The LAW on prevention of VIRUS INFECTION CAUSING IMMUNODEFICIENCY SYNDROME MADE in PERSON (HIV/AIDS) _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ based on the Constitution of the Socialist Republic of Vietnam in 1992 was amended and supplemented by resolution No. 51/2001/QH10 on 25 December 2001 of the Xth Congress, session 10;
 
This law regulations on HIV/AIDS.
Chapter I GENERAL PROVISIONS article 1. Scope, application object 1. This law regulates the measures for HIV/AIDS; the care, treatment, support for people infected with HIV and the conditions for ensuring the implementation of measures for HIV/AIDS.
2. This law applies to agencies, organizations, individuals in the country and abroad in Vietnam.
Article 2. Explanation of terms In this law, the terms below are interpreted as follows: 1. HIV is the acronym of the English phrase "Human Immunodeficiency Virus" is causing immunodeficiency virus in humans, make the body against potential pathogens.

d) other obligations under the provisions of this law and the provisions of relevant laws.
Article 5. Responsibility in the prevention of HIV/AIDS 1. Agencies, organizations, people's armed unit within the mission, powers was given the responsibility to build and organize the implementation of the programme of action on HIV/AIDS.

3. the authorities, institutions and individuals in the country and abroad in Vietnam have the responsibility to implement the provisions of the law on prevention of HIV/AIDS.

Article 6. The State's policy on HIV/AIDS 1. Encouraging agencies, organizations, individuals in local and foreign cooperation, help in all forms of HIV/AIDS; development of models of self-care of people infected with HIV.
2. Support for the production of drug resistant HIV in the country; implement measures to reduce the price of HIV drug resistance.
3. Encourage enterprises, agencies, units of the people's armed forces training organization and recruit people with HIV and their family members work or investment of resources on HIV/AIDS.
4. Mobilize the participation of the whole society, financial donations, the Agency's techniques, organizations, domestic and foreign individuals in the prevention of HIV/AIDS.
5. Mobilization and coordination of resources for HIV/AIDS with suitable conditions for socio-economic development and the situation of the country's HIV/AIDS epidemic in each stage.
6. support scientific research, training and exchange of experts, technical transfer in the prevention of HIV/AIDS.

Article 7. State Agency on prevention of HIV/AIDS 1. The unified Government Administration about HIV/AIDS.

Article 8. The prohibited acts 1. Deliberate transmission or HIV transmission to others.
2. Threaten HIV transmission to others.

Chapter II the SOCIAL MEASURES in prevention of the HIV/AIDS section 1 INFORMATION, education and COMMUNICATION ABOUT HIV/AIDS 9. The purpose and requirements of information, education and communication about HIV/AIDS 1. Information, education and communication on HIV/AIDS in order to raise awareness, change attitudes and behavior, against stigma, discrimination people with HIV infection.

3. Rights, obligations of individuals, families and of persons infected with HIV in HIV/AIDS.
4. Methods, laboratory services, care, support and treatment of people infected with HIV.
5. The responsibilities of the Agency, organization, people's armed units and communities in the prevention of HIV/AIDS.
6. The harm reduction interventions in HIV prevention.
7. Combating stigma, discrimination people with HIV infection.
8. The way, advocates of the party, policy, the laws of the State of HIV/AIDS.
Article 11. Subject access to information, education and communication about HIV/AIDS 1. Everyone has the right to access to information, education and communication about HIV/AIDS.
2. Priority access to information, education and communication on HIV/AIDS for the following objects: a) People with HIV and their family members;
b) drug users, people who sell sex;
c) incidence of sexually transmitted diseases;
d) Who had same-sex sexual relations;
DD) groups of migrants;
e) pregnant women;
g) who live in remote areas, the socio-economic conditions extremely difficult.
Article 12. Responsible for the information, education and communication about HIV/AIDS 1. The Agency, organization, unit within the mission, his powers are responsible for the information, education, communication of knowledge about HIV/AIDS.
2. The Ministry of health is responsible, in coordination with relevant agencies in providing accurate and scientific information about HIV/AIDS.

4. The Ministry of education and training is responsible for chairing, in cooperation with the Ministry of health, Ministry of labour, invalids and Social Affairs, the ministries concerned to build programs, teaching content; combining education, HIV/AIDS with sex education, reproductive health and directed the institution in the national education system, education on HIV/AIDS.
5. Section 2 MOBILIZING FAMILIES, agencies, organizations, INDIVIDUALS in the prevention of HIV/AIDS article 13. HIV/AIDS in the family 1. The family is responsible for advocacy, educate family members about prevention of HIV/AIDS, actively implement the preventive measures of HIV infection.

d) other responsibilities on prevention of HIV/AIDS in accordance with the law.
2. The employers do not have the following behavior: a) the termination of the employment contract, contract work or cause difficulties in the process of work of workers because workers infected with HIV;
b) forced laborers still healthy enough to transfer the work to which they are kept for reasons of workers infected with HIV;
c) refused to raise wages, promoted or not secured the rights, legitimate interests of workers because workers infected with HIV;
d) require HIV tests or present HIV test result for labor, the applicant refused employment because of applicant HIV workers, except in cases provided for in paragraph 3 to article 28 of this law.
Article 15. HIV/AIDS prevention in educational institutions in the national education system

1. The institution is responsible for the organisation of teaching for pupils, students, trainees, on prevention of HIV/AIDS, integrating with sex education, reproductive health and the implementation of the activities, HIV/AIDS in that basis.
2. Educational establishments not has the following behavior: a) refused to accept students, students, students for reasons that people infected with HIV;
b) discipline, expulsion of students, students, students for reasons that people infected with HIV;

Article 17. HIV/AIDS in the community 1. Article 18. HIV/AIDS in education institutions, school nursing, the basis of healing, the basis of social protection, detention, detention 1. Article 19. 2. The persons specified in clause 1 of this article are responsible for keeping HIV-positive test results, except in cases defined in art. 1 of this article.

Chapter IV the TREATMENT, care and SUPPORT of PEOPLE INFECTED with HIV to article 38. Responsible for the treatment of HIV infection 1. Chapter V CONDITIONS for ENSURING the IMPLEMENTATION of PREVENTIVE MEASURES against HIV/AIDS, Article 43. Resources for HIV/AIDS 1. Every year, the State spent an appropriate budget for HIV/AIDS.

Article 48. International cooperation in the prevention of HIV/AIDS 1. The State to expand cooperation with the country, the international organization in the prevention of HIV/AIDS on the principle of respect for the independence, sovereignty, territorial integrity and mutual benefit.
2. Encourages the organizations and individuals, Vietnam to cooperate with international organizations, institutions and individuals active in HIV/AIDS.
3. The Prime Minister determines the coordination between the ministries of local government, with the corresponding agencies of countries that share a border, carry HIV/AIDS across the border.
Chapter VI ENFORCEMENT PROVISIONS Article 49. Effect of this Law has effect from January 1, 2007.
Ordinance on prevention of virus infection causing immunodeficiency syndrome made in people (HIV/AIDS) in 1995 expired from the day this law is in effect.
