Veterinary LAW _ the constitutional base of the Socialist Republic of Vietnam;
Congress enacted the law on veterinary medicine. Chapter I GENERAL PROVISIONS article 1. 8. Minister of Defense is responsible for coordination with the Minister of agriculture and rural development in ensuring that defence and security related to animal epidemic prevention and quarantine of animals, animal products; directed border guard, marine police in collaboration with the authorities, against the smuggling, illegal transport of animals, animal products, veterinary drugs across the border.
9. The Minister of information and communications is responsible for coordination with the Minister of agriculture and rural development, directing, guiding the transmission of disease information animal, animal disease prevention.
10. The Minister of natural resources and environment is responsible for chairing, in collaboration with the Minister of agriculture and rural development regulation on the protection of the environment, national technical regulation on the environment related to the field of veterinary medicine. 11. 3. the people's committees of communes, wards and towns (hereinafter referred to as the social level) has the following responsibilities: a) organizing advocacy, dissemination of knowledge, education and veterinary legislation;
b) prescribing places and organize the handling, destruction of infected animals, animal products, veterinary pathogens, poor quality, of unknown origin, import contraband;
c) Organization oversees the early detection and notification of animal disease situation; implementing measures for prevention of animal epidemics; General, reports of damage caused by the animal disease; guide the policy of support of animal epidemic prevention;
d) collaboration with specialized management agency-level veterinary animal disease monitoring, statistics on animal health;
DD) organization active veterinary inspection, complaints, accusations, handled violated the legislation on veterinary medicine according to the authority.
Article 10. The responsibility of the Vietnam Fatherland Front, the front's member organizations and social-professional organizations, civil society organizations 1. Article 11. International cooperation on animal health 1. c) where used to produce the cultivars are derived from the secure basis of disease, with or without the dangerous infectious diseases under the provisions of the World animal health organization and Vietnam.

Article 51. Requirements for terrestrial animals participate in fairs, exhibitions, sporting events, artistic performances; terrestrial animal products fair, the exhibition 1. Animals, aquatic animal products specified in paragraph 1 to article 53 of this law be implemented quarantine, as follows: a) the Organization, individuals when transporting animals, animal products and aquatic products registered with the quarantine authorities of local veterinary specialisation;
b) within 7 working days from the date of receiving the check registration room, specialized management agencies local veterinary decision and inform the Organization, individuals register check out the location, the time of quarantine;
c) performed quarantine included clinical examination, diagnosis, tests of animals, animal products and aquatic products to detect quarantine objects, objects of veterinary hygiene inspection;
d) within 3 working days from the date of start of quarantine, the quarantine requirements if it meets the specialized administration of animal health quarantine certificates; the event lasts more than 3 days or no quarantine certificates, the specialized management agencies local veterinary report, answered in writing and stating the reason.

b) refuse imports of animals, animal products do not meet veterinary hygiene requirements prescribed;

c) comply with the conditions of preservation of the veterinary record on the label and instructions for use veterinary drugs to buyers according to the content of the label veterinary;

Article 94. Conditions for import of veterinary organizations and individuals to import veterinary drugs to ensure the following conditions: 1. the veterinary trade conditions specified in paragraphs 1, 2 and 3 Article 92 of this law;
2. Have qualified warehouse to storage;
3. Certified circulation of veterinary medicine in Vietnam or veterinary import permit under the regulations;
4. quality control record and monitor for each type of import export of drugs;
5. Certified eligible to import veterinary medicine. Article 95. The rights and obligations of organizations and individuals to import veterinary drugs 1. Organizations and individuals to import veterinary drugs have the following rights: a) Are protected by law about the brand goods;
b) Is the denunciation, complaint under the provisions of the law;
c) in damages under the provisions of the law;
d) other rights prescribed by law.
2. organizations and individuals to import veterinary drugs have the following obligations: a) provides the correct import profile with the registered content;
b) compliance with regulations regarding storage conditions;
c) provide quality assurance according to the subscription content;
d) retention of documents relevant to each batch of veterinary drugs within a period of at least 6 months from the date of expiry of the use of veterinary drugs;
DD) subject to management, supervision of competent State agencies; provide full documentation relevant for the sampling, inspection, inspection when required;
e) Paid the expense of handling, damages due to violations of the rules on veterinary import cause in accordance with the law.
Article 96. The sequences, procedures, grant, revoke the certificate of eligible veterinary medicine manufacturing 1. Registration certificate manufacturing qualified veterinary drugs include: a) registration form;

d) certificate of veterinary practice. 2. Order and procedure for certification of qualified veterinary drug trafficking: a) individual organizations trafficking in veterinary medicine applicants registered certification trade qualified veterinary professional management agency for animal health;
b) within 5 working days from the date of receiving documents, specialized agency provincial veterinary check condition of establishments veterinary drugs, if eligible, then within 3 working days from the date of the end of the inspection are qualified certification of veterinary drug trafficking; the case does not grant the right to reply in writing and stating the reason.
3. d) certificate of veterinary practice. 2. Order and procedure for certification are eligible to import veterinary medicine: a) individual organizations to import veterinary drugs submission of registration certification are eligible to import veterinary drugs for animal health;
b) within 10 days from receipt of valid records, animal health check the condition of the facility to import veterinary drugs, if eligible, then within 3 working days from the date of the end of the examination are certified eligible to import veterinary drugs; the case does not grant the right to reply in writing and stating the reason.
3. 3. Raw materials imported veterinary medicines in the following cases: a) used for the production of veterinary drugs has had a circulation certificate veterinary drugs in Vietnam;
b) Used in diagnosis, tests, testing of veterinary medicine as prescribed by the Minister of agriculture and rural development.
4. organizations and individuals importing vaccines, the microorganisms specified in paragraph 1 of this article and veterinary, veterinary materials prescribed in clause 2 and clause 3 of this article apply to register imported veterinary medicines, veterinary medicines, raw materials for animal health. within 5 working days from the date of receiving documents, the animal health import permit review; the case does not grant the right to reply in writing and stating the reason.

b) Manager or directly tested must have the certificate of veterinary practice. 4. The rights and obligations of veterinary testing facility: a) has the right to refuse to accept the form if not satisfactory in number, preserved, attached records;
b) provided relevant information to the sample tested;
c) responsible for the test results of samples tested were veterinary drugs;
d) Only provide information results, test records upon request of competent State agencies;
DD) compensation under the provisions of the law for the Organization, the individual suffers damage due to incorrect test results.

Article 102. Veterinary inspection 1. The veterinary inspection is performed to re-evaluate the quality of veterinary drugs. 2. Veterinary drugs tested in the following cases: a) is the denunciation, complaint about the quality of veterinary medicine;

Veterinary drugs must be used according to the manufacturer's instructions, the prescription of veterinary practitioners, specialized agency animal health. 2. Section 4 recovery, DESTRUCTION of veterinary medicine Article 105. Withdrawing veterinary drugs on the market, handle veterinary drugs recovered 1. b) expiration of use;

Article 106. Destruction of veterinary medicine 1. Veterinary drugs were destroyed in the following cases: a) no certificate of circulation of veterinary medicine in Vietnam, except in the case prescribed in clause 2 and clause 3 Article 100 of this law;
b) does not guarantee the quality, expired and cannot be recycled; contain prohibited active substances used;
c) veterinary, veterinary unattended, veterinary drugs of unknown origin.
2. Responsible for the destruction of veterinary medicine: a) the Organization, individuals are veterinary drugs are destroyed under the provisions of the law on the protection of the environment and bear all costs;
b) provincial people's Committee, directing and funding the layout destroyed for veterinary unattended;
c) competent State authorities decided to destroy veterinary supervision responsibility, confirm the destruction.
Chapter VI Article 107 veterinary PRACTICE. The type of veterinary practice 1. Vaccination, healing, animal surgery; consultation activities related to the field of veterinary medicine. 2. Examination, diagnosis, tests of animal disease.

3. The order and procedure for certification of veterinary practice: a) individual wishing to be certified veterinary practitioners apply for specialized administration of animal health as defined in paragraph 1 of this article;
b) within 5 working days from the date of receiving a valid profile, the receiver records the decision granting the certificate of practice veterinary medicine; the case does not grant the right to reply in writing and stating the reason.
4. The certificate of practice veterinary medicine worth 5 years.
5. Profile, sequence, procedure for renewal of the certificate of practice veterinary medicine: a) individuals have a need to renew the certificate of practice animal health sending records for specialized administration veterinary medicine before the expiration of the 30 days prescribed in paragraph 1 of this article. b) within 3 working days from the date of receiving documents, the agency receiving records decided to the renewal of the certificate of practice veterinary medicine; case of non-renewal must reply in writing and stating the reason.
Article 110. To practice veterinary medicine 1. Veterinary practice certificates are issued in the following cases: a) lost, errors, damaged;
b) Have changed the information related to individuals who have been granted certificates of veterinary practice. 2. The record level again practice veterinary medicine include: a) registration form again;

b) veterinary practice certificate has been issued, except in the case of loss.
3. The order and procedure of reissuing a certificate to practice veterinary medicine: a) the Organization, individuals registered to practice animal health sending records to the management agency specialized in animal health as defined in paragraph 1 to article 109 of this Act;
b) within 3 working days from the date of receiving a valid profile, the receiver records the decision to practice veterinary medicine; the case does not grant the right to reply in writing and stating the reason.
Article 111. No certificate of veterinary practitioners certified individuals to practice veterinary medicine in the following cases: 1. No diploma, certificate suitable expertise;
2. Are within the prohibited period of practice according to the verdict, the decision of the Court;
3. being in time disciplinary expertise relevant to animal health;
4. Are suffering prejudice criminal liability;
5. Are the Executive during the Court's criminal judgment; are being applied to administrative processing measures taken on the basis of compulsory education, compulsory detoxification facility;
6. Restricted or lost the capacity for civil acts.
Article 112. Revocation of the certificate of practice veterinary medicine 1. Veterinary practice certificate revoked in the following cases: a) Was erased, corrected the content;
b) discovered false papers, dishonest information in records of registration certificate of practice veterinary medicine;
c) Are violations of professional ethics and rules of the relevant law.
2. the competent agency specified in clause 1 Article 109 of this act revoked the certificate of veterinary practice. Article 113. Rights and obligations of the Organization, individuals practicing veterinary medicine 1. Organizations, veterinary practitioners have the following rights: a) Is practicing according to content recorded in the practice of veterinary medicine;
b) Are training, advanced training of professional, veterinary profession;
c) is State support, encouraging active participation, animal epidemic prevention at the local level.
2. organizations and individuals practicing veterinary medicine has the following obligations: a) in compliance with the provisions of the legislation on veterinary medicine and related law in practice; compensation for damage caused by his fault causes in veterinary practice;
b) provides information relating to the management of animal health; compliance with and participate in the activities of veterinary medicine when required by the competent authority.
Article 114. Veterinary councils 1. Board of veterinary medicine was established at Central, provincial level.
2. Veterinary Council work in part-time mode, which functions to advise the Minister of agriculture and rural development, the Director of the Department of agriculture and rural development on veterinary activities. 3. Veterinary Board composition includes representatives of specialized administration of animal health, representatives of associations, associations, universities, research institutes and experts in the field of animal health. 4. The Minister of agriculture and rural development of detailed rules regarding the Organization, functions, duties and powers of the Veterinary Council levels.
Chapter VII ENFORCEMENT PROVISIONS Article 115. Effect 1. This law is in effect from July 1, 2016.
2. Animal Health Ordinance No. 18/2004/PL-UBTVQH11 expire from the date this law have enforceable.
3. Types of licenses, certificates, certificate in the field of veterinary medicine was granted before the date this law take effect without expiry shall remain valid until their expiry.
Article 116. Detailed rules of the Government, the competent authority detailing the article, account was given in the law.
