 The CIRCULAR regulates operation of competitive power markets _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to Decree No. 189/2007/ND-CP on December 27, 2007 of the Government functions, tasks, powers and organizational structure of the Ministry of industry and trade;
Pursuant to the law on electricity of 3 December 2004; 
Pursuant to decision No. 26/2006/QD-TTg on January 26, 2006 by the Prime Minister on the approval of the roadmap, the conditions of formation and development of the electricity market level in Vietnam;
Industry regulations operate competitive power markets as follows: chapter I GENERAL PROVISIONS article 1. Scope this circular regulates the operation of a competitive electricity market and the responsibilities of the unit participated in the mobile market.
Article 2. The object that applies to this circular applies to the unit participated in competitive electricity markets: 1. buy wholesale units only.

Chapter II REGISTRATION article 4 ELECTRICITY MARKET PARTICIPANTS. Power market participant responsibilities 1. Article 5. Application of electricity market participants 1. Generator unit that owns the power plant as defined in article 4 of this circular are responsible for submission of registered market participants for each power plant.
2. Registration documents to join the electric market include: a) A register of electric market, which specify the name, address of unit generators, power plant;
b) copy license to operate in the field of electricity generators;
c) material testing system put into operation the equipment to connect to the electricity markets information system, SCADA/EMS system and counting system of electric power;
d) other necessary information required by the electricity system operators and market power.
Article 6. The order approval sign market participants 1. Within ten (10) working days from receipt of valid records, power system operators and the mobile market is responsible for the evaluation and the electricity regulatory Bureau to allow the power plant to join the mobile market.
2. In the case of invalid records, within a period of five (5) working days from the date of the application, the electrical system operators and market power must have a written request additional generator units, complete the profile.
3. within five (5) working days of receipt of the text of the unit operating the power system and electricity markets, electricity regulatory Agency is responsible for issuing the decision to allow the power plant to join the market power and notified in writing to the unit operating the power system and electricity markets to bring power plants on the list of market participants the electric field.
4. within five (5) working days since the power plant is allowed to join the market power, generator units are responsible for registering with the unit operating the power system and the market power of the subject bid on electricity markets (electricity or power plants).
Article 7. Membership information, entering the market of electricity 1. Power transmission unit, the unit bought the only merchant and data management unit for measuring electric energy counting is responsible for registering the General information about the unit for power system operators and market power.
2. electrical system operators and market power have a responsibility to store registration information, update the changes to the registration information of the members participate in the mobile market.
3. the electricity market participants are responsible for notifying the unit operating the power system and electricity market when there is a change in the registered information.
4. electrical system operators and market power have a responsibility to publish registration information of the electricity market participants and registration information has changed.
Article 8. Suspend and restore the right to participate in the market of electric power plants 1. The power plant is suspended the right to participate in the mobile market in the following scene: a) does not fulfill the provisions of article 4 of this circular;
b) Have the following behavior:-do not provide information or provide incorrect information for the planning of power market operation and the mobilization of the aggregates in the electric system;
-Agreement with the electric system operators and market electricity or other power units in the bid to mobilize non-scheduled rules;
-Direct or indirect agreement with other units in the announced capacity and bid on the market power to raise prices of electric power market and affect the security of electricity supply;
-The other violations that cause serious consequences on power system security or financially for the other units in the mobile market.
2. electricity regulatory Bureau reserves the right to participate in the market of electric power plant had violations of the provisions of paragraph 1 of this article. The sequence and procedures for suspension of the right to participate in the market of power plants are specified in article 108 of this circular.
3. During the power plant suspended the right to join the market power: a) power unit or power plants are not bid directly on the mobile market but must comply with the provisions of this circular;
b) unit purchase only merchant is responsible for bid instead of power plants;
c) power plant has the responsibility to provide information to the unit purchase wholesale only to bid instead.
4. the suspended power restore the right to participate in the mobile market when it meets the following conditions: a When the right suspension period) to join the mobile market expire;
b) has fulfilled the obligations stipulated in the decision on sanctions.
5. When did meet the conditions specified in paragraph 4 of this article, the power plant is responsible for sending the text suggested restoring the right to participate in the mobile market accompanied by the documents operational unit to the electrical system and the electrical market. Power systems operators and market power have a responsibility to check and to allow the power plant to be market participants.

6. In the case of the time limit for the suspension of the right to participate in the mobile market ended but the power plant has not yet meet all the conditions specified in point b of paragraph 4 of this article, the mobile system operators and market power have a responsibility to report the electricity regulatory Bureau to review the process.
Article 9. Termination of market participants 1. Termination of power plant electric power market participant in the following cases: a) as proposed by the unit in the following cases:-the unit's power generator stop or stop generator national power system;
-The unit's power generator is not maintained and is not likely to restore capacity set greater than 30 MW.
b) license to operate in the field of electricity generators of the power plant is revoked or expired.
2. In the case provided for in point a of this paragraph 1, unit generator is responsible for filing the proposal ended up electricity market electricity regulatory Bureau at least thirty (30) days before the time of wanting to end the electricity market participants.

4. Chapter III the PRINCIPLE of OPERATION of the ELECTRICITY MARKET article 10. Limit bid 1. The price of the generator on the market competitive power is limited from a floor price to a ceiling price.
2. a ceiling price of thermal power is determined annually, adjusted monthly and is calculated based on the following factors: a) the thermal power of the generator;
b) coefficient of performance according to the operating time of the generator;
c) fuel prices;
d) startup costs.
3. floor Price of thermal power is 1/kWh.
4. Limit the bid of hydropower is determined according to the value of the water every week and is prescribed in article 37 of this circular.
Article 11. The value of water 1. The value of water is used for the planning of the operation next year, next month, next week and determine the price limit Hi of hydropower in electricity market.

Article 13. Electricity market price 1. Electricity market price is the price for the entire system, which is used to calculate payment power on power market for each transaction cycle.

3. The price of electric energy market does not exceed the ceiling price of the market due to the electrical system operators and market electricity regulatory Bureau and the computational power of approval each year.

Article 14. Market capacity price 1. Market power prices for each transaction cycle was operated by electric systems and power computing market in the process of planning for operation next year and no change in the applicable year.
2. market power Prices are calculated on the principle of ensuring the best new power plants sufficient recovery of fixed and variable costs.
3. The determination of market power prices are stipulated in article 25 and 26 of this circular.
Article 15. Power purchase contracts other false shape 1. Generator unit dealing directly and purchase unique wholesale unit is responsible for signing the wrong form power purchase contract under model by other Industry.

-Stable sales of generator unit;
-Average electricity price stability, in line with the regulations on the construction schedule of the retail price of electricity.
b) power output rate of payment under the contract price in electricity market operation start no higher than 95%, and a gradual decline in the next year but not lower than 60%.
Article 16. The principle of payment of electricity market 1. Power unit to be paid under the contract and paid the market price of electricity.

b) power purchase contracts for hydro power multi strategy objectives;
c) ancillary services contract for the power unit provided supporting services.

4. The payment is made according to the provisions in chapter VI to this circular.
Chapter IV PLANS to OPERATE the ELECTRIC MARKET section 1 PLANS article 17 NEXT YEAR. Plans to operate next year 1. Power systems operators and the mobile market is responsible for planning the operation next year, including the following: a) the choice of the best new power plants;
b) calculate the price the market capacity;
c) calculated the value of water and limited water level of the reservoirs of hydroelectric power;

DD) determine the price ceiling market;
e) presided, in collaboration with the only merchant to buy units of calculation of output plans, contract-year production and distribution contract production in the month of the year of the transaction generator unit directly.

Article 18. Classification of hydroelectric plants 1. The hydropower plants in electricity market are classified as follows: a) hydro power multi strategy objectives;
b) groups of terraced hydropower;
c) other hydropower plants.
2. Every year, the electricity system operators and the mobile market is responsible for updating the list of terraced hydropower group.
3. electricity regulatory Bureau responsible created list of hydro power multi strategy targeted to Industry the Prime Minister for approval.
Article 19. Extra load forecasting for planning next year's operating units operating the power system and the mobile market is responsible for load forecasts to serve operational planning next year according to the method prescribed in the electrical transmission systems regulated by the Ministry of industry and trade. 3. Article 100. The notice of dispute and negotiation preparation 1. Article 106.  Establish a violation of the law 1. Article 108. Order and procedure for suspension of the right to participate in the electricity market 1.
