DECREE amending and supplementing a number of articles of Decree No. 63/1998/ND-CP dated 17/8/1998 of the Government on the management of Foreign Exchange _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the GOVERNMENT pursuant to the law on Government Organization, 30 September 1992;
Pursuant to the law the State Bank of Vietnam no. 01/1997/QH10 on 12 December 1997;
Pursuant to the law of credit institutions number 02/1997/QH10 on 12 December 1997;
According to the proposal of the Governor of the State Bank of Vietnam, the DECREE: article 1. Modifying, supplementing a number of articles of Decree No. 63/1998/ND-CP of August 17, 1998 by the Government as follows: 1. Article 12 is amended as follows: "article 12. Sale of foreign currency obligations of the resident is organizing residents hosted Vietnam's economy, businesses invested abroad and foreign parties involved in business cooperation contracts, foreign affiliates, foreign contractors, with foreign contractors, State agencies units of the armed forces, political organization, social-political organizations, social organizations, civil society organizations-career, social funds, charitable foundation of Vietnam to sell of foreign currency obtained from the current source of revenue for banks are allowed under the rules of the Prime Minister ".
2. Article 13 is amended and supplemented as follows: "article 13. The right to buy foreign currencies of the Organization 1. Residents hosted Vietnam's economy, businesses invested abroad and foreign parties involved in business cooperation contracts, foreign affiliates, foreign contractors, contractors with foreign credit institutions in Vietnam, State agencies, units of the armed forces , political organization, social-political organizations, social organizations, civil society organizations-career, Social Fund, Fund of Vietnam are buying foreign currency at banks to be allowed to respond for the current transaction or the transactions to be allowed on the basis of the presented papers and vouchers valid.
2. Resident's businesses have foreign capital and foreign parties involved in business cooperation contracts have especially important projects invested by the Government's program in each period, or construction projects of infrastructure, other important projects in Vietnam the Government ensure the balance of foreign currency or foreign exchange balance support guarantee worse then make the purchase of foreign currencies according to the regulations on Foreign Exchange Management in the field of foreign direct investment in Vietnam ".
3. Non-resident are diplomatic representations, consular agencies, representative offices of international organizations, representative offices of international organizations, government agencies, non-governmental organizations, the armed forces and political institutions, social-political organizations, social organizations , social-professional organization of foreign representative offices of foreign economic organizations and of foreign credit organizations operating in Vietnam have revenues in Vietnam from the grant of the visa, the consular fees, and other legal transactions are purchases of foreign currency and foreign currency transferred abroad through banks was allowed on the basis of export the relevant papers.
3. Article 24 is amended as follows: "article 24. Domestic lending in foreign currency credit institutions operate Forex made the lending foreign currencies to residents as stipulated by the State Bank of Vietnam Governor ".
Article 2. This Decree takes effect after 15 days from the date of signing and the replacement of article 12, article 13 and article 24 of Decree No. 63/1998/ND-CP of August 17, 1998 by the Government of Vietnam's State Bank Governor has the responsibility to guide implementation of the content is modified and supplemented in this Decree.
Article 3. The Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of people's Committee of the central cities, is responsible for the implementation of this Decree.
