Decrees: Chapter I


General Provisions Article 1. Scope
this Decree regulating in the field of building materials including development planning of construction materials; exploitation and processing of minerals as construction materials; investment, manufacturing and trading of construction materials (except mining, mineral processing and production of metal building materials do not originate from minerals).
Article 2. Subject to
This Decree applies to organizations and individuals in foreign countries and activities in the field of building materials in Vietnam.
Article 3. Definitions
In this Decree, the following terms are construed as follows:
1. Building materials are products derived organic, inorganic, metals are used to make up the construction, except electrical equipment.
2. Mineral construction materials including: minerals for the production of building materials, minerals as raw materials for cement production. 3
. Sanitary ware products is derived from ceramics to installation of sanitary facilities, laboratories and other specialized rooms.
4. Paving materials are construction materials used for tiles, paving and construction work.
Article 4 of the state policy on the development of construction materials
1. State investment policies to encourage organizations and individuals of all economic sectors to invest in developing the technical infrastructure to ensure its consistency and conformity with the development plan of building materials from time to time sign.
2. Activities in the field of construction materials are investment incentives or special investment incentives and investment projects in the fields of building materials on the investment incentive areas of investment incentives under law on investment.
Article 5. Requirements of mining technology, processing, production of construction materials

Article 6. Standards and technical regulations building materials products

Article 7. Requirements on environmental protection
mining activities, mineral processing construction materials; manufacturing and trading of building materials to meet the requirements of the law on environmental protection.
Article 8. Prohibited acts
1. Manufacturing and trading of counterfeit goods; fake labels, signs conformance, conformity mark of building materials.
2. Import and trading of building materials imported without quality standards and unclear origin. 3
. Provide false information about the quality and origin of building materials products.
4. The mining and processing of minerals as construction materials, minerals used as common building materials without exploitation permits.
5. Exploitation of agricultural land, river sand as building material unplanned.
6. Production, sales, use amphibole group of asbestos fibers to produce construction materials.
7. Investment works solidly built not for the purpose of mining, on an area of ​​the mine has been planned exploration and exploitation of construction materials, except with the Prime Minister allows.
8. Taking advantage of managing to hinder the illegal activities of organizations and individuals in the mining and processing of minerals as building materials, production and trading of construction materials. Chapter II

DEVELOPMENT PLANNING CONSTRUCTION MATERIALS Section 1


GENERAL PROVISIONS Article 9 Classification of development planning of construction materials development planning

C) Development Planning paving materials;
D) development planning sanitary ware.
Article 10. phasing, timing of development planning of construction materials
overall planning of construction materials development, product development planning major construction materials are prepared for the period is 10 years, the development orientation for the next 05 to 10 years and represents 05 years for each period.
Article 11 Adjustments, additional development planning of construction materials

Article 12. Funding for development planning of construction materials

Article 13. Management development planning of construction materials
1. Government unifies state management for planning development of building materials in the country.

GENERAL DEVELOPMENT PLANNING CONSTRUCTION MATERIALS
Article 14. Pursuant to the general planning
1. Pursuant to the overall planning for development of Vietnam's construction materials:
a) strategy, overall planning of economic development - economic development of the country;
B) The potential of natural resources and minerals as building material of the country, the results of the baseline survey, exploration, mineral prospecting and other data collected on natural resources of minerals construction materials;
C) Ability to meet the labor, technology and markets.
2. Pursuant to the planned development of regional construction materials:
a) The potential of natural resources and minerals used as building materials, basic survey, exploration, mineral prospecting and data other collection of mineral resources as building materials of the region;
B) Ability to meet the labor, technology and markets. 3
. Pursuant to the planned development of local building materials:
a) developing the master plan of building materials in Vietnam, the product development planning major construction materials, development plan building materials areas (for local cases were planning zone);

Article 15. The order for general planning

C) To analyze and evaluate the current state of development of the industry of building materials throughout the country, the current status of exploration, exploitation and potential use of mineral resources as building materials, the resources invested for development, policy mechanisms, management solutions and mobilize resources, distribution industry situation in the territories, structure type, main products, investment, technology, labor , organization of production and competitiveness;
D) Justifying plans on utilization of savings, efficiency potential mineral resources as building materials;
E) Justifying the allocation plans on the territory sector, structural development plan type, major products, investment, technology and labor;
E) Determine the solution of mechanisms, policies and proposed implementation plans.
2. Content development planning regional construction materials:

Article 17. Profile general planning
1. Planning documents submitted to the authority competent to approve include:
a) Report includes the notes, the legal basis for the submission and approval of the general development plan of building materials together with the draft resolution planning approval;
B) The maps include: mapping the distribution of mineral resources as building materials, produced maps of building materials and that the planning maps;
C) The critical opinions, the comments of the agencies and individuals; record, the conclusions of the evaluation council;
D) The appendices include: Appendix mineral resources as building materials; Annex the production base of building materials available; Annex the calculation method needs construction materials; Annex list of investment projects is the production of construction materials and certain common types of local building materials have strengths (Annex is just for planning development of local building materials Phoenix).
2. The contents of planning documents specified in paragraph 1 of this article are stored and preserved.
Article 18. Responsibility for overall planning
1. The Ministry of Construction held up development master plan of building materials in Vietnam, planned development of regional construction materials.
2. Provincial People's Committee organized development planning of local building materials.
Article 19. Evaluation and approval of general plan
1. Development plan of building materials Evaluation Council must be competent before being submitted to the competent authority for approval.
2. Appraisal Board:

A) The Ministry of Construction organized Evaluation Council for evaluation, the planning provisions in points a and b, Clause 1, Article 9 of this Decree. Composition Evaluation Council composed of representatives of the Ministry of Construction, Planning and Investment, Finance, Natural Resources and Environment, Industry, Transport and other relevant ministries; professionals with expertise in the field of building materials, has experience in the planning; representatives of organizations and professional associations Association of building materials;
B) Provincial People's Committee organized Evaluation Council for evaluation, planning provisions in point c paragraph 1 of Article 9 of this Decree. The Council is composed of representatives evaluating the provincial People's Committee, representatives of departments: Building, Planning and Investment, Finance, Natural Resources and Environment, Industry, Transport and the Department, other relevant sectors; professionals with expertise in the field of building materials, has experience in the planning; representatives of organizations and professional associations Association of building materials.
When necessary, the provincial People's Committee may invite representatives of the Ministry of Construction and the Ministry and agencies participating Evaluation Council. 3
. Competence to approve:
a) the Prime Minister approving the master plan on development of Vietnam's construction materials; development planning of regional construction materials;
B) The Chairman of the provincial People's Committee approving the development planning of construction materials in the locality.
Article 20. The contents of the general planning evaluation
1. Authenticity, reliability of the information, data and documents on the mineral resource potential as reserves, quality, location and scope of the mine.
2. The relevance of the strategic planning of economic development - social; consistency with other relevant plans. 3
. Goals, attitudes, orientations exploration, mineral processing, construction materials development in stages, the general development indicators, the disposition of resources reasonably, plan provisions planning.
4. The solution of economic and synchronous measures to preserve, maintain, efficient exploitation of resources. Section 3


DEVELOPMENT PLANNING PRODUCTS MAJOR CONSTRUCTION MATERIALS
Article 21. Pursuant to the planned development of building material products mainly
1. Strategy, planning and overall economic development - society of the country and other relevant information.
2. The general development plan of building materials. 3
. The survey documents the domestic market, the region, the world and other relevant information about the product concerned.
Article 22. The order of development planning of construction material products mainly

Article 23 The main contents of the development planning of construction material products mainly
1. Objectives, perspectives, strategic product development of building materials mainly.
2. Analyze and evaluate information and data on potential mineral resources as building material of the country concerned about the product and other resources that Vietnam has strengths to develop construction materials . 3
. Forecast of building materials market in the country, the region and the world, import and export forecasts for construction materials.
4. Construction methods of calculating market demand under the timeline.
5. Recommended guidelines and plans to balance the supply - demand for building material products mainly under the timeline.
6. Selection of technology solutions.
7. Expected list of investment projects, investment distribution plan, the scale of investment and investment schedule.
8. Calculating capital requirements, labor.
9. Solutions to ensure balanced supply - demand.
10. The responsibilities of the relevant agencies and mechanisms, policies and inter-sectoral coordination mechanisms, inter-provincial planning to implementation.
Article 24. Profile Product development planning major construction materials
1. Planning documents submitted to the authority competent to approve include:
a) The report shall include the legal basis, notes, written approval of the planning together with the draft decision approving the planning;
B) The maps related to each building material products are planned: A map of the production; that the planning maps;
C) The critical opinions, the comments of the agencies and individuals; record, the conclusions of the evaluation council;

D) The relevant annexes: Annex on mineral resources as raw materials; Annex on the basis of existing production, the Annex on the calculation method of market demand and supply - demand, Annex on investigation documents the market situation of the region and the world countries, forecast import and export of products in the international integration, the Annex on the list of planned investment projects according to timelines, location, size and capacity.

Article 25. Responsibility for planning development building material products mainly
MOC organizations planning to direct product development of building materials mainly cement, animal paving materials, construction glass, sanitary ware.
Article 26. Evaluation and approval of product development planning major construction materials
1. Product development planning major construction materials Evaluation Council must be competent before being submitted to the competent authority for approval.
2. Evaluation Council:
organization MOC evaluation council to appraise the development plans of building materials products mainly under the following provisions:
a) Evaluation Council approved planning development of elements of cement as defined in clause 2 of Article 19 of this Decree;
B) Composition of evaluation of development plans: building glass, paving materials, sanitary ware decided by the Construction Ministry. 3
. Competence to approve:
a) the Prime Minister approving the development plan of cement;
B) Minister of Construction approved the development plan: paving materials, construction glass, sanitary ware.
Evaluation Article 27. Content development planning building material products mainly
1. Legal basis, scientific basis, the reliability of the information, data and documents for planning.
2. The relevance of the strategic planning of economic development - social; consistency with other relevant plans. 3
. The objective, perspective, orientation in phases of construction material products mainly, the general development indicators, the disposition of resources reasonably and other contents of the plan .
4. Plans to balance the demand - supply of building material products mainly.
5. The list of investment projects scheduled under the timeline, the relevant annexes.
6. The solution, implemented measures that the planning; solutions and measures to ensure balanced supply - demand, stabilizing the market.

Chapter III BUSINESS OPERATIONS BUILDING MATERIALS
Article 28 Conditions of the agency, organization development planning of construction materials
1. There advisory functions of construction materials in accordance with the law.
2. There is the project leader planning engineer or equivalent or higher level and have time to participate in the planning of construction materials at least five (5) years.
Article 29. Conditions mining activities as building materials
Organizations and individuals involved in mining activities as building materials must meet the following conditions: || | 1. There are mining licenses are state agencies competent.
2. There are investment projects have been approved; mining design approved. 3
. Conditions and technological capacity:
a) Investment projects selected must ensure the advanced technology to produce high quality products, save resources, protect the environment;
B) size, technology, equipment and mining construction materials must conform to the investment report approved; consistent with the characteristics of each type of mineral to maximize the recovery factor major mineral, associated minerals;
C) For mining operations must have project management board under the provisions of the law on minerals;
D) There are all the conditions for the implementation of environmental protection, ecology, reconstitution plans for each divergence mined in accordance with the law on environmental protection;
E) To take measures to ensure the safety and occupational health as stipulated by labor legislation.
4. For mineral deposits located on the boundary of the locality, the plans must be exploited by the local authorities regarding approval of mining technologies to ensure safe, hygienic environment, save money original; capacity and schedule; zoning for partners to join mining investment and other related obligations.
5. Mining case does not belong planned exploration, exploitation, processing and use of minerals as building material and not subject to reserve mineral resources countries need to comply with mining licenses the state agency authorized to issue;
Article 30. Requirements on processing, production of construction materials
1. Must comply with the provisions of environmental law, labor law and other relevant legislation.

Case of using waste as raw materials, fuels, additives for the production of building materials, the production technology, waste storage warehousing, transport must meet the environmental regulations bare.

Article 31. Sales of building materials
1. Sales of building materials comply with the provisions of the law on trade.
2. MOC specific instructions for building materials business.
Article 32. Conditions on the quality of building materials products to market
1. Is the building materials of domestic production to market must meet the following requirements:
a) Is the building materials must meet the criteria announced. For products on the list must comply with technical regulations must ensure quality and technical regulations;
B) The construction material products no national standards, the manufacturer shall have published standards apply and must take responsibility for the quality of products they produce;
C) building materials products have labels and labels to ensure full record content as stipulated by the law on goods labeling.
2. Products imported construction materials to published standards that apply and meet the provisions of Point c, Clause 1 of this Article.
Article 33. Rights and obligations of organizations and individuals working in mining construction materials
1. Rights of organizations and individuals:
have the rights prescribed by the law on minerals.
2. Obligations of organizations and individuals:
a) Implementation of the obligations under the provisions of the Minerals Law, the Law on Environmental Protection and other provisions of law;
B) mining activities must be consistent with the approval decision;
C) Protection, saving mineral resources, environmental protection and landscape during and after mining;
D) Compensation for damage caused by mining activities cause as prescribed by law;
E) Implement the provisions on administrative management and order and social safety and perform other duties as prescribed by law;
E) To comply with the regulations on the inspection and examination by the competent state authority.
Article 34. Rights and obligations of organizations and individuals of mineral processing, construction materials production
1. Rights of organizations and individuals:
a) Selection and decision technology of mineral processing, production of construction materials in accordance with the law;
B) Choices, decisions and publish standards of product quality building materials they produce;
C) Decision on the organization and the internal controls of product quality and environmental standards and environmental quality;
D) Decision product prices and sales of building materials they produce.
2. Obligations of organizations and individuals:
a) Disclosure of applicable standards, responsible for the quality of products they produce;
B) correctly and fully implement the content of the decision approving the investment;
C) correctly and fully implement the contents of the report of environmental impact assessment and the requirements of the decision approving the reports environmental impact assessment or the contents of the commitments environmental protection and other provisions of law on environmental protection and the provisions of this Decree;
D) Provide adequate information, instruction manual, transportation, storage, storage of building materials;
E) Stop production immediately and remedial measures to detect building material products of substandard quality and may cause damage to the dealers and users; pay damages for dealers and users by the use of construction materials products of substandard quality caused;
E) To comply with the regulations on the inspection and examination by the competent state authority;
G) Provide information about product quality, environmental management agencies authorized in accordance with the law.
Article 35. Rights and obligations of organizations and individuals dealing in building materials
1. Rights of organizations and individuals:
a) the rights of the traders of goods in accordance with the law on trade;
B) Decide on the organization and the internal control measures of quality building materials;
2. Obligations of exporting building materials:
a) To ensure quality construction material suitable for commercial contracts;
B) Compliance with the requirements for quality construction materials export provisions in the international treaties to which Vietnam is committed;
C) Where building materials are re-imported for domestic use, the exporter must fulfill the obligations as importer specified in paragraph 3 of this Article. 3
. Obligations of importers of building materials:
a) Take responsibility for the quality of construction materials they import;

B) organize and control the process of transportation, storage and preservation in order to maintain product quality and requirements for environmental protection;
C) Responsible for the re-export of imported construction materials inconsistent with technical regulations;
D) Building materials imported not guarantee technical regulations are not re-exported and not recyclable, the importer must be destroyed within regulations and bear all the costs of destruction ;
E) Provide adequate information, the conditions must be taken when transporting, storing and preserving products building materials dealers and users;
E) To comply with the regulations on the inspection and examination by the competent state authority.
4. Obligations of the building materials business:
a) Comply with the requirements of the building materials business as stipulated in Article 31 of this Decree;
B) Responsible for building materials products they sell;
C) To organize and control the process of transportation, storage, storage of building materials to maintain quality;
D) Provide adequate information, the conditions must be taken when transporting, storing and preserving building materials products to the buyer;
E) Upon receiving information about product quality building materials do not meet the quality standards specified in the manufacturer, importer, shall promptly provide adequate information and measures reasonable for the buyer;
E) Comply with network planning construction materials business conditions in urban areas (if any);
G) Compliance with the regulations on the inspection and examination by the competent state authority.

Chapter IV EXAMINATION, INSPECTION AND HANDLING OF VIOLATIONS
Article 36. Examination and inspection activities in the field of construction materials
1. Content inspection, inspection:
a) The implementation plan of building materials;
B) activities of mining, mineral processing, production of construction materials;
C) Product quality building materials of domestic production, export, import and circulation on the market;
D) meet the environmental standards of production facilities, sales of building materials;
E) Conditions construction materials business.
2. Form check:
a) Check periodically;
B) Extraordinary inspection upon complaints and denunciations. 3
. Inspection forms:
a) Inspectors planned;
B) Extraordinary inspections: in case of signs of violations or complaints and denunciations.
4. The inspection agency, inspection:
a) The Ministry of Construction organized test and inspect the implementation of the provisions in paragraph 1 of this Article; coordinate with the General Department of Customs check product quality construction materials export and import;
B) Provincial People's Committee directed the provincial authorities organize the examination and inspection activities in the field of building materials according to their competence in their respective localities.
Article 37. Handling of violations
1. Organizations and individuals active in the field of construction materials on the territory of Vietnam with the violation of the provisions of this Decree, depending on the severity, be sanctioned for administrative violations, if damage is caused, to compensation or prosecuted for criminal liability in accordance with law.
2. Those who abuse their positions and powers to prevent organizations and individuals active in the field of legal construction materials on the territory of Vietnam or personal gain will be disciplined, if causing damage, they must compensation or prosecuted for criminal liability in accordance with law.
Article 38. Handling the technology exists to produce investment before the decree takes effect
For establishments producing construction materials with outdated technology, polluting school has been invested before this Decree takes effect:
1. Provincial People's Committee checks, direct manufacturer of construction plans for the overall improvement of technology and environmental treatment under specific progress; approve the plans and oversee the implementation of the plan has been approved;
2. Where there is no plan to overcome, it must convert the production and application of more advanced technology or stop production. Chapter V


IMPLEMENTATION Article 39. Responsibilities of the Ministry of Construction
Ministry of Construction is responsible for State management activities in the field of construction materials tasks:
1. Develop, promulgate or submit to state agencies issued and organizations implement the legal documents on construction materials; building development plan, national programs in the field of construction materials and guiding the implementation of divergence times up all kinds of development planning of construction materials;
2. Develop and promulgate national technical regulations on construction materials; 3
. Unified management of the appraisal and assessment of production technology and product quality construction materials;
4. Other duties prescribed by law related to the field of construction materials.
Article 40. Responsibilities of ministries and agencies

Ministry of Planning and Investment, Ministry of Finance, Ministry of Natural Resources and Environment, Ministry of Industry, Ministry of Transport, Ministry of Commerce, Ministry of Science and Technology and other ministries and branches according to function assigned task with the responsibility to coordinate with the Ministry of construction in performing state management of activities in the field of construction materials and ensure synchronization between the development of construction materials for infrastructure development .
Article 41. Responsibility of the provincial People's Committee
Provincial People's Committee within the duties and exercise their powers to perform the tasks of state management of activities in the field of materials built locally shall:
1. Issued under the authority of legal documents on the management of the activities in the field of construction materials;
2. Organize the implementation of legal documents on the management of the activities in the field of construction materials; 3
. Tracking, statistics, review the situation on the activities in the field of building materials locally;
4. To propagate, disseminate and organize legal guidance, providing information in the field of building materials locally;
5. Other duties as prescribed by law.
Article 42. Effect
1. This Decree shall take effect after 15 days from the date of its publication.
2. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairman of People's Committees of provinces and centrally-run cities and organizations and individuals concerned shall be responsible for implementation of this Decree ./.
