Pursuant to decision No. 3697/QD-BNN-CB on December 29, 2005 of the Minister of agriculture and rural development on the test project "certified agricultural products of high quality and prestigious Vietnam trade";
Proposal of the Director General of processing trade of agriculture and forestry aquatic products and salt, DECIDES: 1. Modify the name and some of the registration regulation, certified agricultural products of high quality and prestigious Vietnam trade decision No. 3699/QD-BNN-CB on December 29, 2005 and decided to amend Regulation No. 1198/QD-BNN-CB on 4/5/2007 are as follows:-name: this Regulation On the registration certificates regulations agricultural, forestry and aquatic products of high quality and prestige Vietnam commercial credit.
-All the phrases "high-quality" products are transformed into "agricultural, forestry and aquatic products of high quality."
-Article 1: additional phrase "register" in the sentence "this Regulation applies to register certification...".
-Article 2 (application object): Remove from fresh "" in the sentence "... including fresh produce, through processing, preserving, processing ...".
-Paragraph 8, article 7 (application): additional time on the sentence "copy of the text, documents relating to the products in the range from 5 years from the date of registration".
-Article 9 (evaluation criteria): additional clarification clause 1: the management system.
1. "production management system: the product must be produced at the facility has applied the following management systems: ISO +: for all industrial processing base + GAP, GMP, TQM: for fruit products, agricultural products and food specialties.

Article 6. The order of registration 1. Periodically once a year, at least 60 days before the date the Organization reviews, the Ministry of agriculture and rural development announced the plan widely, fees and certification organization form of agricultural and forestry products, fishery products Vietnam high quality and commercial credibility.

Article 7. Profile register registration documents are: 1. The application of product certification organizations, individuals (Appendix 1) 2. Chapter III: assessment and CERTIFICATION of article 9. Evaluation criteria 1. Production management system: the product must be produced at the facility applies the following management systems: ISO +: for all industrial processing base + GAP, GMP, TQM: for fruit products, agricultural products and food specialties.
HACCP +: for the products of canned vegetables and aquatic products.
2. The quality of the product:-the product must be consistent with production standards have been published (TCVN, TCCS, international standards).
-Products to ensure food safety and hygiene and safe use according to the current rules of the State.
-Products must be recorded, marks of origin in accordance with the current regulations of the State.
3. environmental protection: production base product is not causing adverse impact on the ecological environment.
4. commercial credibility: the product must be consumed widely in the market, ensuring the trade reputation, no complaints related to the quality of the product.
Asked: with regard to the criteria 1, 2, 3, in the registration documents of the Organization, the individual must be confirmed in writing by the competent authorities; private 4 criteria must be confirmed by the client to consume a large volume of product.
Article 10. The Council reviews 1. The Council reviews include the members represent management, production-business (business-production base has registered certified products do not participate in the Council), industry associations, consumers and scientists in the fields of product registration certificate.
2. The Director of the Department of agriculture and rural development, Chairman of the industry association decided to form the Council reviews the base level (job board), consisting of 5 to 7 people, including the President, 1st Vice President of the 1st, 2nd and 1st Deputy Secretaries. The two boards had job functions, duties and powers alike.
3. The Minister of agriculture and rural development decided to establish the Council reviews the Ministry, composed of 7 to 9 people, including 1 President, 1 Vice President, Secretary and Commissioner 01 02 fellow critics. The Chairman is the Chief processing, agriculture and forestry commercial fisheries and salt. Council consists of the President, Vice-President and Secretary of the Council. Article 11. Receiving and handling of records 1. Board Secretary reviews the base level of receiving and reviewing the validity of the registration documents according to the provisions in articles 4, 5, 7 of these rules, the Organization reviews the level prescribed in article 13 of this regulation and reporting process of the heads.

Article 12. The principle of work of the Council reviews 1. The Council reviews the work according to the principles of democracy, the secret ballot.

Article 13. The sequence and results evaluation 1. Reviews: grassroots-level evaluation is made at the latest within 30 days from the expiry date of the registration application and certification is done through 2 steps: evaluation at the scene (if necessary) and reviews on record.

-Reviews on the record: plenary session meeting of the Council, heard the report of the expert group; reviews, product reviews by the Commissioner; discuss and vote on reviews (annex 3) for each product.
Board votes, by the Board of elections, ballot, set the minutes (Appendix 4) and announce the results of the vote.
The successful product is the product that is at least 2/3 of the Council members voted to recommend certification.

Article 14. Certification 1. The Minister of agriculture and rural development, the decision and the certification for agricultural, forestry and aquatic products quality standard and commercial credibility. The time limit for the validity of the decision is 12 years.
2. The Ministry of agriculture and rural development presented the decision, certificate and Trophy for the Organization, individuals are certified products and organization promotion products are certified on the mass media.
3. Expiry of validity of the decision, in order to be certified, products must be assessed under the provisions of this regulation.
4. Every year, the Ministry of agriculture and rural development announced the list of certified products and products of the expiry of the certification decision.
Chapter IV: management and SUPERVISION article 15. Manage, monitor 1. Article 16. Handle violation 1. If the Organization, individuals with certified products violate the provisions in article 9 of this Regulation shall, depending on the level, will be suspended temporarily or revoke the validity of the certification decision.
2. During the period of temporary suspension, the Organization, individuals are responsible for performing these corrective action, reports of the Department of agriculture and rural development, the Association and the Department of agriculture and forestry trade processing, fisheries and salt.
3. The temporary suspension, effective recovery or cancel the effect of the decision on certification by the Director of Department for processing, commercial agriculture and forestry fisheries and salt recommendations, the Minister of agriculture and rural development decided.
Chapter v: RIGHTS and LIABILITIES article 17. The rights organization, individual products are allowed to use the certified logos agricultural forestry and fisheries Vietnam high quality and commercial reputation on product labels are certified and are allowed to propagate, advertising products on the mass media.
Article 18. Responsible for 1. The promotion of products, use of logos is not causing the misunderstanding is the other product of the Organization, individuals are also certified as a high-quality product and commercial credibility.

The Department of agriculture and rural development, the Association sent reports about the processing of agriculture and Forestry Bureau of commercial fisheries and salt.
Article 19. Complaints and complaints 1. The Organization, individuals with or without products registration certificate of agricultural, forestry and aquatic products of high quality and prestigious Vietnam trade has the right to complain about the results of reviews and the violations of the provisions of this regulation.
2. The complaint must indicate the name, address and sent to the Department of agriculture and rural development, the Association and/or the Bureau of agriculture and forestry trade processing, fisheries and salt.
3. The Director of the Department of agriculture and rural development, Chairman of the Association, Director, commercial processing of agriculture and forestry fisheries and salt have a responsibility to consider and respond to the complaint in writing according to the current rules of the State.
4. where the complainant does not agree with the content of the reply of the Director of the Department of agriculture and rural development, President, or Director of processing, commercial agriculture and forestry aquatic products and salt, can appeal to the Minister of agriculture and rural development. The Minister's decision is the final decision.
Chapter VI: FINAL PROVISIONS article 20. Additional regulation amendments the amendments and supplements to this regulation by the Director of Department for processing, commercial agriculture and forestry fisheries and salt recommendations, the Minister of agriculture and rural development decided.
