The use of the use of domestic and chronoscale vehicles

On the recommendation of the Minister of Transport,

The government issued a decree regulating the use of the domestic vehicle and the usage date of the means of water allowed to be imported.

Chapter I

GENERAL REGULATION

Number one. Adjustment range

1. This decree regulates the use of domestic vehicles operating in Vietnam and the usage date of the means of water is allowed to be imported for domestic vehicles operating in Vietnam.

2. This decree does not adjust to the domestic means of defense, security, fishing and foreign domestic vehicles beyond Vietnam.

Article 2. Subject applies

1. In terms of the use of the domestic vehicle: This decree applies to the organization, the individual is the owner or manager, exploiting the use of domestic vehicles operating in Vietnam, including the following types of vehicles:

a) The cargo ship is dangerous, carrying oil, carrying a bucket of liquefied air;

b) A night sleep cruise ship, floating hotel, floating restaurant;

c) The passenger vessel is not a night-night cruise ship, floating hotel, floating restaurant, high-speed train, gas buffer; and more.

d) The high-speed train carrying passengers;

Gas train.

2. In terms of the use of the means of water allowed to be imported: This decree applies to the organization, the individual is the owner, the importer or the tenant, exploiting the use of the domestic vehicle operating in Vietnam, including all of its operations. The local waterway.

3. The case of international treaties in which the Socialist Republic of Vietnam is another regulated member then applies the regulation of that international treaty.

Third. Explain the word

In this decree, the words below are understood as follows:

1. The usage date of the inland waterway is the maximum time to be calculated according to the year in which the domestic vehicle is allowed to operate.

2. The usage date of the means of water is allowed to be imported as the maximum time is calculated according to the year in which the motor vehicle is allowed to be imported to Vietnam, the following is generally the age of the means of water being allowed to be imported.

3. The passenger ship is a domestic vehicle with a capacity of over 12 people.

4. The passenger train is a domestic water vehicle carrying capacity from 12 people back down.

5. The passenger high-speed train is a passenger liner tested by the Vietnam Agency for certification in accordance with the national technical regulation of the distribution and shipbuilding of the high-speed boat; the passenger ship operates in the glide mode in which the hull separates from the water due to the lifting force. The aerodynamus generated by the surface effect, which has the greatest speed of 30 knots (30 km/h) or more in a full-load state.

6. The gas carrier is the inland water vehicle for which the whole or most of the weight of the ship can be raised in a stationary state or motion thanks to the continuous gas buffer to lift the ship to the surface of the water and run on that surface.

7. The night's nighttime cruise ship is a tourist destination for tourists, with a bedroom, on the journey that anchorage to allow tourists to sleep through the night.

8. The floating hotel is a tourist-carrying tourist destination, registered hotel business, which is anchored in a location on the inland waterway and can be moved from the anchorage to the other anchorage when needed.

9. The floating restaurant is a passenger domestic vehicle, which has a restaurant business registry that serves on the vehicle without the layout of the shelter cells in the vehicle.

Chapter II

USAGE DATES OF THE LOCAL WATERWAY AND

THE AGE OF THE WATERWAY IS ALLOWED TO IMPORT

1. The usage term of the domestic vehicle is prescribed as follows:

2. In some special cases, the Prime Minister decides to date the use of the domestic vehicle at the recommendation of the Minister of Transport.

What? 5. The age of the waterway is allowed to import

1. The age of the waterway is allowed to be imported to passenger and passenger ships for no more than 10 years, for other aquatic vehicles no more than 15 years.

2. It is not permitted to import night-night cruise ships, floating restaurants, wooden floorage hotels and unqualified waterway facilities that are located in the year of the vehicle.

3. In some special cases, the Prime Minister decides the age of the water vehicle is allowed to be imported at the recommendation of the Minister of Transport.

What? 6. Age of use

1. The usage term of the domestic vehicle is calculated from the year of the vehicle closed. The identification of the five vehicles is carried out by regulation at Article 7 of this decree.

2. The age of the water is allowed to be imported from the year of the vehicle closed until the year of registration for the publication of the foreign language import customs in Vietnam.

What? 7. Five media

1. For domestic water vehicles to be closed in the country, the year of the vehicle closes is determined to be five vehicles that are issued for registration records after the new closure.

2. For the imported waterway, the five vehicles are determined to be five vehicles that are closed and recorded in the registration or profile file by the country ' s governing body that the vehicle is already granted to the waterway.

Chapter III

ORGANIZATIONAL RESPONSIBILITY

What? 8. Transport Ministry

1. The organization of deployment, the direction of implementing this Protocol.

2. The organization scrutinuses, fining the technical rules associated with the age of use of domestic water facilities in Vietnam.

3. The organization of inspectors, inspection and disposal of the violation of the local waterway by regulation at this decree and other provisions are related by the law.

What? 9. Ministry of Public Security

Coordinate with the Department of Transport in the inspection, inspection, and disposal of violations against the local aquatic vehicles by regulation at this Decree and other provisions relevant to the law.

What? 10. Ministry of Finance

The guidelines for customs procedures involve the importation of water by regulation at this decree and other provisions relevant to the law.

What? 11. The People ' s Committee of the Provinces, the Central City

1. Base functions, duties and powers under the rules, the organization implementing this Protocol.

2. Command local authorities to carry out inspection, inspection and disposal of violations against the local aquatic facilities at this decree and other provisions relevant to the law.

Chapter IV

EXECUTION CLAUSE

What? 12.

This decree has been in effect since 5 January 2015.

What? 13. The transition clause

1. For the passenger high-speed train, since the date of this Decree is valid, the usage date is extended, in particular as follows:

a) The expiration of the term used before 5 January 2015 will be allowed to operate until the end of December 31, 2016.

b) The expiration date from 5 January 2015 to before 5 January 2016 will be allowed to operate until the end of December 31, 2017.

c) The expiration dates from 5 January 2016 to before 5 January 2017 will be allowed to operate until the end of December 31, 2018.

d) The expired means of use from 5 January 2017, after this deadline will not be extended to the time of operation.

2. For the local aquatic vehicles specified at Article 4 of this Decree minus the passenger high-speed train, since the date of this Decree is valid, the usage date is extended, in particular as follows:

a) The expiration of the term used before 5 January 2015 will be allowed to operate until the end of December 31, 2019.

b) The expiration date from 5 January 2015 to before 5 January 2016 will be allowed to operate until the end of December 31, 2020.

c) The expiration dates from 5 January 2016 to before 5 January 2017 will be allowed to operate until the end of December 31, 2021.

d) The expiration date from 5 January 2017 to before 5 January 2018 will be allowed to operate until the end of December 31, 2022.

The expiration dates from 5 January 2018 to before 5 January 2019 will be allowed to operate until the end of December 31, 2023.

e) The expiration date from 5 January 2019 until January 5, 2019 mushrooms will be allowed to operate until the end of December 31, 2024.

g) The expired means of use from 5 January 2020, after this deadline will not be extended to the time of operation.

3. For non-sufficient inland waterways that determine the year of the close since the date of this Decree is valid, the usage date is extended, in particular as follows:

a) The passenger high-speed trains were allowed to operate until the end of December 31, 2016.

b) The local waterways stipulated at Article 4 of this decree unless the passenger high-speed train is allowed to operate until the end of December 31, 2019.

4. For the vehicles that have been contracted to be imported to Vietnam prior to this time of the Protocol, the use of the method is not applicable to the method used by the means of importing but must apply the usage date of the vehicle. The domestic ship was prescribed at Article 4 of this decree when it operated on the domestic waterway in Vietnam.

5. The vehicles stipulate in Clause 1, 2, 3 and Clause 4 This must ensure technical safety and environmental protection by regulation.

The ministers, the chief of the government, the Head of the Government, the Chairman of the Government, Chairman of the People's Committee of the provinces, the city of the Central Committee and the organization, the individual is responsible for the implementation of this decree.
