The DECREE stipulates the functions, duties, powers and organizational structure of the Ministry of Foreign Affairs _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the GOVERNMENT pursuant to the law on organization of the Government of 25 December 2001;
Pursuant to Decree No. 178/2007/ND-CP dated 3 December 2007 of the Government functions, tasks, powers and organizational structure of ministries, ministerial agencies;
Considering the recommendation of the Minister of Foreign Affairs and Minister of the Interior, the DECREE: article 1. The position and function of the State's Government agencies perform management functions of State for Foreign Affairs, the including: diplomacy, national territory border, Vietnam community abroad, signing and implementing international treaties, international agreements, the management of the representative body of the Socialist Republic of Vietnam abroad , activities of foreign representative offices in Vietnam; the State management in the field of public services in the scope of the governance provisions of the law.
Article 2. Duties and powers of Foreign Affairs are responsible for implementation of the duties and powers prescribed in Decree No. 178/2007/ND-CP dated 3 December 2007 of the Government functions, tasks, powers and organizational structure of ministries, ministerial agencies and those duties, the following specific powers : 1. 9. Regarding the representation of foreign State: a) to propose to the Prime Minister and the President summons Ambassador Extraordinary and Plenipotentiary, head of the delegation of Vietnam's Permanent Representative at the meeting;
b) and summons the Chief permanent representative delegation to Vietnam at the doors of international intergovernmental organizations, the head of Vietnam consulate abroad; decide on the appointment, dismissal of the Honorary Consulate in Vietnam;
c) represents the State of diplomatic relations with the country, the international intergovernmental organizations; conduct the Foreign Affairs of the State.

d) unify management, directing, guiding and checking the Vietnam representative offices abroad implement the diplomatic work serving economic development;
DD) in collaboration with the ministries, related organizations and local implementation of international economic integration, the commitment in the regional economic organizations and that international Vietnam as members; Join protect the economic interests of the State and of the institutions and individuals overseas Vietnam.
12. For information about foreign propaganda, foreign culture: a) in coordination with the ministries departments manage information propaganda, presided over the deployment of the active propaganda information abroad; presiding over the track, general public opinion the foreign press relating to Vietnam;
b) spokesman perspective, Vietnam's official stance on international issues; the Organization of the International Conference and the preparation of the content of the interview, the senior leadership of the State, the Government and the Foreign Ministry for foreign correspondents on the regular or irregular demand;
c) in collaboration with the ministries, relevant local instructions and check the domestic press reported on the activities of foreign heads of State, the Government, the Foreign Ministry and coordinated guidelines on the international situation, domestic foreign-related;
d) management and licensing of the press activities of foreign correspondents in Vietnam and of the foreign delegation to visit Vietnam at the invitation of the heads of State, Government and Ministry of Foreign Affairs;

14. State management for migratory activities of Vietnam citizens abroad: a) presiding, to coordinate building advocates, policy on international migration issues, in accordance with the conditions of Vietnam and international practices;
b) to coordinate the management of legal migration, prevent illegal migration and handle the matter arose;
c) presiding, to coordinate the protection of citizens in the immigration operations of Vietnam nationals abroad; measures to guarantee the citizen overseas Vietnam enjoy equal rights as citizens of third countries;
d) presided, coordinate, guide, check out the Ministry, local branches, representative offices overseas in Vietnam the work related to immigration operations of Vietnam nationals abroad.
15. On the work for the overseas Vietnam: a) presiding, in cooperation with the ministries, related local research, general situation, proposed to the Government and the competent authorities of advocates, policy with regard to Vietnam people abroad;
b) presiding, coordinate, guide, check out the ministries, localities, Vietnam representative offices abroad about done work for the Vietnam abroad;

16. 18. On governance for representatives of State bodies, economic institutions, the social organization of the Socialist Republic of Vietnam abroad (hereinafter referred to as the agencies, organization of Vietnam abroad), the Vietnam delegation be sent to work abroad : a) unified direction, guide, inspect, monitor the implementation of the policy, the policy of the State, the implementation of the functions, duties and powers of the Agency, held in Vietnam under the provisions of foreign law;
b) presiding, in coordination with the ministries concerned, facilitating support for the Agency, the overseas Vietnam organization fulfills the functions, duties and powers prescribed by the law of the receiving countries, Vietnam and international law;

22. Article 4. Enforceable decrees has effect after 15 days from the date the Gazette; replace the bolt No. 21/2003/ND-CP dated 10 March 2003 of the Government functions, tasks, powers and organizational structure of the Ministry of Foreign Affairs and repealed the previous provisions contrary to this Decree.
Article 5. Responsibility of Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of the provincial people's Committee, the central cities is responsible for the implementation of this Decree.
