The CIRCULAR issued to national technical regulation on labor safety for the system of conditioning _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ pursuant to Decree No. 106/2012/ND-CP dated December 20, 2012 of the Government functions, tasks, powers and organizational structure of the Ministry of labor, invalids and Social Affairs;
Pursuant to Decree No. 127/2007/ND-CP on 1st August 2007 detailing the Government's implementation of some articles of the law on technical regulation and standards;
Pursuant to Decree No. 132/2008/ND-CP on December 31, 2008 detailing the Government's implementation of some articles of the law on product quality, the goods;
At the suggestion of Director of Department of labor safety;
Minister of labor, invalids and Social Affairs issued a circular regulating the national technical regulation on labor safety for refrigeration systems.
Article 1. Attached to this circular to the national technical regulation on labor safety for refrigeration systems.

NATIONAL TECHNICAL REGULATION on LABOR SECURITY SYSTEM for CONDITIONING National technical regulation on safe work of refrigerating system 1. General provisions 1.1. Scope 1.1.1. This regulation stipulates the requirements for the safety of people and equipment in the process of production, circulation, import, install and operate the system.
1.1.2. this Regulation applies to the system in which the solvent evaporation cooling and condensation in a closed cycle, including heat pumps and absorption systems, except the system uses water or air cooling lips.
1.1.3. this Regulation applies to the installation of new air conditioning systems, air conditioning systems are moving from positions to other operators except the air conditioning system was designed on vehicles such as cars, frozen or cold systems on ships.
This regulation also applies to cases of cold system moved from agent to agent.
1.2. The object of this Regulation applies to: 1.2.1. The organizations and individuals who manufacture, import, circulation, installation and use of the system;
1.2.2. The bodies and organizations, other individuals involved. terms explained. Air Chamber: the Chamber containing the parts of the system (for security reasons) but does not include the Chamber contains the evaporated, the condensation or pipe.

2. technical provisions 2.1. General rules: The system of conditioning in the object and scope of section 1 must ensure minimum technical characteristics according to the technical requirements of ISO 6644:1996 (ISO 5149:1993).

+ Presentation of the purpose of use of the system;
+ Description and devices along with circuit diagram for cooling and electrical diagrams;
+ Details about start and stop the machine;
+ Describing the cause and method of repairing the damaged;
+ Outlined the measures along with maintenance schedule maintenance.
+ Accurate information about refrigerants used and warnings necessary for this type of environment.

3. Regulations on labor safety management in the manufacture, import, circulation, installation and use of the system.

3.2. Conditions to ensure safety for domestic refrigeration systems: systems of conditioning in the scope of this regulation must: 3.2.1. Sufficient technical records;
3.2.2. conformity certified and announced the combination rules (according to the method of assessing the match: 8 method specified in circular No. 28/TT-BKHCN on December 12, 2012 of the Ministry of science and technology);

3.3. security conditions for imported system: 3.3.1. Cold import system to satisfy specified in section 3.1, conformity certified and announced the combination rules (according to the method of assessing the match: 8 method specified in circular No. 28/TT-BKHCN on December 12, 2012 of the Ministry of science and technology) by the specified certification organization of Vietnam or foreign certification organization recognized under international treaties to which the Socialist Republic of Vietnam is a member or international agreement to which the competent authorities of the Socialist Republic of Vietnam signed.
3.3.2. In the case of imported systems that according to bilateral agreements, multilateral between competent authorities of the Socialist Republic of Vietnam with the country exporting system specified is not checked when importing the system is free of import inspection.
3.3.3. system imported does not satisfy the provisions of Item 3.1 shall when imported to be the specified inspection organization or recognized by international treaties to which the Socialist Republic of Vietnam is a member or international agreement to which the competent authorities of the Socialist Republic of Vietnam signed the inspection at the gate to enter.
3.3.4. system imported must be inspected according to the procedures prescribed and dealt with if there is violation of the law.
3.3.5. refrigeration system only be installed when the following conditions:-there are enough technical records;
-Certified conformity, conformity announced as specified. Cold import system must have completed customs procedures;

3.3.6. Unit installation, adjustment, maintenance and repair of refrigeration system must have the following conditions:-Have legal personality, being the competent authority the registration level of business activity in this field;
-Have sufficient technical staff has been trained in specialized techniques. Having a team of skilled technical workers, training, and certification of labor safety and hygiene as specified;
-Qualified technical, technological capabilities for the installation, calibrate and repair;
-Comply with the instructions of installation, operation, use of the manufacturer and to ensure the specifications of the system according to technical records;
-On the basis of technical records, unit installation must establish the following documents to hand over to the unit using: + manual, use the secure system of conditioning before put into use;
+ Guide to maintenance mode, regular and periodic inspection;
4. technical safety inspection and registration system 4.1. The system of conditioning before putting into use must be calibrated first, periodic inspection during use, and extraordinary auditing under the auditing process by the Ministry of labor, invalids and Social Affairs.
The technical safety inspection system auditing organizations must be safety Bureau, Ministry of labor, invalids and Social Affairs specified in sequence.
4.2. In the course of the audit, the auditing organization and management unit uses refrigeration systems must adhere to strict auditing process refrigeration systems safety engineering due to the Ministry of labor, invalids and Social Affairs.
4.3. The system of conditioning after satisfactory inspection must be stamping as specified.
4.4. system control for the cold cycle is 11 years.
5. Inspect, examine and handle breach 5.1. Inspection and handling of violations in the implementation of this regulation by the State labour inspection done.
5.2. The quality control of the manufacture, import, circulation and use of the system is done according to the law on product quality, the goods.
6. The responsibilities of organizations and individuals, 6.1. Organizations and individuals on duty, import, circulation, repair installation, management and use of the system is responsible for compliance with the provisions of this regulation.
6.2. this regulation is grounds for the Agency to check the quality system conducted the inspection and also the grounds for the organizations conduct conformity assessment certificate of conformity.
7. Implementation 7.1. Industrial Safety Bureau, Ministry of labor, invalids and Social Affairs has the responsibility to guide and inspect the implementation of this regulation.
7.2. State management agencies of local workers have the responsibility to guide and inspect, examine the implementation of the provisions of this regulation.
7.3. this regulation takes effect after 6 months from the date of signing.
7.4. in the implementation process, if there are problems, the agencies, organizations, individuals concerned are responsible for timely reflection with the Ministry of labor, invalids and Social Affairs to consider resolution./.
