RENTALS


THE LAUNCHES AGAINST AIRRENDATARIOS GOOD PAYERS OF FARMS ARE SUSPENDED UNTIL APRIL 30, 1968, THE EXCEPTIONS ARE FIXED AND NEW RULES ARE ESTABLISHED FOR THE FIXING OF RENTS.


The Senate and the House of Representatives of the Eastern Republic of Uruguay, meeting in General Assembly,

DECREE:




Article 1 °.
Suspend, until April 30, 1968, all launches against good-paying tenants and subtenants, of any property whatever their destination.
This suspension will only govern until the March 31, 1968, when the eviction was requested by invoking the causation of sole property in the locality.

Article 2 °.
The price of the current leases, corresponding to room-to-room estates, whose tenants or subtenants would have been covered by law N ° 13,292, of 19 October 1964, following and amending, shall be multiplied by three. This increase will be payable by halves successively from the following dates: 1 ° January 1968 and 1 ° March 1968.
Entiendase for current leases resulting from the application of the coefficients established in the (b) of Article 6 °, or of the provisions of Article 4 (3) and the following of Article 4 (3) of that Law.
For tenants or subtenants who shall cease to be allowed to comply with the laws Nos. 13.292, of 1 ° October 1964 and its carry-overs, the current price shall mean the They would have had to pay for the application of that law and of Article 12 of Law No. 13,454of 2 December 1965.

The increase will be automatically operated, within the time limits provided for in Subsection 1 °; it will be rejected indivisible with the rent and its non-payment will have the same effects as the rent itself.

In no case shall the application of the rules of this law mean the distribution of the income in force at the date of publication of the law.

Article 3 °.
If under the new price set according to the rules in the previous article, 20% (twenty percent) of the liquid monthly income of the family's occupying core is exceeded, the new rent will be lowered to the referred percentage.

For liquid monthly income, the nominal minus the corresponding legal discounts and the family core is comprised of the lessee or subtenant and his/her spouse, their ancestors, descendants and collaterals until the second degree by consanguinity or affinity that inhabit the estate.

The sixth part of the total income or liquid income received during the six months preceding the date of the reduction demand shall be considered as a monthly income.

Article 4 °.
The deadline to deduct the rent reduction action will expire on February 29, 1968. Together with the demand, the actors will have to attach an affidavit of the income of each of the members of the family nucleus.

The Judge when substantiating the claim shall decree the suspension of the payment of the increase exceeding the percentage fixed in the previous article. The defendant shall have a period of 15 days in which to reply to the application, following otherwise the procedure laid down in Articles 591 et seq. of the Code of Civil Procedure.

When false sworn statements were verified, tenant or subtenant shall be excluded from the benefits of the law and the Judge in assessing this fact in the judgment, shall declare the respective contract terminated and shall condemn the tenant or sub-entity for payment of the corresponding ones and the taxes and costs, raising the background to the Justice of Instruction, for the purposes of applying the penalty set out in Article 347 of the Penal Code.
Article 5 °.
They may not be evicted and launched until April 30, 1968, whichever procedure is used, the inhabitants of Hotels, Pensions and related, not registered in the Ministry of Transport, Communications and Tourism at 1 ° October 1967.

Article 6 °.
This law will begin to apply from December 21, 1967.
