The Education Act (Statements of the Mejlis of Turkmenistan, 2013, no. 2, p. 21) (with amendments the law of Turkmenistan dated 08.11.2014 № 152-V.)
 
This law governs the legal framework of social relations in the field of education, defines the basic principles of State policy in the field of education, as well as the goals, objectives, functions of the education system and the management of its activities.
 
Chapter i. General provisions article 1. The notion of education right to education is one of the fundamental and inalienable constitutional rights of citizens of Turkmenistan.
Improving education as the Foundation of the spiritual, social, economic and cultural progress of society is a priority direction of the development of Turkmenistan.
Education is the subject of a deliberate and systematic activities of Turkmenistan, whose goal of meeting the needs of the individual, society, the State in the education and training of the younger generation.
Under upbringing refers to activities aimed at the development and improvement of the individual on the basis of national and universal spiritual, moral, cultural and social values and the Turkmen society rules and standards of conduct for the benefit of man, society and the State.
Under the training refers to the process of purposeful learning, skills and competence, development of abilities, experience, knowledge in everyday life and a citizen of Turkmenistan a deep motivation to obtain continuous education and improvement of professional qualifications throughout active life.
 
Article 2. The legislation of Turkmenistan in the field of education and its objectives 1. The legislation of Turkmenistan in the field of education is based on the Constitution and consists of this law and other normative legal acts of Turkmenistan relating to education.
2. If an international treaty to which Turkmenistan stipulates other rules than those stipulated by the legislation of Turkmenistan, then the rules of the international treaty shall apply.
3. The objectives of the legislation of Turkmenistan in the field of education are:-the promotion and protection of the constitutional rights of citizens of Turkmenistan to education;
-establishment of legal guarantees for the continued operation and development of the educational system of Turkmenistan;
-definition of competence in education authorities;
-the definition of rights, obligations, powers and responsibilities of legal and physical persons in the field of education, as well as legal regulation of their relations in this field.
 
Article 3. Principles of State policy in the field of education, the State education policy is based on the following principles: 1) equality of rights of every person in the full realization of his abilities and talents;
2) humanistic nature of education, the priority of general human values, human life and health, free development of the personality;
3) organic link education with national history, culture and traditions of the people of Turkmenistan;
4) citizenship and patriotism, industriousness, respect for human rights and freedoms, love of nature, family, homeland;
5) accessibility to every citizen of Turkmenistan, all kinds of educational services provided by the State;
6) compulsory general secondary education for every citizen and his free of charge in public educational institutions;
7) continuity of education and continuity of its stages;
8) diversity of forms of education and educational institutions by types, types and forms of ownership;
9) system integration of education with science and industry and its interaction with the education systems of other countries;
10) the secular nature of the public education system and its separation from religious organizations.
 
Article 4. The State guarantees the rights of citizens of Turkmenistan in the area of education 1. Citizens of Turkmenistan are guaranteed access to education regardless of nationality, race, sex, origin, property and official status, place of residence, language, attitude to religion, political beliefs, party affiliation or lack of affiliation with any political party, as well as age and health.
On the grounds of sex, age and State of health of the Cabinet of Ministers of Turkmenistan may be limits for receiving education on individual occupations, professions and areas of training based on the terms of their replacement and work on them, as well as forms of education.
2. the State guarantees citizens the right to education through the creation of the system of education and relevant socio-economic conditions for receiving an education.
3. The State guarantees citizens accessible and free development of education programmes in public educational institutions, as well as on the competitive basis, accessibility and free professional education in State educational establishments, if this degree professional education receives for the first time, in the manner provided by this Act.

4. In order to realize the right to education of citizens in need of social support, the State bears the costs for their maintenance during the period of their education. Categories of citizens who are granted this support, order and dimensions of its provision shall be established by the legislation of Turkmenistan.
5. the State creates citizens with disabilities, that is flawed in the physical and (or) mental development, conditions for their education in educational institutions of the regular type (inclusive education). 6. the State provides assistance in obtaining education citizens, demonstrating outstanding ability, including by providing special State scholarships, including scholarships for study abroad. The criteria and procedure for granting such scholarships are established by the Cabinet of Ministers of Turkmenistan.
 
Article 5. Languages of education and training 1. Languages of education and training in educational institutions shall be determined by the present law and other normative legal acts of Turkmenistan.
2. The Turkmen language as the State is the main language of teaching and education in educational institutions of all types, regardless of their forms of ownership.
All educational institutions should provide training of the State language of Turkmenistan.
3. The State provides assistance to citizens of Turkmenistan in the study of their mother tongue in accordance with the legislation of Turkmenistan.
4. In the educational institutions of foreign States or cooperative with them, operating on the territory of Turkmenistan, in accordance with this law and other normative legal acts and international treaties of Turkmenistan, the main language of instruction is the foreign language (s).
The national language of Turkmenistan in such educational institutions applied for the teaching of subjects falling within the national component of the educational program.  
5. The State promotes mastery of Turkmen citizens in foreign languages in educational institutions of all types, regardless of their form of ownership.  
Learning foreign languages is included in the General and professional educational programme as compulsory subjects.
6. the State, in accordance with the international treaties to which Turkmenistan is Turkmen citizens assists nationality residing outside its territory, in obtaining general secondary education in their native language.


 



CHAPTER II. THE EDUCATION SYSTEM

 
Article 6. The structure of the education system, the education system in Turkmenistan includes:-State educational standards;
-educational programs;
-network of educational institutions;
-management bodies in the field of education and other bodies created by them.
 
Article 7. State educational standards 1. In Turkmenistan, the State educational standards are established, representing a set of requirements that are mandatory when implementing educational programs educational institutions.
2. State educational standards are the basis for an objective assessment of the education and skills of graduates, irrespective of their form of education.
3. State educational standards provide unity of educational space of Turkmenistan and the continuity of the educational and vocational training programmes.
4. For learners with disabilities special State educational standards.
5. development and approval of national standards of education are carried out in accordance with the procedure set by the Cabinet of Ministers of Turkmenistan.
 
Article 8. Educational programs 1. The educational program is a set of content, volume, planned outcomes of education and which is presented as a curriculum, the academic calendar, schedule educational programs on subjects (courses, cycles), other components, as well as assessment and instructional materials.
2. in Turkmenistan, educational programs are subdivided as follows: 1) General;
2) professional.
3. Educational programmes are aimed at the acquisition of knowledge, skills and competence, the development of a common culture of personality, her adaptation to life in society, the creation of conditions for informed choice of professional educational programs.
To education include: 1) pre-school education;
2) primary education;
3) basic secondary education;
4) General secondary education;
5) non-formal education.
4. Professional educational programs aimed at the acquisition of knowledge, skills and competence for professional activity in a particular area, and (or) perform the work in a particular profession or occupation, as well as consistent training.
Professional include: 1) initial vocational training;
2) secondary vocational education;

3) higher professional education;
4) post-graduate professional education;
5) training;
6) training and retraining.
5. the normative terms of mastering of educational programmes in educational institutions shall be determined by the present law, as well as model provisions on educational establishments appropriate types and forms of ownership or appropriate State educational standards.
 
Article 9. Level 1. The classification of education is carried out in accordance with the content of the educational programmes based on their complexity, acquired knowledge and skills requirements set by previous educational programs, conditions and modes of organization of educational services, as well as binding and (or) a final certification.  
2. For postsecondary education are as follows: 1) early childhood education (including preparation for primary education);
2) primary education;
3) basic secondary education;
4) General secondary education.
3. Professional educational programs establishes the following education: 1) initial vocational training;
2) secondary vocational education;
3) higher education;
4) post-graduate professional education.
 
Article 10. General requirements to the content of education 1. The content of education should ensure that:-the formation of a common citizen of Turkmenistan and a professional culture that meets international standards;
-integration of the individual into the national and world culture;
-formation of high spiritual and moral qualities;
-development of the abilities of each person.
2. the content of education should be consistent with the achievement of national consolidation of the Turkmen people, securing civil, inter-ethnic and inter-religious peace and harmony in Turkmenistan, take into account the diversity of attitudes, to facilitate realization of the right of students to choose and the freedom of expression and belief.
3. the content of education in a particular educational institution defined educational program (educational programs), which ensure the achievement of the students requirements appropriate State educational standards.
 
Article 11. Forms of education and learning 1. Taking into account the needs and capacities of students mastering educational programs may occur through such forms of education as an educational institution, self-education, external studies.
2. Educational institutions use such forms of education as full-time (full-time), full-time-part-time (on-the-job training, with training outside working hours) and part-time (in-service training).
3. For all forms of education within a particular General or professional educational programs have uniform State educational standards.

Article 12. Categories of students to students depending on the educational program, the regime of stay in an educational institution are: 1) the pupils of children attending pre-school establishments, and children, mastering educational programme with a simultaneous residence or presence in the educational institution;
2) students-children, mastering educational programmes of primary, basic secondary and general secondary education, as well as non-formal education;
3) students are citizens, groups of elementary vocational education programs, secondary vocational, higher vocational education;
4) listeners citizens "programme of training and retraining, as well as training programmes;
5) èksterny-citizens enrolled in educational institutions to undergo intermediate and state final certification in general education programmes.
 
CHAPTER III. NETWORK of EDUCATIONAL INSTITUTIONS Article 13. Educational institutions 1. Educational institution is an institution that conducts educational activities, including implementation of one or more educational programs for students, as well as their education and maintenance.
2. Educational institution is a legal person.
3. Educational institutions in accordance with the legislation of Turkmenistan on property can be public, private and other forms of ownership.
The basis of the educational system of Turkmenistan comprise the State educational institutions.
4. The legislation of Turkmenistan in the field of education extends to all educational institutions on the territory of Turkmenistan, regardless of their form of ownership and affiliation.
5. educational institutions include the following types: 1) pre-school education;
2) educational institutions;
3) initial vocational training institutions;
4) institutions of secondary vocational education;
5) institution of higher professional education;

6) institutions, postgraduate education;
7) establishment of training and retraining;
8) special institutions for the education of students with disabilities;
9) special educational institutions for orphans and children deprived of parental care (alternates);
10) non-formal education;
11) other institutions engaged in educational activities.
6. the activities of educational institutions shall be governed by the model provisions on educational establishments appropriate types and forms of ownership, approved by the Cabinet of Ministers of Turkmenistan and developed on their basis of the charters of these educational institutions.
The structure of the Charter of the institution, its approval and registration shall be governed by the laws of Turkmenistan.
7. the status of educational institutions (type, type, form of ownership) is its founder.
8. Educational institutions of foreign countries or joint can be created in Turkmenistan in accordance with this law and other normative legal acts and international treaties to which Turkmenistan is a party.
9. Educational institutions for the purpose of developing and improving education has the right to establish educational associations, including with the participation of enterprises, institutions and organizations. Educational associations to carry out their activities in accordance with their charters. The procedure for the establishment, registration and operation of educational associations shall be determined by the legislation of Turkmenistan.
 
Article 14. The founders of educational institutions 1. The founders of educational institutions may be:-the public authorities and management;
-local authorities;
-domestic and foreign legal entities of all forms of ownership;
-public associations, registered on the territory of Turkmenistan;
-Turkmen citizens and foreigners.
In case of reorganization of the founder of his rights are transferred to the respective successors and assigns.
2. Educational institutions of all types and implementing educational programmes on training for military and law enforcement, created by decision of the Cabinet of Ministers of Turkmenistan.
3. the relationship between the founder and the educational institution are defined by the Treaty signed between them in accordance with the legislation of Turkmenistan.
 
Article 15. Modalities for the functioning of educational institutions 1. Educational institution created and registered in accordance with the legislation of Turkmenistan.
2. the right to conduct educational activities and benefits established by the legislation of Turkmenistan, the institution issuing the license.
The regulations on the procedure for the licensing of activities in the field of education and vocational training approved by the Cabinet of Ministers of Turkmenistan.
3. The right to an educational institution for the grant of its graduates document State standard of relevant education arises from the moment of its State accreditation, confirmed the certificate of State accreditation.
Certificate of State accreditation issued by the educational institution (excluding preschool), confirms its status, as well as the content and quality of training trainees State educational standards.
State accreditation of educational institutions shall be conducted in accordance with the procedure established by the Cabinet of Ministers of Turkmenistan.
4. State control of education quality is carried out by the State body managing education through the State final certification, certification of graduates of the educational institutions, as well as scheduled and unscheduled inspections of the content and quality of training students, their consistency with ongoing educational programmes in educational institutions.
Order of certification of educational institutions and inspection established by the Cabinet of Ministers of Turkmenistan.
5. Educational institution may be reorganized or liquidated in accordance with the legislation of Turkmenistan.
 
Article 16. Managing educational institutions 1. The management of educational institutions is effected on the basis of the legislation of Turkmenistan in accordance with their model provisions and statutes to the principle of undivided authority and collegiality.
2. Direct management of educational institution is performed by its head appointed to Office and released from Office in the manner prescribed by the legislation of Turkmenistan.
3. the name of the post of the head of an educational institution, its powers and responsibilities, procedures of formation and activities of the collegial bodies of educational institutions, the lines of authority between them are determined by the model provisions and statutes of educational establishments.
4. the head of State institution passes certification in accordance with the legislation of Turkmenistan.
5. Educational institutions creates collegial management bodies.

Forms of collegial management educational institution may be academic Council, Board of Trustees, pedagogical, methodical (uchebno-methodical, scientific-methodical) tips and other forms, the rules of the organization whose work, including the order of their election, shall be determined by the model provisions and statutes of educational establishments.
 
Article 17. General requirements for the Organization of educational activities 1. Organization of educational activity in an educational institution shall be carried out in accordance with the curriculum, educational programmes (courses) and class schedule.
2. Educational institution when the realization of educational programs uses a variety of educational technologies, including distance education, implemented with the use of information and communication networks at the interaction of students and teachers in the remote mode, and e-learning based on comprehensive application of information contained in databases, information technologies and equipment for its processing, information and telecommunication networks on its wire transfer.
3. Educational institution uses a system of assessments, forms, procedures and periodicity of intermediate and final appraisal students developed by the authorized body of public administration education.
To determine the structure of professional educational programmes and capacity development can be applied system illest units (credits).
4. development of programmes of general secondary education and vocational training programmes is completed obligatory state final attestation of students and issuance of the document on the appropriate education.
5. development of programmes for basic secondary education concludes with interim attestation of pupils on the basis of which issued the recommendation on the development of educational programmes of general secondary education the corresponding direction (the profile).
6. Discipline in an educational institution is maintained on the basis of respect for the human dignity of pupils and teachers. The use of physical and mental violence against students is not allowed.
7. Educational institution carries out individual accounting results development of students educational programmes, as well as storage in the archives of data about these results on paper and/or electronic media in order to be determined by the authorized body of public administration education.
 
Article 18. General requirements for reception of citizens in the educational institutions 1. General requirements for admission of citizens of Turkmenistan in educational institutions are regulated by the present law and model provisions on educational establishments appropriate types and forms of ownership.
2. When receiving a citizen in an educational institution is obliged to acquaint his last and (or) its parents (alternates) the Charter educational institutions, authorization documents for the right of conducting educational activities and issuing of the relevant education of national standard, basic educational programmes implemented this educational institution and other instruments governing the Organization of the educational process.
3. Turkmenistan provides access to pre-school and general education of all children residing on the territory of Turkmenistan and have that right in accordance with the prescribed age.
4. Reception of citizens in public pre-school and general educational establishments is carried out according to the parents (alternates).
5. Reception of citizens in public educational institutions to obtain vocational training is carried out on a competitive basis on citizens ' applications. Conditions of the contest shall be ensured compliance with State guarantees citizens ' rights to education and the admission of citizens of the most capable and prepared to develop relevant professional education program.
6. the State institutions of secondary vocational and higher vocational education for trades and (or) areas of training, requiring the presence of incoming persons certain creative abilities, physical and/or psychological qualities, have the right to conduct additional examinations of creative and (or) of professional orientation, the results of which are taken into account in the conduct of the competition, together with the results of the entrance examinations on general subjects.
List of directions of training (professions) with additional tests may be conducted with creative and (or) professional orientation is determined by the Cabinet of Ministers of Turkmenistan.
List of additional tests and conditions in institutions of secondary vocational and higher vocational education, which is related to entering public service and citizens access to the information constituting a State secret, are established by the Cabinet of Ministers of Turkmenistan.
7. Out of competition is credited to government institutions professional education upon successful passing of entrance examinations:

-orphans and children left without parental care (alternates);
-disabled children, disabled persons in groups I and II, which according to the establishment of a medical social examination is not contraindicated training in relevant educational institutions;
-children of employees of military and law enforcement officers killed in the line of duty.
8. Priority enrolment in public institutions professional education upon successful passing of entrance examinations are:-State winners of the Olympiad of schoolchildren, members of national teams of Turkmenistan participated in the international Olympiads in general educational subjects in the year proceeds;
Turkmenistan champions and winners of international competitions, entering the educational institutions in the areas of training (specialty) in the sphere of physical culture and sports;
-winners of national and international artistic contests coming in educational institutions on the creative direction of training (specialty);
-disabled persons in Group III.
9. Article 19. Special educational institutions 1. CHAPTER IV. The IMPLEMENTATION of EDUCATIONAL PROGRAMMES Article 20. Pre-school education 1. Preschool education serves the purposes of education and upbringing of children in early childhood, laying the foundations for ensuring physical and intellectual development of the individual child, accustoming it to national and universal spiritual and cultural values, identification and development of abilities and talents.
2. Educational programs for pre-school education is usually covered by children aged one to six years.  
3. For the upbringing and education of children of pre-school age in helping the family in Turkmenistan operates a network of preschools.
As types of pre-school institutions based on the terms of their operation may be: nurseries, kindergartens, nurseries and other.
4. Public Administration Education carry out methodological guidance and supervision of the activities of all preschool institutions regardless of their departmental subordination and forms of ownership.
5. An integral part of pre-school education is to prepare pre-schoolers to develop an educational program for primary education which is compulsory and is carried out in the home, in preschool or other educational institutions.

Article 21. Primary education 1. 2. Primary education is compulsory.
3. Training on educational programmes for primary education begins with children up to age six years entering year general education institution.
4. Normative term of getting the educational programmes of primary education shall not be less than four years.
5. primary education can be obtained in one of the following educational institutions: school, specialized secondary school (with specializations), boarding school and others.
6. primary education is completed the transition to teaching programme on educational basic secondary education.
 
Article 22. Basic secondary education
 

1. basic secondary education educational programs focused on the formation and development of student's personality by shaping of ethical beliefs, he has aesthetic taste and the desire for a healthy lifestyle, high culture of interpersonal and interethnic communication, mastering the basics of science, skills, mental and physical work, revealing his inclinations and interests.
Educational programs of basic secondary education aimed at developing students ' abilities of social self-determination and formation of a conscious career guidance.
2. Basic secondary education is compulsory.
3. educational programs basic secondary education begins with children with primary education.
4. Normative term of getting the educational programmes of basic secondary education is usually six years, and taking into account the primary education-ten years.
5. Basic secondary education can be obtained in one of the following educational institutions: school, specialized secondary school (with specializations), boarding school and others.
6. the development of educational programs of basic secondary education does not complete the State final attestation and issuance of the document on education.
Mastering educational programs of basic secondary education concludes with interim certification on the basis of which issued the recommendation on the development of educational programmes of general secondary education in the appropriate direction (the profile).
 
Article 23. General secondary education 1. Educational programmes of general secondary education aims to develop the cognitive interests and creative abilities of the student; formation of skills training activities on the basis of specialized vocational guidance, differentiation and content of education; preparing the learner for life in society, independent life choice and start work.
Educational programmes of general secondary education aimed at preparing students for professional development education programmes.
2. the content of the educational programmes of general secondary education is determined on the basis of specialized training, i.e. the orientation of educational programmes on specific areas of knowledge that define its subject-the thematic content, the prevailing types of training activities and the requirements for the results of the development of the educational program.

7. Citizens of Turkmenistan did not fully mastered the educational program for receiving the document of secondary education may complete them through a system of external, approving the notified body of public administration education.
8. the development of educational programmes of general secondary education in general education institutions completes the State final attestation and issuance of certificate of secondary education, allowing the programme to vocational education.
 
Article 24. Out-of-school education 1. Out-of-school education are an integral part of the education system and aims to develop the abilities and talents of students, their interests, spiritual needs.
2. in order to develop multifaceted interests and abilities of students created a network of out-of-school education: cultural, aesthetic, scientific, technical, sports and others.
3. Extracurricular activities are conducted jointly with educational institutions, public associations, creative groups and is based on the principle of voluntary choice of both types of institutions and activities.
4. The activities of the various types of institutions out-of-school education is governed by the model provisions of them approved by the authorized body of public administration education.
 
Chapter v. IMPLEMENTATION of PROFESSIONAL EDUCATIONAL PROGRAMMES Article 25. Elementary professional education
 

1. Basic vocational education is the training of skilled labour in all major areas of socially useful activity.
2. training of the citizen of Turkmenistan on programme of initial vocational training is carried out on the basis of not lower general secondary education.
3. Basic vocational education can be obtained at elementary vocational training institutions of different kinds (professional school, the Lyceum, and others), as well as in institutions of secondary vocational and higher vocational education, with appropriate licenses.
4. Training in institutions of elementary professional education is conducted both on internal and correspondence forms of training taught.
5. occupations, including forms of training are determined by the State classifier of professions of initial vocational training of Turkmenistan or by the Cabinet of Ministers of Turkmenistan.

2. training of the citizen of Turkmenistan on programme of secondary vocational education is carried out on the basis of not lower general secondary education.
3. Secondary vocational education can be obtained at institutions of secondary vocational education of various types (average vocational school, College, and others) and institutions of higher professional education, with appropriate licenses.
4. Training in institutions of secondary vocational education is conducted by full-time, full-time-part-time and extra-mural forms of studies.

8. Article 28. Postgraduate education 1. Postgraduate education as the highest level of continuing education in Turkmenistan is the training of scientific personnel of higher qualification.

Article 30. Improvement of professional skill and retraining of personnel 1. Improvement of professional skill and retraining of personnel are carried out with the aim of increasing professional knowledge and skills, update professional knowledge taking into account modern advances in science and technology, as well as international practices, acquire new skills, specializations and qualifications.
2. In accordance with the labor laws of Turkmenistan the employer for their own needs independently determines the need for frames, forms, training and retraining, which are carried out in the manner determined by the work or collective agreement (Agreement), as well as performing employees relevant activities (work, service).
If the employee on vocational retraining or upgrading without good reason is not fulfilling its obligations under the Treaty, it shall reimburse the amount of the expense incurred by the employer for this purpose.
3. Improvement of professional skill and retraining of personnel (workers, employers, professionals) can be made at the expense of the State, or on a contract basis in educational institutions of all types, research organizations and industries, other organizations with license to operate in the field of education and vocational training and education, defined by programmes of training and retraining.
4. Issues of organization and conducting of training and retraining shall be governed by the laws of Turkmenistan.
 


CHAPTER VI. MANAGEMENT OF THE EDUCATION SYSTEM

 
Article 31. The powers of the Cabinet of Ministers of Turkmenistan in the area of education, the Cabinet of Ministers of Turkmenistan in the field of education: 1) ensures compliance with the Constitution of Turkmenistan, this Act, the acts of the President of Turkmenistan and the decisions of the Cabinet of Ministers of Turkmenistan, international treaties related to education;

8) organizes the execution of the State budget of Turkmenistan in the field of education;
9) develops and implements government social policies with respect to staff in the education system, support the least socially protected students;
10) carries out measures on the development of pedagogical sciences;
11) provides for cooperation with foreign countries and international organizations in the field of education.
 
Article 32. Public administration education 1. In Turkmenistan for management education creates a system of organs of State administration of education, which act within the authority established by this law and other normative legal acts of Turkmenistan.
2. Public administration education in Turkmenistan are: the authorized body of State management of education;
local executive bodies.
 
Article 33. Powers of the authorized body of public administration education authority body of the Government:-implements State policy in the field of education;
-develops perspectives and directions of development education, requirements for the content, level and scope;
-develops State educational standards;
-coordinates the activities of educational institutions;
-provides international cooperation with other States, study and dissemination of advanced world experience;
-develops regulatory guidance documents on the Organization of educational, educational, methodical and scientific work, educational institutions of all types;
-participates in the drafting of the State budget of Turkmenistan in the field of education;
-carries out scientific-methodical maintenance of State final certification and quality control of preparation of graduates who, upon completion of the relevant stage of Education issued documents state;
develops terms of admission in educational institutions;
-establishes the procedure for admission of foreign citizens and stateless persons in pre-school and general educational establishments;
-developing model provisions for educational institutions, the order of their certification and accreditation;
-carries out licensing of activities in the field of education and vocational training;

-carries out the procedures for the recognition and establishment of equivalence of foreign States on education in Turkmenistan;
develops order appraisal and development educators.
Normative-legal acts prepared by the authorized body of public administration education may be approved by this authority on behalf of the Cabinet of Ministers of Turkmenistan.
 
Article 34. Powers of the local authorities in the field of management education to the competence of the local authorities include:-registration of children subject to compulsory education in educational institutions, implementing educational programmes of primary, basic secondary and general secondary education;
-development of a network of pre-school and general educational institutions, strengthening their resource base, providing commercial services;
-ensuring the maintenance of buildings and structures of pre-school and general educational establishments, construction of adjacent territories;
-social protection of educators, students, as well as the creation of conditions for their work, education and training in accordance with the regulations in logistic and financial support;
-catering of students and pupils in pre-school institutions;
-providing due to local budgets for the regular transportation of students to place learning in rural areas;
-Organization of training-methodical maintenance of educational institutions, improving the professional level of teachers, improving their skills;
-identification of needs and order for teaching staff, their training contracts;
-monitoring compliance with State requirements to the level of pre-school and general secondary education.
 
Article 35. Education documents 1. Document on Education issued to persons successfully completing General education stage of general secondary education is general certificate of secondary education.
2. Documents on education, issued to persons who successfully complete their professional education programs the following levels of education are: 1) the initial professional education-diploma of primary vocational education;
2) secondary vocational education-diploma of secondary vocational education;
3) higher education (baccalaureate)-Bachelor's degree;
4) higher education (master's degree)-master's degree;
5) higher education (specialist)-diploma.
3. State educational agencies that implement programmes of general secondary education and professional education programs, successful graduates are being issued by the State final attestation, government documents, certifying receipt of appropriate education and duly signed by the Chief Executive Officer and seal of the corresponding educational institution.
4. Educational institutions of non-State form of ownership that implement programmes of general secondary education and professional programs in the prescribed manner the State attestation and accreditation, graduates, successful State final certification, a corresponding document State standard of education, certified by the signature of the Chief Executive Officer and seal of the corresponding educational institution.
5. the Government of the relevant education is a prerequisite for continuing education in the State educational institution of Turkmenistan on programme of subsequent stages of education.
6. Stage of vocational education and qualifications, referred to in documents on vocational education, provided their owners the right to engage in professional activities on the territory of Turkmenistan, including posts, for which in accordance with the legislation determined mandatory qualification requirements for education.

10. State educational establishments and educational institutions of non-State form of ownership, in accordance with established procedure the past State attestation and accreditation that implement programmes of training and retraining and vocational training, graduates have successfully completed training, government documents certifying the receipt of relevant qualifications and duly signed by the Chief Executive Officer and seal of the corresponding educational institution.

15. Documents on education and (or) qualifications are issued in the official language of Turkmenistan.
Education documents and (or) about qualifications can also be decorated in a foreign language in the manner prescribed by the authorized body of public administration education.

CHAPTER VII. ECONOMICS OF EDUCATION

 
Article 36. Funding for educational activities 1. The activities of an educational institution shall be funded in accordance with this law and other normative legal acts of Turkmenistan.
2. Financing of public educational institutions is effected on the basis of financing standards defined for each type and type of educational institution per one student taking into account the content of the educational programmes and teaching technologies, forms of training, special educational conditions for students with disabilities, ensuring a secure and safe environment training and education, protecting the life and health of students.
3. For ungraded rural and as such considered educational institutions, defined on the basis of the conditions of their remoteness from other educational institutions, transport availability and (or) the number of pupils, the standard should take into account the financing costs regardless of the number of students.
4. Non-State educational institutions to finance its activities applying the standards of financing public educational institutions as a minimum level.
5. Admission on a competitive basis to obtain for the first time at the expense of the State budget of Turkmenistan vocational or secondary vocational or higher vocational education in the relevant public educational institutions within the State educational standard is carried out in accordance with the plan of reception of students on training, approved by the Cabinet of Ministers of Turkmenistan.
6. Educational institution is entitled to involve in the manner prescribed by the legislation of Turkmenistan, additional funding at the expense of providing paid additional educational and other statutory educational institutions receiving additional services on major educational programs on a fee basis, as well as at the expense of voluntary donations and contributions of legal entities and (or) physical persons of Turkmenistan, as well as legal entities and (or) physical persons of foreign States.
While attracting additional funds educational institution does not entail lowering the standards and (or) the absolute size of its financing at the expense of the founder.
7. Within existing extra-budgetary resources educational institutions can independently provide social support to needy students.
8. Educational institution independently carries out financial and economic activity, has independent balance and account.


 



Article 37. Paid educational activities



 

1. State educational institutions of vocational education have the right to carry out training on contracts with legal entities and (or) physical persons from paying their tuition in the following cases: 1) over targets students admission to relevant professional education programs financed by the State budget of Turkmenistan;
2) upon learning by full-time or part-time distance learning;

3) to get the second education on the corresponding level of vocational education.
2. State educational institution under an appropriate license may provide to the population, enterprises, institutions and organizations other paid educational services.
3. income from paid public educational institution specified in parts 1 and 2 of this article, you use them in accordance with the statutory objectives.
Paid educational services cannot be rendered instead of educational activities, funded by the State budget of Turkmenistan. Otherwise the funds, earned through such activities, shall be in the State budget of Turkmenistan.
4. Non-governmental educational institution will charge students a fee for educational services.
Paid educational activities of such an educational institution is not considered as a business, if the resulting income from it completely goes for cost recovery to ensure educational activities (including wages), its development and improvement.
Relationship of non-governmental educational institution and the student, his parents (alternates) are governed by a contract, defining the level of education, duration of tuition, fees, guarantees and responsibility of educational institutions in cases of suspension or revocation of the license, deprivation of educational institutions of termination of activities of the State accreditation of educational institutions and others.
5. Educational institution has the right to conduct entrepreneurial or other gainful activities, in accordance with the legislation of Turkmenistan.
6. individual labour pedagogical activity, accompanied by income is considered as a business and is subject to registration in accordance with the legislation of Turkmenistan.
 
Article 38. Educational lending 1. Turkmenistan granted State support of educational crediting of citizens enrolled in professional education programs both in the respective educational institutions of Turkmenistan and foreign States.
2. Educational loans are earmarked and are provided by banks and other credit organizations of Turkmenistan citizens enrolled in vocational education, regardless of their form of ownership and form of training.
3. Educational loans can be directed to tuition institutions of vocational education in the amount of the cost or a portion of the cost of education (primary education) and (or) to pay for their stay, meals, purchase of educational and scientific literature and other living expenses during the training period (the accompanying student loan).
4. Dimensions and procedure for the provision of State support of educational crediting shall be determined by the Central Bank of Turkmenistan.
 
Article 39. The material base of educational institutions 1. The material base of educational institutions make up the land, buildings, equipment, vehicles and other property of the consumer, social, cultural and other destination used for learning, education and other problems in the field of education.
Depending on the form of ownership of an educational institution base material can be owned or docked behind him full rights of economic management or operative administration, or used them on loan or otherwise.
2. Educational institution is responsible before the owner for safety and efficient use of property.
3. the exemption and (or) the alienation of the property, fixed for the educational institution is permitted only in accordance with the legislation of Turkmenistan.
4. State property, which is for the educational institution may be leased by the owner in accordance with established legislation of Turkmenistan.
5. Educational institution, which has property, has the right to act as his landlord.
6. production and social infrastructure Objects, including accommodation, school buildings, industrial, social, cultural facilities and dormitories, as well as clinical medical education institutions base located in the operational management of State educational institutions or other conduct, privatisation (deregulation) will not be considered.
7. the founders of educational institutions under its authority shall ensure the renewal and development of their material resources and social conditions of education and training, taking into account the increasing requirements to the level and quality of education. For this purpose, educational institutions are allocated the necessary material resources and capital investments.
8. Intentional acts, resulting in a decrease or degradation of the material base of educational institutions have the responsibility established by the legislation of Turkmenistan.


 



CHAPTER VIII. SOCIAL GUARANTEES FOR THE REALIZATION OF CITIZENS ' RIGHTS TO EDUCATION

 
Article 40. Law and social support of students
 

1. Rights and responsibilities of students of educational institutions shall be determined by the present law, the model provision and the statutes of the educational institution.
2. Turkmen citizens have the right to choose an educational institution and forms of education in the manner to be determined by the present law and other normative legal acts of Turkmenistan.
3. Students in all educational establishments have the right to receive an education in accordance with State educational standards, for additional (including fee-paying) educational services as well as free textbooks and manuals in State educational institutions.
4. Graduates of educational institutions with State accreditation, regardless of their forms of ownership enjoy equal rights of access to the educational institution following steps.
5. Studying in State educational institution in the manner prescribed by the legislation of Turkmenistan are provided with grants, places in hostels and boarding schools, they also apply other measures of social support.
6. Turkmen citizens have the right to free education in State educational institutions in the development of educational programmes, and first-professional education programs at the corresponding level, on a competitive basis.
7. Studying in professional educational institutions on full-time-part-time and distance learning are eligible for benefits in the manner established by the legislation of Turkmenistan.

Article 41. Protection of life and health of students 1. Educational institution creates the conditions to guarantee the protection of the lives and improving the health of students.
Academic and extra-curricula load, students are determined by the authorized body of the Government entity, educational institution Charter taking into account the recommendations of the health authorities.
2. For children in need of long-term care are health institutions, including a sanatorium. Training for these children can be educational institutions at home or in hospitals.
3. Teaching staff of educational institutions are required to take place at the expense of the employer periodic free medical check-ups.
4. Medical trainees educational institutions provide health authorities. Educational institution is obliged to provide the premises with relevant working conditions of health workers.
5. Schedule an educational institution must include sufficient length break for nutrition students.
Creation of conditions for nutrition in educational institution lies with the institution itself. The educational institution must be provided premises for catering students.

6. Responsibility for creation of necessary conditions for study, work and rest of students educational institutions are officials of educational institutions in accordance with the legislation of Turkmenistan and the statutes of the educational institution.
 
Article 42. Rights and duties of parents (alternates) juvenile students 1. Parents (substituting persons) juvenile students are obliged to raise their children, to take care of their health, development, education and prepare them for work, inculcate a culture of respect for laws, historical and cultural traditions of the Turkmen people, national and universal values.
2. parents (substituting persons) juveniles enrolled prior to receiving the latest compulsory general secondary education have the right to choose the form of education, educational institutions, protect the legitimate rights and interests of children, to participate in the activities of an educational institution.
3. parents (substituting persons) juvenile students are obliged to ensure that their children receive compulsory general secondary education.

5. parents (substituting persons) of juvenile students are responsible for their upbringing and education in accordance with the legislation of Turkmenistan.
 


CHAPTER IX. PEDAGOGICAL WORKER STATUS

 
Article 43. The notion of a pedagogical employee and his/her status 1. The pedagogical employees include those dealing with education (pedagogical) activities related to training and (or) the upbringing of students in educational institutions, and other organizations that implement educational programs.
Teaching staff of higher educational institutions with degrees and (or) scientists rank, defined as well as scientific and pedagogical workers.
2. the State recognizes the special status of teachers in society and creates the conditions for the exercise of their professional activities.
 
Article 44. Lesson teaching activities 1. The right to engage in teaching activities at educational institutions have a person with relevant pedagogical or professional education.
2. To implement educational programmes referred to in paragraph 3 of article 8 of this law, the following minimum level of qualifications of teaching staff: 1) early childhood education: preschool teacher-diploma (Bachelor's degree), issued by an institution of higher education pedagogical profile;
2) primary education: primary school teacher-diploma (Bachelor's degree), issued by an institution of higher education pedagogical profile;
3) basic secondary and general secondary education: subject teacher-Bachelor's degree (diploma), issued by the Faculty of the pedagogical profile higher educational institution or pedagogical higher educational institution, as well as a Bachelor's degree (diploma) on relevant humanitarian, a math or science provided additional teacher training course in higher school (Faculty) of the pedagogical profile.
3. For the implementation of vocational training programmes referred to in paragraph 4 of article 8 of this law, the following minimum level of qualifications of teaching staff: 1) primary education: teacher professional subjects-diploma of secondary vocational education on the appropriate specialty secondary vocational educational institution, provided additional teacher training course in higher school (Faculty) of the pedagogic profile and work experience specified in the diploma not less than three years;
2) secondary vocational education: teacher professional subjects-a diploma in a relevant Bachelor's degree on a specialty or appropriate in training provided additional teacher training course in higher school (Faculty) of the pedagogic profile and work experience (in preparation), specified in the diploma, not less than three years;
3) higher education: teacher-master's degree (diploma) in the appropriate direction (specialty), issued by the Faculty of the pedagogical profile higher educational institution or pedagogical institution of higher education or master's degree (diploma) is not on the teacher in the training provided additional teacher training course in higher school of pedagogical profile (Faculty); a person in possession of a diploma, you must have a length of service of not less than three years in the area of chosen educational activities.

5. pedagogical activities in educational institutions are not allowed the people to whom it is prohibited to conclude a medical Consultative Commission on the basis of medical evidence or a court sentence for a crime committed, as well as persons with convictions for premeditated offences of medium gravity, serious and particularly serious crimes.
The list of diseases that do not allow the occupation of pedagogical activity is approved by the authority on health management in agreement with the Cabinet of Ministers of Turkmenistan.

7. Persons engaged in the teaching activities are exempt from the pedagogical work in the manner prescribed by labour legislation of Turkmenistan, in the following cases:-post mismatches due to insufficient qualification or health status, hindering implementation of the pedagogical functions;

-committing immoral transgression incompatible with the continuation of pedagogical activity;
-non-compliance with other requirements of the labour legislation of Turkmenistan and of the Charter of the institution.
 
Article 45. Rights and duties of workers 1. Teaching staff have the right to:-to ensure the conditions for their professional activities;
-individual pedagogical activity;
-to protect professional dignity and honour;
-training;
-the preferential provision of educational-methodological and scientific literature;
-the material and moral encouragement for successes in teaching and educating the younger generation.
2. Pedagogical workers with higher pedagogical education, and working in public authority on teaching positions in educational institution located in rural areas, for the period of work in it are eligible for deferment of the conscription under the law of Turkmenistan "on conscription and military service".
3. Teaching staff in educational institutions located in townships and villages, are provided with appropriate social and living conditions in accordance with the legislation of Turkmenistan.
This pedagogical workers is installed in addition to the official salary in accordance with the procedure determined by the legislation of Turkmenistan.
4. Pedagogical employees are required to:-to constantly improve their professional knowledge and pedagogical skills;
-respect the honour and dignity of pupils, their parents (alternates), as well as work colleagues;
-to conduct training at the highest professional level, to ensure uptake of the curriculum students at the compulsory State requirements;
-create conditions for development and individual and creative abilities of students;
-to observe the rules of teaching ethics.
Pedagogical employees do not use their position in the educational process vis-à-vis students for political purposes or to encourage them to act contrary to the Constitution of Turkmenistan.
 
Article 46. Labour relations in the education system 1. The employment relationship between the employee and the educational institution are regulated by the labour legislation of Turkmenistan.
2. With the teachers of educational institutions of vocational education employment contracts are concluded for a specific period according to the results of the competition carried out in the manner prescribed by the authorized body of public administration education.
3. For teacher educators set short working time of not more than thirty-six hours per week.
Features of moonlighting for pedagogical workers in accordance with the labor laws of Turkmenistan are determined by the regulations on working conditions, approved by the Cabinet of Ministers of Turkmenistan.
4. For teachers and managers of educational institutions in accordance with the labor laws of Turkmenistan establishes the annual basic paid vacation of forty-five calendar days.
Annual basic leave, usually during summer holidays, regardless of the time joining this educational institution.
5. An employee of the institution, successfully combining pedagogical or production activity with scientific work, on recommendation of the Academic Council in accordance with the labor laws of Turkmenistan granted sabbatical to write textbooks and teaching manuals, to complete the dissertation on competition of a scientific degree with saving the average salary and position at the place of work.
6. the salary of an employee of an educational institution is paid for his functional responsibilities and work covered by an employment contract.

Pedagogical worker wages are determined on the basis of tariff rates and salaries taking into account the occupational category. Professional category is established depending on the skill level of the pedagogical worker, complexity and intensity of work, its conditions, the quantity and quality of labor spent.
Professional categories of teaching staff and the timing of its actions are installed in the order specified by the authorized body of public administration education.
7. employees of educational institutions of all types and other enterprises, institutions and organizations in carrying out educational activities establishes the pay supplements for academic degree and rank of scientists in the manner and amount determined by the Cabinet of Ministers of Turkmenistan.


 



 



CHAPTER X. INTERNATIONAL ACTIVITIES



IN THE FIELD OF EDUCATION

 
Article 47. International cooperation 1. International cooperation of Turkmenistan in the field of education are carried out in accordance with the legislation of Turkmenistan and the international treaties to which Turkmenistan is a party.
2. The authorized body of public administration education carries out international cooperation in education through a system of analysis and forecasting of current global processes in the field of training and education of young people, as well as inter-State relations, aimed at studying and implementing advanced pedagogical experience and establishing effective linkages for training.
Authorities exercising control in the sphere of education, educational institutions can establish direct communication with foreign enterprises, institutions and organizations that implement the various educational programs, in a manner to be determined by the Cabinet of Ministers of Turkmenistan.
3. people of Turkmen nationality who are not citizens of Turkmenistan have the right to receive education in educational institutions of Turkmenistan under the conditions laid down for citizens of Turkmenistan.
4. Turkmenistan contributes to meeting the educational needs of people of Turkmen nationality living abroad, by providing assistance in training and providing educational-methodical literature in the Turkmen language, in the manner prescribed by international treaties to which Turkmenistan is a party.
5. education of foreign citizens in the educational institutions of Turkmenistan, as well as Turkmen citizens in foreign educational establishments, is carried out under the direct contracts concluded between entities as well as individuals with educational institutions, management bodies in the field of education, in accordance with this law and other normative legal acts and international treaties to which Turkmenistan is a party.
6. receipt of foreign citizens and stateless persons permanently residing in Turkmenistan, education in educational institutions of Turkmenistan is carried out in accordance with this law, other legal regulations and international treaties to which Turkmenistan is a party.
7. Organization and functioning on the territory of Turkmenistan of educational institutions (or their affiliates) of foreign States or joint with them shall be carried out in accordance with this law and the international treaties to which Turkmenistan is a party.
8. recognition of documents of foreign States about education, about the awarding of academic degrees and ranks of scientists on the territory of Turkmenistan is carried out in accordance with the law and international treaties to which Turkmenistan is a party.
 
Article 48. Foreign economic activity management bodies in the field of education, educational institutions have the right to carry out foreign economic activities, in the manner prescribed by the legislation of Turkmenistan.


 



CHAPTER XI. FINAL PROVISIONS

 
Article 49. Liability for violation of the legislation of Turkmenistan on the formation of the violation of the legislation of Turkmenistan on education implies the responsibility established by the legislation of Turkmenistan.
 
Article 50. The entry into force of this law 1. This law enters in force from September 1, 2013 onwards, except for provisions for which this clause establishes the dates of their entry into force.
2. the provisions of this Act relating to educational programmes of general secondary education stage, will take effect from the 2014/2015 academic year.
3. the provisions of this Act relating to educational programs of higher professional education (Bachelor's degree, master's degree), will take effect from the year of introduction of these levels of education according to the established requirements for them.
4. Paragraphs 1 and 2 of part 2 of article 44 of this law shall become effective from the year of training teachers in preschool and primary school teachers of higher vocational education programme.
5. From the date of entry into force of the present law normative legal acts, regulating relations in the sphere of education, apply insofar as they are not inconsistent with this Act or issued in accordance with it, other regulatory legal acts of Turkmenistan.

6. In order to harmonize educational activities in accordance with the present law previously issued license for conducting educational activities are reissued to January 1, 2016 onwards.
