Pursuant to the law on road traffic, November 13, 2008;

Pursuant to Decree No. 51/2008/ND-CP on April 22, 2008 Government's functions, tasks, powers and organizational structure of the Ministry of transportation;

The Minister of transportation regulations on quality control of technical safety and environmental protection machines as follows: chapter I GENERAL PROVISIONS article 1. Scope, application object 1. This circular provisions on quality control of technical safety and environmental protection (hereafter referred to as check) for the types of vehicles used when importing, producing, assembling, renovating and exploit used in transportation.

2. This circular apply to organizations and individuals related to management, import, manufacture, assemble, and tapping machines in use nationwide.

 3. This circular does not apply to machines of the army, the police use in defense and security purposes.

Article 2. Check the base test base consists of: 1. The standard rules, regulations, technical standards.

2. Profile design or technical records.

Article 3. The types of machines to test the 1. For imported machines, Assembly production in the country, according to the catalogues of the goods must be checked on the quality attached to decision No 50/2006/QD-TTg dated 7 March 2006 Prime Minister's Government.

2. for machines are in use, according to the directory of machines are calibrated are stipulated in Subsection lục1 of this circular.

Chapter II INSPECTION MACHINES 1. CHECK the MACHINES when the IMPORT of article 4. 2. A copy of the Declaration of imported goods;

3. A copy of the purchase invoice (Invoice) or equivalent document;

4. The document introduces the basic technical features of each type of import machines (original or copy) or A register specifications machines imported by organizations and individuals to import;

5. the certificate of quality (C/Q) manufacturer's level for machines not through the use of import (if available);

6. Long document specified in clause 4 of this type for the type of machines has been confirmed the test results are satisfactory.

Article 5. The method, content and location check 1. For machines not in use, there are valid records according to the provisions of article 4 of this circular are checked to confirm the parameters of the shape, size, texture, number of frames, number of General Motors.

2. for machines used have valid records according to the provisions of article 4 of this circular or machines not through the use of C/Q is checking each aircraft as defined in the standards, the technical standards for the quality of technical safety and environmental protection machines.

There are doubts about the case of the frame or engine number of the vehicle, the quality control authorities may requisition the assessment of specialized examiners.

Article 6. Confirm test results 1. For machines imported by using meet the requirements as specified in clause 1 5 of this circular shall be granted exemption from notification quality control of technical safety and environmental protection of imported machines (hereafter referred to collectively as the long message check) according to the model in annex 3 of this circular.

2. for imported machines have test results meet the requirements stipulated in article 5 clause 2 of this circular shall be quality certification technical safety and environmental protection of imported machines (hereinafter referred to as certificates imported vehicles) according to the model in annex 4 of this circular.

3. for machines imported through check does not meet the requirements stipulated in article 5 clause 2 of this circular shall be given notice of quality technical safety and environmental protection of imported machines (hereinafter referred to as notice of quality) according to the model in annex 5 of this circular.

Section 2. DESIGN and TEST MACHINES in PRODUCTION, Assembly, article 7. Profile design profile design was established as 3 sets of send the check post authorities to evaluator.

-Drawings and specifications of the production system in the country;

-The technical documentation of the import System.

-Calculating machines design.

2. for machines, profile design improvements include: a) the overall drawing of the machines before and after the restoration;

b) drawings, technical documentation of the system, to be used to renovate;

c) A presentation, content-related calculations.

Article 8. Design 1. The evaluation design profile (hereinafter referred to as the assessment) is done for the machines before initial Assembly, manufacturing or renovating.

2. The appraisal is the review, collate the suitability of design profile machines with the rules, standards, existing technical standards. The evaluation is done within 15 working days from the date of receipt of a valid application. Cases must extend the evaluation due to the additional requirements, modified the design profile, then the check post authorities notified in writing to the base design.

3. After the appraisal, records to be 2 to the base or production facility design and 1 set of archives at the Agency.

Article 9. Check the machines production, the Assembly 1. The profile used in the screening process include: a) the profile design of machines has been register agency appraisal;

b) test profile and products of the production base.

2. content check includes: review, evaluate the quality of the machines according to the rules, regulation, current technical standards and design records have been verified.

3. test method: test of each aircraft.

Article 10. Check the machines restoration 1. The profile used in the screening process include: a) the profile designed to renovate machines were register agency appraisal;

b) records check and machines of production facilities.

2. content check includes: review, evaluate the quality of reclamation machines according to the rules, regulation, current technical standards and design improvement, records have been verified.

3. test method: test of each aircraft.

Article 11. Validation of results the evaluation design, the test results 1. For the record the design satisfactory evaluation of the provisions of article 8 of this circular shall be issued a certificate of design assessment machines according to the model in annex 6 of this circular.

2. for machines manufactured, assembled, modified to create satisfactory check prescribed in article 9, article 10 of this circular shall be issued a certificate of technical safety and quality, environmental protection, manufacturing machines for the Assembly, renovation (hereinafter referred to as the certificate of vehicle production the Assembly, renovation), according to the model in annex 7 of this circular.

Category 3. CHECK the MACHINES to EXPLOIT the USE of article 12. Profile check 1. First check records include: a) grant proposal Paper Window check the technical safety and environmental protection machines (hereafter referred to as the shared audit) by the owners of the machines.

Article 13. The content and location of test 1. Machines are tested in accordance with the standards, technical standards for the quality of technical safety and environmental protection machines.

2. place the test machines in the place where the owners of machines required and must match the test conditions specified in relevant technical regulation.

Article 14. Confirm test results 1. Machines first test requirements specified in paragraph 1 of article 13 of this circular shall be granted audit Book form in annex 8, the test certificate technical safety and environmental protection machines (hereafter referred to as the audit certificates) according to the model in annex 9 and technical safety inspection Stamps and lip protection market (hereinafter referred to as the audit Stamp) according to the model in annex 10 of this circular.

Article 15. The auditing cycle 1. For machines not in use, the first test cycle is 24 months.


2. for machines used, the auditing cycle is 12 months.

Item 4. The DEADLINE to CONFIRM TEST RESULTS, HOST RECORDS article 16. The deadline to confirm test results 1. The time limit for the notification level long test, the certificate of notification, import car quality, certificate of car production, assembling, renovating is 5 working days from the date of the end of the test.

2. The time limit for the certification of design evaluation, auditing Book, certificate of audit appeals is 10 working days from the date of the end of the test.

3. inspection Stamps are glued on the machines after satisfactory inspection techniques.

Article 17. Archive of records 1. Inspection records specified in article 4, paragraph 1 article 9, paragraph 1 article 10 of this circular and the type of inspection and documentation thereon are set up in the vetting process are stored in the Agency register within a period of 3 years from the date of the confirmation level test results.

2. Design records specified in article 7 of this circular after the appraisal is stored in the Agency register within a period of 3 years from the date of stopping the production of machines.

3. inspection records specified in article 12 of this circular are stored during the operation of the machines.

Chapter III LIABILITY of the STATE MANAGEMENT AGENCY Article 18. Vietnam register 1. Unified management, oversee the organization test machines in nationwide.

2. Build and issued guidance documents related to the work of register machines according to the authority.

3. Training Organization, appointed, dismissed members register machines.

4. Uniform issuing, managing, printing the form, check the machines specified in this circular.

5. hold the direction and management of professional service register units perform periodic inspection machines are exploited, used in traffic.

6. Annual periodic reports of Ministry of transport of results to perform quality control of technical safety and environmental protection machines.

Article 19. The Department of transportation to oversee the Organization of periodic inspection machines to exploit used in traffic in units directly under the register.

Chapter IV RESPONSIBILITIES of ORGANIZATIONS and individuals who MANUFACTURE, ASSEMBLE, IMPORT, IMPROVEMENT and EXPLOITATION of USED MACHINES article 20. The liability of the Organization, individual manufacturing, assembling, renovating, import machines 1. Compliance with the rules, standards, existing technical standards when importing, manufacturing, Assembly, repair, renovate machines.

2. Build process and product quality control test equipment investment consistent with production; test equipment calibration must be periodically; quality control organization for each product and responsible for the quality of products marketed.

3. Responsible for the source, origin, quality imported used vehicles.

Article 21. The liability of the Organization, the individual exploit using machines is responsible for repairs and maintenance to ensure technical safety standards and protect the environment of the machines between two test of the unit.

Article 22. The liability of the Organization, individual manufacturing, assembling, renovating, importing, mining uses machines to preserve, maintain, repair, erasing papers confirm test results has been issued and when required by the person on duty.

Chapter V ENFORCEABLE and the ORGANIZATION Do 23. Effect 1. This circular has the effect after 45 days from the date of signing. Repeal of section 3 in the regulation on the grant of registration, number plate, check the technical safety and environmental protection machines have involved road traffic attached to decision No. 4381/2001/QĐ-BGTVT dated 19 December 2001 of the Minister of transport.

2. Papers confirmed the test results give the machines before the validity period of the circular is still worth using under the time limit stipulated in the documents.

Article 24. Implementation 1. Vietnam register has the responsibility to organize the implementation of this circular.

2. The Chief, Chief Inspector, Director of the Service, the Director of the Vietnam register, General Director of the Bureau of roads in Vietnam, the Director of the Department of transportation, the heads of the agencies, organizations and individuals concerned is responsible for the implementation of this circular.
