On Amendments to the Law of Ukraine "On Narcotic Drugs, Psychotropic substances and Precursors"

(Information of the Verkhovna Rada of Ukraine (VR), 2013, No. 2, pp. 9)

Verkhovna Rada of Ukraine Orders:

1. Carry to Law of Ukraine "On drugs, psychotropic substances and precursors" (Information of the Verkhovna Rada of Ukraine, 2007, No. 10, art. 89) such changes:

(1) in paragraph 17 of Article 5, part 6, article 8, part one, third and fourth article 11, parts first and second article 26, paragraph 1 of Article 32, part one of the first Article 33, the "legal person" in all differences and numbers According to the "subject of the master" in the appropriate case;

(2) In Article 7:

In part three of the words "legal entities of all forms of property", replace the words "the subjects of the household";

Part of the fifth to exclude;

(3) Paragraph 2 of the second part of Article 8, of article 8, shall be read:

" a certificate (certificate, certificate of specialist) affirms the professional suitability of a legal person ' s supervisor or a supervisor of the relevant unit of legal person, a physical person-an entrepreneur who has a license to fail medical or Veterinary practice, for employment with the circulation of drugs, psychotropic substances and precursors ";

(4) Part of the second article 9 is set out in such an editorial:

" Apart from the basis of the above Law of Ukraine "On licensing of certain types of economic activities" The basis for refusal to issue licenses for drug use, psychotropic substances, and precursors are as follows:

lack of a household subject to ensure the safety of activities on the circulation of drugs, psychotropic substances and precursors, accounting and disposal of drugs, psychotropic substances and precursors defined by the organ Licensing

The presence of a mental institution, a mental disorder associated with alcohol abuse, is established in the medical examination of or among workers of the person who is responsible for the medical examination. Drugs or psychotropic substances, or the installation of such a diagnosis of a physical person, an entrepreneur who has a license to exercise a medical or veterinary practice;

Whether or among workers of legal entity, persons recognized unfit for individual activities (work, professions, services) related to the circulation of narcotics, psychotropic substances and precursors, in order established by the Cabinet of Ministers of Ukraine, or recognition in the same manner unsuitable for the exercise of individual activities (works, professions, services) related to the circulation of narcotics, psychotropic substances and precursors, An entrepreneur who has a license to exercise medical or veterinary practice;

Whether or among workers, persons who have access directly to narcotics, psychotropic substances and precursors, who have not been removed or extinguished in the order of the crimes committed Severity, serious or especially serious crimes, or crimes involving illegal drug use, psychotropic substances and precursors, or whether not withdrawn or repaid in the prescribed order for committing such crimes physical person-an entrepreneur who has a license to exercise medical or veterinary care practices ";

(5) Part 3 of Article 21 complements the sentence of such content: "Individuals-entrepreneurs who have a license to fail medical practice, undertake activities to acquire, transport, storage, waste, use and destruction of narcotics." Psychotropic substances included in tables II and III Perelics, and precursors included in the EV to the Perilic table, in the presence of a licence to carry out the relevant activities on the circulation of narcotics, psychotropic substances and precursors in the the order established by the Cabinet of Ministers of Ukraine ";

(6) Article 23 is supplemented by part of the third such content:

" Physical persons-entrepreneurs who have a license to fail the veterinary practice, carry out activities on the application of drugs, psychotropic substances and precursors, listed in part one of this article, and related to it. acquisition, transport, storage, waste, use and destruction of drugs, psychotropic substances for the availability of appropriate activities on drug use, psychotropic substances and precursors in order; The Cabinet of Ministers of Ukraine ";

(7) In part of the first article 25, the words "legal entities of all forms of property" would be replaced by "the subjects of the household";

(8) Part of the third article 31 is set out in such an editorial:

"The bodies of the executive branch within their authority control the activities of the household entities on the circulation of narcotics, psychotropic substances and precursors";

(9) The first sentence of Article 34 shall be supplemented with the words "and in the journals of the individuals-entrepreneurs who have a licence to perform activities on the circulation of drugs, psychotropic substances and precursors-directly such a person".

2. This Act will take effect two months from the day of its publication.
