ArtAculo 1Aº.-Declare that night work is a negative factor for the health of workers, which must be especially protected by safety and health standards at work.

ArtAculo 3Aº.-A mAnima surcharge of 20% (twenty percent) is established for the different areas of activity or equivalent in time reduction in those cases that do not have it in their salary specific or in the form of remuneration established according to the award, a percentage equal to or higher than that. When the compensation is less it shall be adjusted to the minimum set in this law. The same applies to time reduction cases. The Salaries Councils may set higher percentages than the mAnima surcharge set out above.
ArtAculo 4Aº.-The hourly surcharge or offset provided in the previous article, will only apply to the worker as the worker effectively develops the tasks in the night time for more than five hours (a) a day of work. For these purposes it is established as night work, all that is performed between the 22 hours and 6 hours of the next day. The provisions are without prejudice to the provisions of the special laws, the decrees which have approved agreements of the Councils of Salaries or the awards given in the framework of the Act No. 18,566of 11 September 2009, which may establish different time limits or more beneficial conditions for this type of work.
ArtAculo 5Aº. (Vigencia).-This standard will be applied from July 1, 2015.
