CIRCULAR additional amendments the regulations about licensing of practice drill under land attached to decision No. 17/2006/QD-BTNMT on October 12, 2006 by the Minister of natural resources and the environment _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ the MINISTER of NATURAL RESOURCES and the ENVIRONMENT pursuant to the law on water resources, 20 May 1998;
Pursuant to Decree No. 25/2008/ND-CP DATED April 3, 2008 of the Government functions, tasks, powers and organizational structure of the Ministry of natural resources and the environment;
Pursuant resolution No. 56/NQ-CP on December 15, 2010 by the Government on plans to simplify administrative procedures (AP) in the scope of the management function of the Ministry of natural resources and the environment;
According to the proposal of the Director General of the water resources management and the Director of the legislation, REGULATION: article 1. Modify, supplement the content specified in a number of articles of the regulation on the licensing of practice drill under land attached to decision No. 17/2006/QD-BTNMT on October 12, 2006 by the Minister of natural resources and the environment (hereinafter referred to as the decision No. 17/2006/QD-BTNMT) as follows : 1. Modify, supplement a, item 2 article 6 "a) for underground water drilling practice small scale:-Have a high professional level and above in departments of geology, hydrology, geology, drilling and have at least two (2) years of experience in the field of practice; drilling rig workers or skilled tier 3/7 or equivalent and have at least four (4) years of experience in the field of practice;
-Were directly involved in the design, construction or drilling reporting at least five (5) the process of exploration and exploitation of the water under the Earth. ".
2. Amendments, supplements article 13 a) modifying, supplementing clause 1: "1. Filing: organizations and individuals recommend licensed underground water drilling filed two (2) sets of records directly or sent by post to the Agency handles licensing records; Why send a (01) record to the Department of natural resources and the local environment where the registered permanent address of the organization or individual for accepting the Agency's records management Bureau of water resources. The records include: a) permit application of underground water drilling (according to the model No. 01a-M attached to this circular);
b) decided to establish the organization or business registration certificate of the Organization, the proposed personal license (certificate copies or copies certified by the Agency; the case has only A copy must accompany original to collate);
c) diploma, a certificate of the person responsible for technical (authenticated copies or copies certified by the Agency, case only A copy must accompany original for collation) and labor contracts for the Organization, the individual proposed licensed labor contracts with the main responsibility of the technique;
d) affidavit of professional experience in the operation of drilling of exploration, drilling underground water extraction of person in charge of the engineering organization, personally recommended the license (in the form of 308B attached to decision No. 17/2006/QD-BTNMT). ".
b) modification, additional paragraph 4: "4. License: decision within a period not exceeding three (3) working days from the date of receiving the record process, the Agency has the authority to license professional licensing decision (according to the Model number 01d and Model number 01 DD attached to decision No. 17/2006/QD-BTNMT); the case does not accept the license, must be notified in writing, stating the reason for accepting the license profile returned for the Organization, individuals applying for license.
The license granted is paid directly to organizations, individual licensing proposal at the Agency accepting resumes or sent by post. ".
3. Modify article 14 paragraph 1, add "1. Submission: institutions, individuals recommended to extend, adjust the contents licensed underground water drilling filed two (2) sets of records directly or sent by post to the Agency handles licensing records; Why send a (01) record to the Department of natural resources and the local environment where the registered permanent address of the organization or individual for accepting the Agency's records management Bureau of water resources. The records include: a) petition to extend, adjust the contents licensed drilling underground water (according to the Model of the M-02a attached to this circular);
b) a copy of the license has been granted;
c) synthetic Table works exploration, drilling for the extraction of underground water by organizations, individuals make in the time use license was granted (according to the model No. 809 attached to decision No. 17/2006/QD-BTNMT);
d) for renewal of license proposal that would shift the main responsibility of the engineering in addition to the documents specified in points a, b and c of this paragraph, the records suggest the extension of the licence include:-Diploma, certificate of responsible person about techniques (certificate copies or copies certified by the Agency granted, the case has only A copy must accompany original for collation) and contract workers for cases held individual licensing proposal, labor contracts with the main responsibility of the technique;
-Affidavit of professional experience (in the form of 308B attached to decision No. 17/2006/QD-BTNMT) who's responsible about technique. ".
4. additional point c, paragraph 2, article 15, "c) the time limit for the decision to grant leave of license and how to pay the license as specified in paragraph 4 of article 13 of decision No 17/2006/QD-BTNMT on October 12, 2006 by the Minister of natural resources and the environment were amended and supplemented.".
Article 2. Repealed, replaced, some forms of licensing regulations permit the drilling of underground water attached to decision No. 17/2006/QD-BTNMT on October 12, 2006 by the Minister of natural resources and the environment are as follows: 1. Removal model No. 01b;
2. Replacement model No. 01a by model No. 1a-M attached herewith;
3. Replace the Sample of form 2a 02a-M attached to this circular.
Article 3. Implementation 1. This circular is in effect from November 1, 2011.
2. During the implementation process, if there are difficulties and obstacles, organizations, personal reflections about the Ministry of natural resources and environment to consider, resolve./.
