About the principles of a state regional policy

(Information of the Verkhovna Rada (VR), 2015, No. 13, pp. 90)

This Act defines basic legal, economic, social, environmental, humanitarian and organizational institutions of state regional policy as part of the domestic policy of Ukraine.

Section I
GENERAL PROVISIONS

Article 1. Term Definition

1. In this Act, the following terms are used in this respect:

(1) State regional policy-a system of purposes, measures, means and concerted actions of the central and local executive bodies, local governments and their officials to ensure a high level of quality of life of people throughout The territory of Ukraine is subject to natural, historical, ecological, economic, geographical, demographic and other features of the regions, their ethnic and cultural identity;

2) The macroregion is part of the territory of Ukraine within several regions or parts united by the common signs inherent in common development issues within which special regional development programmes are implemented;

(3) The microregion is part of the territory of the region characterized by the territorial integrity and development features, within which special regional development projects are implemented;

4) monitoring and evaluating the performance of state regional policy-periodic tracking of relevant indicators on the basis of official statistics and information of the central executive bodies, local authorities The self-government and conduct on the basis of monitoring the performance assessment of the performance of the indicators by comparing the resulting results to their target values;

9) medium-and long-term planning-a function of public administration on the election of priorities, definition based on the available resource goals and areas of development, development and execution of interrelated tasks and measures of socio-economic development in the mid-(from three to five years) and long-term (over five years) periods.

Article 2. The goal of the state regional policy

1. The goal of state regional policy is to create conditions for the dynamic, balanced development of Ukraine and its regions, ensuring their social and economic unity, raising the level of living of the population, holding the guaranteed state of standards for each citizen regardless of their place of residence.

Article 3. Principles of State Regional Policy

1. State regional policies are implemented based on the following principles:

(1) legality-compliance The Constitution and laws of Ukraine, international treaties, consent to the duties provided by the Verkhovna Rada of Ukraine;

2) Cooperation-reconciliation of targets, priorities, tasks, measures and actions of the central and local executive bodies, the Supreme Council of the Autonomous Republic of Crimea, the Executive authorities of the Autonomous Republic of Crimea, local government bodies, To provide cooperation between them during the formation and implementation of public regional policies;

(3) parity-ensuring equal opportunities for the access of regional policy facilities to the resources of public financial support for regional development;

4) openness is ensuring free access to information that defines state regional policy and is at the disposal of the bodies of state power, the Supreme Council of the Autonomous Republic of Crimea, the Executive authorities of the Autonomous Republic of Crimea and Local government;

(5) subsidiarity-the transfer of power to the lowest level of management for the most effective implementation;

(6) Coordination-relationships and coherence of long-term strategies, plans and development programmes at the state, regional and local levels;

(7) Unification-ensuring spatial, political, economic, social, humanitarian integrity of Ukraine;

8) the historical continuity-the accounting and preservation of the positive superbanks of the previous development of the regions;

9) Ethnocultural development-the revival of ethnic self-consciousness and the preservation of the spiritual and material culture of ethnicities, promoting the development of their ethnic, cultural, linguistic and religious identity;

10) Sustainable development-Society development to meet the needs of the current generation with regard to the interests of future generations;

(11) Objectivity is the development of all documents defining state regional policy, based on real indicators, which are actually to be achieved and which can be evaluated.

Article 4. Entities and Subjects of State Regional Policy

1. The object of public regional policy is the territory of regions, macroregions, and microregions.

The objects of the state regional policy can be groups of regions (or parts), towns, villages, villages, united by criteria and in the order established by the Cabinet of Ministers of Ukraine.

2. The subjects of the state regional policy are the President of Ukraine, the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, the Supreme Council of the Autonomous Republic of Crimea, the Council of Ministers of the Autonomous Republic of Crimea, the central and local bodies of the executive, organs of local government, their officials.

In the development and implementation of the State Regional Policy, associations and other associations of local government, public unions, legal and physical persons are involved.

Article 5. Legislation on Public Regional Policy

1. The public regional policy legislation consists of Constitution of Ukraine laws of Ukraine "On the principles of domestic and foreign policy" , "On the stimulus of the development of the regions" , "Local Government in Ukraine". , "Local Government Administration". , "On transboundary cooperation" , "About the Regulation of Urban Activities" , "Public Service Programs". , "On state forecasting and development of economic and social development programmes of Ukraine" , "About the General Plan of the Planning of the Territory of Ukraine" The Law and other laws of Ukraine, the acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, as well as international treaties of Ukraine, consent to the duties provided by the Verkhovna Rada of Ukraine.

2. If the International Treaty of Ukraine, which has taken effect in the established order, has established other rules than those envisaged by this Act, the rules of the international treaty apply.

Article 6. Priorities of the state regional policy

1. The Priorittes of the State Regional Policy are:

1) to stimulate and support local initiatives on the effective use of the internal capacity of regions to create and maintain a full life environment, improving the quality of life of people;

2) Reducing territorial differentiation by the regional human development index;

(3) The formation of competitiveness of regions by elaborating and implementing programs and projects to increase the competitiveness of territories;

4) stimulating inter-regional integration, integration of regional economic, information, educational spaces into a single nationwide space, to overcome interregional alienation;

(5) The determination of problematic areas in the regions and implementation of public measures to address issues;

(6) Establishment of an effective environmental protection system by taking into account the environmental component in the strategies of regional development, evaluation, alignment and reduction of the technology and environmental burden on the environment in the regions;

7) the introduction of the effective instruments of state support for interregional integration, the execution of interregional programs and projects;

(8) The formation of documents of the Council of Europe and the European Union of the regulatory framework needed to implement the state regional policy defined by this Act;

9) improving the tangible, financial, information, staffing and other resource development of the regions, facilitating the exercise of local self-government authorities;

10) To create effective mechanisms of representation of the interests of regions on the national level and territorial communities-at the regional level.

Chapter II
FORMATION AND IMPLEMENTATION OF THE STATE REGIONAL POLICY

Article 7. Documents defining state regional policy

1. The realization of public regional policy is carried out on the basis of a system of interrelated documents based on the Strategy of the Development of Ukraine, General scheme of planning for the territory of Ukraine , area planning schemes at the regional and local levels.

2. To documents that determine the state regional policy include:

1) State strategy for regional development of Ukraine;

2. Plan of measures to implement the State Strategy for Regional Development of Ukraine;

(3) Regional development strategies;

4) plans to implement regional development strategies;

(5) Investment programs (projects) aimed at developing regions.

3. The development of documents defining state regional policy is carried out by the priorities of the state regional policy defined by this Act, and the state forecasting and strategic planning documents. Legislation.

Article 8. State Strategy for Regional Development of Ukraine

1. The State Strategy for Regional Development of Ukraine is developed for a period of seven years and approved by the Cabinet of Ministers of Ukraine.

2. The development of the State Strategy for Regional Development of Ukraine provides a central executive body providing the formation of state regional policy, in Order established by the Cabinet of Ministers of Ukraine.

3. The State Strategy for Regional Development of Ukraine shall determine:

1) trends and major issues of socioeconomic development of regions;

2. To prioritize public regional policy on the appropriate period;

(3) Strategic goals and areas of regional development and inter-regional cooperation;

(4) Operational goals to ensure the achievement of strategic objectives;

5) the main tasks, stages and mechanisms of their implementation;

6) the monitoring and evaluation system implementation of the State Strategy for Regional Development of Ukraine.

4. The Central Executive Body, providing the formation of public regional policy, with the aim of taking into account the State Strategy for Regional Development of Ukraine's regional development interests:

1) reports through the media about the beginning of work on the project of the State Strategy for Regional Development of Ukraine and defines for the subjects of regional development of the term and form of submission of proposals;

(2) To carry out (if necessary) consultation with the subjects of regional development to reconcile the positions;

3) promulgates the report on the results of the proposals for the subjects of regional development to the project of the State Strategy for Regional Development of Ukraine.

5. The implementation of the State Strategy for Regional Development of Ukraine is carried out in two stages by developing and executing the Plan of Measures to implement the State Strategy for Regional Development of Ukraine.

6. The Central Executive Body, which ensures the formation of public regional policy, monitors the implementation of the State Strategy for Regional Development of Ukraine and three years after its implementation is provided by the Cabinet of Ministers Ukraine's demand for adjustment (if necessary) its tasks and measures, and the continuation of the period of action.

After the end of the State Strategy for Regional Development of Ukraine the central executive body, which ensures the formation of a state regional policy, prepares a summary report of its execution.

Article 9. Plan of measures to implement the State Strategy for Regional Development of Ukraine

1. Plan of measures to implement the State Strategy for Regional Development of Ukraine is being developed on the implementation of the State Strategy for Regional Development of Ukraine and approved by the Cabinet of Ministers of Ukraine.

The plan for implementation of the State Strategy for Regional Development of Ukraine is being developed for three years and the next four years of the State Strategy for Regional Development of Ukraine.

Development of the Plan of Measures to implement the State Strategy for Regional Development of Ukraine exercises the central body of the executive branch providing the formation of state regional policy, jointly with other central executive bodies in the Order established by the Cabinet of Ministers of Ukraine.

3. The Plan of Measures to implement the State Strategy for Regional Development of Ukraine involves the task and measures, volumes and sources of their funding to determine indicators of assessing the performance of their performance.

Article 10. Regional development strategies

1. Regional development strategies are developed during the State Strategy for Regional Development of Ukraine in Order determined by the Cabinet of Ministers of Ukraine.

2. Regional development strategies and changes are approved by the Supreme Council of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city councils.

3. The development of regional development strategies and changes is provided by the Council of Ministers of the Autonomous Republic of Crimea, regional, Kyiv and Sevastopol city government administrations.

4. Regional development strategies should meet the position of the State Strategy for Regional Development of Ukraine and to determine:

1) trends and major issues of socioeconomic development of the Autonomous Republic of Crimea, areas, cities of Kyiv and Sevastopol;

(2) Strategic goals, priorities for the development of the region for the appropriate period;

(3) Operational goals to ensure the achievement of strategic objectives;

4) the main tasks, stages and mechanisms of their implementation;

5) the monitoring system and appraisal of the performance implementation of a regional development strategy.

5. The development of regional development strategies is carried out with regard to the development strategies of cities, villages and villages, the primary development of depressed areas, strategic priorities for the development of the area.

6. Council of Ministers of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city government administrations:

1) report via media about the start of work on a draft regional development strategy and define for the subjects of regional development of the term and the form of submission of proposals;

(2) hold (if necessary) consultation with the subjects of regional development to harmonise positions;

3) publicize the report on the results of regional development entities ' proposals to a regional development strategy project.

7. Realization of regional development strategies is implemented by elaborating and executing plans to implement regional development strategies that are concrete in the programs of economic and social development of the Autonomous Republic of Crimea, areas, districts, cities.

Article 11. Plan for implementation of regional development strategy

1. The development of regional development strategy measures shall be carried out by the Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city governments on the implementation of regional development strategies in Order determined by the Cabinet of Ministers of Ukraine.

Plans to implement regional development strategies are being developed for three years and over the next four years of the regional development strategies.

2. Plans to implement regional development strategies are approved by the Supreme Council of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city councils.

Chapter III
POWERS OF STATE OF STATE REGIONAL POLICY

Article 12. Powers of the Cabinet of Ministers of Ukraine in the field of state regional policy

1. The Cabinet of Ministers of Ukraine in the field of state regional policy provides:

1) to develop and execute public programs aimed at developing regions;

2) approval of the State Strategy for Regional Development of Ukraine, a plan for measures to implement it;

3) to develop and make in the established order of agreements on regional development;

(4) Definition of the order of preparation, evaluation and selection of programmes and projects that can be implemented by funds of the state fund of regional development, and order of the use of specified funds;

(5) To approve a list of programmes and projects of regional development, implementing the funds of the State Fund for Regional Development;

6) identify the order of elaboration and the approval of the State Strategy for Regional Development of Ukraine and the Plan of Measures to implement, as well as regional development strategies and plans to implement their implementation;

7) defining the order of coordination of the actions of the executive authorities to ensure the formation and implementation of public regional policies;

(8) Approval Order and methodical Monitoring and assessing the performance of the State Regional Policy and the list of indicators of such monitoring;

9) direct and coordinate the activities of the central and local executive authorities on the formation and implementation of public regional policies;

10) to review reports on monitoring and assessing the performance of the State Regional Policy;

11) exercise other powers in the field of regional policies defined Constitution and the laws of Ukraine.

Article 13. Powers of the central executive bodies in the field of state regional policy

1. To the authority of the central authority of the executive branch providing the formation of the state regional policy, the following are the following:

(1) Preparation and amendment of the order of legislation on public regional policy;

(2) Preparation and amendment of the Cabinet of Ministers of Ukraine proposals on the reconciliation of targets, priorities, tasks and measures of the central and local executive bodies, the Executive authorities of the Autonomous Republic of Crimea, local authorities Self-governance during the development and execution of documents relating to the formation and implementation of public regional policies, monitoring and evaluation of the performance of the tasks provided;

3) to ensure coordination of the activities of the central and local executive bodies on the formation of public regional policies;

4) to develop jointly with other central and local executive bodies, all-Ukrainian associations of local self-government bodies of the State Strategy for Regional Development of Ukraine;

(5) Preparation jointly with other central and local executive bodies and contributions to the Cabinet of Ministers of Ukraine Plan of measures to implement the State Strategy for Regional Development of Ukraine;

(6) Organizing and methodical implementation of projects of regional development strategies and plans to implement their implementation;

7) assessment and selection of programs and projects, including investment programs (projects), implementing the funds of the state fund for regional development, representation according to the legislation of relevant Cabinet proposals Ukraine;

8) participate in cooperation with international financial organizations, programs and foundations in the field of public regional policy, the use of appropriate resources of international technical assistance;

9) conducting monitoring and evaluation of the implementation of the State Strategy for Regional Development of Ukraine, the plan of measures to implement and other programmes and projects of regional development, preparation and submission of relevant Cabinet reports Ministers of Ukraine;

10) to carry out other defined law and order it in the established order of authority on the formation of a state regional policy.

2. To the authority of the central executive body implementing the state regional policy, the following are the following:

1) implementation jointly with other central and local executive bodies of the State Strategy for Regional Development of Ukraine;

2) to ensure coordination of the activities of the central and local executive bodies on the implementation of public regional policies;

(3) To stimulate the participation of regions in programs and projects for the development of inter-regional and transboundary cooperation;

4) to carry out other established law and order it in the established order of authority on the implementation of the State Regional Policy.

3. The powers of the public regional policy of other central executive bodies are determined by the Constitution and the laws of Ukraine and rely on them the Cabinet of Ministers of Ukraine.

Article 14. The powers of the Supreme Council of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city councils in the field of state regional policy

1. To the authority of the Supreme Council of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city councils in the sphere of state regional policy include:

(1) Initiating the development and approval of regional development strategies and plans to implement their implementation;

2) to provide an account of the interests of territorial communities in regional development strategies and plans to implement their implementation;

(3) Approval of reports on monitoring and assessing the performance implementation of regional development strategies and plans to implement them;

4) The pursuit of the project of the State Strategy for Regional Development of Ukraine;

(5) the exercise of other powers defined by the law.

Article 15. The powers of the Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations in the sphere of state regional policy

1. To the mandate of the Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city administrations in the sphere of state regional policy include:

1) to ensure in the appropriate region of implementation of the state regional policy;

2) The pursuit of the project of the State Strategy for Regional Development of Ukraine;

3) to provide development of regional development strategies and plans to implement them;

4) preparation and representation in accordance with legislation to the central executive body implementing state regional policy, proposals for programs and regional development projects that can be implemented through state funds. Regional Development Fund;

5) conducting monitoring and assessment of the implementation of regional development strategies and plans to implement their implementation, preparation and submission of reports on approval by the Supreme Council of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol City Council;

Article 16. Powers of district, urban, village, rural councils in the field of state regional policy

Article 17. Coordinating the activities of the executive authorities and local governments to ensure the formation and implementation of public regional policy

Article 18. Inter-Agency Coordination Commission for Regional Development

1. Article 19. Regional Development Agency

1. With the goal of effective implementation of state regional policy to the Supreme Council of the Autonomous Republic of Crimea and the Council of Ministers of the Autonomous Republic of Crimea, regional, Kiev, Sevastopol city councils and relevant public administrations can establish Regional Development Agency.

Co-founders of regional development agencies can also be regional trade-industrial houses, regional entrepreneurs associations, regional offices of all-Ukrainian associations of local self-government or association of organs local government of the region, higher education institutions, scientific institutions, profile public associations of the region.

2. The Regional Development Agency is a non-profit institution formed on the basis of a partnership between the public, private and public sectors, employers ' organizations and their associations based on this Act and other laws of Ukraine.

The Regional Development Agency cannot be a budget institution.

3. The structure, the order of activity and the authority of the management of the regional development agency is defined by the legislation of Ukraine and the position to be responsible for the model of regional development agencies.

A typical position on the regional development agency is approved by the Cabinet of Ministers of Ukraine.

Chapter IV
FINANCIAL SUPPORT FOR PUBLIC REGIONAL POLICY

Article 20. Mechanisms for funding the public regional policy

1. Financial enforcement of public regional policy is carried out in accordance with Budget and Tax Codes of Ukraine.

2. The policy of financing of the state regional policy is:

(1) Interbudget transfers from the state budget to local budgets;

(2) Union on the contractual basis of the financial resources of the entities of regional policy, public and private partners on the principles of implementation of public-private partnerships, international institutions;

3. Capital expenditures of the state budget;

(4) government target programs, including programs to overcome the depressive territories;

(5) Agreements on regional development;

6) programs and activities, including investment programs (projects) implemented by funds of the state fund of regional development.

Article 21. Sources of funding of the state regional policy

1. Sources of funding of public regional policies are:

1) funds of the State Budget of Ukraine, including the State Fund for Regional Development;

(2) Local budget funds;

(3) Charity contributions;

(4) The funds of international organizations;

5) funds from other sources not prohibited by legislation.

Article 22. Funding for the state fund for regional development

1. Funding for regional development through regional development fund funds can be carried out on the terms of investing, on the terms of providing safeguards, on an irrevocable basis in the form of grants.

2. The financing of regional development is based on the following principles:

1) according to the State Strategy for Regional Development of Ukraine, the relevant regional development strategy and measures of measures to implement them;

(2) The competitive selection of regional development programmes (projects);

(3) Effectiveness of the use of involved resources;

4) the capacity of facilities and entities, funded by the State Fund for Regional Development, alone to provide further funding or to refrain from the funds of local budgets;

5) an adequate financial and other participation of local government bodies, in the territory of jurisdiction or in the interest of which the relevant measures are implemented, programs or projects;

6) the unbiased distribution of funds of the state fund of regional development with regard to the level of socio-economic development of administrative and territorial units.

3. State support for regional development through the funds of the State Budget of Ukraine, in particular the funds of the State Fund for Regional Development, is carried out in accordance with Budget Code of Ukraine .

Section V
MONITORING THE IMPLEMENTATION OF PUBLIC REGIONAL POLICY

Article 23. Monitoring the implementation of public regional policy

1. Monitoring the implementation of public regional policies is carried out by establishing a list of relevant indicators, tracking their dynamics, preparation and publishing of the results of such monitoring.

In order to ensure the monitoring of documents defining state regional policy is specified in Part 2 Article 7 of this Act must contain the relevant indicators of achievement of the goals that are possible to assess.

2. A list of indicators is determined by the methodology for monitoring the implementation of the state regional policy, which is approved by the Cabinet of Ministers of Ukraine.

3. Monitoring the implementation of the State Strategy for Regional Development of Ukraine and the Plan of Measures to implement the implementation and analysis of indicators characterizing the implementation of the State Strategy for Regional Development of Ukraine, at Based on official statistical data and information of the central executive authorities.

4. Evaluation of the performance of the State Strategy for Regional Development of Ukraine and the Plan of Action to implement its implementation by periodic tracking, measurement and comparison of actual results with indicators of achievement and priorities, defined by the State Strategy for Regional Development of Ukraine and the Plan of Measures to implement it.

5. Monitoring and evaluation of the implementation of the State Strategy for Regional Development of Ukraine and the Plan of Measures to be implemented annually by the central body of the executive branch, providing the formation of state regional policy, with The involvement of public associations and scientific institutions.

Order Monitoring and evaluating the performance of the State Strategy for Regional Development of Ukraine and the plan of measures to implement its implementation is determined by the Cabinet of Ministers of Ukraine.

6. Monitoring and evaluation of the implementation of regional development strategies and plans to implement their implementation every year under the Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city governments. Administrations.

The results of the monitoring and evaluation of the performance are subject to the public and are taken into account in the reports of the annual programs of the economic and social development of the regions.

Reports on monitoring and assessment of the implementation of regional development strategies and plans for the implementation of their implementation are presented in the established order of the Council of Ministers of the Autonomous Republic of Crimea, the region, Kiev and Sevastopol city state administrations for approval by the Supreme Council of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city councils.

Approved reports on monitoring and assessment of the implementation of regional development strategies and plans of measures to implement their implementation are served by the Council of Ministers of the Autonomous Republic of Crimea, Cloud, Kiev and Sevastopol City Council. Government administrations to the central executive branch, which ensures the formation of a state regional policy.

Order Monitoring and evaluating the performance implementation of regional development strategies and plans for measures to be approved by the Cabinet of Ministers of Ukraine.

7. The Central Executive Body, providing the formation of a state regional policy, delivers the Cabinet of Ministers of Ukraine relevant reports in a manner defined by the Cabinet of Ministers of Ukraine.

Chapter VI
FINAL POSITIONS

1. This Act will take effect from the day, the following day by the day of its publication.

2. The Cabinet of Ministers of Ukraine for six months since the Act:

(1) To submit to the Verkhovna Rada of Ukraine to consider amendments to the legislative acts of Ukraine that derive from this Act;

(2) To bring their legal and legal acts into compliance with the Act;

(3) To ensure the revision and adhement of ministries and other central and local authorities and the executive authorities of their regulations in compliance with the Act.
