The DECISION to establish the Management Committee MOC Bai border gate economic zones, Tay Ninh province _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the PRIME MINISTER pursuant to the law on organization of the Government of 25 December 2001;
Pursuant to Decree No. 106/2006/ND-CP of September 22, 2006 the Government detailing and guiding the implementation of some articles of the law on investment;
Pursuant to decision No. 140/2007/QD-TTg dated 24 August 2007 by the Prime Minister on the regulation of activities of the MOC Bai border gate economic zones, Tay Ninh province;
Consider the proposal of the President of the people's Committee in Tay Ninh province in the sheet of 3000/TTr-April 12, 2007 and the sheet number 112/TTr-April 16, 2008; of the Minister of the Interior in the sheet number 3741/TTr-BNV on December 26, 2007; the Minister of planning and investment in no. 377/BKH TM DV & on October 17, 2008, 1st Run 1. On the establishment and regulation of position, the function of management of MOC Bai border gate economic zones, Tay Ninh province 1. Establishment of the Management Board of MOC Bai border gate economic zones, Tay Ninh province (hereinafter referred to as the management).
2. The Management Board is the State agency directly under the people's Committee in Tay Ninh province; the investment management function, construction and development of MOC Bai border gate economic zone in Tay Ninh province, according to the regulations, zoning, planning and progress are the competent State agencies for approval.
3. The Management Board has legal personality, Member, Office and seal coat shape; is the focal point of the budget plan in Tay Ninh province. The funding of operations management, active career funding due to State budget level as prescribed by the law.
Article 2. The duties and powers of the management board the management board performs the duties and powers prescribed in the: 1. Article 81 of Decree 108/2006/ND-CP of September 22, 2006 the Government detailing and guiding the implementation of some articles of the law on investment;
2. Article 18 active regulation of the MOC Bai border gate economic zones, Tay Ninh province attached to decision No 140/2007/QD-TTg dated 24 August 2007 by the Prime Minister;
3. other legal texts concerned and of the duties, powers by the people's Committee in Tay Ninh province.
Article 3. Organizational structure and staffing of the Management Board 1. Organization structure: a) the Management Board has the head due to the people's Committee Chairman appointed in Tay ninh province, dismissed; a number of Deputy Chief and a number of Board members by the President of the people's Committee in Tay Ninh province appointed, dismissed the proposal of the Management Board;
b) management has the apparatus consists of: the Office, departments;
c) The unit directly.
The required base, the task of developing MOC Bai border gate economic zones, Tay Ninh province in each particular stage, head of the Management Board Chairman of the people's Committee in Tay Ninh province decided under jurisdiction of organization of the Board of management.
2. Staffing: a) staffing of the Management Board are: head, the Deputy Head of Department who are dedicated and staffing of offices, departments;
b) staffing of the Management Committee by the President of the people's Committee in Tay Ninh province decided in accordance with the hierarchy of administrative payroll management and payroll management mechanism for the business units of the State.
3. the head of the Management Board of the people's Committee in Tay Ninh province specified functions, tasks, powers and organisational structure of the Management Board in accordance with the law.
Article 4. Enforceable decision has effect from the date of signing.
Article 5. Responsibility of Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of the people's Committee in Tay Ninh province, head of the Board of management of MOC Bai border gate economic zones, Tay Ninh province, heads of agencies, units, organizations and individuals responsible for the implementation of this decision.
