The CIRCULAR stipulated the estimating, billing, settlement the State budget for the work, protecting the professional flight muscles of the Vietnam base of Decree 60/2003/ND-CP dated 6/6/2003 by the Government on detailed rules and guidelines for implementing the law on the State budget;
Pursuant to Decree No. 118/2008/ND-CP on November 27, 2008 of the Government functions, tasks, powers and organizational structure of the Ministry of finance;
Pursuant to Decree No. 03/2009/ND-CP on 09/01/2009 of the Government on the work of ensuring the flight muscle;
The Ministry of Finance regulates the estimating, billing, settlement the State budget for ensuring the protection, special flights of Vietnam as follows: article 1. Object: the object to perform the specified in this circular is the Organization, individuals are related to the implementation of the special flight of Vietnam; includes: 1. The Party Central Office.
2. The Office of the President.
3. The Office of the National Assembly.
4. Office of the Government.
5. The Chamber of Commerce and industry of Vietnam.
6. The Ministry, the central authorities and the people's committees of provinces and cities under central authority relevant to the flight muscle.
7. Organizations and individuals concerned by the announcement of the Party Central Office, Office of the President, Office of the National Assembly, government offices.
Article 2. Regulation on estimating: every year, on time estimating the State budget according to the provisions of the law on the State budget; the Agency was tasked to organize missions of the senior leaders of the Communist Party of Vietnam and the State of the Socialist Republic of Vietnam is responsible for building the necessary expenditure estimation made the task of ensuring, protection of muscle in flight planning the General synthesis, in the estimation of the annual State budget of his authority, the approval authority.
Article 3. -Prime;
-President of the National Assembly;
b) other special objects when informed of the Party Central Office, Office of the President, Office of the National Assembly, government offices.
2. The institutions, enterprises go along special flights according to the tasks assigned by the party and the State, the free train tickets for the whole group. The specific list of the delegation led by the Party Central Office, Office of the President, Office of the National Assembly, the Government Office announced.
3. The institutions, enterprises (independent businesses, corporations, corporations) have organized the delegation travelling with muscle but not subject to the provisions of point b of paragraph 1 and paragraph 2 above, each of the business are exempt from the money train ticket for 1 person, the rest make money train ticket to fly economy class ticket prices at the time due to flight Vietnam Airlines announced (this provision does not apply to the special flight made by the Ministry of defence).
Article 6. Procedures, records, responsible for the payment of professional costs: 1. for special flights by Vietnam Airlines: a) The competent authority informed the flight muscle of Vietnam under the provisions in article 7 Decree No. 03/2009/ND-CP, in addition to the implementation of the content of the provisions in article 8 Decree No. 03/2009/ND-CP is also responsible for correctly specify the object to be secured State budget money for tickets and the objects must collect the money train ticket. Vehicle rental agencies have the responsibility to urge, to check the currency lodging fare, aircraft of the Vietnam Chamber of Commerce and industry.
d) on the basis of special flight alerts, flight muscle boat rental price by the Minister of finance decision, the competent authorities informed the flight muscle is responsible for signing the contract with Vietnam Airlines are assigned specialized flight muscles of Vietnam. In the content of the regulations on payment terms of the contract must show clearly the 2 following:-Vietnam Airlines is responsible for collecting the money train tickets for train ticket money receivable object dedicated by Vietnam Chamber of Commerce and industry on behalf of businesses that, filed; at the same time responsible level invoices, vouchers for businesses under the provisions of the law.
-After deducting the part cost was obtained as defined in point a above, the remaining value of the contract will be the contracting agency pay for Vietnam Airlines on the basis of ensuring the full records, vouchers: Bill payment services; the contract; liquidation of the contract attached to collect votes by Vietnam Airlines for the Chamber of Commerce and industry in Vietnam, the list object to collect the money train ticket and other legal documents are relevant.
2. for the flight muscle of the Defense Ministry, the payment of professional costs on the basis of the decision of approval of the Minister of national defence about the costs of ensuring for each flight are the State Affairs.
