VITICULTURE
RULES ARE IN PLACE SO THAT WINEGROWERS CAN MAKE THE CREDITS BY CONCEPT OF GRAPE DELIVERIES EFFECTIVE.
The Senate and the House of Representatives of the Eastern Republic of Uruguay, meeting in General Assembly,
DECREE:
Article 1 °. The winegrowers who have sold grapes to vinify the 1967 vintage, by submitting the corresponding certificate, guide or other document that accredits the delivery, may be intimate judicially to the buyer to recognize the liquid quantity owed to them by such a concept.
Article 2 °. The debtor shall have a period of 10 days, time-bound and non-extendable, to oppose, and if it does not do so or if it accepts in whole or in part what is expressed in the intimation, the amount admitted either tacitly or expressly, shall be made by liquid and enforceable and the testimony of the proceedings shall be a title which shall be enforceable (Code of Civil Procedure, Article 874, paragraph 4).
Article 3 °. The debtor may only object to what the viticultor expressed in his intimation, alleging:
1) Error in the official price taken as a basis or error in arithmetic calculation.
2) Total or partial payment.
3 )False of the guide certificate or delivery document.
In the first case, the Judge, without further processing, will determine the figure.
In the case of the second indent, the debtor must accompany the corresponding receipts and request, in the same act, the recognition of his/her signatures.
When such signatures are recognized or have been recognized, the amount intended by the viticultor shall be deducted, the sums to be expressed by the receipts thus credited.
When the debtor objects on the grounds of falsehood, the the procedure provided for in this law will be interrupted and the Court will send all the actions to the competent court in criminal matters for the purpose of the offence of forgery being punished if the offence has been committed or the offence of slander or simulation of offence if the debtor's claim is not proven.
Article 4 °. Established a liquid and enforceable quantity, the viticultor who initiated the procedure, may request and obtain for one time, testimonial copy containing all the actions, extended by the Court with the express constancy that it is the "special testimony valid to be discounted".
Article 5 °. The Banco de la República Oriental del Uruguay will be able to discount the special testimonies described in the previous article and the Central Bank of Uruguay will be able to answer them.
consider the debtor as the bookseller of that debit document and, when the debtor is discounted, to the viticultor as his endorsement. Only the bookseller will be responsible for the payment of capital, taxes, interest and commissions.
Article 6 °. Whatever the amount of the debts, you will be competent to understand in the procedures provided for in this law, the Justice of the Peace of the debtor's domicile.
