unit has a legal personality, which created works, where management author works or where the author is working.
The works do not use funding from the State budget have to be registrations and reward in science specialization or science and engineering majors.
For the social science works not to use of funds from the State budget, but it's not science majors like sociology, religion, philosophy, must be registered and reward in the respective professional Institutes affiliated to the Vietnam Academy of social sciences.
b) base unit heads are responsible for establishing the Council award level.
Grassroots Awards Council has from 7 to 9 members. Chairman of the grassroots awards must be reputable scientists, understanding the field of scientific works. In case of lack of knowledgeable professionals works, heads to the base unit can invite more outside experts join grassroots Awards Council.
c) grassroots Award Council is responsible for reviewing, evaluating each project: written comment votes (E1-3-KH, E1-3-CN, E1-3-UD), confirmed a list of co-authors (if any), voting reviews (E1-4, E1-5), tally (E1-6, E1-7) set the minutes reviews (E1-8) and send the proposal to grant reward the following respective addresses :-The managing departments, provincial people's Committee, the corresponding cities;
-The Union of scientific and engineering society of Vietnam (for registered reward work through science and engineering majors);
-Institute of social sciences Vietnam (for registered reward work through specialized institutions).
Article 17.
1. the suggested profile reward levels include: a) The text of the proposal consider Ho Chi Minh Prize and State Prize of base unit heads.
b) recommended records reward level.
c) the minutes of the Board's Awards reward level.
2. reward institutions the Ministry: a) Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of the provincial people's Committee, the central cities, Chairman of the Vietnam Association for science and technology, Chairman of the Vietnam Academy of social sciences is responsible for establishing the Council level award.
The Service management of science and technology, the Department of science and technology, scientific management and technology users in the above mentioned agencies have a responsibility to help heads held Ministerial-level awards Council to evaluate selected works.
b) Council award the Ministry there from 9 to 11 members. The Council is responsible for reviewing, assessing, selecting the standard work reward: write comment votes (E2-1-KH, E2-1-CN, E2-1-UD), voting reviews (E2-E2, 2-3), tally (E2, E2-5-4), record-setting reviews (E2-6) and send the proposal to reward national award Council.
Article 18.
1. the suggested profile reward national level include: a) The text of proposed reward of the heads of the agencies referred to in point a of article 17 item 2 of the temporary regulations (according to the schedule of E3-1-CV) and the attached appendices 1, 2 and 3:1 the original b) summary report works (according to the expression E1-1-KH , E1-1-CN or E1-1-UD): 15 copies (1 original, 8 copies) c) A brief work with the list author (E1-2): 1 original d) a copy of the text, documents relating to the work: each 15 a-dissertations, monographs, articles (cover page and table of contents).
-Degree of protection (if any).
-Review of the Organization, individuals using the results.
-Certificate of inspection technology or product testing, measurement science and technology works.
-Other related documents (if any).
DD) report on the evaluation of results of research topics in science and technology or experimental production project of the Council of State or Review Board reviews due to the corresponding topic management level established: 15 e) the minutes of the Board's Awards reward level and level Sets : each 15 copies (1 original and 14 copies) g) Paper certifying the report research results as specified in clause 4 Article 6 of the temporary regulations: 1 copy as requested, the author or the co-author to create most favorable conditions for the members of the Council are working directly with the original of the text documents related to the work specified in point d of paragraph 1 of this article.
2. The Council of the national awards only consider the proposed reward profile is valid. Valid profile is the profile filed timely, full text documents, as specified in paragraph 1 of this article, there is no dispute about copyright, no complaints about the content and results of the work at the time of reward.
The last time limit receipt of proposed reward national level is 1200 hrs on 10th May 2005. Receipt is calculated according to the postmark of the Hanoi Post Office (cases submitted via the post office) or "text to the" Office of the Ministry of science and technology at the Ministry headquarters, 39 Tran Hung DAO, hoan Kiem district, Hanoi (the case sent directly).
A permanent body to help the National Council Award by the Minister of science and technology establishment is responsible for checking the validity of suggested reward profile.
3. The National Council Award announcement summary content about the work accompanied by the list of authors in the journal Science and development network, the http://www.vista.gov.vn and http://www.most.gov.vn Network of the Ministry of science and technology and a number of other mass information media in the evaluation process, the reward of the specialized Council Award and national award Council.
4. reward institutions the national level:

a) National Award Council recommendations to the Minister of science and technology established the specialized Awards Council to assess the work.
b) specialized Award Council has from 11 to 13 members, including the members of the Board of the national awards have the expertise along with the specialized Council areas; scientists, technologists, managers, have the appropriate expertise and deep understanding of the scientific field of works and represents the base has applied the results of research works. The Council elected 12 members of the Scientific Secretary of the Council.
c) specialized Award Council assigned 3 expert written reviews, reviews of works (E3-2-KH, E3, E3-CN-2-2-UD). In case of need, as proposed by the Council of professional awards, the Minister of science and technology offers more knowledgeable professionals works, are not members of the Council participate in reviews, reviews of works.
d) specialized Award Council standard base of each category of awards to consider, evaluate each work and vote reviews (E3-3 for the proposed works consider Ho Chi Minh Prize and E3-4 for recommended works, consider the State Award), and set up a tally (E3-5 , E3-6), a reward (E3-7), a general reward results (E3-8) with a list of suggested works awarded prizes (in two award categories respectively) to the National Council Award consideration.
DD) based on the results of reviews of the Council of professional awards and compare with the standard of every kind of award, the national award Council will review each works, voting reviews (E4-1, E4-2), tally the reviews (E4, E4-4), established a reward according to fields of Science (E4-5) , a general reward results (E4-6) with a list of suggested works Ho Chi Minh Prize and State Prize 2005 submission to the Prime Minister.
Article 19. The Organization, individuals have the right to complain about the reward results and violating regulations, the order procedure.
The complaint must record the name, address and send the heads of agency level awards Council respectively.
Agency heads established the awards Council accepting responsibility to consider and respond to the complaint and does not consider there is no single obvious name, address or impersonate.
Chapter IV the TERMS OF IMPLEMENTATION of article 20.
1. The review of awards and State prizes in science and technology in 2005 in base level must be completed before October 4, 2005.
2. The review of awards and State prizes in science and technology in 2005 in order to be conducted from November 4, 2005 to May 15, the day before 2005.
3. The national reward at the specialized Council Award and national award Council was conducted from May 2005 to November 16, before November 7, 2005.
4. Ho Chi Minh Award Council and State Awards reward results announcement on some mass media in December 07 until 22 July, 2005 and the Prime reward results last week at the latest, 2005./.
