Energy Conservation Act

President

Based on the provisions of the Constitution, and as approved by the People's Assembly at its meeting held on 20/2/1430 A.H., 15/2/2009, the following shall be issued:

Section I

Definitions and terminology

Article 1

Definitions

The following words and expressions shall mean where they are contained in this Act, as shown by each of them:

- Law: Energy Conservation Act

- Minister: Minister of Electricity

- Centre: National Centre for Energy Research, updated by Law No. 8 of 2003

- Board of Directors: Board of Directors of the National Energy Research Center

- Director General: Director of the National Center for Energy Research.

- Fossil fuels: oil, natural gas, coal, or shale oil.

- Energy bearings: are all materials that contain latent energy that is being converted into use in various fields of human activity such as oil and its derivatives, natural and biological gas, electric power, coal, wind, solar radiation, biomass.

- Energy conservation: actions and measures taken to reduce the amount of energy used in all aspects of production and consumption while maintaining the same performance.

- Renewable energy: Sustainable energy that is inexhaustible with consumption and includes solar energy, wind power, biomass energy, geothermal energy, hydro, tidal, and wave energy.

- Rationalization of energy consumption: the set of behavioural measures and engineering measures that lead to the reduction of waste in energy consumption of different types.

- Improved energy efficiency: the set of engineering, scientific and technical measures and measures that reduce the qualitative consumption of energy in energy consuming devices without affecting the quality of work and performance.

- An examination of energy: the study of energy consumption in all forms, the moment of waste and the irrational use of it, and the creation of appropriate technical solutions to improve efficiency and minimize waste so that these solutions are economically viable.

- An energy liaison officer is a factor that is called by the relevant actor who has sufficient experience in saving energy consumption and raising the efficiency of its use.

- Code: It is expressed in the symbolic order, the set of instructions and technical procedures governing a particular applied scientific subject.

Part two.

Objectives of law

Article 2

The law aims to:

a. To support the economic and social development of the Syrian Arab Republic.

b. prolongation of fossil fuel reserves available in the Syrian Arab Republic for as long as possible.

C) Reduced negative environmental impacts resulting from the use of various conventional energy bearings.

d - To contribute to meeting the requirements of sustainable development.

It shall work to achieve the above objectives as follows:

1. To deploy and apply energy conservation concepts that include saving and maintaining energy consumption and raising the efficiency of its use in all areas with a lasting effect on energy production and consumption rates.

2. Deploy the use of renewable energies with their various applications.

Section III

Law enforcement agencies

Article 3

This Act shall apply to the following:

a. All energy producers, distributors and consumers of different types of energy, whether governmental, private and joint.

b. All importers and local manufacturers of energy-consuming and energy-generating devices.

C) Unions, institutions and engineering offices that work in the field of design of buildings, installations, sites and energy consuming equipment belonging to the public, private or joint sector.

d - Public and private educational institutions, scientific research centres, grass-roots organizations, civil societies and religious bodies.

Article 4

The parties mentioned in article 3 of the provisions of this Law shall apply the following procedures:

a. To conserve energy by rationalizing its consumption and raising the efficiency of its use in the near, medium and long term in accordance with the provisions of this law.

b. Take advantage of renewable energy applications and increase the participation of these applications in all sectors.

C) To adopt concepts of energy conservation during design, implementation and use in all areas.

d - Orientation towards local manufacture, importation and marketing of equipment and equipment consumed for high efficiency, as well as equipment and equipment for renewable energies with high technical levels.

Section IV

Chapter I

Functions of the Centre in the application of law

Article 5

Specifies the functions of the Centre as follows:

a. Monitor the application of the provisions of this law and monitor their good compliance.

b. Development of policies and strategies in the field of energy conservation and determination of the energy needs of the country in the near and distant future.

C) Preparation of draft laws for the production of assets and draft regulations and codes governing all forms of energy conservation and the development of renewable energy applications in all sectors, in cooperation with universities, scientific research centres and relevant ministries and institutions The Syrian Arab Configuration and Standards Authority and the Syrian Engineers' Union and its removal through the Minister to the Council of Ministers for the adoption of assets prior to their implementation.

d - To guide local manufacturers and importers to raise the efficiency of electrical appliances used in the domestic, commercial and service sectors through a card on energy consumption, or what is known as the energy spitting of each household, industrial or commercial device that consumes energy for operation and status. e Mandate the organizational units to maintain energy in the public by working to implement the provisions of this Act under the direction of the Centre and to ensure the proper training of the components of these services and units to carry out this task in the required form.

And - Cooperation with the relevant ministries to develop proposals for government facilities, physical incentives, tax and customs exemptions, and to propose financing and banking mechanisms to encourage energy conservation and raise them through the Minister to the Cabinet for adoption of assets.

g The creation of laboratories to test and evaluate the performance and development of systems used in the areas of energy conservation.

h Preparation of awareness-raising and education programmes in the field of energy conservation and dissemination in the visual, print and audio media, exhibitions and training courses in the field of energy conservation for other stakeholders, in addition to cooperating with the Ministry of Education to introduce concepts of rationalizing consumption Energy in school curricula and the guidance of community associations, grass-roots organizations and religious bodies to adopt and activate such programmes after providing them with the necessary information and data.

i Projects in various areas of energy conservation shall be carried out in order to recover the amounts paid for the savings resulting from the implementation of these projects to the owner of the relationship with a part of the profit set by the Governing Council and by the proposal of the Director General of the Centre.

j To direct the private sector and activate its role in energy conservation and stimulate it to create private or joint companies with the concerned parties in accordance with the provisions of the laws and regulations that are specific to energy services.

K Working with stakeholders to include the science and concepts of energy conservation in educational curricula, in addition to the graduation of two metaphorically in this sciences, including the axes of saving energy consumption, raising the efficiency of their use, and using renewable energies in practical scientific research plans. l Work with the private sector to take advantage of the potential of electric power generation using renewable energy sources.

Chapter II

Regulatory units for energy conservation

Article 6

Organizational units for energy conservation

Article 7

Organizational units are divided into two sections:

a. Central organizational units: the updated units in the ministries, institutions and their directorates in the governorates, as well as trade unions and public bodies, and all donors for building licenses. These units work in coordination with the Centre according to the tasks assigned to them by them and explained. Later in the law.

b. Sub-organizational units: the updated units in the facilities and locations identified by the central organizational units in cooperation with the Centre, whether public or private, and depending on the overall consumption and the qualitative consumption of these facilities and locations, and these units operate in accordance with the guidance The central organizational units and the Centre in accordance with the functions assigned to them and subsequently explained in this Law.

Section V

Energy conservation in the industrial sector

Article 8

Energy conservation measures in the industrial sector

1. The organizational units for the conservation of updated energy in the ministries of industry, electricity and oil, their directorates in the provinces, their industrial enterprises and the productive industrial sectors, wherever there are central organizational units, supervise the existing sub-organizational units. Public or private industrial facilities under the supervision of the ministries concerned.

2. The central units are a link between the subsidiary organizational units located in the industrial facilities and the centre.

3. Functions of subsidiary organizational units for energy conservation in industrial facilities:

a. Establishment of databases on the consumption of all energy bearings, production quantities and all energy-consuming equipment in the public or private unit of the unit.

b. To prepare monthly and annual reports on the consumption of various energy pregnant women in accordance with the modelling adopted by the Centre and to provide it with the information contained in such reports, which affect the private enterprise of the Centre and are used solely to achieve the provisions of this law.

C) Identify opportunities to rationalize energy consumption and raise the efficiency of its use by preparing energy audit studies in cooperation with central organizational units and the Centre and proposing appropriate and economically viable solutions.

d - Implementation of all work assigned to it by the central organizational units and the Centre with a view to applying the provisions of this Act.

4. The subsidiary organizational units shall be equipped with the equipment and equipment required for the preparation of energy reports and the studies of the energy inspection at the expense of the facilities for which such units are followed.

5. The energy reports and energy audit studies of industrial facilities are studied by the central organizational units and the Centre and the selection of projects proposed for implementation will be in accordance with the results of the economic feasibility studies.

6. The industrial facilities are committed to implementing the projects proposed and approved by the central organizational units and the Centre, while the Centre shall verify and grant certificates in lieu of allowance, depending on the value, size and type of the project and within the range of 5 to 15 per cent of the value of the provided save.

7. The Center, in cooperation with the relevant authorities, will study and prepare regulations, standards, codes and instructions for improving energy efficiency and rationalizing consumption in the public and private industrial sector.

8. Industrial enterprises and institutions are committed to the content of the aforementioned systems and codes.

9. Under a decision by the Council of Ministers, the regulations and codes for improving energy efficiency and rationalizing their consumption in the industrial sector are issued on the basis of the proposal of the board of directors and become binding six months after the date of publication in the official gazette.

Section VI

Energy conservation in the home, commercial and service sectors

Article 9

Energy conservation measures in the domestic, commercial and service sectors

1. All public donors to the building permits, the Engineers' Union, companies and public and private engineering offices designed and constructed to build on the contents of the buildings, codes and instructions for buildings, and which notice the following matters:

a. Use of renewable energies applications in all private and public buildings.

b. Thermal insulation applications for the building.

C) The use of energy-saving lighting systems and the adoption of natural lighting concepts.

d - Optimal design of the building with a view to improving thermal performance and raising the efficiency of its energy use.

e The use of waste from cities and towns in energy.

2. All public donors for construction permits, the Engineers' Union, companies and public and private engineering offices designed and built for the building are committed to including the use of solar water heating systems in design schemes, taking into account all basic requirements Add them to buildings to facilitate the use of these systems.

3. Encourage all public and private facilities, including farms and residential complexes, to use electric power generation equipment from renewable energies in their collective and individual forms and to connect with distribution networks through bidirectional meters.

4. The organizational units for maintaining energy conservation in ministries, public institutions, the Engineers' Union and its branches in the governorates and other public donors for building permits are central organizational units to which the following functions are assigned:

a. Be responsible for overseeing, checking and monitoring the implementation of items 1, 2 and providing the Centre with the necessary information and documentation to demonstrate good implementation.

b. Establishment of sub-organizational units in locations identified in cooperation with the Centre according to total energy consumption and the qualitative pattern consumption of such sites and mandated to establish databases on the consumption of all energy bearings and for the use of energy consuming equipment in the public domain or the special procedures of the unit in addition to preparing monthly and annual reports on the consumption of various energy bearings for these sites.

C) To identify and enhance the efficiency of energy consumption and to adopt the building efficiency management systems in the above-mentioned locations by preparing the energy audit studies in cooperation with the subsidiary organizational units and in coordination with the Centre and proposing appropriate and economically viable solutions.

d - Implementation of all work assigned to it by the Centre with a view to applying the provisions of this Act.

5. The Centre, in cooperation with the relevant stakeholders, will study and prepare regulations, codes and guidance for energy conservation.

6. Under a decision by the Council of Ministers, the regulations and codes of energy conservation in residential, commercial, public service and private service buildings are issued on the proposal of the board of directors and become binding six months after the date of publication in the official gazette.

Section VII

Energy conservation in the transport sector

Article 10

Energy conservation measures in the transport sector

1. The central organizational units for the preservation of the updated energy in the Ministry of Transport and its directorates in the governorates are responsible for the study of improving energy efficiency and rationalizing their consumption in the transport sector in coordination with the center.

2. Functions of organizational units for the conservation of updated energy in the Ministry of Transport and its Directorates:

a. Establishment of databases on the consumption of all energy bearings and all of the energy consuming equipment in its subsidiary bodies within the transport sector.

b. Preparation of monthly and annual reports on the consumption of various energy bearings according to graphic models developed by them in coordination with the Centre.

C) Identify opportunities to rationalize energy consumption and raise the efficiency of its use in the transport sector in coordination with the Centre.

3. Adopt policies, strategies and techniques for energy conservation in the transport sector to observe the following:

a. Development of mass transport in and out of cities to ensure optimal use of energy bearings.

b. Improve the energy efficiency of the mechanisms and adopt a power sheet for them.

C) To stress the need to improve the efficiency of bus engines by adhering to technical performance auditing, gaseous emissions and stimulating the use of transport modes that rely on advanced technologies that contribute to improving energy efficiency and rationalizing energy consumption.

Section VIII

Energy conservation in the agricultural sector

Article 11

Energy conservation actions in the agricultural sector

1. The organizational units for maintaining energy conservation in the Ministries of Agriculture and Irrigation and their directorates in the governorates and agricultural establishments of the Ministry of Agriculture, the Agricultural Engineers Association and its branches in the governorates are central units that supervise the sub-organizational units. In public and private agricultural facilities.

2. The central units are a link between the subsidiary organizational units located in the agricultural facilities and the centre.

3. Functions of subsidiary organizational units for energy conservation in agricultural facilities:

a. Establishment of databases on the consumption of all energy bearings, production quantities and all energy-consuming equipment in the public or private unit of the unit.

b. To prepare monthly and annual reports on the consumption of various energy pregnant women in accordance with the modelling adopted by the Centre and to provide it with the information contained in such reports, which affect the private enterprise of the Centre and are used solely to achieve the provisions of this law.

d - Implementation of all work assigned to it by the central organizational units and the Centre with a view to applying the provisions of this Act.

4. Energy reports and studies examine the following points:

a. The agricultural mechanization.

b. Water pumping techniques for irrigation.

C) Livestock facilities.

d - Uses of agricultural and animal waste in the energy field.

e The use of renewable energies techniques in various fields of agricultural cutter.

5. The energy reports, energy audit studies and economic feasibility studies of agricultural enterprises are examined by the central organizational units and the center, and the proposed projects for implementation are selected according to the results of these studies.

6. Agricultural facilities are committed to implementing the projects proposed and approved by the central organizational units and the Centre.

Section IX

Government facilities

Article 12

The following government facilities include:

a. :: Adopt symbolic and promotional wages for the examination and testing of energy efficiency tools, equipment and equipment, and examine and evaluate the performance of renewable energy applications systems, to be determined by the governing body of the Centre in coordination with relevant stakeholders and issued by decision.

b. The determination of symbolic wages by the Centre for the preparation of energy audit studies for all buildings and installations upon request and approved by the Centre's board of directors.

C) The granting of incentive rewards for research, works and efficient inventions in the field of energy conservation in light of the Centre's proposal and the approval of the Prime Minister's Cabinet.

d - To allocate incentive rewards for workers in all government bodies who are committed to implementing energy conservation measures in accordance with the laws and regulations in force, and to act against the balance of the employees who are employed and derived from their savings due to the application of this law.

Section X

Contraventions

Article 13

a. Violations shall be determined in the application of the provisions of this Act, as set out below:

1. Lack of commitment to implement projects identified by organizational units and the Centre.

2. Failure to apply the regulations, codes, and instructions issued in the course of applying this law.

3. Failure to apply the procedures contained in sections V, VI, VII and VIII except for occupants and residential buildings.

b. Whoever commits any of the offences listed in paragraph (a) above shall be fined a fine equal to half the value of the energy assumed if the provisions of this law are observed and according to the local prices applicable to the energy bearings, and the value of the offence is determined by the central organizational units and the Centre The penalty decisions are issued by decision of the Minister upon the proposal of the Board of Directors.

C) In the case of a repeat of the offence, the fine is doubled according to the above.

d - The amounts obtained from fines imposed as a result of contravention of the provisions of this Act pursuant to section (a) above shall be transferred to the State treasury.

Article 14

a. Personnel assigned to visit places of work to investigate violations committed in the course of the implementation of the provisions of this Law and the decisions issued pursuant to it shall have the status of the judicial officer.

b. The workers referred to in the preceding paragraph (a) are sworn in before the rudimentary judge who has their duty station to do their work with honour, honesty and sincerity.

C) The employees hold a card proving their job as signed by the minister and they have the right to control violations resulting in the execution of this law and to carry out any inspection in public and private establishments of a economic, service and administrative nature at any time during the time of official working and checking the books. d - The Minister shall issue a decision containing the means to ensure the proper investigation of the violations of the provisions of this Law and the working times and to determine the remuneration of those working for violations of this law.

Section XI

General provisions

Article 15

The Centre is called a national focal point for this law.

Article 16

The bodies covered by this Act shall be provided to the Centre:

a. Instruments for the establishment of energy conservation regulatory units and the functions of the personnel assigned to it and the names of persons who will undertake the task of the energy liaison officers immediately following the operation of this law.

b. The necessary information necessary for the issuance of the annual energy statistical report for the distilat.

Rule 17

Executive instructions for the provisions of this Act shall be issued by decision of the Minister of Electricity on the proposal of the Board of Directors.

Rule 18

This law is published in the Official Journal and is considered to be effective six months after the date of publication.
