On migration (records of the Mejlis of Turkmenistan, 2012, no. 1, p. 41) (with additions made by the laws of Turkmenistan dated 04.05.2013 № 399-IV, 09.11.2013, no. 453-IV, 13.06.2014, no. 90-V and from 28.02.2015 № 204-V) this Act in accordance with the Constitution of Turkmenistan, the universally recognized norms of international law establishes the procedure for entry into Turkmenistan, stay in and departure from its territory of Turkmenistan of citizens of Turkmenistan , foreign citizens, persons without citizenship, the legal relations in the sphere of migration processes in Turkmenistan, the competence of the public authorities of Turkmenistan on the regulation of migration processes in Turkmenistan.
 
Chapter i. General provisions article 1. Basic concepts in this Act uses the following concepts: 1) migration-the movement of natural persons from Turkmenistan to foreign States and from foreign countries in Turkmenistan, as well as within Turkmenistan, with the change of permanent or temporary place of residence;
2) migrant-physical person moving from Turkmenistan to foreign States and from foreign countries in Turkmenistan, as well as within Turkmenistan to change permanent or temporary place of residence;
3) a foreign national is a person who is not a citizen of Turkmenistan and has dokazatel′stvo their belonging to citizenship of a foreign State;
4) a stateless person-a person who is not a citizen of Turkmenistan and has no dokazatel′stva their belonging to citizenship of a foreign State;
5) emigration-departure of citizens of Turkmenistan abroad in the foreign State for permanent residence;
6) emigrant-citizen of Turkmenistan, is coming from Turkmenistan to a foreign State for permanent residence;
7) internal migration-the movement of natural persons in the territory of Turkmenistan with a change in permanent or temporary place of residence;
8) transit migration-move through the territory of Turkmenistan of foreign citizens, persons without citizenship in a foreign country;
9) labour migration is a voluntary move individuals legally residing in Turkmenistan, abroad as well as foreign citizens and stateless persons permanently residing in foreign countries and arriving in Turkmenistan with a view to their implementation of work;
91) work by a foreign citizen, stateless person in Turkmenistan is a foreign citizen, stateless person, carried out in Turkmenistan on the basis of an employment contract or civil contract for execution of works (provision of services);
92) the illegal work in Turkmenistan, a foreign citizen, stateless person is work in Turkmenistan, a foreign citizen, stateless person without a work permit, issued in accordance with the legislation of Turkmenistan, as well as work on a speciality within the territory, unlike the specified in the work permit, based on not decorated, not prodlënnogo in the prescribed manner work permit;
93) a foreign worker is a foreign citizen, carrying out work in Turkmenistan, in the manner prescribed by the legislation of Turkmenistan;
10) illegal migration-entry into Turkmenistan, stay on its territory and leaving Turkmenistan individuals in violation of the legislation of Turkmenistan;
11) visa-a special mark (a special sticker with the stamp of the respective public institutions) in a recognized Turkmenistan passport or another travel document exchanging it a foreign citizen, stateless person, allowing entry into Turkmenistan, stay in and departure from its territory of Turkmenistan;
12) accreditation certificate is a document issued by a foreign citizen or stateless person authorized State Agency of Turkmenistan to participate in international sports events on the territory of Turkmenistan;
13) residence permit in Turkmenistan-the document issued in the manner prescribed by the legislation of Turkmenistan, foreign citizens, persons without citizenship, their identity and the right to accommodation in Turkmenistan;
14) administrative expulsion is enforced and controlled movement of foreign citizens and stateless persons across the State border of Turkmenistan abroad in cases stipulated by the legislation of Turkmenistan;
15) the unified register of the population of Turkmenistan-accounting system of personal data of citizens of Turkmenistan;
16) place of residence-a place where an individual permanently or primarily lives;
17) location-the place where the natural person resides temporarily.
 
Article 2. Turkmen legislation on migration 1. Turkmen legislation on migration is based on the Constitution and consists of this law and other normative legal acts of Turkmenistan, governing issues relating to migration.
If an international treaty to which Turkmenistan stipulates other rules than those stipulated by this law, the rules of the international treaty shall apply.

2. This law shall not apply to persons seeking admission, restoration and renunciation of citizenship of Turkmenistan, as well as persons granted refugee status or asylum granted.
 
Article 3. The basic principles of regulation of migration processes in Turkmenistan, the regulation of migration processes in Turkmenistan is based on the following principles: 1) enshrined in the Constitution of Turkmenistan human rights to free choice of place of residence, type of activity and profession, freedom of movement;
2) inadmissibility of the infringement of rights and freedoms on grounds of nationality, race, sex, origin, property and official status, place of residence, language, attitude to religion, political beliefs, party affiliation or lack of affiliation with any party, or for any other reason;
3) ensuring compliance with the legislation of Turkmenistan, the universally recognized norms of international law and the international treaties of Turkmenistan in the field of migration;
4) identifying, preventing and responding to illegal migration in Turkmenistan;
5) respect and observance of migrants the Turkmenistan legislation in force;
6) cooperation of public authorities with public associations of interaction in the sphere of regulation of the processes of internal migration;
7) involvement of public authorities in the management of external migration processes.
 
Article 4. The main tasks of the present law, the main objectives of this law are: 1) the regulation and stabilization of migration processes in Turkmenistan;
2) protection of the rights and legitimate interests of migrants, to provide them with social protection;
3) detection, prevention and preventing illegal migration;
4) keeping the uniform register of the population of Turkmenistan;
5) promote national security and respect for the interests of the State in development of migration processes;
6) improvement of the mechanism of legal regulation of migration processes.
 
Article 5. The public authorities of Turkmenistan in the area of migration 1. The public authorities of Turkmenistan in the field of migration are the State migration service of Turkmenistan, Ministry of Foreign Affairs of Turkmenistan, Ministry of national security of Turkmenistan, Ministry of Internal Affairs of Turkmenistan, the State border service of Turkmenistan and other public bodies dealing with migration.
2. Monitoring compliance with the requirements of the present law shall be carried out by the public authorities referred to in paragraph 1 of this article, within the terms established by the legislation of Turkmenistan.
 
CHAPTER II. Entry into TURKMENISTAN, stay on its territory and LEAVING TURKMENISTAN foreign citizens, persons without citizenship, article 6. Permission to enter, stay in and departure from Turkmenistan, foreign citizens, persons without citizenship 1. Foreign citizens and stateless persons may enter and stay on the territory of Turkmenistan on the basis of the entry visa to Turkmenistan, unless otherwise stipulated by international treaties to which Turkmenistan is a party.
Entry and stay in the territory of Turkmenistan of foreign citizens, persons without citizenship, arriving to stay, is carried out on the basis of a residence permit issued in accordance with the legislation of Turkmenistan.
2. stateless persons for the stateless person, issued by the authorized bodies of Turkmenistan in the manner prescribed by the legislation of Turkmenistan, reside on the territory of Turkmenistan without visas, travel document travel from Turkmenistan and enter Turkmenistan.

For registration and issuance, extension, rotation, making reuse of the identity of a stateless person, as well as for the processing and issuance of a travel document to a stateless person charged stamp duty or consular fees in the manner prescribed by the legislation of Turkmenistan. In accordance with the legislation of Turkmenistan, individuals may be exempt from payment of State fees or consular fees.
3. Foreign citizens, persons without citizenship upon entry into the territory of Turkmenistan or upon arrival at your destination after you change the place of residence on the territory of the country are obliged within three working days (excluding the day of entry into the territory of the country) to register on the basis of visa or residence permit in the manner prescribed by the present law, unless otherwise provided by international treaties to which Turkmenistan is a party.
4. To work in Turkmenistan, foreign citizens, persons without citizenship must have a permit to work in Turkmenistan.
The requirement to obtain work permits in Turkmenistan does not apply in respect of the following persons: persons without citizenship having identity papers issued by the authorized State bodies of Turkmenistan;
members of diplomatic missions, consular offices of foreign States, as well as representatives of international organizations accredited by the Ministry of Foreign Affairs of Turkmenistan;

foreign employees of scientific, educational and cultural institutions established in accordance with the law and international treaties to which Turkmenistan is a party, as well as official representatives of the international humanitarian and charitable organizations;
(journalists) correspondents of foreign mass media accredited by the Ministry of Foreign Affairs of Turkmenistan;
Foreign spiritual workers religious organizations officially registered on the territory of Turkmenistan;
foreign citizens, persons without citizenship, invited ministries and departments of Turkmenistan in agreement with the Cabinet of Ministers of Turkmenistan to implement teaching, scientific, cultural and educational activities, including for educational institutions of Turkmenistan short-term or designed for a specific term educational trainings and seminars;
foreign citizens and stateless persons arriving in Turkmenistan for up to one month to conduct financial audits and other inspections, official negotiations, Contracting, as well as experts;
employees of legal persons of foreign States, arriving in Turkmenistan for up to one month for the installation, repair and maintenance of equipment;
the founders, shareholders, executives, legal entities (their branches and representative offices) and foreign citizens, persons without citizenship, the members of the management team of legal persons of foreign States in labor relations in accordance with the labor laws of Turkmenistan;
foreign students enrolled in full-time education in educational institutions of Turkmenistan and running away from the study time and during the holidays in these institutions;
conditionally sentenced foreign citizens, persons without citizenship;
members of the crews of vehicles of foreign States engaged in international carriage of goods and passengers;
persons who have been granted asylum in Turkmenistan;
persons with refugee status in accordance with the legislation of Turkmenistan;
foreign citizens and stateless persons permanently residing in Turkmenistan or staying in Turkmenistan for permanent residence;
persons who have been granted a residence permit in Turkmenistan;
foreign citizens, persons without citizenship, for which the international treaties of Turkmenistan establishes another procedure for bringing them to work.
5. in Turkmenistan, foreign citizens, persons without citizenship have the right to apply for extension of period of validity of the visa, residence and work permits in Turkmenistan.
6. foreign citizens and stateless persons are obliged to leave Turkmenistan in the following cases: on the expiry of the visa, residence permit;
in denial of applications for visa extension, residence permit;
reducing the length of stay on the territory of the country or the revocation of a visa, a residence permit;
as well as upon expiry of the term of stay in Turkmenistan, on other grounds.
 
Article 7. The entry of foreign citizens and stateless persons in Turkmenistan and exit 1. Foreign citizens may enter and leave Turkmenistan Turkmenistan through checkpoints at the State border of Turkmenistan, open to international traffic, valid, regardless of age, individually arranged foreign passports and stateless persons-valid, regardless of age, documents certifying their identity, issued by the competent authorities of the States of their permanent residence, if they have the appropriate visas.

4. During international sporting events, foreign nationals and stateless persons may enter and leave Turkmenistan Turkmenistan without a visa if there is accreditation certificate valid foreign passports or substituting for their documents.
5. A procedure for entry into and exit from Turkmenistan Turkmenistan foreign citizens, persons without citizenship can be established by international treaties of Turkmenistan.
6. entry into Turkmenistan of foreign citizen, stateless person are not permitted on the following grounds: 1) If, in accordance with the legislation of Turkmenistan, it restricted entry to Turkmenistan;
2) in the absence of a valid visa, a passport or a document replacing it;
3) in the interests of national security or public order;
4) if entry poses a threat to the health, rights and interests of citizens of Turkmenistan and other persons residing in Turkmenistan;

5) If during his previous stay abuses were established the Turkmenistan legislation in force;
6) if the application for entry in Turkmenistan have been communicated false information or submitted false documents;
7) on other grounds established by the legislation of Turkmenistan.
7. To refuse entry to Turkmenistan to foreign citizens and persons without citizenship who have entry visas, it was reported by an official of the State migration service of Turkmenistan.  The refusal of foreign citizens, stateless persons entry into Turkmenistan may be appealed in the manner prescribed by the legislation of Turkmenistan.
8. A foreign citizen, stateless person is not allowed to leave Turkmenistan in the following cases: 1) if there are grounds for instituting criminal proceedings against him, until the end of proceedings;
2) if he is convicted of an offence-until expiry or until exemption from punishment;
3) if his departure from the territory of Turkmenistan runs counter to the interests of national security, to the exclusion of the circumstances preventing his departure;
4) if he evades the obligations placed upon it by the Court, pending the fulfilment of the commitments;
5) if in the Court against him filed a civil lawsuit or arbitration, until the end of proceedings;
6) if there are circumstances, established by the legislation of Turkmenistan, or other circumstances preventing his departure.
 
Article 8. Pass in transit through the territory of Turkmenistan 1. Transit passage of foreign citizens and stateless persons through the territory of Turkmenistan is carried out in accordance with the legislation of Turkmenistan and the international treaties to which Turkmenistan is a party.
2. foreign citizens, stateless persons transiting through the territory of Turkmenistan, shall observe the rules of transit and follow the route. They may stay in the territory of Turkmenistan over the period referred to in the transit visa, only subject to the extension of the visa.
3. foreign citizens, awarded with ranks "honorary citizen of Turkmenistan, while transiting the territory of Turkmenistan can stay without a visa in the territory of Turkmenistan.
 
Article 9. The order of entry into Turkmenistan, movement on the territory of Turkmenistan and exit of foreign citizens, persons without citizenship for personal or official vehicle 1. The order of entry into Turkmenistan, movement on the territory of Turkmenistan and exit of foreign citizens, persons without citizenship for personal or official vehicle is established by legislation of Turkmenistan.

Article 10. Visa issuance and extension of their actions 1. Visa issuance for entry into Turkmenistan and the extension of the term of their validity, foreign citizens, persons without citizenship shall be:-on the territory of Turkmenistan through the State migration service of Turkmenistan;
outside Turkmenistan through diplomatic representatives and consular institutions of Turkmenistan in foreign countries.
2. Categories and types of visas, as well as the order of their registration, issuance and extension of their actions are determined by the President of Turkmenistan.
3. Grounds for the issuance of visas for entry into and exit from Turkmenistan Turkmenistan and extension of visas for foreign citizens, persons without citizenship are: 1) for members of diplomatic missions, consular posts and other equated missions of foreign States and international organizations in Turkmenistan, foreign journalists accredited in Turkmenistan, as well as to members of their families-accreditation card issued by the Ministry of Foreign Affairs of Turkmenistan and written or in electronic form for the treatment of these missions, agencies and organizations;
2) for foreign citizens and stateless persons arriving in Turkmenistan through host organizations of Turkmenistan and permanent foreign missions, written or in electronic form for the treatment of these organisations and representations;
3) for foreign citizens and stateless persons arriving in Turkmenistan official and business purposes-a written or electronic form application host organizations with application required documents attesting to official or business trips;
4) foreign citizens and stateless persons arriving in Turkmenistan to implement employment-authorization of the State migration service of Turkmenistan to work in Turkmenistan;
5) to foreign citizens and stateless persons arriving in Turkmenistan on personal matters, the invitation of individuals established form or a written or electronic form application of foreign citizen, stateless person;

6) for foreign citizens, persons without citizenship, passing in transit through the territory of Turkmenistan, in writing or electronically personal statement with the application documents granting the right to enter the country of destination;
7) for foreign citizens and stateless persons arriving in Turkmenistan with the purpose of tourism, personal statement or a written or electronically petition host Tourism Organization;
8) for foreign citizens and stateless persons arriving in Turkmenistan with the purpose of training, written or electronically petitions of educational institutions;
9) for foreign citizens and stateless persons arriving in Turkmenistan for a medical examination and treatment, in written or electronic form, personal statement and documents issued by medical institutions, confirming the need for the arrival of these persons in Turkmenistan;
10) for individuals forming part of the crews of vehicles of foreign States involved in the transport of passengers and goods on the lines of international communication, in written or in electronic form or a written personal statement either electronically petition host organization;
11) in the case of arrival in Turkmenistan, a foreign citizen, stateless person without a visa and stay in its territory, as well as in connection with the expiration of the visa, the visa cancellation and reduced length of stay in Turkmenistan, expiration of certain otherwise stay in Turkmenistan, in connection with the loss of the passport or document replacing it in writing or electronically personal statement of these individuals on an exit visa or in written or electronic form circulation in Turkmenistan, host of legal persons.

4. Legal and natural persons, organizations, host in Turkmenistan, foreign citizens, persons without citizenship, on the prescribed form, written or electronically as a treatment that the visa request is sent to the State migration service of Turkmenistan.
5. Appeals Form and list of documents annexed to the treatment, approved by the State migration service of Turkmenistan.
 
Article 11. Grounds for refusal of the visa 1. Grounds for refusing foreign citizen, stateless person in the granting of visas could be: 1) of his having committed a crime against peace and humanity;
2) conviction for committing a serious or particularly serious crimes;
3) instituting criminal proceedings against him-until the end of the preliminary investigation, the judicial investigation or proceedings;
4) when his stay on the territory of Turkmenistan runs counter to the interests of national security, might disrupt public order or cause moral damage to populations of the country;
5) if it is necessary to protect the rights and legitimate interests of citizens of Turkmenistan and other persons;
6) if he is infected with the human immunodeficiency virus (HIV) infection, sexually transmitted disease, suffers from an addiction or other disease included the Ministry of health and medical industry of Turkmenistan in the list of diseases harmful to the health of the population of Turkmenistan;
7) if it is for the purpose of obtaining a visa knowingly false information;
8) if he was previously applied the restriction of entry into Turkmenistan, until the expiry of the limitation;
9) if it has been subject to administrative expulsion from Turkmenistan, before the expiration of the administrative expulsion;
10) his illegal stay in Turkmenistan or assist another foreign citizen, stateless person unlawfully on the territory of Turkmenistan;
11) if he is a terrorist, anti-State, extremist or other criminal organization or person involved in it.
2. The decision on refusal to grant a visa to the applicant are reported within three working days from the date of adoption of the decision.
 
Article 12. Registration of foreign citizens, persons without citizenship in the State migration service of Turkmenistan 1. Foreign citizens, persons without citizenship, arrived in Turkmenistan are obliged within three working days (excluding the day of entry into the territory of the country) to register with the relevant authorities of the State migration service of Turkmenistan.  

Registration of foreign citizens, persons without citizenship is based on written applications receiving legal and physical persons and organizations. Extension of registration of foreign citizens and stateless persons is carried out following the extension of the visa or residence permit in Turkmenistan. Procedure for registration and prolongation of its validity is determined by the State migration service of Turkmenistan.
Check-in and check-out through the State border of Turkmenistan, foreign citizens, persons without citizenship shall be carried out at migration control posts at the border crossings of the State border of Turkmenistan with putting a stamp on the date of crossing the State border of Turkmenistan in passports or substituting documents. Foreign citizens, persons without citizenship, arrived in Turkmenistan for more than three working days are required to register at the place of residence or place of stay respectively, in offices in provinces and cities regions, divisions in etraps and etrap cities of the State migration service of Turkmenistan (hereinafter-migration service bodies), unless otherwise prescribed by the legislation of Turkmenistan.
Registration of foreign nationals arriving in Turkmenistan in a simplified manner, is carried out only at the immigration control at the State border of Turkmenistan and the duration of their stay are defined by intergovernmental agreements. They must travel from Turkmenistan through post immigration control at the State border of Turkmenistan at the place of arrival.
Registration of foreign citizens and stateless persons transiting through the territory of Turkmenistan is carried out only at the immigration control at the State border of Turkmenistan if the duration of their stay in Turkmenistan (except for the day of entry into the territory of the country) does not exceed five days.
Foreign citizens who came to participate in the work of international forums, fairs, conferences, festivals, as well as to participate in sports competitions, educational contests and other events in Turkmenistan at the State level, can be registered in a privileged manner. Grace order of registration is determined by the State migration service of Turkmenistan.
2. Registration in places of stay exempt: 1) heads of States, parliaments and Governments of foreign countries, members of the public, parliamentary and governmental delegations, as well as delegations of intergovernmental and international organizations arrived in Turkmenistan at the invitation of the President of Turkmenistan, Turkmenistan's Majlis, the Cabinet of Ministers of Turkmenistan, as well as the personnel of these delegations, and family members of the above;
2) individuals belonging to the crews of foreign military marine (River) and aircraft arrived in Turkmenistan in the established order;
3) persons included in the composition of crews of foreign non-military marine (River) vessels while in ports and port cities of Turkmenistan;
4) individuals belonging to the crews of civil aircraft of international airlines, trains teams of international rail transport, while in airports and railway stations of Turkmenistan, cities with airports and railway stations;
5) foreign nationals, awarded with ranks "honorary citizen of Turkmenistan.
 
Article 13. Registration of foreign citizens, persons without citizenship in the other competent government bodies of Turkmenistan 1. The Ministry of Foreign Affairs of Turkmenistan are registered by the following categories of foreign citizens and stateless persons enjoying international protection and have special legal status: 1) the heads of foreign diplomatic missions and consulates, diplomatic personnel, consular officers, and administrative and technical staff of diplomatic missions and consular posts, employees of the apparatus of military attachés and trade missions and their spouses, children, parents who are dependent on these individuals, as well as guests of the heads of foreign diplomatic missions and consular posts If these guests stay in their residences or in the territories of these missions and institutions;
2) staff members of the foreign policy departments of foreign countries arrived in Turkmenistan on official business and holders of diplomatic or service passports and members of their families;
3) foreign citizens and members of their families who arrived on official business in diplomatic missions and consular offices of foreign States in Turkmenistan;
4) arriving in Turkmenistan on official business officials of international organizations, staff of the missions of these organizations in Turkmenistan, as well as members of international organizations of foreign States, with headquarters in Turkmenistan, which according to the statutes of these organizations or by the relevant international instruments enjoy diplomatic privileges and immunities, as well as members of their families;
5) persons arriving in Turkmenistan on passports issued by the United Nations, if the duration of their stay (excluding the day of entry into the territory of the country) in Turkmenistan for more than five days;

6) foreign journalists, which the Ministry of Foreign Affairs of Turkmenistan issued accreditation cards, and members of their families.
2. The Ministry of Foreign Affairs of Turkmenistan gives these persons accreditation cards or writes about registering in their passports. The Ministry of Foreign Affairs of Turkmenistan produces appropriate registration arrived in Turkmenistan public figures of foreign States and members of their families, when it sought diplomatic missions and consular offices of foreign States, as well as international organizations and other host organizations. In these cases, foreign citizens are exempt from registration in the State migration service of Turkmenistan.
3. Foreign citizens, persons without citizenship, arrived in Turkmenistan for tourism, are registered at the State Committee of Turkmenistan for tourism.
4. Foreign citizens, persons without citizenship, arrived in Turkmenistan on accreditation certificates to international sports competitions are registered in an authorized State body.
Order processing and issuing of accreditation certificates for international sport competitions shall be established by the President of Turkmenistan.
5. the competent authorities referred to in this article, within twenty-four hours are required to submit to the State migration service of Turkmenistan information about registration and renewal of registration of foreign citizens and stateless persons.
6. the organs of the State migration service of Turkmenistan are registered foreign citizens, stateless persons, not mentioned in this article.
 
CHAPTER III. RESIDENCE PERMIT in Turkmenistan, Article 14.  Issuance of permit 1. 3) committing acts contrary to the interests of national security, public order and morality;
4) if he is a terrorist, anti-State, extremist or other criminal organization or person connected with him;

6) if it is registered in a specialised medical treatment facility;

Article 20. Movement on the territory of Turkmenistan 1. Foreign nationals and stateless persons may freely enter and move through the territory of Turkmenistan is open to visits by foreign citizens and stateless persons.

5), he shall, on conviction, convicted of a particularly serious crime or perpetrator is recognized as a crime committed intentionally by a particularly dangerous recidivist or is under administrative supervision by the police-to maturity of conviction or the termination of supervision;

Article 34. Procedure for the departure of citizens of Turkmenistan for permanent residence abroad 1. Turkmen citizens have the right to leave the country for permanent residence abroad. Turkmen citizens, leaving for permanent residence abroad, must have an appropriate visa or permit, issued in accordance with the legislation of the State of entry.
2. General term of consideration of applications of citizens of Turkmenistan and paperwork leaving Turkmenistan for permanent residence should not exceed three months.
3. Turkmen citizens leaving Turkmenistan for permanent residence are entitled to removal of property belonging to them and the family members of foreign currency purchased legally, as well as ownership of property on the territory of Turkmenistan, belong to them on the right to personal property, money, securities and other valuables stored in banks. Any restriction of their civil, social, labour, housing and other rights are not allowed.
Export of Turkmen citizens subjects representing cultural, historical or other value to States outside of Turkmenistan is governed by the laws of Turkmenistan and international treaties to which Turkmenistan is a party.
4. Turkmen citizens to exit beyond permanent residence are obliged to execute proprietary obligations before individuals and legal persons under the jurisdiction of Turkmenistan.
Turkmen citizens leaving Turkmenistan for permanent residence to obtain permission to travel out of Turkmenistan serves a notarized statement on absence of claims for alimony from remaining in Turkmenistan parents, as well as if there are remaining in Turkmenistan of minor children from their legal representative in Turkmenistan. Persons who are not immigrants Emigrants are not employees of diplomatic missions, consular posts and other representations in foreign countries, Turkmen citizens engaged in other States, temporary work, as well as those in foreign countries on her studies, treatment, leisure trip, at the invitation of the legal and natural persons, as well as a business trip.
Immigrants are also not others, temporarily emigrated from Turkmenistan.
 
Article 36. Departure from Turkmenistan of Turkmen citizens having access to State secrets 1. Departure from Turkmenistan of Turkmen citizens having access to State secrets may not be allowed in the cases stipulated by the Turkmenistan law "on the protection of State secrets".
2. Temporary restrictions on leaving the country must be brought to the attention of citizens relating to the admission to the information constituting State secrets, the administrations of enterprises and institutions, heads of educational establishments, the command of the military units with employment (study) and enrolling in the military.
 
CHAPTER VI. INTERNAL MIGRATION Article 37. The right of citizens of Turkmenistan to freedom of movement and choice of place of residence and place of stay within Turkmenistan 1. Every citizen of Turkmenistan in accordance with the Constitution of Turkmenistan and other normative legal acts of Turkmenistan has the right to freedom of movement, choice of residence and place of stay on the territory of Turkmenistan.
2. Restrictions on the right of citizens of Turkmenistan to freedom of movement and choice of place of residence and place of stay within the limits of Turkmenistan are allowed on the grounds established by law.
3. Decisions, actions or omissions of bodies of State authority and administration, officials, as well as other legal and natural persons, restricting the right of citizens of Turkmenistan to freedom of movement and choice of place of residence and place of stay within Turkmenistan, may be appealed to the citizens to a higher authority, a higher-ranking official or in court.
 
Article 38. Passport of the citizen of Turkmenistan
 

1. Passport of the citizen of Turkmenistan is a document certifying the identity and nationality of its holder.
2. Passport of the citizen of Turkmenistan is the property of Turkmenistan and is valid throughout the territory of Turkmenistan.
3. Turkmen passport is issued to every citizen of Turkmenistan, who has attained 16 years of age.
4. Passport of the citizen of Turkmenistan shall be made in the manner prescribed by the legislation of Turkmenistan.
5. In accordance with the legislation of Turkmenistan, according to the citizen of Turkmenistan may be exchanged his passport.
6. For registration and issuance of a passport of a citizen of Turkmenistan, as well as its exchange fees are charged in accordance with the established procedure. In accordance with the legislation of Turkmenistan, individuals may be exempt from the levy.
7. Sample and description of a passport of a citizen of Turkmenistan shall be approved by the President of Turkmenistan.
8. The order of registration and the issuance of a passport of a citizen of Turkmenistan, the rules for its use are approved by the Cabinet of Ministers of Turkmenistan.
 
Article 39. The right to protection from forced displacement of 1. Every Turkmen citizen has the right to protection from forced displacement of his place of residence or place of stay.
The right to protection from forced displacement can be realized by means of recourse to the Court in the manner prescribed by the legislation of Turkmenistan.
2. Forced displacement is a citizen of Turkmenistan from the place of residence or place of stay may be carried out on the basis of a court decision.
 
Article 40. Restrictions on freedom of movement, choice of residence and the place of residence in the interests of national security, public order, protection of public health by the Cabinet of Ministers of Turkmenistan there may be limits to freedom of movement and choice of place of residence and place of stay in the following areas of Turkmenistan: 1) in the border zone;
2) in closed military bases;
3) in environmental disaster areas and natural threats (man-made) catastrophes-because of the danger of the spread of infectious diseases and mass poisoning of people;
4) in areas where a State of emergency.
 
Article 41. Forced migrants 1. In exceptional circumstances the Government of Turkmenistan, the State of emergency is introduced in accordance with the Turkmenistan law "on the legal regime of the State of emergency.
2. During a State of emergency, authorized bodies of State power and administration have the right to permanently or temporarily evicted civilians from areas dangerous for them to stay, with obligatory provision of other fixed or temporary dwellings.
Forced migrants with necessary assistance and create the necessary conditions of life, including the provision of food and potable water, basic sanitation and health services.
3. The Turkmen Government, public authorities and management, local executive bodies and local self-government, social institutions and legal entities have forced migrants possible assistance, as well as to create the necessary conditions for their stay at the new place of residence or place of stay.
 
4. After the Elimination of consequences of natural disasters and other circumstances of the Turkmen Government and the relevant bodies of State power and administration, in conjunction with local executive authorities and bodies of local self-government have forced migrants to return to their previous place of residence and his arrangement, including the restoration of destroyed houses.
 
Article 42. Registration of citizens of Turkmenistan's places of residence and sojourn within Turkmenistan 1. In order to regulate the processes of internal migration, ensure the necessary conditions for the realization of internal migrants of their rights and freedoms, as well as their responsibilities vis-à-vis other citizens of Turkmenistan establishes the place of residence of the citizen's place of residence and registration of place of residence within Turkmenistan.
Registration by place of residence is a formalization of the residence of a citizen of a certain address in residential premises in the territory of the respective districts and cities in Turkmenistan, as well as entry or mark (stamp) registration in the passport of the citizen of Turkmenistan.
2. Any person having ownership of several residential premises on the territory of Turkmenistan, is written in only one of them.
3. citizens temporarily eliminated in another locality for more than forty-five calendar days without statement with permanent residence, as well as nonresident students and pupils of educational institutions in the training period must be registered at the place of their stay. Registration of citizens at the place of residence shall be carried out by authorized officials of the respective units.
Registration at the place of residence is a formalization of the temporary residence of a citizen in a residential area on a specific address.  
4. the order of registration of citizens on place of residence and registration of citizens on place of stay is approved by the President of Turkmenistan.
 
Article 43. Guarantees of the rights and freedoms of the citizens of Turkmenistan, regardless of residence and registration
 

1. Every Turkmen citizen enjoys the rights and freedoms guaranteed by the Constitution of Turkmenistan and the Turkmenistan legislation throughout Turkmenistan, regardless of the fact of registration on place of residence or registration on place of residence.
2. no registration or registration may not serve as a ground for restricting the rights and freedoms of citizens in Turkmenistan.
 
Article 44. Unified Register of the population of Turkmenistan 1. Unified Register of the population of Turkmenistan is designed to collect, store, compile and analyze information about citizens of Turkmenistan, as well as to provide this information, the State authorities of Turkmenistan, other legal entities and natural persons in the manner prescribed by the legislation of Turkmenistan.
2. The Unified Register of the population of Turkmenistan consists of personal data of citizens of Turkmenistan. The content of the personal data of citizens is the basis of governmental informational resources on the formation and use of which is made of personal data by the Central Bank.
3. monitoring data collection to form a single registry of the population of Turkmenistan and their use by the Cabinet of Ministers of Turkmenistan.
4. The procedure for the formation and functioning of the unified register of the population of Turkmenistan shall be determined by the President of Turkmenistan.
 
CHAPTER VII. LIABILITY for VIOLATION of the LEGISLATION of TURKMENISTAN on migration, article 45. The basis of liability for offences, foreign citizens, stateless persons who have committed wrongful acts on the territory of Turkmenistan shall be responsible to the General principles established by the legislation of Turkmenistan, except for cases stipulated by international treaties to which Turkmenistan is a party.
 
Article 46. Responsible for the reception of foreign citizens and stateless persons illegally staying on the territory of Turkmenistan the legal and physical persons in cases of registration to work without a permit, registration and assist foreign citizens, stateless persons illegally staying on the territory of Turkmenistan, as well as in cases of non-compliance with the requirements of article 21 of this law bear responsibility established by the legislation of Turkmenistan.
 
Article 47. The liability of foreign citizens and stateless persons for violation of the order arriving in Turkmenistan, stay and departure from Turkmenistan, as well as for transit through the territory of Turkmenistan 1. Violation of foreign citizens and stateless persons in the order of stay in Turkmenistan, namely: accommodation without documents on the right of residence in Turkmenistan, or without a visa;
accommodation in invalid documents;
the illegal employment;
failure to comply with the established registration procedure, of movement and choice of residence;
accommodation at the expiration of the visa or residence permit;
accommodation after receiving non-renewal of a visa or residence permit;
accommodation after the expiration of the redused the length of their stay on the territory of the country or the cancellation of their visas, residency;
refusal to leave the country on expiry of a certain period of stay on other grounds in Turkmenistan, as well as non-compliance with the rules of entry into Turkmenistan, exit from and transit through the territory of Turkmenistan shall incur the liability established by the legislation of Turkmenistan.
2. The question of the liability of persons enjoying privileges and immunities in accordance with the legislation of Turkmenistan and international legal acts, allowed through diplomatic channels.
 
Article 48. Responsible officials of enterprises, institutions and organizations in Turkmenistan, foreign citizens, persons without citizenship, officials of enterprises, institutions and organizations in Turkmenistan, foreign citizens, persons without citizenship, or providing their service, performing duties relating to compliance with the conditions of entry into Turkmenistan, stay in and departure from the Turkmenistan, as well as for transit through the territory of Turkmenistan of foreign citizens, persons without citizenship set the order of their registration, registration and visa renewal for these documents on the right of residence, movement and change of residence in Turkmenistan bear the responsibility established by the legislation of Turkmenistan.
 
Article 49. The responsibility of citizens taking on private business in Turkmenistan of foreign citizens, persons without citizenship citizens invited to Turkmenistan foreign citizens, persons without citizenship on private business and not adopting measures to ensure their timely registration, as well as measures to ensure their departure from Turkmenistan on the expiry of the visa, as well as contributing to foreign citizens, persons without citizenship, housing, vehicles or had other facilities in violation of the established rules the responsibility established by the legislation of Turkmenistan.
 
Article 50. The liability of the carrier
 

Foreign citizens, persons without citizenship, arrived on the territory of Turkmenistan without authorization, the competent authorities are obliged to ensure that the departure from the territory of Turkmenistan at the expense of the funds of foreign citizens, persons without citizenship, and in case of lack of such funds at the expense of the carrier.
If the immediate departure of foreign citizen, stateless persons, who are not allowed to enter the territory of Turkmenistan is impossible or extremely difficult, the competent State authorities of Turkmenistan to designated individuals are instructed to stay in a certain place before leaving the country, and that related expenses by the carrier.
The carrier that brought on the territory of Turkmenistan of foreign citizen, stateless person in violation of the order arriving in Turkmenistan established articles 6 and 7 of this Act, is responsible under the legislation of Turkmenistan.
 
CHAPTER VIII. FINAL PROVISIONS Article 51. The entry into force of this Act, this Act shall enter into force on the day of its official publication.
From the date of entry into force of this law shall be declared null and void the following legislation: 1) Turkmenistan law dated December 7, 2005 "on migration" (records of the Mejlis of Turkmenistan, 2005, no. 3.4, art. 29);
2) the law of Turkmenistan from October 23, 2008 year "about entry of changes and additions in the law of Turkmenistan" on migration "(records of the Mejlis of Turkmenistan, 2008 г., no. 4, p. 64);
3) part VII of the Act of Turkmenistan on May 10, 2010 "on amendments and additions to certain legislative acts of Turkmenistan" (records of the Mejlis of Turkmenistan, 2010 г., no. 2, p. 34);
