Decree on sanctioning administrative violations in the field of veterinary medicine the GOVERNMENT pursuant to the law on organization of the Government of 25 December 2001;

According to the recommendation of the Minister of agriculture and rural development, the DECREE: chapter I GENERAL PROVISIONS article 1. Scope 1. This Decree provisions on sanctioning administrative violations in the field of veterinary medicine. 2. Administrative violations in the field of veterinary medicine is the behavior of the individual, the Organization violates the provisions of State management in the field of veterinary medicine in a manner intentionally or unintentionally not that crime and under the provisions of this Decree are sanctioned administrative offense. Administrative violations in the field of veterinary medicine including: a) violating the regulations on prevention, cure diseases, fight disease for animals;
b) infringe regulations on quarantine of animals, animal products; slaughter control; veterinary hygiene inspection;
c) violated the regulations on the management of veterinary medicines, probiotics, microorganisms, chemicals used in veterinary medicine;
d) violate other regulations in the field of animal health. 3. The administrative violations related to the field of veterinary medicine that is not directly specified in this Decree shall apply according to the provisions of the Government on sanctioning administrative violations in the field of management of the State concerned.
Article 2. Application object 1. Individuals, Vietnam had organized administrative violations in the field of animal health shall be sanctioned under the provisions of this Decree.
2. Individuals, foreign institutions have administrative violations in the field of animal health within the territory of Vietnam then sanctioned under the provisions of this Decree.
The case of the international treaties to which the Socialist Republic of Vietnam is a member have other regulations shall apply under the provisions of international treaties.
Article 3. The principle of sanctioning the principle of sanctioning administrative violations in the field of animal health is made according to the provisions of article 3 of the Ordinance on handling administrative violations.
Article 4. The extenuating circumstances, aggravating The extenuating, apply in aggravating the sanctioning administrative violations with regard to the violations of the provisions of chapter II of this Decree shall be made according to the provisions of article 8 and article 9 of Ordinance on handling administrative violations.
Article 5. Time limits sanctions 1. Time sanctioning administrative violations in the field of veterinary medicine is one year from the date of the administrative offense was made.
2. for administrative violations in the field of animal health related to the export, import and export of animals, animal products, veterinary drugs, the time sanctions are two years from the date of the administrative offense was made.
Article 6. The time limit is considered to be not yet sanctioned personal administrative violations, the organization sanctioned administrative violations in the field of veterinary medicine after one year from the date of decision done executive sanction or from most time limits enforced sanctions decision without re-offending, then regarded as not yet sanctioned administrative violations in the field of veterinary medicine. Article 7. The sanctions administrative violations and remedial measures 1. For each administrative violations in the field of animal health, personal, held in violation must bear one of the following sanctions: a) caution;
b) fine.
Specified the maximum fine for a violation in the veterinary field is 30 million.
2. Depending on the nature and extent of the violation, individual, organization, administrative violations are also being applied one or the additional sanctions: a) deprived of the right to use have limited time or no time limit for the type of license, certificate of practice veterinary medicine;
b) confiscated exhibits, the means used to administrative violations.
3. In addition to the sanctions set forth in paragraph 1 and 2 of this Article, personal, organizational administrative violations can also be applied to one or more remedial measures: a) Forced to restore original state has been changed due to administrative violations cause;
b) enforce the remedy of environmental pollution, the spread of disease due to administrative violations cause;
c) Forced destruction for: animal disease, animal products carry germs, chemicals harmful to human health, for animals belonging to the category of objects of animal quarantine, animal products of Vietnam or wear weird microbes cause harm.
Veterinary medicines, probiotics, microorganisms, chemicals used in animal health (hereinafter referred to as veterinary medicine) list banned in Vietnam; veterinary medicine, of unknown origin, expired, poor quality affecting animal health, no veterinary drug is allowed to circulate in Vietnam;
d) Forcibly taken out of the territory of Vietnam imported goods, re-export, import export temp re enter, move the gate, transiting the territory of Vietnam, including: animals, animal products, means of transport of infected objects in the quarantine directory of quarantine object of animals, animal products of Vietnam or strange harmful microorganisms that the returns are not transit a third countries.

g) forcing the implementation of preventive measures for animals belonging to the category of diseases is prevention is required;
h) enforce the regulations on veterinary hygiene conditions for breeding, slaughter, processing, preservation of animals, animal products; production base of business, veterinary medicine;
I) enforce sanitation measures, reduction of disinfectant livestock, environment, transport, packaging, packaging containers of animals, animal products;
k) unidentified animals handling Required, fillers, animal waste;
l) forced the fix for the transport of animals, animal products do not warrant veterinary sanitation;
m) forced the executive regulations, unscheduled check for animals to detect the disease;
n) Force published quality standards in veterinary medicine;
o) Forced quality veterinary fit standard;
p) forced the test again to make veterinary medicines;
q) forced the suspension of the floated veterinary, veterinary materials;
r) The other remedies set forth in this Decree.
Remedial measures only applied when violations of administrative rules applicable to this measure and apply accompanied by sanctions, in order to handle thoroughly violated, eliminate the causes, conditions it, fix any consequences caused by administrative infringement.
The application of remedial measures, individuals, organizations must implement administrative violations or bear all costs for the implementation of these measures.
Chapter II ADMINISTRATIVE VIOLATIONS, FINES and FORM Item 1 VIOLATIONS of REGULATIONS on PREVENTION, healing, ANIMAL DISEASE PREVENTION article 8. Violating the regulations on prevention, cure for animals 1. Caution or a fine from 50,000 to 200,000 Dong Dong for one of the following violations:

a) does not make the vaccination or other preventive measures required to prevent for animals belonging to the category of diseases must apply the preventive measures required by the Ministry of agriculture and rural development;
b) fail the serum samples to detect animal diseases in the region of the old outbreak, the disease according to the safety regulations.

d) use veterinary drugs for prevention, cure for animals do not follow the instructions of the manufacturer of the medicine or veterinary practice. 3. A fine from 500,000 to 800,000 VND VND for one of the following violations: a) the use of animal infectious disease dangerous to done the same;
b) use veterinary drugs not on the formulary, the list of veterinary probiotics, microorganisms, chemicals used in veterinary medicine are allowed to circulate in Vietnam to the room, healing for animals; use of raw materials to make drugs, cure for animals do not comply.
4. A fine of twice the level of the fines prescribed in clause 1, 2, and 3 of this article if the violation is of the individual animal breeding organizations, focus.
5. A fine from 1.000.000 VND to 1,500,000 đồng for one of the following violations: a) non-observance of the regulations about checking, sudden disease; veterinary hygiene conditions for breeding animals;
b) Throw accurately animals trapped the dangerous infectious diseases into the environment.
6. remedial measures: a) the Forced implementation of the preventive measures required for animals for violation of the provisions in paragraph 1 point a, point b paragraph 2 of this Article;
b) forced the handle veterinary hygiene, feed animals for violation of the provisions in point c of paragraph 2, point a of paragraph 3 of this article;

Article 9. Breach of rules on animal disease prevention 1. A fine from 200,000 to 500,000 Dong Dong for one of the following violations: a) does not make the quarantined animals infected, affected facilities room in the time available;

b) infected animal transport to the place of slaughter is not required in accordance with the provisions of the State Management Agency specialized on animal health;
c) slaughter of animals, circulation, buying and selling animals, animal products easy-opportunistic diseases were published in translation.
3. A fine of twice the level of the fines prescribed in clause 1, 2 of this Thing if the violation is of the individual animal breeding organizations, focus.
4. A fine from 1.000.000 VND to 1,500,000 đồng for one of the following violations: a) Take the animal, animal products easy-opportunistic diseases announced from the room menace out of the buffer or the other regions without quarantine certificates;

5. 6. A fine of 3 million VND 5 million dong to for one of the following violations: a) the transport of infected animals, animal products carrying the pathogen was announced out of the room to the other, the local region;
b) breeding or export sale of animal infectious disease dangers when the State Management Agency specialized on animal health has required mandatory slaughter or destruction.
7. additional sanctions and remedial measures: a) forced the implementation of veterinary measures to fight disease animals for violation of the provisions in paragraph 1 of this article;
b) forced the destruction of animals, animal products, animal feed, animal waste for violating the provisions of art. 2, art. 6 of this Article;
c) enforce the reduction of disinfectant, transport livestock tools for violating provisions of a d clause 4;
d) confiscated animals, animal products for violating the provisions in point c of paragraph 2, point b of this clause 4;
DD) enforce measures to handle veterinary hygiene prescribed for violation of the provisions of paragraph 5, point b paragraph 6 of this Article.
Section 2 VIOLATIONS of REGULATIONS on QUARANTINE of ANIMALS, ANIMAL PRODUCTS, SLAUGHTER CONTROL, veterinary HYGIENE INSPECTION article 10. Violating the rules of procedure of the quarantine of animals, animal products 1. A fine from 100,000 to 300,000 Dong Dong for one of the following violations: a) Not declaring quarantine when domestic transportation of animals, animal products must quarantine regulations;
b) Not declare when importing animals, animal products by post.
2. A fine from 1.000.000 VND to 1,500,000 đồng for one of the following violations: a) Does quarantine declarations when exporting animals, animal products contained in the list of animals, animal products subject to quarantine;
b) is not registered and quarantine declaration when imported temporarily, temporary export, re-export import re import, transfer, transit the territory of Vietnam the animal, animal product in the category of animals, animal products subject to quarantine;
c) did not notice the time through the gate when the export, import, re-export, import export temp re enter, move the gate, Vietnam territory transit of animals, animal products in accordance with the legislation on animal health of Vietnam.

Article 11. Violation of regulations of quarantine of animals, animal products circulation in water 1. c) shipping business, animals, animal products are not the right kind of record in animal quarantine certificates;
d) transported food scraps, wastes of animal infectious disease not yet treated veterinary hygiene. 3. A fine from 1.000.000 VND to 2 million contract for one of the following violations: a) the transport of animals, animal products are not enough veterinary hygiene standards without quarantine certificates;
b) Not done properly the provisions of animal quarantine authority when transporting animals, animal products had concluded that infected objects to quarantine processing.
4. A fine of 3 million VND 5 million dong to for transport behavior of animals, animal products out of the locality are suspended the export of animals, animal products, according to the decision announced by the competent authority on animal health. 5. Additional sanctions and remedial measures: a) confiscating animals, animal products for violation of the provisions of paragraph 4 of this Article;
b) enforce the quarantine of animals, animal products for violating rules at points a, b, c paragraph 2 of this Article;
c) enforce measures to handle veterinary hygiene of animals, animal products, animal feed, animal waste for the offense specified in point d of paragraph 2, point a of paragraph 3 of this article.
Article 12. Violation of regulations of quarantine of animals, animal products, export, import, re-export, import export temp re enter, move the gate, transiting the territory of Vietnam 1. A fine from 200,000 to 500,000 Dong Dong for one of the following violations: a) does not make provisions regarding the import of animals, animal products carried;

4. A fine of 4 million to 6 million dong VND for one of the following violations: a) the import, export, re-export import temporarily re-enter, transfer, transit the territory of Vietnam is not the right kind of animals, animal products, the location recorded in the certificate of quarantine of animals, animal products;

5. A fine of 6 million to 8 million dong VND for one of the following violations: a) Take the animal breeds imported to monitor the quarantine at the incorrect location of the Agency regulation of animal quarantine authority;
b) does not approve the regulations of the animal quarantine agencies for animals, animal products are monitored during quarantine;
c) switch or increase the number of animals, animal products have been certified by quarantine of animals, animal products have not been quarantined;
d) does not have a valid quarantine records when the export, import, re-export, import export temp re enter, move the gate, Vietnam territory transit of animals, animal products;
DD) Pipe riveted or dispose of animals, animal products to evade quarantine;

k) non-observance of sanitary disposal measures required by veterinary quarantine organs animals for dead animals, animal waste, fillers, food scraps and packaging, animal products and other waste in the course of transit.
6. A fine of 10 million to 12 million dong VND for one of the following violations: a) in transit the territory of Vietnam, move the gate of animals, animal products are not allowed by the competent veterinary authorities of Vietnam;
b) brought into Vietnam territory of animals, animal products contained in the list of animals, animal products in an have to quarantine that unknown origin;
c the Executive or non-executive) but not enough track time limit quarantine was put out of business, use of animals, animal products;
d) executive measures Not siege, destruction of animals, animal products infected with the pathogen belongs to the category of dangerous animal diseases or categories of diseases have to publish epidemic or strange harmful microorganisms that State administration specialist veterinary authority of Vietnam has decided to destroy;
DD) imported the disease quarantine objects, animals, animal products without the written consent of the Department of animal health;
e the executive measures) are not processed for diseases not be approved in the territory of Vietnam.
7. A fine of 12 million contract to 15 million contract for one of the following violations: a) the import, export, re-export import temporarily re-enter, transfer, transit the territory of Vietnam infected animals, animal products carrying the pathogen in the list of diseases is published room prescribed law of Vietnam's animal health;

b) dispose of identified animals, waste, food scraps, packaging products, spam containing dangerous pathogens, other malicious elements in the place of quarantine before gate animal quarantine authorities conduct sanitary disposal measures and veterinary. 8. Additional sanctions and remedial measures: a) enforce the sanitary disinfectant deodorant location, transport, animal waste, fillers and other relevant items for breach of specified in point b of paragraph 3 of this article;
b) forced the re-export of animals, animal products, animal quarantine objects for the offense specified in point c of paragraph 3, art. 4, point c paragraph 5 of this Article;
c) enforce the quarantine of animals, animal products in the right place, the right time limit prescribed for the offense specified in point a, b paragraph 5, point c of paragraph 6 of this Article;
d) confiscated animals, animal products for breach of specified in point a, b item 6 of this;
DD) forced the handle veterinary hygiene of animals, animal products, animal waste, fillers, food packaging, for violating the provisions in points i and k points account 5 this;

Article 13. Violation of regulations on the control of slaughter animals 1. c) fine from 500,000 to 800,000 VND VND for the behavior does not make separation of infected animals, own the affected facilities, infected, affected facilities to slaughter, processed or not to own, mark to distinguish the animal products not enough veterinary hygiene standards. 3. A fine from 1.000.000 VND to 1,500,000 VND for the behavior of animal slaughtering infected, dangerous infectious disease facilities in locations not specified animal health agency.
4. remedial measures: a) the Forced implementation of veterinary hygiene measures to ensure product quality animals for violation of specified in point b of paragraph 1, point c of paragraph 2 of this Article;
b) enforce the sanitary, disinfectant deodorant slaughter of animals, the preservation of animal products for violation of at point b paragraph 2 of this Article.
Article 14. Violation of the regulations on trading of animals, animal products 1. Fined for meat business behavior, other products of animals not yet state management agency specialized on animal health control authorities slaughter according to the following penalties: a VND 50,000 fine to) 100,000 contract when animal products valued up to 1.000.000 VND;
b) fines from 100,000 to 200,000 Dong Dong when animal products valued at 2 million came from the same 1.000.000 VND;
c) a fine of 300,000 to 500,000 Dong Dong when animal products valued at 2 million to 5 million from the Council;
d) fine from 500,000 to 800,000 Dong Dong when animal products valued at 5 million to 8 million contract from the Council;
DD) fine from 1.000.000 VND to 1,500,000 Dong when animal products valued at from 8 million to 15 million dong on;
e) fine from 2 million to 3 million dong VND when animal products valued at from 15 million to 30 million contract on copper;
g) fines from 5 million to 7 million dong VND when animal products valued at 30 million đồng from back up.
2. A fine of 200,000 to 500,000 Dong Dong for acts not done properly the provisions of veterinary hygiene conditions for business place of animals, animal products; the media herd sale, preserving, packaging, containing animal products.

b) meat business, fresh animal products infested or other toxic substances exceeding the limit allowed.
5. A fine from 1.000.000 VND to 3 million contract for the business behaviour of fresh animal products containing pesticide residues, chemical is too limited to allow.
6. A fine of 2 million to 5 million dong VND for business behavior animal products that use external additive categories are allowed to use or use exceeding the allowable limit.
7. A fine from 4 million to 8 million dong VND for one of the following violations: a) the meat business, other products of animals in fresh form is preserved by the chemicals are not allowed to use;
b) meat business, other animal products, fresh from being injected, inject impurities or put more chemicals that affect the health safety of users or the environment, the environment;
c) meat business, other products of animals fresh, bringing dangerous infectious pathogens;
d) infected animals in the business directory of the disease is announced.
8.8 million to 10 million dong fine bronze for one of the following violations: a) the meat business, other products of slaughter animals required fresh;
b) business animals trapped the dangerous contagious disease pursuant to the destruction or their products.
9. additional sanctions and remedial measures: a) forced the destruction of animals, animal products for violation of the provisions of point b paragraph 4; the 5, 6, 7, 8 this;
b) seizure, destruction of animal products for violations specified in point b of paragraph 4; the 5, 6, 7, 8 in this case does not apply the measures provided for in point a of this paragraph;
c) enforce strictly the regulations on veterinary hygiene conditions for the violation of the provisions in paragraph 2 of this Article;
d) forcing the veterinary sanitary disposal of animals, animal products prescribed for violation of the provisions of paragraph 3, art. 4 this.
Article 15. Violation of regulations of veterinary hygiene 1. Caution or a fine from 50,000 to 200,000 Council fellow for the behavior does not guarantee the regulation of veterinary hygiene conditions in livestock animals.

2. A fine from 100,000 to 400,000 Council Council for one of the following violations: a) veterinary hygiene does not guarantee the transport of animals, animal products;

c) slaughter of animals are not enough veterinary hygiene standards to business.
3. A fine from 1.000.000 VND to 2 million contract for one of the following violations: a) insufficient veterinary hygiene standards for animal breeding establishments concentrated; production facilities, sales fingerlings; animal slaughter, processing, packaging, storage, trading animal products; the secure facility, animal disease; basis of business outlets, veterinary medicine;
b) not qualified veterinary hygiene testing establishments, testing, veterinary assay; the basis of animal disease diagnostic tests; animal surgery facility;
c) Don't make the handling or not handling as prescribed for animals, animal products that the quarantine agency has concluded that not enough veterinary hygiene standards;
d) imports of animals, animal products sent by post are not enough veterinary hygiene standards. 4. 2 million to 3 million dong fine bronze for one of the following violations: a) does not warrant veterinary hygiene for home, unloading of animals, animal products in airports, stations, ports; animal quarantine zones, animal products;
b) not qualified veterinary hygiene regulations for the transport of animals, animal products when the import, re-export, import export temp re enter, move the gate, transiting the territory of Vietnam.
5. A fine of 4 million to 6 million dong VND for inadequate behavior of veterinary hygiene standards of manufacturing, machining, san chia veterinary. 6. 6 million to 8 million dong fine copper for the behavior of importing, temporary import export temporary export, re-re-enter, move the gate, Vietnam territory transit of animals, animal products are not enough veterinary hygiene standards. 7. 3. A fine of 2 million to 3 million dong VND for one of the following violations: a) the use of veterinary drugs, veterinary materials to room, cure that cause adverse consequences for animal health, the health of people who use animal products;

Article 30. The authority sanctioning administrative violations of the people's Committee of the level 1. 2. President of the district-level people's committees have the right to sanction the administrative violations specified in chapter II of this Decree in local management include: a) caution or impose a fine of up to 20 million VND;
b) confiscated exhibits, the means used to administrative violations;
c) apply remedial measures prescribed in points a, b, c, e, g, i, k, l, m paragraph 3 article 7 of this Decree.
3. The Chairman of the provincial people's Committee has the right to sanction the administrative violations specified in chapter II of this Decree in local management include: a) caution or impose a fine to a maximum prescribed in this Decree;
b) deprived of the right to use the license, a certificate, the certificate of practice veterinary medicine;
c) confiscated exhibits, the means used to administrative violations;
d) apply remedial measures prescribed in paragraph 3 article 7 of this Decree.
Article 31. The authority sanctioning administrative violations of other agencies 1.
