The CIRCULAR revising, supplementing a number of articles related to administrative procedures of the rules on the type of rail business enterprise must have the safety certificate and conditions, order, certificate of safety procedures attached to decision No 63/2007/QD-BGTVT on December 24, 2007 by the Minister of transportation _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to the law on 14 June, rail 2005;
Pursuant to the law enacting the legal text on 03 June 2008;
Pursuant to Decree No. 24/2009/ND-CP on May 03, 2009 by government regulation and details measures law enacted the legal text;
Pursuant to Decree No. 51/2008/ND-CP on April 22, 2008 Government's functions, tasks, powers and organizational structure of the Ministry of transportation, the Minister of transport regulation: article 1.
Modifying, supplementing a number of articles related to administrative procedures of the rules on the type of rail business enterprise must have the safety certificate and conditions, order, certificate of safety procedures attached to decision No 63/2007/QD-BGTVT on December 24, 2007 by the Minister of transport.
1. Article 8 is amended and supplemented as follows: "article 8. The safety certification procedure 1. Order a) business for safety certification needs to send the suggested profile safety certificate according to mail or lodged directly at the Vietnam railway Bureau.
b) Vietnam railway Bureau to receive and review the records. If the profile is not properly specified, then within 5 working days from receipt of notice of Vietnam railway Bureau, in writing for the business and complete business guide profile.
c) based on the conditions of the safety certificate, the railway Bureau of safety certificate for Vietnam business within 20 days from the date of the application.
2. safety certification profile a) number of records: 1.
b) component profile:-for business enterprise infrastructures: rail + application safety certificate according to the form prescribed in annex 2 of this regulation.
+ Presentation reporting the conditions of safety certificate for the business of railway infrastructure as defined in article 6 of this regulation.
-For the business: rail transport + application safety certificate according to the form prescribed in annex 2 of this regulation.
+ Presentation reporting the conditions of safety certificate for enterprise business rail transport the provisions of article 7 of this regulation. "
2. Article 10 is amended and supplemented as follows: "article 10. Secure certificate level 1. Secure certificate level again for the lost business, temporarily revoked in the following cases: a) proves the business has to fix the cause of the accident and have adequate security measures in next: b) When there were qualified according to the type of business set forth in article 6 (for business enterprise infrastructures the railway) and article 7 (for the business of rail transport) of this regulation.
2. The procedure of reissuing a security certificate) order-business needs please send security certificate re-issuance of records suggest the safety certificate re-issuance by mail or lodged directly at the Vietnam railway Bureau.
-Vietnam railway Bureau to receive and review the records. If the profile is not properly specified, then within 5 working days from receipt of notice of Vietnam railway Bureau, in writing for the business and complete business guide profile.
-Based on the conditions for granting the certificate again, Vietnam railways Bureau to secure certification for business within 20 days from the date of the application. "b) records reissued safety certificate-number of records: 1.
-The profile component for business enterprise infrastructures: rail + application level safety certificate according to the model defined in annex 3 of this regulation.
+ Presentation reports the conditions reissued safety certificate for the business of railway infrastructure as defined in article 6 of this regulation.
-Profile components for enterprise business rail transport: + application level safety certificate according to the model defined in annex 3 of this regulation.
+ Presentation reports the conditions reissued safety certificates for enterprise business rail transport the provisions of article 7 of this regulation. "
3. Item 2 article 11 be amended and supplemented as follows: "2. the safety certificate change procedure a) order-business needs secure certificate change sender records suggest change the safety certificate according to mail or lodged directly at the Vietnam railway Bureau.
-Vietnam railway Bureau to receive and review the records. If the profile is not properly specified, then within 5 working days from receipt of notice of Vietnam railway Bureau, in writing for the business and complete business guide profile.
-Based on the modified conditions of safety certificate, the railway Bureau of Vietnam in Exchange for safety certificate within 10 business days from the date of the application. "b) secure certificate change profile-number of records: 1.
-The profile component for business enterprise infrastructures: rail + certificate change form safe according to the form prescribed in annex 4 of this regulation.
+ Presentation reports the conditions changed for safety certification business of railway infrastructure as defined in article 6 of this regulation.
-For the business: rail transport + certificate change form safe according to the form prescribed in annex 4 of this regulation.
+ Presentation reports the conditions changed for safety certification business rail transport the provisions of article 7 of this regulation. "
4. Replace Appendix 2 and Appendix 3 of the supplement, Appendix 4 as follows: a) Annex 2: proposed Single safety certificate.
b) Appendix 3: application level security certificate.
c) Appendix 4: application safety certificate change proposal.
Article 2. Effective enforcement of this circular effect after 45 days from the date of signing.
Article 3. The responsibility and implementation 1. Vietnam railways Bureau implementation and examine the implementation of this circular.
2. The Chief, Chief Inspector, Chief of the Service of the Ministry, the Vietnam railway Bureau Chief, heads of agencies, organizations and individuals concerned is responsible for the implementation of this circular.
