PROVISIONS OF LAW 14.219 HAVE BEEN REPLACED WHICH AMENDED THE CURRENT SYSTEM OF LEASES.

The State Council approved the following

LAW PROJECT

Article 1 °.
Substitute the last paragraph of article 3 ° of the law on leases of urban and suburban estates enacted by the Executive Branch on July 4, 1974, by the following:

"Due to the deadlines of the leases for industry and commerce referred to in this paragraph, the landlord may request the eviction of the estate with a term of one year."

Article 2 °.
Replace Article 13 of that law, as follows:

" Article 13. The pending agreements shall be governed by the provisions of Article U.o of this Law. "

Article 3 °.
Add to the penultimate paragraph of Article 15 of the same law, the following paragraph:

"The prices of the leases which at the date of validity of this law are not twelve months old, shall be updated in accordance with the preceding rules, at the end of the twelfth month".

Article 4 °.
Modifies item 18 (3) of the same law, which will be worded as follows:

" The downgrade action does not reach the tenant, even if it has lower income than the indicated, when he or the housing unit that integrates, owns real estate of any kind, even rural, if the sum of its values Prosecutors will exceed * 5:000,000 (five million pesos). "



Article 5 °.
Modify the title of Chapter IV of the same law, which will be worded as follows:

" PREMISES FOR INDUSTRY AND COMMERCE. General rules for contracts prior to this law ".

Article 6 °.
Replace Article 21 of that law with the following:

" Article 21. Contracts for the leasing of farms for industry and commerce shall be automatically updated from the date of validity of this law on the basis of the last rent and according to the percentage of variation of the UR (Readjustable Unit, Articles 14 and 15) since the rental was in force. Except for leases with a contractual term of less than three years, which, on the basis of the current price established for the third year, shall be updated in accordance with the percentage of variation of the UR (Unit Readjustable, Articles 14 and 15) within the last 12 months of the last rental being applied "

Article 7 °.
Replace Article 22 of the same law with the following:

" Article 22. The contracts referred to in the preceding Article shall be extended within four years from the date of validity of this law, with rents which shall be updated every 12 months in accordance with the procedure referred to in Article 3, until the date of unemployment. the farm, having the lessor, at the expiration of the extension period, the right to evict a year.
Except, as regards the extension of the period, those whose contractual period is still outstanding, be more than four years, shall be governed by the parties 'agreement.'

Article 8 °.
Please modify the final paragraph of article 26 of the law, which will be worded as follows:

"The exceptions provided for in this Article and in Article 24 (4) shall not be deducted as long as there is a pending contractual period."

Article 9 °.
This law shall enter into force on 1 August 1974. The Executive Branch shall have the necessary to ensure that its publication in the "Official Journal" is carried out simultaneously to the one which, on the same subject, promulgated on 4 July 1974.
