Pursuant to the law on organization of the Government of 25 December 2001;

Pursuant to the law on telecommunications, November 23, 2009;

Basing the Ordinance on administrative violations processing 2 July 2002; Ordinance amending and supplementing some articles of the Ordinance on handling administrative violations on 02 Apr 2008;

Considering the recommendation of the Minister of communication and information, the DECREE: chapter I GENERAL PROVISIONS article 1. Scope 1. This Decree the provisions sanctioning administrative violations of telecommunications activities, including investment, business and telecommunications; telecommunications public utility; Telecommunication management; rights and obligations of the Organization, individuals involved in telecommunications activities.

2. The other administrative violations in the field of telecommunications are not specified in this Decree shall apply to the provisions in the Decree of the Government on sanctioning administrative violations in the field of governance related to sanctions.

Article 2. The principle of sanctioning the principle of sanctioning administrative violations in the field of telecommunications are made according to the provisions of article 3 of the Ordinance on handling administrative violations, article 3 and article 4 of Decree 128/2008/ND-CP on December 16, 2008 detailing the Government's implementation of some articles of the Ordinance on handling administrative violations in 2002 and the revised Ordinances , the addition of some articles of the Ordinance on handling administrative violations in 2008.

Article 3. Time limits sanctions 1. Time sanctioning administrative violations in the field of telecommunications is one year from the date of the administrative offense was made.

2. for individuals be prosecuted, indicted or have decided to put the case in the telecommunications field trial under criminal proceedings, but later decided to suspend the investigation or the suspension of the case which have sign violations administrative violations, the sanctioned administrative offense; within 3 days from the date of the decision to suspend the investigation, to suspend the case, who decide to send the decision to the person who has the authority to sanction; in this case, time sanctioning administrative violations is 3 months from the date the competent sanctions get decided to suspend and records violations.

3. the time limits referred to in paragraphs 1 and 2 of this Article, then no sanctions but still apply remedial measures prescribed in article 4 paragraph 3 of this Decree.

4. Within the time limit specified in paragraph 1 and 2 of this Article If individual organizations implement new administrative violations in the field had previously violated or willfully evading, obstructing the sanction, the time sanctioning administrative violations are calculated from the time of implementation of new administrative infringement or from termination behavior escape , obstructing the sanction.

Article 4. The sanctions administrative violations in the field of telecommunications and the remedial measures 1. For each administrative violations, organizing, personal offense suffered one of the sanctions: a) caution;

b) fine.

2. Depending on the nature and extent of the violation, the Organization, the individual administrative violations can be applied one or the additional sanctions: a) deprived of the right to use has a time limit or expiry of the license type;

b) confiscated exhibits, the means used to administrative violations.

3. In addition to the fines, the additional sanction specified in clause 1 and clause 2 of this individual, organization, administrative violations can also be applied to one or more remedial measures: a) Forced to restore original state has been changed due to administrative violations cause;

b) Forcibly taken out of the territory of Vietnam or forcing the re-export of goods, articles, media related to administrative violations in the field of telecommunications.

c) forced the destruction of articles or delete the content of electronic information on telecommunications network with content toxic, harmful to human health, spirit, influence the customs;

d) forced the withdrawal or forced to refund expense currency wrong or exhibits, the media have gone to scatter;

DD) forced the termination of provision or use of telecommunications services;

e) compel the early numbers, the repository of telecommunications.

4. Alien administrative violations can also sanctioned deportation. Expulsion is applied as the main sanctions or additional sanctions in each specific case.

Chapter II ADMINISTRATIVE VIOLATIONS of telecommunications, the FORM and the LEVEL of SANCTIONS 1. VIOLATION of the REGULATIONS on TELECOMMUNICATIONS BUSINESS article 5. Violation of the regulations on telecommunications services resellers and authorized trading points 1. A fine from 5,000,000 VND to 10,000,000 VND for one of the following behaviors: a) set the system terminals in addition to the location agreed upon in the contract of telecommunication service agents or the transaction is authorized to provide the service;

b) provide telecommunications services not on time according to the provisions of the local government;

c) telecommunications service agents or authorized transactions but does not meet the conditions, the standards of the telecommunications service agent or authorized transactions.

2. A fine from 10,000,000 VND to 20,000,000 Board for one of the following behaviors: a) Didn't sign the contract of telecommunication service agents but still provide the service for the use or resale of telecommunications services;

b) do not provide the necessary information related to the use of telecom services for people who use the service.

3. Fine fellow to fellow 70,000,000 50,000,000 for the behavior to provide services for users of telecommunications services article 12 violation of telecommunications Laws.

Article 6. Violation of the regulations on the use of telecommunications services and telecommunications subscribers 1. Article 7. Violation of the regulations on property in the business telecommunications services 1. b) simultaneously owned on the level prescribed for capital stock or shares in two or more different telecommunications business of the same business telecommunications services in telecommunication services category by the Ministry of information and communications regulation.

3. Fine fellow to 50,000,000 70,000,000 Council for one of the following behaviors: a) make proposals exempt under the provisions of competition law but not approved in advance in writing by the Ministry of information and communications;

b) does not inform the specialized administration of telecommunications before conducting the economic focus have combined market share from 30% or more on the market related services.

4. Fine fellow to 70,000,000 100,000,000 contract for one of the following behaviors: a) telecommunications business has a dominant position in the market, Telecom business holds essential media use the information of other businesses to unfair competition;

b) telecommunications business has a dominant position in the market, Telecom business holds essential means implemented to compensate telecom service cross to unfair competition.

Section 2 VIOLATION of the RULES of PUBLIC TELECOMS Regulator 10. Violation of the regulations on providing public telecommunications services 1. b) can not currently funding or support content, telecommunications service of public interest under State regulations.

Section 3 VIOLATION the RULES on ESTABLISHING NETWORKS and TELECOMMUNICATIONS SERVICE PROVIDERS article 12. Violation of the regulations on telecommunications service providers 1. A fine from 1,000,000 to 2,000,000 VND VND for acts not listing service manuals and emergency telecommunications services, Concierge service subscriber phone number lookups fixed.

b) provide telecommunications services are not properly specified in the licence;

c) does not make provisions regarding the resale of telecommunications services;

d) provide basic telecommunications services or telecommunications service value without the consent of the Subscriber of telecommunications; ask the user to confirm with the Subscriber terminals, Terminal agree or do not agree to the use of basic telecommunications services or telecommunications service value.

5. Article 17. Violation of the regulations on emergency telecommunications service and the failure of the fixed phone subscribers 1. b) does not implement technical measures to minimize the loss of contact before, during and after the process of telecommunications subscribers.

Article 19. Violation of the regulations on registration, retain and use information subscribers 1. Caution or a fine from 200,000 to 500,000 Dong Dong for one of the following behaviors: a) providing or using information not accurate when the contracts of use of telecommunications services;

b) does not change the registration information when changes to the subscription server.

b) Sells SIM subscription or terminal type does not use the SIM CARD has been registered by another Subscriber information.

3. A fine of 5,000,000 VND to 10,000,000 VND for one of the following behaviors:


a) receiving registration information when the subscription is not authorized under the regulations;

b) does not meet the prescribed conditions for registration the Subscriber information;

c) transaction topics not done properly the process receiving the subscription registration information;

d) does not report to the business or the competent authority when it discovered the breach in the registration process, keep and use subscriber information;

DD) does not check, update or does not convert correctly to the business of the registered subscriber information at the point of transaction;

e) provide services for the Subscriber for the subscription provided incomplete or inaccurate information to the Subscriber in accordance with the number under 100 subscribers;

g) purchase and sale, Exchange or use of equipment has the function to activate the SIM CARD subscription, Subscribe Subscriber information without having to crack the SIM.

4. A fine of 20,000,000 30,000,000 VND to Board for one of the following behaviors: a) the proxy implementation receiving subscriber registration information is not properly regulated;

8. remedial measures: enforce strictly the decision of State administration competent for violations of the provisions of paragraph 1, paragraph 2 point e, paragraph 3, point e, g, h paragraph 4, point b paragraph 5 and paragraph 6 of this Article.

Article 20. Violation of the rules on invoicing and payment tariff 1. A fine from 5,000,000 VND to 10,000,000 VND for established acts billing telecommunications service rates demonstrated incomplete or incorrect with respect to one of the following: a) tariff and payment amount for each type of telecommunications service;

b) the total amount to pay;

c) value added Tax.

2. A fine from 10,000,000 VND to 20,000,000 Board for one of the following behaviors: a) do not offer Telecom subscribers free detailed once attached to the Bill for the telecommunication services by category of service by the Ministry of information and communications regulations, unless other agreement;

b) charging of calls from a fixed telephone subscription to emergency contacts or 116 or service service failed number of fixed telephone subscribers;

c) Don't set billing rates for users of telecommunications services in the form of pay, unless the user manually recharge cards.

3. the remedial measures: Forcing withdrawal or forced to refund expense currency wrong for violations specified in point b of paragraph 2 of this Article.

VIOLATIONS of section 4 of the REGULATIONS on TELECOMMUNICATIONS LICENSE article 21. Violation of the regulations on telecommunications licence 1. A fine from 5,000,000 VND to 10,000,000 VND for acts not to present one of the following telecommunications licenses when the competent authority request: a) certificate of public telecoms networks;

b) license to provide telecommunications services;

c) license installation of telecommunications cables at sea;

d) license to set up private telecommunications networks;

2. A fine of 20,000,000 30,000,000 VND to Board for one of the following behaviors: a) corrected, erased do change content license;

b) deceptive acts or provided fake information to be granted one of the licenses mentioned in paragraph 1 of this article;

b) provide telecommunications services;

c) installation of telecommunications cables at sea.

5. remedial measures: Forcing termination network setup, installation of telecommunications cables or forced termination of telecommunications service providers with regard to the violations of the provisions of paragraph 3 and paragraph 4 of this Article.

Article 22. Violation of the regulations on disclosure, change the content in the license 1. A fine from 10,000,000 VND to 20,000,000 Board for one of the following behaviors: a) not publish or not publish full content business license of telecommunication services;

b) not publish or not publish full content modification, addition, extension of the business license of telecommunication services;

c) announced the content of the business license of telecommunication services not on time or not published enough on 3 times in a row;

d) announced revised content, addition, extension of the business license of telecommunication services not on time or not published enough on 3 times in a row.

2. A fine of 20,000,000 30,000,000 VND to Board for one of the following behaviors: a) change the address of its headquarters but not notified or not reported on time for the licensing agency;

b) change the name of the business, the scope of telecommunication network settings, the scope of telecommunication service provider, service type has been licensed or other information but do not suggest amendments, additional content business license of telecommunication services;

c) change of name licensed organization or the list of members of the network or the network configuration or the network's scope of activities or type of service provided but not the procedures suggested additional content license set private telecommunications networks;

d) does not comply with the provisions of the telecommunications license.

3. Fine fellow to fellow 70,000,000 50,000,000 for behavior change the licensed organization or information about the cable gland is installed but not doing the procedure proposed amendments, additional content license installation of telecommunications cables at sea.

4. Fine fellow to 100,000,000 đồng 70,000,000 for acts not performed properly committed that licensing of telecommunications organizations have committed to the licensing agency.

Article 23. Violation of the regulations on the installation of telecommunications cables at sea 1. A fine fellow to 100,000,000 đồng 70,000,000 from for one of the following behaviors: a) provided incomplete or inaccurate information concerning cable gland for the specialized Administration about telecommunications;

b) fail the test, the control of the authorized State agencies when the survey or installation or maintenance, repair of the cable glands in Vietnam waters;

c) fail the guidelines of the competent State agencies when the survey or installation or maintenance, repair of the cable glands in Vietnam waters;

d) perform the operations in addition to the survey, installation, maintenance and repair of telecommunication cable lines in Vietnam waters;

DD) survey, installation, maintenance and repair of telecommunication cable glands which have yet to be allowed by the competent State agencies as prescribed by law.

2. additional sanctions: deprived of the right to use license for 1 month for violations of the provisions of point b, c, d paragraph 1 of this article.

3. the remedial measures: Forcing restore original state has been changed due to administrative violations cause for violations specified in point d of paragraph 1 of this article.

Article 24. Violation of the rules on the conditions for licensing private telecommunications network Setup 1. A fine fellow to fellow 30,000,000 20,000,000 words for one of the following behaviors: a) provides services for organizations or individuals not members of private telecommunications networks;

b) set private telecommunications networks are not properly defined in the license.

2. A fine of from copper to copper 100,000,000 70,000,000 for unauthorized use of private telecommunications networks on business purposes.


3. additional sanctions: confiscate the money there was due to administrative violations caused with regard to violations of the provisions in paragraph 2 of this Article.

Article 25. Violation of the regulations on fees, fees for The violation of rights charge and fees for telecommunications activities in the field of telecommunications are applied according to the Decree of the Government regulation on sanctioning administrative violations in the field of fees.

Section 5 VIOLATIONS of the REGULATIONS and CONNECTION SHARING TELECOM INFRASTRUCTURE Article 26. Violation of the rules of public telecoms network connection 1. A fine from 10,000,000 VND to 20,000,000 Board for one of the following behaviors: a) telecommunications business holds the essential media does not publicize the connection agreement templates;

b) telecommunications businesses does not meet enough of connection according to the master plan on development of network, telecommunications services and the connection agreement;

c telecommunications business) does not guarantee the quality of the connection.

2. A fine of 30,000,000 VND to 50,000,000 Council for business Telecom holds the essential vehicle not registered with the specialized administration of the telecommunications connection agreement form.

3. Fine fellow to 50,000,000 70,000,000 Council for one of the following behaviors: a) telecommunications business holds the necessary means not building a telecommunications connection rates as prescribed;

b) telecommunications business limit, deny, arbitrarily stop, making it difficult for the telecommunication networks connected together or provide the service activities of other telecommunications businesses;

c) does not allow connections though there technically feasible on the telecommunications network;

d) does not ensure timely connection or openly, transparently;

Procedure for sanctioning of administrative violations in accordance with the Ordinance on handling administrative violations in 2002, Ordinance amending and supplementing some articles of the Ordinance on handling administrative violations in 2008 and Decree No. 128/2008/ND-CP on December 16, 2008 detailing the Government's implementation of some articles of the Ordinance on 2.

2. The application of coercive measures to enforce the decision sanctioning administrative violations made under the provisions of Decree No. 37/2005/ND-CP dated 18 March 2005 of the Government regulating the procedure of applying coercive measures to enforce the decision sanctioning administrative violations and clause 27 article 1 amending Ordinance , the addition of some articles of the Ordinance on handling administrative violations in 2008.

3. The administrative infringement sanctioned shall be established and kept at the Agency fully sanction within the time limit prescribed by law.

Article 51. Sample documents, sample decided to use in sanctioning administrative violations in the field of telecommunications attached to this Decree's annex and decision thereon patterns used in sanctioning administrative violations in the field of telecommunications.

Chapter IV Article 52 ENFORCEMENT TERMS. Effective enforcement of this Decree in effect enforced since January 1st, 2011 and repealed section 2, item 4, item 5 and Item 6 Chapter II of decree 142/2004/ND-CP of July 8, 2004 regulations sanctioning administrative violations of postal, telecommunications and radio frequency , Decree No. 50/2009/ND-CP dated 25 May 2009 supplement 12a decree 142/2004/ND-CP of July 8, 2004 of the Government sanctioning administrative violations of postal, telecommunications and radio frequency.

Article 53. Responsible for enforcement of the Minister of information and media, the Ministers, heads of ministerial agencies, heads of government agencies, the Chairman of people's Committee of the central cities, is responsible for the implementation of this Decree.
