About chemical safety (Gazette of the Mejlis of Turkmenistan, 2011, no. 1, art. 9) this law determines the legal framework for the protection from the harmful effects of chemistry to life, health and environment Wednesday, use of chemicals for economic, social and other development, work with them to ensure the rights of consumers, as well as the legitimate interests of States relating to activities in the field of chemistry.

7) period of vital activity of chemical products − time of production, use, storage, transportation, sale, destruction and disposal of chemical products;
8) chemical weapons − toxic chemicals and their precursors, which can be used to manufacture munitions and any other devices specifically designed to cause death or other harm due to their toxic properties;
9) a dangerous chemical − a chemical or combination of chemicals capable of causing harm to human life and health and the environment Wednesday;

Article 2. Turkmen legislation on chemical safety 1. Turkmen legislation on chemical safety is based on the Constitution and consists of this law and other normative legal acts of Turkmenistan.
2. If an international treaty to which Turkmenistan stipulates other rules than those stipulated by this law, the provisions of the international treaty shall apply.
 
Article 3. The scope of this law 1. This law determines the legal framework for the protection of life, human health and the environment from the harmful effects of chemistry Wednesday, working with chemicals, registered in the established order and the public accounting, economic, research, medical and other sectors not prohibited by law, other activities, protection of consumers ' rights in the field of household chemicals and other chemical products, as well as ensure public interests connected with the implementation of the chemical works.

Chapter II. The principles and MEASURES TO ENSURE CHEMICAL SAFETY Article 4. Basic principles of chemical safety 1. Turkmenistan's State policy in the field of chemical safety, based on the fulfilment of international obligations, prohibits the following: 1) development, manufacture or otherwise acquire chemical weapons, their accumulation, storage or transfer to anyone, directly or indirectly, by the way, transit through the territory of Turkmenistan;

Article 5. Measures to ensure chemical safety in Turkmenistan chemical safety is ensured by the implementation of the following activities: 1) holding a set of measures of educational, educational, legal, organizational, technological, engineering, technical, sanitary, medical and preventive nature;
2) implementing measures to comply with the rules, norms and standards in the field of chemical safety, public institutions, public associations, other legal entities and physical persons;
3) systematic conduct of complex of actions on environmental, health, social assessment of chemically dangerous objects that store dangerous chemicals, taking into account their possible impact on the status of the territories;
4) holding a set of measures of organizational and technical measures to prevent accidents on chemically hazardous objects, aimed at decreasing the level of possible damage and losses, identifying and eliminating the causes of the accident with consideration of timely prevention of proliferation and the Elimination of the possible consequences of accidents;
5) creation of dispatching services on dangerous chemical facilities, as well as automated chemical contamination control services;
6) execution of State control over the importation of hazardous chemicals and their precursors, including dual-use chemicals, as well as the associated technical and chemical processing equipment on the territory of Turkmenistan, their export and transit;
7) permanent informing of the population on measures to ensure chemical safety;
8) conducting special training for action in the field of chemical safety.
 
Chapter III. The AUTHORITY of STATE BODIES in the field of chemical safety Article 6. The powers of the Cabinet of Ministers of Turkmenistan in the field of chemical safety, the Cabinet of Ministers of Turkmenistan in the area of chemical safety: 1) defines the main directions of State policy;
2) adopts regulations, government programs, funding them and supervises their implementation;
3) organizes State monitoring of chemical safety and conducts its accounting;
4) conducts public policies aimed at stimulating economic activity of legal entities and individuals on chemical safety;
5) creates a uniform system of bodies of State authority and administration, establishes the authorized departmental and interdepartmental governance bodies, State supervision and control (hereinafter referred to as departments), coordinates their activities clearly defines their tasks, relationships, ensures their functioning;
6) defines and approves the list of hazardous chemicals not prohibited to use, and the procedure for maintenance of the State Register of hazardous chemicals;
7) claims to conduct accounting and reporting on its chemical product distribution in the prescribed manner to the group, a list of chemical products subject to control;
8) assists in the reliable work of relevant services and organizations in case of a chemical accident or threat of danger of its occurrence, in accordance with the established procedure provides for the collection and exchange of information, conducts organizational and technical activities in a timely manner notifies the according to population issues;

9) provides assistance to the population in the territories subjected to chemical contamination, facilitates chemical studies and introduces a special regime for the population in these areas;
10) organizes rescue, rehabilitation and other urgent works;
11) approves the deployment in the territory of Turkmenistan of enterprises carrying out works and services related to the production, use, recycling, destruction, transport, storage, stowage of dangerous chemicals, equipment repairs and servicing (hereinafter referred to as "enterprises that perform work with dangerous chemicals);
12) establishes rules for import, export and transit of hazardous chemicals in Turkmenistan and monitors their observance;
13) sets the size of supplementary payments for special risks associated with causing harm to people's health as a result of chemical exposure;
14) is an international cooperation of Turkmenistan;
15) performs other tasks within its competence.
 
Article 7. The competence of the local authorities and local self-government bodies in the field of chemical safety, local authorities and local self-governance bodies in the area of chemical safety: 1) are involved in the implementation of government programs;
2) provide a set of legal, institutional, technical, sanitary, medical, educational, educational nature on the territory concerned;
3) are involved in matters of accommodation enterprises, carrying out work with dangerous chemicals in its territory;
4) participate in the environmental assessment of project design enterprise performing work with dangerous chemicals in their territories;

8) provide training and maintenance status of necessary forces and means to protect the population and territory against chemical accidents, teach the population protection methods and actions in these cases;

10) provide conditions for the protection of the rights of the people and respect the interests of the State in the field of chemical safety;
11) organize and conduct rescue and other urgent work, maintain public order during these operations;
12) provide measures on liquidation of consequences of chemical accidents in the territory concerned;
13) perform other tasks falling within their competence.
 
Article 8. The powers of the agencies in the field of chemical safety in the field of chemical safety: 1) participate in the formulation of public policies and public programs and implement them;

11) organize and conduct activities for the Elimination of the chemical accident and its consequences;

13) provide training and protection methods of population actions when a chemical accident;

16) perform other tasks falling within their competence.
 
Chapter IV. The OFFICE of chemical safety and the PROVISION of MONITORING HER CONDITION of Article 9. System of bodies engaged in ensuring chemical safety 1. Public administration, State supervision and control in the field of chemical safety is carried out by the Cabinet of Ministers of Turkmenistan, departments and local authorities and local self-government.

Article 12. Implementation of works and services related to hazardous chemicals works and services related to the production, use, recycling, destruction, transporting, storing, warehousing, repairs or maintenance are carried out by specially authorized persons in the manner prescribed by the legislation of Turkmenistan.
 
Article 13. Production control in the field of chemical safety 1. Production control in the field of chemical safety is carried out in enterprises that perform work with dangerous chemicals.
2. procedure of production control is determined separately for each company performing work with dangerous chemicals, taking into account the characteristics and circumstances of work performed and is consistent with the authorized State bodies.

4. the official carrying out the production control, in case of detection of violations of rules of chemical safety in enterprises that perform work with dangerous chemicals to chemically dangerous objects has the right to suspend or prohibit work with dangerous chemicals to eliminate the violations.
 
Article 14. The participation of NGOs in ensuring chemical safety associations carry out monitoring of implementation rules and norms in the field of chemical safety in the manner prescribed by the legislation of Turkmenistan.
 
Chapter v. requirements for CHEMICAL SAFETY Article 15. Chemical safety assessment 1. 7) number of people and animals exposed to hazardous chemicals;

3. the results of the assessment of the State of chemical safety are registered in the order established by the legislation of Turkmenistan.
 
Article 16. Basic requirements to work with hazardous chemicals Enterprises, carrying out work with hazardous chemicals, shall:

1) comply with the requirements of the legislation of Turkmenistan in the field of chemical safety, the relevant rules, regulations, standards and regulations;
2) plan and implement activities on chemical safety;
3) to carry out systematic production control in the workplace, in premises on the territory of enterprises, industrial sites, sanitary-protective zones and control as well as for waste and garbage, hazardous chemicals;
4) accounting degree chemical poisoning workers and monitor them;
5) provide training and certification on chemical safety executives, performers and production control technicians, other workers directly doing permanent or temporary work with dangerous chemicals;
6) organize preliminary (at entry) and systematic medical examinations of workers;
7) regularly inform employees about the extent and amount of accumulation of dangerous chemicals and the degree of poisoning directly at the workplace;
8) to inform State authorities about emergency situations, technological violations endangering chemical safety on the importation of products containing hazardous chemicals in excess of the permissible limit;
9) comply with regulations, orders, instructions and conclusions of bodies exercising public administration, State supervision and control in the field of chemical safety, their officials;
10) ensure the existence and operation of the necessary devices and systems for controlling the production processes and labour operations employees, in accordance with the established requirements;
11) to prevent penetration of chemically dangerous objects by unauthorized persons;
12) enforce security requirements when storing dangerous chemicals;
13) to suspend the operation of the hazardous production facility on its own or as prescribed by authorized State bodies and their officials in case of an accident or incident, as well as in case of detection of newly discovered circumstances, influence on chemical safety;
14) to carry out activities for the study and elimination of consequences of the accident at the chemically dangerous objects to assist public authorities in investigating the causes of the accident;
15) to participate in the technical investigation into the causes of chemical accidents, implement measures to eliminate these causes and the prevention of accidents;
16) to create and store personal protective equipment at the place of residence of the employees in a State of readiness for use during chemical accident;
17) prepare protective objects of civil defence and industrial buildings to protect workers from hazardous chemicals;
18) to work on the chemical safety of new products and other raw materials, technological processes and productions;
19) ensure the rights of citizens in the field of chemical safety.
 
Article 17. Ensure chemical safety in the production of foodstuffs and food raw materials consumption of drinking water, food, drinking water and come into contact with them in the process of manufacture, storage, transportation and sale of items and products must meet the requirements for chemical safety and production are subject to monitoring in accordance with the legislation of Turkmenistan.

Article 22. Monitoring and accounting of maximum permissible concentration of hazardous chemicals control and accounting of maximum allowable degree of concentration of dangerous chemicals, as well as those affected by exposure to hazardous chemicals when conducting medical procedures are carried out within the framework of a unified State accounting and control systems the permissible concentrations of hazardous chemicals, created in accordance with the procedure determined by the Cabinet of Ministers of Turkmenistan.
 
Chapter VI. ENSURING CHEMICAL SAFETY CHEMICAL ACCIDENT Article 23. Measures to protect the population and workers at a chemical accident Enterprises carrying out work with dangerous chemicals, which may experience a chemical accident by release of dangerous chemicals, in accordance with the legislation of Turkmenistan shall: 1) plan and implement activities for the prevention, containment and elimination of consequences of accidents;
2) in consultation with the public authorities to plan and implement measures to protect the population and workers against a chemical accident and its consequences;
3) to prepare the necessary requirements for public notification and chemical prediction of accidents and their consequences, decision-making in the event of a chemical accident and a list of possible chemical accidents;
4) conclude co-operation agreements with specially generated during chemical accident for rescue services, create in the prescribed manner of emergency rescue team, consisting of employees of the enterprise;
5) create reserves funding and material resources for localization and elimination of the consequences of a chemical accident in accordance with the legislation of Turkmenistan;
6) train employees order action, regulation of use of special means of individual and collective defence in the event of an accident on chemically hazardous objects, as well as the Elimination of the consequences of a chemical accident;
7) create a system of monitoring, alerting, communications and support, and contain them in a condition suitable for use during chemical accident;
8) to prevent damage when chemical accident, prepare the necessary medicines to provide medical assistance to the victims.
 
Article 24. Duties of officials on chemical safety in chemical accident in case of a chemical accident, officials of enterprises, carrying out work with dangerous chemicals shall: 1) ensure the implementation of measures to protect workers, the public and the environment Wednesday from a chemical accident and its consequences;
2) immediately inform about a chemical accident relevant government authorities and the people of the territories, which may impact chemical contamination;
3) take measures to provide medical assistance to the victims of the chemical accident;
4) to localize a hotbed of chemical contamination and prevent the spread of dangerous chemicals in the environment Wednesday;
5) analyse and prepare information about the forecast of development of the chemical accidents and chemical change of the situation when it occurs;
6) take measures to normalize chemical situation on the territory of the enterprise after the Elimination of a chemical accident.
 
Article 25. Forces and resources involved to cope with chemical accidents 1. In attracting people to eliminate the consequences of a chemical accident, rescue, decontamination and disinfection of the number of people attracted to this work must be attributed to solely by the need to save lives and protect against chemical influence more people.
2. Attracting people to eliminate the consequences of chemical accidents is allowed only with their consent and their preliminary report on the possible hazardous chemical exposure and risk their lives and health.

Chapter VII. Essential requirements for the safety of CHEMICAL PRODUCTS Article 26. Classification of chemical products 1. With a view to taking appropriate measures to ensure the protection of life, human health and the environment Wednesday chemical products shall be classified in accordance with the requirements of existing standards and normative documents. Classification of chemical products is carried out by hazard and groups (categories) of chemicals.

Article 27. Accounting of chemical products
 

1. Chemical manufacturers, importers in Turkmenistan and other vendors are required to register chemicals in offices.

Article 28. Risk assessment risk chemical products 1. Application of measures to ensure chemical safety chemical products based on risk assessment.
2. risk assessment of chemical products by chemical manufacturers, importers in Turkmenistan and other suppliers is mandatory for all chemical products.

2) holding production control of chemical products for compliance with the requirements of the legislation of Turkmenistan and the confirmation of their compliance with those requirements;
3) environmental, sanitary-epidemiological, toxicological examination and examination of industrial safety;
4) applying measures of State regulation in the field of the safety of chemical products.

3. Developed, created and produced in the treatment of chemical products must meet security requirements established by normative documents in the field of chemical safety.
 
Article 30. Document security of chemical products and the requirements 1. For placing on the market of chemical products, chemical manufacturers, importers of foreign countries in Turkmenistan and other providers are obliged to make document security products.

Article 31. Requirements for the safe handling of chemical products 1. In accordance with the requirements of existing standards and regulations when working with chemical production conditions should be created to ensure her safety.
2. accompanying documents of chemical products must contain information on the concentration of dangerous signs, about precautionary measures aimed at reducing the dangerous risk. Chemical products manufacturers of chemical products, importers in Turkmenistan and other suppliers is provided by security instruments and warning signs of dangerous signs.
 
Article 32. Requirements to stop working with chemical products since the discovery of chemical products established by this law and other normative legal acts of Turkmenistan the security requirements for the life and health of workers and consumers, as well as environmental protection Wednesday or on the basis of the requirements of departmental management bodies chemical manufacturers, importers in Turkmenistan and other suppliers are obliged to stop working with chemical products.
 

Article 33. Confirmation of conformity with the requirements of chemical products 1. Confirmation of conformity with the requirements of chemical product safety is carried out in accordance with the legislation of Turkmenistan.
2. When determining compliance with the requirements of chemical products, documents issued by foreign countries are recognised in accordance with the legislation of Turkmenistan.
 
Chapter VIII.  The rights and obligations of natural and legal persons in the field of CHEMICAL SAFETY Article 34. The rights of legal persons in the field of chemical safety, legal persons engaged in the production of chemical products, its importation to Turkmenistan and placing on the market, have the right to: 1) in accordance with the legislation of Turkmenistan to participate in the development of normative legal acts in the field of chemical safety;
2) develop programmes of safety production control of chemical products;
3) introduce a system of quality management and safety of chemical products;
4) participate in the development of mandatory standards, satisfying the requirements of the legislation of Turkmenistan in the field of chemical safety;
5) informed about hazardous chemicals that may affect human life and health, Wednesday;
6) to apply to the relevant public authorities about the conduct of the evaluation and validation of the risk of chemical products.
 
Article 35. Responsibility of legal persons in the field of chemical safety, legal persons engaged in the production of chemical products, its import from foreign countries in Turkmenistan and placing on the market shall be obliged to: 1) comply with the requirements of the legislation of Turkmenistan on chemical safety;
2) ensure production control during the entire period of the vital activity of chemical products;
3) to inform the public authorities about the violations of this law and regulations in the field of the safety of chemical products during the whole period of the vital activity of chemical products;
4) to stop one or more stages of the life period of chemical products in case of non-compliance with the safety requirements established by the present law and normative legal acts;
5) at the request of the consumer or authorized State bodies to provide reliable information about the safety of chemical products;
6) provide the required information and documents the public authorities: document on the safety of chemical products, a certificate of registration, certificate of conformity, other documents and technical information;
7) evaluate the security risk of chemical products.
 
Article 36. The rights of individuals in the field of chemical safety 1. Individuals living in Turkmenistan have the right to demand from State bodies and their officials complete and flawless execution of the requirements of this law and other normative legal acts on chemical safety.
2. Chemical safety population is provided for the following activities: 1) protection from chemical exposure in excess of the maximum permissible norms;
2) conducting of complex of actions on prevention of chemical risks;
3) timely informing the population about the situation with chemical safety;
4) provision of State guarantees of working with hazardous chemicals;
5) reparation to the victims of a chemical accident, accumulation above the maximum permissible level of dangerous chemicals and other activities.
3. the procedure for reparation from the accumulation of hazardous chemicals above the maximum permissible level of the norm or chemical accident, its size and species are determined by the legislation of Turkmenistan.
 
Article 37. Responsibilities of individuals in the field of chemical safety individuals in the field of chemical safety must: 1) comply with the requirements on chemical safety;
2) participate in the implementation of measures to ensure chemical safety;
3) perfectly meet the requirements of the authorized government bodies.
 
Chapter IX. Final clauses article 38. Liability for violation of the legislation of Turkmenistan on chemical safety violations of the legislation of Turkmenistan on chemical safety engages the responsibility established by the legislation of Turkmenistan.
 
Article 39. Procuracy supervision over compliance with this Act, the Procuracy supervision over compliance with this Act is exercised by the Prosecutor General of Turkmenistan and subordinates to him by prosecutors.
 
Article 40. The entry into force of this Act, this Act shall enter into force on the day of its official publication.
