CIRCULAR provisions on quality control of technical safety and environmental protection machines _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to the law on road traffic, November 13, 2008;
Pursuant to the law of product quality, the goods on November 21, 2007;

Pursuant to Decree No. 132/2008/ND-CP on December 31, 2008 of the Government detailing a number of articles of the law on product quality, the goods;
Pursuant to Decree No. 187/2013/ND-CP on November 20, 2013 of government regulation in detail Trade Law enforcement activities in the international sale of goods and the activities of dealers buying, selling, processing and transiting goods with foreign countries;
Pursuant to Decree No. 107/2012/ND-CP dated 20 December 2012 of the Government functions, powers and organization of the Ministry of transportation;
At the suggestion of the Director of science-technology and Director of the Vietnam register, the Minister of transport issued the circular provisions on quality control of technical safety and environmental protection machines.
Chapter I GENERAL PROVISIONS article 1. Scope 1. This circular provisions on quality control of technical safety and environmental protection (hereafter abbreviated as ATKT & PROVINCIAL) with respect to the types of machines; produced, assembled from the component parts not yet through the use of or from the base vehicle has not passed yet and use the sea register; reclamation and mining use.
2. This circular does not apply to machines are manufactured, assembled, importing used directly on defense purposes, security of the Ministry of defence, the Ministry of public security. 2. The object that applies to this circular apply to agencies, organizations, individuals are related to management, check; produced, assembled from the component parts not yet through the use of or from the base vehicle has not passed yet and use the sea register; reclamation and mining uses machines.
Article 3. Explain some words from languages and standards, technical standards used in this circular includes: 1. 9. The evaluation design is the consideration, checked the content of the profile design products with the standards, technical standards, the current rules in order to ensure that the products are manufactured, assembled to meet the quality requirements of safety engineering and environmental protection.
10. The base design is the Organization of business registration, operation or design industries are manufacturing, Assembly, Automatic Vehicle design improvements due to his production unit, the Assembly, renovation.
11. Manufacturing facilities are the business production, Vehicle Assembly operating under current rules.
12. The basis of improvement is trades business organization improving the car.
13. Chapter II QUALITY CONTROL of TECHNICAL SAFETY and ENVIRONMENTAL PROTECTION MACHINES What IMPORTS 4. Registration records check 1. Article 6. Test method 1. Article 7. Processing test results 1. b) vehicles are tested according to the test method of probability or checking each car and meet the requirements, then the Vietnam register CL certification form referred to in annex IV attached to this circular;
c) car was checked and do not meet the requirements, then the Vietnam register notification level not reached according to the template outlined in Appendix V attached herewith;
d) cars have the engine number, chassis number was erased, opaque, closed the Vietnam register as follows: stop the testing procedures, accreditation PROVINCIAL & ATKT machines; Set the minutes noted about the condition of the car violated the provisions of Decree No. 187/2013/NĐ-CP dated according to the model in annex VI attached to this circular. d) for not taking the road traffic in the quality certificate notes as follows: this Car does not participate in road traffic;

I) In the production of the vehicle is determined according to the following: the vehicle's identification number (PIN); the car's chassis number; the manufacturer's documentation, such as catalogs, technical manual; the lookup software organization, International Association provides information on the vehicle; information on the manufacturer's labels are attached or close on the car; the information in the copy of the certificate of registration of the vehicle or vehicle registration cancellation Certificate are circulating in foreign countries.
3. The assessment of COP in foreign production facilities are made for the car through the use of the content and manner specified in article 12 of this circular.
Chapter III

QUALITY CONTROL of TECHNICAL SAFETY and ENVIRONMENTAL PROTECTION MACHINES manufacturing, ASSEMBLY of article 8. Design profile 1. Car design profile (7 sets of 3) include: a) demonstration Vehicle engineering design (original) as specified in section A of annex VIII, attached to this circular;
b) technical drawing (original) as specified in section B of annex VIII, attached to this circular;
c) A specification of the overall import system, related to the content of the design calculation.
2. Free created design profile: for car production, assembling as designed and branded commodities of foreign, if production facilities offer the following alternative documents: a) the car's engineering drawings show the General layout of the product; the basic dimensions of the vehicle; the layout and size of installed systems, cabin;
b) copy the product type certificate by the competent foreign authority;

Article 9. Design 1. Profile design of the vehicle must be appraised Vietnam register.
2. Design records following the satisfactory due diligence, execution of the Vietnam register certification design according to the form prescribed in annex IX attached to this circular.
3. Design records following the appraisal certificate: 01 archive at the Vietnam register; 01 archive at the facility design and 1 in production facilities and Assembly.

Article 10. Test, test specimen 1. Production facilities are responsible for preparing the typical form in the test venue were consistent with the Vietnam register. The categories and subjects are tested, the test set forth in annex X attached to this circular.

Article 11. Product inspection record 1. Test records for the car including: a) A key report the test results, the test specimen;
b) profile design has been Vietnam register appraisal or alternate documents prescribed in paragraph 2 of article 8 of this circular;
c) photographs of designs; A Car information according to the form prescribed in annex XI attached herewith;
d) statistics the total production system in the country and imports used to produce, assemble the product according to the form prescribed in annex XII attached herewith;
DD) A description of the manufacturing process technology, Assembly and quality control of products;
e) A presentation method and location of the engine number, chassis number closed;
g) manual document and product warranty.
2. product inspection records must be stored at the Vietnam register and production facilities for at least 10 years, since the time of the production facilities reported to the Vietnam register ceased production, the Assembly of the type of products that have been certified.
Article 12. Reviews of conditions of quality assurance at the manufacturing facility (COP) 1. To ensure the quality of the products of mass production, the manufacturing facility must meet the following requirements: a) regulations and guidance quality control for each type of product from the quality control of the input components, quality control on each stage to check the quality of marketed products and stitch control warranty maintenance;
b) Have the proper test equipment with the stages of the production process and factory inspection;
c) Have the technician responsible for the quality of the factory have proper profession.
2. execution of the Vietnam register reviews COP at production facilities according to the following method: a) first assessment: done before certification of the quality of technical safety and environmental protection the vehicle manufacturing, and Assembly (hereinafter abbreviated as the certificate type) on the basis of the review , reviews the content: workflow manufacture, Assembly and test processes for product quality; Regulation of storage and control of quality records; human resources production, Assembly and quality control; quality control equipment factory; operation of quality control system in the production process, Assembly, quality control of marketed products and products out of circulation on the market;

The content reviews COP in manufacturing is done on the basis of ISO 9000 quality management systems and the requirements of the standard, the corresponding technical regulation.
3. Exemption from performing reviews of COP for the type of products manufactured, assembled according to the technological processes and the same checkout process or without a fundamental change compared with technological processes and control of this type of product have been evaluated before.
Article 13. Certification types

1. Vietnam base register records specified in article 11 of this circular, to report test results, test specimen and results reporting reviews COP in production base to certificate types for the types of products according to the corresponding template in Appendix XIII provisions attached to this circular.
2. Order and how to do it: a) production base establishment inspection pursuant to the provisions in article 11 of this circular and the submission directly or through the postal system or by other suitable form to the Vietnam register;

3. The time limit for solving: time limit for type certification type: within 5 working days from the date of full test records as prescribed.
Article 14. Check out the production process, Assembly of series 1. 2. Production facilities are responsible for the source, origin, the quality of the products marketed.
3. Each product series production must be the basis of the production factory quality control (hereinafter referred to as the test factory) in the form of self-examination.

c) production facilities are responsible for periodic reports annually on the number, types and results of check involves checking the car factory to the Vietnam register.
Article 15. Reviews the type of products that have been granted the certificate types; suspension and revocation of certificates of type 1. Vietnam register conducted reviews of the product types were type certification in the following cases: a) the annual review type product type;
b) reviews when there is a change of the product versus product type certificate has been issued;
c) reviews when there is a change of standards, technical regulation and regulation concerned.
2. Grounds for review type product type was the type certification types include: a) the COP rating results in production facilities as stipulated in paragraph 2 of article 12 of this circular;
b) the suitability of the product has been granted a certificate of the type style compared to regulations, standards and national technical regulation respectively.
3. When the rules, standards and national technical regulation related to the type of products that have been certified to change or when a product changes affect the fit of the model types that product than the regulations, standards and national technical regulation respectively, the manufacturing facility must conduct the check type product type according to the rules defined standard, and the new national technical regulation. 4. Suspension of the validity of the certificate type register Vietnam will suspend the validity of the certificate types issued during 3 months and notified in writing to the production facilities in the following cases: a) production facility has violated the regulations related to the quality control of products or use slip check the quality factory;
b) products shipped does not match the type of profile categories and sample products have been certified and type-type production facilities are not taken to remedy the product has no match.
During the type certification type suspension effect, production facilities must be made to remedy the violation error. Vietnam will consider register, check after the production base has the fix the offending error; If the offending error has been remedied, the Vietnam register cancel the suspension of the validity of the certificate type and notification in writing to the production facility; If most of the suspended time that manufacturing has yet to fix the error violated the Vietnam register will continue to suspend the validity of the certificate of type type with duration of 03 months. The base case production still did not fix the violation after the expiration of the suspension 2 times in a row then type type certificate issued for the type of products would be revoked as prescribed in point c paragraph 5 of this Article.

c) type product type certificate was valid 2 consecutive times as specified in clause 4 of this that production facilities still do not fix bugs of this type of product.
Chapter IV

QUALITY CONTROL of TECHNICAL SAFETY and ENVIRONMENTAL PROTECTION MACHINES IMPROVING article 16. Profile design of car restoration 1. Profile design of Airport improvement include: a) text recommended improving Car quality certification;
b) business registration certificate or a sheet instead of the design basis (for the base case first design);

b) Vietnam register to receive and check the profile component within 7 working days from the date of receiving the record: If the record is incomplete according to the Regulations Guide complete base; If the full records as prescribed, then write the paper receipt.
c) within 7 working days, since the basis of sufficient design profile: If Car restoration design profiles meet the requirements, the Vietnam register certificate of design assessment improvement, according to the model in annex XVII attached herewith; If the profile design of Airport improvement unsatisfactory, the Agency design announcements in writing and stating of reasons sent to the facility design.
Article 17. Testing the quality of car restoration 1. The renovated facility is responsible for preparing the car restoration at check points were consistent.
2. Register Vietnam conduct establishment inspections thereon on the basis of the test, the vehicle after improvement with the profile design of the car was improving evaluation and quality control of PROVINCIAL & ATKT standards, technical regulation and the current rules; If any items of the vehicle does not meet the requirements to complete reclamation facility.
Article 18. Certification of the quality Car restoration 1. The car later was renovated and meet the requirements shall be certified quality quality improvement Cars (hereinafter referred to as the certificate of improvement) according to the model specified in annex XVIII attached to this circular.
2. A certificate of improvement consists of 2, granted to car owners to do the auditing procedures and registration plate.
3. The time limit for improvement: certification within 5 working days from the date the car was improving and satisfactory.
Chapter V PROVISIONS on TECHNICAL SAFETY INSPECTION and ENVIRONMENTAL PROTECTION MACHINES of extraction, USE of article 19.
