FARM PROMOTION FUND
(FORMER GRAN 'N' N RECONSTRUCTION FUND)

MODIFY PROVISIONS THAT REGULATE

The Senate and the CA of Representatives of the Eastern Republic of Uruguay, meeting in General Assembly,

DECREE:


ArtAculoA 1Aº. -A Sustit, yese the article A 1Aº of the Law No 17,503of 30 May 2002, in the wording given by the article A 1Aº of the Law No 17,844, of 21 October 2004 and by ArcuculoA 187 of the Law No 18.172of 31 August 2007, which will be worded as follows:

" ARTACULOA 1�A (Creation).-Crate the Farm Development Fund (ex-Fund for Reconstruction and Development of the Farm) to:

1) Cancel or write down the debts that farmers producers have pending with the Bank of the Eastern Republic of Uruguay or any entity whose ownership is wholly owned by it, generated by the activity of its rotation originating before 30 June 2002; all in accordance with the provisions of the the article 8Aº of the Ley NAºA 17,844, 21 October 2004.

2) Cancel or write down the debts that farmers have pending with the Banco de Previsión Social and those originated with the Banco Mortgage del Uruguay, generated by the activity of its rotation prior to the 30th of June 2002, all in accordance with the provisions of Article 8 of the href="areuelveref.aspx?ACT, 17844/art8/HTM"> Act No. 17,844, 21 October 2004.

3) Cancel or write down the debts of farmers and cooperative producers originating in the framework of IFAD financing prior to 30 June 2002; all this in accordance with the provisions of the Article 8Aº of the Law No. 17,844, dated October 21, 2004.

4) Setting up a farm-to-farm risk management system with the following instruments:

i) Promotion of agricultural insurance for the farmer sector and risk systems shared.

ii) Financial support from farmers insurance.

iii) Reinsurance of excess Loss of insurance lines covering systemic or catastrophic events.

5) Promote a garantAas system for the farmer sector by contributing resources for funds from existing garantAa or to be created.

6) Promote integration of farmers to the agro-industrial and commercial chains, through of the following instruments:

i) Financial support with fully or partially reimbursable funds to the promotion and horizontal or vertical integration projects of the agro-industrial and commercial granjera chain.

ii) Financial support with full or partially reimbursable funds to projects that promote stable and permanent access to the external market.

iii) Financial support with total or partially repayable funds to the associative investments in Infrastructure, machinery and equipment declared in the framework of the policies and development plans of the Ministry of Livestock, Agriculture and Fisheries.

iv) Financial support with fully or partially repayable funds to the investments in irrigation infrastructure, preferably of multi-predial carA.

v) Support for organizations and their producers for training, technical assistance, feasibility and feasibility studies, institutional strengthening and technological development and innovation.

7) indemnify or fund the effects of bulk emergencies not covered by the systems of current insurance.

8) Promote a safety program food in order to ensure quality in the internal market as well as contribute to the development of eventual export markets. "

ArtAculoA 2Aº. -A Sustit, then the 8 Aº of the Law No 17,844of 21 October 2004, which shall be worded as follows:

" ARTACULOA 8Aº.-The assets of the Fund will be intended to meet the following objectives:

A) For compliance with the objective set in the numeral 1) of the 1Aº Law No. 17,503, of May 30, 2002, will be allocated up to $800,000 (eight hundred thousand dollars from the United States of America) to settle the eventual amounts of those producers who have been presented in time and how to receive the benefits of Law No. 17,844, dated October 21, 2004, agree with the Bank of the Eastern Republic of Uruguay or Bank trusts a payment formula. The amounts to be allocated will not be higher than those determined in a timely manner to these producers.

Without prejudice to the above, this Fund shall give effect to the agreements established with the abovementioned institutions which were concluded prior to the promulgation of the present law.

B) For the purpose set in the numeral 2) of the item 1Aº of the Law No 17,503, dated 30 May 2002, will be allocated:

i) Up To $2,000,000 (two million dollars from the United States of America) to deal with debts that farmers maintain with the Social Bank. In this case, only debts of employer contributions to the social security of family producers, originating before 30 June 2002, will be considered. The regulation will establish the percentages of support for debt reduction taking into account the producer's size and its economic income.

ii) Up to $1,000,000 (a million U.S. dollars) for to pay debts that farmers maintain with the Banco Hipotecario del Uruguay by the concept of rural loans, originating before 30 June 2002. It will benefit those producers who reside in the predium that generates the debt with the BHU, and provided that the production of the investment is credited. The regulation shall establish the percentages of support for debt relief taking into account the size of the producer and its economic income.

C) For compliance with the objective set in the numeral 3) of the 1Aº Law No. 17,503, of May 30, 2002, will be allocated to $1,200,000 (one hundred thousand dollars from the United States of America) for the reduction of the debts of producers or cooperatives with IFAD generated by the activity of its rotation and originated before 30 June 2002. Beneficiaries will be the producers or cooperative producers that integrate the subsectors frutAcola, hortifrutAcola, apAcola, vitAqueues, hortAqueues of primor, floriculturists, pappers, avAqueues and suinAqueues, whose total amount of debt to June 30 In 2002, it was less than $200,000 (two hundred thousand dollars from the United States of America), but served by a maximum of $150,000 (one hundred and fifty thousand dollars from the United States of America). Cooperatives in excess of that amount of debt will only be eligible for up to this level of indebtedness. They will be considered in a preferential way to the smaller producers with lower levels of indebtedness.

D) For compliance with the objective set in numalA 4) of the article A 1Aº of the Law No 17,503, of 30 May 2002, will be allocated up to 15% (15%) of the collection of Value Added Tax (VAT) on fruits, vegetables and flowers.

E) For compliance with the objective set in the numeral 5) of the article A 1Aº of the Law No 17,503, of 30 May 2002, will be allocated up to 10% (ten percent) of the VAT collection on fruits, vegetables and flowers.

F) For compliance with the objective set in the numeral 7) of the arculoA 1Aº of the Law No 17,503, dated 30 May 2002, will be allocated:

i) The available balance is not committed to 31 December 2006 of the collection of VAT on fruit, vegetables and flowers in the period from 1 June 2002 to 30 June 2005.

ii) Up to 30% (thirty percent) of VAT collection on fruits, vegetables and flowers.

iii) Uncommitted balances from VAT collection to fruits, vegetables and flowers in the period of validity of the href="areuelveref.aspx?ACT, 17844/art1/HTM"> Act No. 17,844, dated October 21, 2004, at the entry into force of this law.

iv) Budget items to be allocated.

v) Inheritance, legacies, and donations you receive.

vi) Refunds of returnable supports received by emergency-affected producers.

G) For compliance with the objectives set in numerals 6) and 8) of the artAculoA 1Aº of the Law No 17,503, dated 30 May 2002, will be allocated:

i) The balance of the VAT collection on fruits, vegetables and flowers.

ii) A part or total of the balance available not committed to the entry into force of this law, in the collection of VAT to fruits, vegetables and flowers in the period of validity of the Act No. 17,844, dated October 21, 2004.

For the purposes of compliance with the Fund's obligations, you will act accordingly set in the respective regulation, which might reassign unused items ".

ArtAculoA 3Aº. -A Suspend the first and fifth incisesA 3Aº from the Law No 17,503of 30 May 2002, with the amendments made by the Article 5Aº of the Law No 17,844, ofOctober 2004, for the following:

" The administration of the Farm Development Fund will be carried out by the Ministry of Livestock, Agriculture and Fisheries and will be executed by means of agreements between the Executive Branch, the Bank of the Eastern Republic of Uruguay, the National Development Corporation or another body designated by the Executive Branch, in the form and conditions established by the regulation. "

" The Fund's operating, administrative, and perception expenses may not exceed 1% (one percent) of the total resources available for all purposes. "
