CIRCULAR rules of training, testing, motor vehicle driver license road _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to the law on road traffic, November 13, 2008;
Pursuant to Decree No. 107/2012/ND-CP dated 20 December 2012 of the Government functions, tasks, powers and organizational structure of the Ministry of transportation;
At the suggestion of the Director of the Organization Department and the General Director of the Bureau of roads in Vietnam, the Minister of transport issued a circular regulating the training, testing, motor vehicle driver license road.
Part I GENERAL PROVISIONS article 1. Scope this circular rules of training, testing, motor vehicle driver license road.
Article 2. Application object 1. This circular applies to management training, testing, driving license; driver training, driving test centre; organizations and individuals related to the training, testing, licensing of motor driving roads within the country.
2. This circular does not apply to the training, testing, driving license of the police, army, national defense security mission.
Article 3. Explanation of terms In this circular, the terms below are interpreted as follows: 1. the loading cars, cars, cars used load used car types are defined in the ISO standard ISO: 2003, 6211 7271:2003.

Part II TRAINING of MOTOR DRIVING the ROAD chapter I TRAINING MANAGEMENT to DRIVE category 1 standards, DUTIES and POWERS of the Driving TRAINING BASE 4. Driver training 1. Driver training facility by the competent organs established, functional training to drive and meet the technical standards, qualified under the provisions of this circular.
2. The basis of automobile driving training to proper planning of the Ministry of transportation.
Article 5. Technical standards, professional driver training facility's training facility to drive must meet the following criteria: 1. professional school system a) classroom expertise ensure minimum area 50 m2;
b) training base automobile driver must have enough specialized classrooms, including: the road traffic law, textures and normal repair, driving techniques, transportation professional, moral and cultural drivers of traffic (which can be folded together with schools of professional transport) are arranged to focus classroom exercises, maintenance repair; Campus Drive A3, A4 class can share specialised classrooms;
c) training base to drive cars with 500 students to flow back up must have at least 2 schools of road traffic law and 2 classroom driving techniques; with 1,000 students or more flow must have at least 3 schools of road traffic laws and driving engineering Room 3;
c) driver training facility two-wheelers grades A1, A2 must be 1 General classrooms road traffic laws and driving techniques.

b) driving teacher grades A1, A2, A3, A4 driving license must have a corresponding class. Automobile driving teacher must have a licence to drive on the corresponding class or higher car class training, but not lower-class B2; driving practice time of the teacher's class B1, B2 from 3 years or more; driving practice time of the teacher's class C, D, E and F from 5 years and over;
c) took over training on professional teaching practice driving under the program by the General Directorate of roads in Vietnam and are certified teachers to teach the practice of driving according to the form prescribed in annex 1a and Annex 1b attached to this circular.

DD) cars to teach driving class B1, B2 to have tonnage from 1,000 kg or up to the amount of not more than 30% of the total class of driver cart training facility;
e) certification inspection technical safety and environmental protection of motor transport is valid road;

k) cars have to have the 2 seas "DRIVE" in the form prescribed in Appendix 3 attached to this circular;
l) three-wheeled motorcycles, tractors and small tonnage up to 1,000 kg must have 2 sea "DRIVING" in the form prescribed in Appendix 3 attached to this circular;

m) have a license to drive cart by General Directorate of roads in Vietnam or the Department of transportation granted when eligible prescribed at points b, c, d, e, f, g, h, i, k, l. Sample cart driving licence specified in the Appendix 4a and 4b in Appendix attached to this circular.

15. 16. Identify training driving cars on the basis of ensuring conditions of classrooms, practice, staff and management, the training flow every driving license class is determined by the number of vehicles of that class driver volume multiplied by the number of students specified on a car and multiplied by 2. The number of students learning at a time should not exceed the capacity of the car each driver file of class training facility.
Article 6. The duties and powers of the base driver training 1. Admissions organization according to the driving license class allowed training guarantees the conditions for the school under the provisions of article 8 of this circular.
2. Registration and liquidation of contract training with people learning to drive a car.

b) driving training grades A3, A4, B1, B2, C, D, E and F: reporting training base register test driving, students list (report 1), a list of suggested verified driving licence was issued (for the case of upgrade license), course training plan according to the form prescribed in annex 7a Appendix 7b, 7 c and Appendix 8 Appendix attached herewith submit the vetting authority, driving license immediately after opening for the A3, A4; not more than 7 days after the opening ceremony for the B1, B2, D, E, F and not more than 15 days after the opening ceremony for the class C; the report must have the seal of armor training facility;

Article 7. Training documents and training management of driver training 1. The syllabus taught to drive by the General Directorate of roads in Vietnam.

b) progress of automobile driving training grades according to the form prescribed in Appendix 3 attached to this circular;

d) Window class; theoretical lesson plan book; practice lesson plan book; grade book, certificate, certificates according to the regulations of the Ministry of labor, invalids and Social Affairs.
3. Training of driving the A4 class using the types window in points c and d item 2 of this Article.

Section 2 the LEARNER DRIVING article 8. Conditions for people learning to drive 1. Vietnam citizens, foreigners are allowed to reside or are working, studying in Vietnam.

c) class C, D, E up FC: time of practice 12 years or 50,000 km and safe driving;
Class B2 up) C C D D E up, up; class B2, D, E Class F respectively: practice time from 3 years or 50,000 km and safe driving;
Class B2 up) D, C E up: practice time from 5 years or 100,000 km and drive safely.

Article 9. Form of training 1. Who needs driving license class A1, A2, A3, A4, B1 is a self study theory, but must register at the training facility was allowed to be training, test preparation; class A4, B1 must be checked, certificate of training.
2. Who needs driving license, class B2, C, D, E and F class driving license must be trained at the facility are allowed to train and to be the primary certificate examination or training certificates.

c) middle school diploma or equivalent and above for the case of upgrade license to drive up the class D, E (present original when checking for testing);
d) driving license copy (present original when testing and getting a driver's license).
People learn to drive a car when to apply the training facility to be photographed directly stored in the database of driver's license.
Section 3-MANAGEMENT TRAINING DRIVING Things 11. Vietnam Road Administration 1. General Directorate of roads in Vietnam are the Ministry of transport assigned to the unified management of training driving range in the country.

Article 12. The Department of transportation 1. Responsible manager training driving range in the province, the central cities.

Article 13. The certification procedure for teaching practiced driving 1. Individuals or institutions established 01 record sent directly or through mail or by other suitable forms to the Department of transportation or the General Directorate of roads in Vietnam. The records include: a) petition according to the form prescribed in annex 13a attached herewith;
b) driving license (copies with originals to collate or authenticated copies);
c) intermediate diploma or vocational skills certificate (copies with originals to reference or copy attested);
d) health certificate by the medical regulatory authorities;
DD) pedagogical certificates (copies with originals to reference or copy attested);
e) 2 color photos, size 3 cm x 4 cm blue background, type certificates;
g) list of suggested teachers certified to teach the practice of driving.
2. The Department of transportation or the General Directorate of roads in Vietnam receive personal profile or profile, list by training facility established by the form prescribed in annex 13b attached herewith; testing, training organization. Individual cases are not eligible, the Department of transportation or the General Directorate of roads in Vietnam must reply in writing and stating the reason.
In less than 10 working days from the date of achieving results, the Department of transportation or the General Directorate of roads in Vietnam teach teacher certification to practice driving, in the form as prescribed in Appendix 13 c attached to this circular.
3. The certificate of teaching practice of driving has a time limit of 5 years. Record, review procedures certificate of teaching practice of driving when the execute expiry as specified at points a, b, d clause 1 and clause 2 of this Thing.

Article 14. Procedure to license the car drive episode 1. The records include: a) a list of recommended vehicles licensed to drive the cart according to the form prescribed in Appendix 13d attached herewith;

2. Within a period of not more than 10 working days from the date of receiving the application, the base test results, the Department of transportation or the General Directorate of roads in Vietnam licensed driving for cart training according to the form prescribed in annex 4a and Appendix 4b attached to this circular. Car license term set of drive correspond to time travelling by car driving episode. The case is not licensed must reply in writing and stating the reason.
3. The grant of leave driving cart license expired when made according to the provisions in clause 1 and clause 2 of this Thing.
Article 15. The procedure to renew the license of vehicle driver training 1. Organizations and individuals wishing to establish 1 record suggest approved new construction advocates training base automobile driving, sent directly or through mail or by another suitable form to the Department of transportation. The records include: a) text recommended to approve new construction training base automobile driving;
b) project to build the basis of automobile driving training, which must have the location, construction area, scale, training flow, number of teachers, the number of media training facility;
c) text approved by land management agencies in order to build local training facility.
2. the review process, the profile suggested resolution to approve new construction training base automobile driving as follows: a) case records not sufficient as a rule, within a period not exceeding 10 working days from the date of receiving the application, the Department of transportation must guide directly, or by writing to the organisation individuals;
b) within a period not exceeding 10 working days from the date of receiving the application regulations, training needs based on local practice and planning the training facility of the Ministry of transportation, the Department of transport review, have accepted the sending organization advocates , personally. c) certified copies or copies with originals to collate decided to establish the institution of occupational driver training function of the competent authority;
d) certified copies or copies with originals to reference the certificate of teaching practice driving longer term;
DD) copy or a copy certified with a key to compare vehicle registration certificate; a copy of the certificate of inspection of technical safety and environmental protection the motor road means longer time limit; copy the license file to drive the car.
4. The Department of transport review the proposal to renew the license of automobile driving training and perform the following: a) cases not sufficient as a rule, within a period not exceeding 10 working days from the date of receiving the application, the Department of transportation must guide directly, or by writing to the organisation individuals;
b) during the period not exceeding 10 working days from the date of receipt as a rule, the Department of transport coordinated with the authority to manage the Organization local vocational reality check training facility, established thereon according to the form prescribed in Appendix 15a attached herewith;
c) In less than 5 working days from the date of the end of test, if qualified, the Department of transportation issued new licences for automobile driving training training facility. The case is not licensed must reply in writing and stating the reason.
Article 16. The procedure of reissuing permits automobile driver training 1. The license of driving training automobiles are level again when they expire, tuning car class training or training capacity.
2. The record level again when they expire or adjust the car class or training flow training base set 1 set of records sent directly or through mail or by another suitable form to the Department of transportation or the General Directorate of roads in Vietnam. The profile includes the composition rules at points a, d, e article 15 paragraph 3 of this circular (only supplements the content changed in comparison with the closest license).
3. In time not exceeding 5 working days from the date of receiving the application, the Department of transportation or the Vietnam Road Administration coordination agency manage the organisation reality check training facilities and created a test according to the form prescribed in Appendix 15b attached to this circular.
4. In time not exceeding 10 working days from the date of the end of the test, the Department of transportation or the General Directorate of roads in Vietnam to permit training of automobile driving training facility. The case does not grant the right to reply in writing and stating the reason.
5. The receiving records and resulting pay made at the Agency headquarters or through mail or by other suitable form.
Article 17. The procedure to renew the license of driving training grades A1, A2, A3 and A4 1. The training base set 1, delivered directly or through mail or by another suitable form to the Department of transportation. The records include: a) The text of the report included suggest training license to drive according to the form prescribed in annex 14 attached herewith;
b) authenticated copies or copies with originals to collate decided to establish the institution of occupational driver training function of the competent authority;
c) a copy of the certificate of teaching practice driving;
d) vehicle registration certificate copy of the vehicle for the driver file A3, A4 class.
2. In time not exceeding 5 working days from the date of receiving the application, the Department of transport examine reality training facility and set up a test according to the form prescribed in annex 16 attached to this circular.
3. In time not exceeding 5 working days from the date of the end of the test, the Department of transportation license driver training for the training facility. The case is not licensed must reply in writing and stating the reason.

Article 18. Procedure for grant of leave driving training license grades A1, A2, A3 and A4 1. Before the license expiration driver training on 15, training base set 1 set the recommended records re-issued the license, send directly or via mail or by other suitable forms to the Department of transportation. The records include: a) dispatch report proposed training license to drive the form prescribed in annex 14 attached herewith;
b) copy of certificate of driving practice teacher (just add the content changed in comparison with the closest license);
c) vehicle registration certificate copy of car driver set for the A3, A4 class (just add the content changed in comparison with the closest license).
2. in less than 10 working days from the date of receiving the application, the Department of transport examine reality training facility and set up a test according to the form prescribed in annex 16 attached to this circular.
3. In time not exceeding 5 working days from the date of the end of the test, the Department of transportation granted leave of license for driving training training facility. The case is not licensed must reply in writing and stating the reason.
Article 19. Driver training permit 1. Training license to drive according to the form prescribed in annex 17a and 17b appendix attached to this circular.
2. The term of the license of driving training is 5 years from the date of grant.
