The DECISION of the MINISTER of posts and TELECOMMUNICATIONS On the promulgation of the Charter the Organization and activities of public telecoms services Fund Vietnam MINISTER of POST and TELECOMMUNICATIONS, pursuant to Decree No. 90/2002/ND-CP dated 11 November 2002 from the Government functions, tasks , powers and organizational structure of the Ministry of posts and telecommunications;
Pursuant to decision No. 190/2004/QD-TTg dated 8 November 2004 of the Prime Minister on the establishment, organization and operation of public telecoms services Fund to Vietnam;
At the suggestion of the Director of the Organization Department and the Board of Trustees public telecommunications services in Vietnam, DECIDES: 1. Attached to this decision, "the Charter organization and operation of public telecoms services Fund to Vietnam".
Article 2. This decision takes effect 15 days from the date The report.

CHARTER of ORGANIZATION and OPERATION of the PUBLIC TELECOMMUNICATIONS SERVICES in VIETNAM (attached to decision No 7/2005/QĐ-BBCVT, on April 25, 2005 the Minister of post and telecommunications) chapter I GENERAL PROVISIONS article 1. Public telecom service fund Vietnam's State financial institutions subordinated to the Ministry of post and telecommunications, the establishment, organisation and operation according to the decision No 191/2004/QD-TTg dated 8 November 2004 of the Prime Minister to support the State's policy of providing public telecommunications services nationwide.

Article 2. Legal status.

Article 3. Active principles.

CHAPTER II OPERATIONAL and CAPITAL article 4: sources of capital.
The capital fund is formed from the following sources: 1. the capital of the Fund is 500 (five hundred), was conceived and composed from the following sources: 1.1. State budget level 200 (two hundred billion) in two years from when the Fund came into operation.

2.3. The aid, funding, voluntary contributions of organizations and individuals in and outside the country to support development and provide public telecommunications services in Vietnam.

Article 5. The Foundation's activities.
1. The scope and the object was to provide public telecommunications services by funding specified in article 5 of decision 191/2004/QD-TTg dated 08/11/2004 of the Prime and the regulation of the Ministry of post and telecommunications.

CHAPTER III tasks, RIGHTS and OBLIGATIONS article 6. Mission.
1. Reception, mobilization of the financial resources of the Fund as defined in article 4 of this regulation.

12. management of the Organization, officers, servants, officers and employees, records, documents, the assets of the Fund in accordance with the law and the hierarchy of the Minister of post and telecommunications.
13. Perform other duties by the Minister of telecommunications.
Article 7. Powers.

2.2. Require enterprises to provide data, documents, explanations of the problems related to service in the financial contribution to the Fund.
2.3. the findings and recommendations of State regulators have authority to treat the breach of the telecommunications business in the observance of the financial contributions to the Fund, in operation to provide services public telecommunications services.

4. Be direct relations with organizations, individuals in and outside the country to call for and receive funding for programs, projects and provide public telecommunications services.

Article 8. The obligation.

CHAPTER IV MANAGEMENT and OPERATING ORGANIZATIONS article 9. Management and administration.

Article 10. The Board of management.

3. working mode of the Management Council.

3.8. The part-time members are entitled to allowances and other benefits under the regulations as a member of the Board of Chief of State enterprises.
4. Chairman of the Board of management.
4.1. Responsible to the Management Board and the Minister of telecommunications on the implementation of the duties and powers prescribed for the Management Board.
4.2. On behalf of the Management Council to sign the resolutions, decisions and other documents are the responsibility of the Board of management.
4.3. Organizing track and monitor the implementation of the resolutions and decisions of the Board of management, has the right to suspend the decision of the executive body as opposed to the resolution, the decision of the Board of management.
4.4. Other rights under the authorization of the Management Board, the Minister of post and telecommunications.

Article 11. Control Board.

2. Control Board responsible to the Board of management, control the entire operation of the Fund and have the tasks and powers of the following: 2.1. Article 12. The Executive Agency.

3. The Director of the Fund has the duty and authority to: 3.1. The organisation, administration and management of the activities of the Fund in accordance with the regulations of the Ministry of post and telecommunications and the regulation of State administration concerned; According to the Fund rules and the regulations of the Board of management;
3.2. State-owned capital Received by the Minister of finance and Minister of post and telecommunication Affairs under the provisions of the law.

3.9. Recruitment, hiring, layout to use, training, promotions, salary raise for officers, employees in the system of the Fund according to the hierarchy of the Minister of post and telecommunications.
