COMPENSATION TO FARMERS


THE EXECUTIVE BRANCH IS AUTHORIZED TO APPLY UNTIL CERTAIN AMOUNT TO THE ASSISTANCE TO THE PRODUCERS HARMED BY GALES AND HAIL THAT HAVE BEEN REGISTERED AS VICTIMS IN THE DIRECTION OF AGRONOMY OR IN THE BANK OF INSURANCE.


The Senate and the House of Representatives of the Eastern Republic of Uruguay, meeting in General Assembly,

DECREE:




Article 1 °.
Authorize the Executive Branch to apply up to the sum of $3:000,000.00 (three million pesos) of the unused surplus of the item of $20,000,000.00 (twenty million pesos) set forth by item A) Article 1 (1) of Law No 13,052, ofMay 1962, for the assistance of producers affected by gales and hail, which occurred between 1 December 1962 and 31 March 1963, in various Member States. Areas of the Departments of Canelons, Cologne, Lavalleja, Thirty-Three, Rio Black, San Jose, Flores and Montevideo, who were registered as victims in the Agronomy Directorate or the State Insurance Bank, within 30 days of the disaster.

Article 2 °.
To make the compensation for the damages, the Executive Branch shall agree with the State Insurance Bank to estimate the total damage to be paid to each injured farmer, and the supply of the necessary means with charges to the fund provided for in Article 1. The damages suffered by the farmers who have insured their crops will be compensated by supplementing the difference between the compensation paid to them by the Insurance and what they had to receive if they were not insured to what is established by this law. The amount of the allowance shall be added to the amount of the premium. In the event that the sum provided for in the said Article does not reach the total compensation for damages, the percentage to be allocated for each case shall be set, on a pro rata basis, on preferential scales for small producers. and especially for fruit growers and winegrowers.

Article 3 °.
When the damages have occurred in crops operated in sharecroceria, the amount of the compensation shall be distributed according to the respective contracts and equal parts between sharecroppers and owners when there is no written contract.

Article 4 °.
The Executive Branch shall regulate the granting of the benefits established by this law, on the basis of the information collected by the relevant technical departments of the Ministry of Livestock and Agriculture and other information of an official nature that would have been collected, and will arbitrate the means required for these benefits to reach the injured farmers.
The compensation will be made effective by the dependencies of the State Insurance Bank.

Article 5 °.
The Executive Branch will forward to the General Assembly 180 days of enactment of this law, a circumstantial relationship of the beneficiaries, establishing the amount of the compensation and the zone in who develop their activities.
